The Staff Accountant of Finance Department will open sealed bids for Claremore Recreation Center
Pool Resurfacing, on August 26, 2014 at 10:00 AM, CST in the Council Chambers located at City Hall,
104 S. Muskogee Avenue, Claremore, OK, 74017. The results will be publicly read aloud during the bid
opening.
A mandatory pre-bid conference is scheduled for August 13, 2014, at 10:00 AM, for this bid. The City
reserves the right to waive informalities in the bids and reject any or all bids for any reason whatsoever
at the sole discretion of the City. The successful bidder will be notified in writing.

~ Section One ~
General Information
1.1
Purpose of the Bid
The bid process is part of a competitive procurement process which will facilitate a fair opportunity for
qualified firms to offer their plans and services for consideration. The City of Claremore is currently seeking
bids for the Claremore Recreation Center Pool Resurfacing for the Finance Department. The City, by
means of this bid, invites all qualified bidders to submit bids in accordance with the requirements outlined in
this bid. The City anticipates that, based on its review and evaluation of the proposals received pursuant to
this bid, it will select a bidder and execute a contract whereby the bidder renders services to the City, in
accordance with terms and conditions set forth in the contract. Pricing is to remain effective for a period of
90 days to allow Council to review and accept or reject awarded bid.
1.2

1.3
Project Overview
The City of Claremore (City) is accepting bids for Claremore Recreation Center Pool Resurfacing.
Delivery of Installation of Tile to be settled upon between the City of Claremore Department Head and
Supplier but could begin immediately after the award of Bid.
1.4
City’s Right to Reject
The City reserves the right to accept or reject, in whole or in part, waive informalities, minor irregularities, or
substitute items desired if deemed in the best interest of the City, therefore selecting the optimum proposal
or issue a new bid. The City of Claremore and its designees reserve the right to determine whether a
proposal is responsive and has the ability and resources to perform the contract in full and comply with the
specifications.

Bid Requirements
2.1
Right to Modify, Rescind, or Revoke BID
The City reserves the rights to modify, rescind, or revoke this bid, in whole or in part, and to make awards in
a manner deemed in the best interest of the City at any time prior to the date on which the authorized
representative of the City executes a contract with the successful bidder.
2.2
Compliance with BID Requirements
By submission of a bid, a bidder agrees to be bound by the requirements set forth in this bid. The City, at its
sole discretion, may disqualify a bidder from consideration, if the City determines a bid is non-responsive
and/or non-compliant, in whole or in part, with the requirements set forth in this bid.
2.3
Signature, Certification of Bidder
The proposal must be signed and dated by a representative of the bidder who is authorized to bind the
bidder to the terms and conditions contained in this bid and to compliance with the information submitted in
the proposal. Each bidder submitting a proposal certifies to both (a) the completeness, veracity, and
accuracy of the information provided in the proposal and (b) the authority of the individual whose signature
appears on the proposal to bind the bidder to the terms and conditions set forth in this bid. Bids submitted
without the required signature shall be disqualified.
2.4
Requirements for Submission
Each bidder shall submit one (1) original – which must be clearly defined as the ORIGINAL – (2) TWO
COPIES and (1) ONE DIGITAL COPY ON CD OR THUMBDRIVE of their proposal. The original shall be
clearly readable and preferably prepared on a word processor and formatted in at least 10-point-font. The
copies shall be of good, readable quality. The original and (3) three copies of the proposal shall be
submitted in a sealed box or envelope, clearly state on the outside, bottom left-hand corner of the package
as shown:

Deadline for Proposals
Proposals must be received by City of Claremore, Staff Accountant’s office in the Finance Department by

“10:00 AM, August 26 , 2014”. Any proposal received after expiration of the deadline will be immediately
disqualified from consideration. To withdraw a proposal, a written request must be made to the
Claremore Staff Accountant prior to the scheduled opening.

3.1
Risk of Loss, Damage, Delay
Bidder acknowledges and agrees to release and hold harmless the City of Claremore, its employees, agents,
and personnel, from and against any and all claims, liability, damages, and costs, including court costs and
attorneys’ fees, arising out of or pursuant to delivery of the proposal or failure to deliver the bid to the Staff
Accountant’s Office of the City of Claremore, as designated in Section 2.5 and 2.6 of this BID. The contractor
shall hold the City harmless and shall be liable in the event of injury to City personnel or damage or loss of
their property caused by the contractor's equipment, personnel supplies or material furnished. The City will
not be liable for loss or damage caused by fires, lightning, sprinkler leakage, earthquake, severe weather,
smoke and smudge, aircraft or motor vehicle damage, strikes, riots and civil disturbance or collapse of
building or structures, etc. The City and its personnel shall not be liable for any loss of or damage to
contractor property unless due to their fault or negligence.
3.2
Ownership of Proposals
All proposals become the physical property of the City of Claremore upon receipt.
3.3
Use, Disclosure of Information
Bidders acknowledge that the City of Claremore is a municipality of the State of Oklahoma and all bids
become a matter of public record once opened. Bid with information marked “confidential” will be rejected
upon discovery of such statement. By submitting a proposal, a proposer specifically assumes any and all
risks and liabilities associated with the information contained in the proposal and the release of that
information contained in the proposal and the release of that information by the City of Claremore for
purposes related to or arising out of the (a) evaluation of bid, (b) selection of a bidder pursuant to the bid
process, and (c) negotiation and execution of a contract, if any, with the bidder selected.
3.4
Costs of Participation
The City of Claremore specifically disclaims responsibility and/or liability for any and all cost, expenses, or
claims related to or arising out of the bidder’s participation in this bid process, including but not limited to
costs incurred as a result of preparing, copying, shipping, presenting, and/or clarifying the bidder and the
information relevant to the bid.
3.5
Compliance with Applicable Laws, Regulations, Ordinances, City of Claremore Policies and
Procedures
By submitting a bid, the bidder agrees to and shall comply with all applicable local, state and federal laws
and regulations, as well as with all applicable policies and procedures of the City of Claremore.

Bid Procedures
3.1
Rescission of Bid
A bid can be withdrawn from consideration at any time prior to expiration of the deadline for bid, as stated in
Section 2.5 of this bid, pursuant to a written request sent to the City of Claremore Staff Accountant’s Office.

3.3
Request for Clarification
The City of Claremore reserves the right to request clarification of any information contained in a bid.
3.4
Questions by Bidders and Addenda
Each bidder shall carefully examine all bid documents and all addenda thereto, and shall thoroughly
familiarize themselves with the detailed requirements thereof prior to submitting a proposal. Should a bidder
find discrepancies or ambiguities in, or omissions from documents, or should they be in doubt as to their
meaning, they shall, at once, and in any event, not later than seven (7) days prior to opening due date, notify
the City of Claremore, who will, if necessary, send written addendum to all bidders. The City of Claremore
will not be responsible for any oral instructions. All inquiries shall be directed to Noelle Hayes, Staff
Accountant in writing at nhayes@claremorecity.com.
3.5
Pre-Proposal Conference

A preconstruction Conference will be held on August 13, 2014 in the Council Chambers at City Hall. This is
a mandatory meeting for interested bidders.
3.6
Specifications:
Specifications are provided in the Project Manual following this section. Bidder must meet specifications.
3.7
Pricing
Price as an integral component of the proposal is required. If pricing is not included within the returned
packet, the packet will be disqualified as incomplete and non-compliant. All prices shall be honored for a
period of 90 days to allow council to review and acceptance.
3.8
Payment
The City of Claremore shall pay all invoices Net 30, pursuant to 62 O.S., Section 41.4a, et seq. Payment will
not be made on invoices submitted later than six-months (180 days) after delivery of goods and any statute
of limitations to the contrary is hereby waived.
~ Section Four ~
Contents
4.1
Bidder Affirmation Clause
Each Bidder must affirm and incorporate in its Proposal all of the Affirmation set forth in this Section 4.4. If
the City of Claremore determines a bidder has submitted a false statement, in whole or in part, in regard to
any of these affirmations, then the City of Claremore will disqualify the bidder from consideration and report
the false statement as such to the Oklahoma Department of Commerce. Also, the City of Claremore will
remove the bidder from the master bidders list of the City. Accordingly, the bidder affirms all of the following,
without limitation

a. The bidder has not conferred or offered to confer, either directly or indirectly, any benefit whatsoever on
a public servant in connection with the submitted proposal or the subject matter of the proposal;
b. The bidder either is not subject to the payment of franchise taxes to the State of Oklahoma or is not
currently delinquent in regard to the payment of franchise tax owed to the State of Oklahoma;
c. The bidder, individually or acting by and through its officers, principals, employees, contractors,
subcontractors, agents, or personnel, has neither (i) violated state or federal antitrust laws nor (ii)
communicated any of the contents of the Proposal to its competitors or any other person or entity
engaged in such line of business;
d. The bidder shall defend, indemnify, and hold harmless the City of Claremore, all of its officers, agents
and employees from and against all claims, actions, suits, demands, proceedings costs, damages, and
liabilities, arising out of, connected with, or resulting from any acts or omissions of the bidder or any
agent, employee, subcontractor, or supplier of contractor in the execution or performance of the
resulting contract;
e. The bidder expressly acknowledges that state funds may not be expended in connection with the
purchase of an automated information system unless that system meets certain statutory requirements
relating to the accessibility by persons with visual impairments. Accordingly, the proposer represents
and warrants to the City of Claremore that the technology provided by bidder for purchase is capable,
either by virtue of features included within the technology or because it is readily adaptable by use with
other technology, of:
(1) providing equivalent access for effective use by both visual and non-visual means;
(2) presenting information, including prompts used for interactive communications, in formats
intended for both visual and non-visual use; and
(3) being integrated into networks for obtaining, retrieving, and disseminating information used by
individuals who are not blind or visually impaired. For purposes of this paragraph, the phrase
“equivalent access” means a substantially similar ability to communicate with or make use of
the technology, either directly by features incorporated within the technology or by other
reasonable means such as assistive devices or Services which would constitute reasonable
accommodations under the federal Americans with Disabilities Act or similar state or federal
laws. Examples of methods by which equivalent access may be provided include, but are not
limited to, keyboard alternatives to mouse commands and other means of navigating graphical
displays, and customizable display appearance.
4.2
Insurance Requirements
Contractor shall provide proof of liability insurance before commencing the Work, shall maintain such liability
insurance during the duration of this Agreement, and shall not allow such insurance to lapse for any reason. The
Contractor shall be responsible for all injuries and losses, both to persons as well as property, which may
arise as a result of the contractor’s operation. This shall include injuries or loss to contractor’s agents,
employees or persons under contract with contractor. Additionally, this shall include injuries to and losses by
third persons. In conjunction herewith, the contractor shall at all times maintain a general commercial liability
policy with limits at no less than $1,000,000 per individual loss, or $1,000,000 aggregate. The provider of
such commercial general liability shall be a reputable company authorized to transact business in the State
of Oklahoma. Contractor shall furnish City of Claremore a certificate of insurance naming the City of

Claremore, Oklahoma, as an additional insured on the General Commercial Liability policy, which shall
include a provision that such insurance shall not be canceled without at least thirty (30) days written notice.
4.3
References
Submit with your bid a minimum of three (3) references of whom you have done business of similar size and
scope to City of Claremore with in the past five (5) years. They must be references who have or are currently
using the products specified in your bid. They may be contacted and interviewed with regard to their overall
satisfaction of product and your company’s performance. Include company name, contact name, address,
phone, fax and email, estimated volume with your company and years serviced.

Evaluation, Selection & Award
5.1
Discussions with Bidders
The City of Claremore may conduct discussions and/or negotiations with any bidder that appears to be
eligible for award (“Eligible Bidder”) pursuant to the selection criteria set forth in this bid. In conducting
discussions and/or negotiations, the City of Claremore will not disclose information derived from proposals
submitted by competing bidders, except as and if law requires disclosure.
5.2
Modification of Proposals
Oral modifications will not be considered. Any bidder may modify their bid in writing prior to date and time of
bid closing. Only modifications received in sealed envelopes with bid number, closing date and project name
clearly marked on outside will be accepted. Written confirmation must be received under the same signature
as prior submitted bid. All modifications are to be clearly numbered and dated as to determine the final one.
5.3
Selection of Bidder
The Bidder selected for award will be the bidder whose proposal, as presented in response to this bid and as
determined by the City in accordance with the evaluation criteria set forth in Section 5.5, to be the most
advantageous to the City. Bidders acknowledge that the City is not bound to accept the lowest-priced

Proposal. The City reserves the right to award this contract, not necessarily to the firm with the lowest cost,
but to the firm that best meets the requirements and needs of the City as determined according to the
evaluation criteria.
5.4
Evaluation of Proposals
The City personnel will evaluate the bid. Submission of a bid indicates the bidder’s acceptance of the
evaluation process set forth this bid and the bidder’s acknowledgement that subjective judgments must be
made by the City in regard to the evaluation process. The final evaluation and selection of a contractor will
be made by the City and submitted to the Claremore City Council for approval.

General Terms and Conditions
6.1
Termination
Contract Termination: The City may terminate any resulting contract for cause by providing a Show Cause
Letter to the contractor citing the instances of noncompliance with the contract. If the noncompliance is not
cured within 10 days, the City may terminate the contract. The City reserves the right to terminate the
contract for convenience by providing 15 days written notice to the contractor.
6.2
Conflicts of Interest
In the event there is a potential or actual conflict of interest, the vendor(s) shall provide full disclosure to the
City of Claremore. The City shall determine if the conflict, whether potential or actual, is material.
6.3
Right to Inspect
The City retains the right to examine, inspect, audit, and copy, regardless of location, any and all documents,
records, files, data, and information generated or utilized by the bidder in the performance of the contract.
6.4
Liens
The successful contractor will not file a lien against the City and shall keep the City harmless and be liable in
the event of injury to City personnel or damage or loss of their property caused by the contractor’s
equipment, personal supplies or materials furnished. The City will not be liable for loss or damage caused by

Choice of Law and Venue
The resulting contract shall be construed under the laws of the State of Oklahoma and venue in any action
and/or litigation commenced to enforce the contract shall be instituted in the appropriate courts in Rogers
County, in the State of Oklahoma.

Indemnification Form
The following indemnification agreement shall be, and is hereby a provision of any contract. Failure to submit
this form with your bid response shall result in your bid being rejected as unresponsive.
The successful contractor agrees to indemnify, investigate, protect, defend and save harmless the City, its
officials, officers, agents and employees from any and all claims and losses accruing or resulting to any and all

SPECIAL BIDDER QUALIFICATION: The General Conditions are hereby
amended to provide for “Quality Assurance” of the swimming pool resurfacing
work, by:
QUALITY ASSURANCE SUBMITTAL
The (OWNER) has established special and specific qualifications for this project to assure quality
of the completed “work” as defined in Division 13 of the specifications. The quality assurance for
this project is to protect public health, safety and welfare.
The Pool Installer who constructs the swimming pool portion of this work shall possess
commercial swimming pool “skill and experience” to perform “quality work” as solely determined
by OWNER, which qualifies it to construct the swimming pool work as detailed and specified.
To assist in determining whether or not this skill and experience is possessed by the bidder or his
proposed subcontractor, the bidder shall fully complete the following pages of the proposal form.
Non-prequalified Pool Installers shall submit this form to the Owner via the Pool Consultant ten
(10) days prior to bid. Approved Pool Installers will be confirmed by Addendum.
Each referenced swimming pool shall conform to the following requirements:
1.
Commercial pool work, not residential type.
2.
Pool water area equal to or larger than detailed for this project.
3.
Shall have been constructed and operated over a period of five (5) years and not just one
(1) or two (2) years.
Following the bid opening, the bidder shall be prepared to furnish, in writing, within three (3) days
of the request, such information to establish the possessions of such skills and experience for the
quality assurance for this work. Information requested may include, but not be limited to, the
following for each REFERENCED pool:

Pool size (water area) and pool volume.
2.
Type of wall and floor construction and interior finish.
3.

BOND REQUIREMENTS
A. The successful Bidder shall, prior to or at the time of execution of the contract, deliver 2 copies to the Owner, and 1
copy to the Architect, of the required Bonds.
B. The Contractor shall furnish bonds covering faithful performance of the Contract and payment of obligations arising
thereunder. Bonds may be obtained through the Contractor’s usual source and the cost thereof shall be included
in the Contract Sum. The amount of each bond shall be equal to 100 percent of the Contract Sum.
C. Bonds shall be written by a Surety authorized to transact business in the state in which Project is located and
executed by an authorized resident agent of the Surety.
1. Both the Surety and the Surety’s agent shall be subject to the Owner’s approval.
2. Credentials showing the legal right of the Surety to transact business in the state in which the Project is located
shall be attached to the Bonds.
3. A certified and current copy of the power of attorney for the attorney-in-fact who executes the required bonds on
behalf of the Surety shall be attached to the Bonds.
D. Bonds shall become effective upon execution of the Contract.
E. The correction period required by Document 007000 - General Conditions (AIA Document 201-1997)
Subparagraph 12.2.2, the warranty required by Document 007000 - General Conditions (AIA Document 201-1997)
Subparagraph 3.5.1, and the special warranties required by individual Sections of the Specifications, shall be
incorporated into and made part of the Performance Bond.
F. The Bidder agrees that changes, additions, and omissions in the Contract Documents shall in no way affect the
validity of the Bonds.

Specification Content: The Specifications use certain conventions for the style of language and the
intended meaning of certain terms, words, and phrases when used in particular
situations. These conventions are as follows:

abbreviated. Words and meanings shall be interpreted as appropriate. Words implied, but not

Use of Site: Limit use of premises to work in areas indicated. Do not disturb portions of site beyond areas

Owner Occupancy: Allow for Owner occupancy of site and those portions of the building not
directly affected by construction activites.

OCCUPANCY REQUIREMENTS

Partial Owner Occupancy: Owner reserves the right to occupy and to place and install equipment in
completed areas of building, before Substantial Completion, provided such occupancy does not interfere
with completion of the Work. Such placement of equipment and partial occupancy shall not constitute
acceptance of the Work.

Pool Consultant will prepare a Certificate of Substantial Completion for each specific portion of the
Work to be occupied before Owner occupancy.
2.
Obtain a Certificate of Occupancy from authorities having jurisdiction before Owner occupancy.
3.
Before partial Owner occupancy, mechanical and electrical systems shall be fully operational, and
required tests and inspections shall be successfully completed. On occupancy, Owner will provide,
operate, and maintain mechanical and electrical systems serving occupied portions of building.
4.
On occupancy, Owner will assume responsibility for maintenance and custodial service for
occupied portions of building.

Preconstruction Conference: Schedule a preconstruction conference before starting construction, at a
time convenient to Owner and Architect, but no later than 15 days after execution of the Agreement. Hold
the conference at Project site or another convenient location. Conduct the meeting to review
responsibilities and personnel assignments.

Attendees: Authorized representatives of Owner, Pool Consultant, and their consultants; Contractor and
its superintendent; major subcontractors; manufacturers; suppliers; and other concerned parties
shall attend the conference. All participants at the conference shall be familiar with Project and

Agenda: Discuss items of significance that could affect progress, including the following:

QUALITY ASSURANCE
A.
Fabricator Qualifications: A firm experienced in producing products similar to those indicated for this
Project and with a record of successful in-service performance, as well as sufficient production capacity to
produce required units.
B.
Factory-Authorized Service Representative Qualifications: An authorized representative of manufacturer
who is trained and approved by manufacturer to inspect installation of manufacturer's products that are
similar in material, design, and extent to those indicated for this Project.
C.
Installer Qualifications: A firm or individual experienced in installing, erecting, or assembling work similar
in material, design, and extent to that indicated for this Project, whose work has resulted in construction with
a record of successful in-service performance.
D.
Manufacturer Qualifications: A firm experienced in manufacturing products or systems similar to those
indicated for this Project and with a record of successful in-service performance.
E.
Professional Engineer Qualifications: A professional engineer who is legally qualified to practice in Oklahoma
and who is experienced in providing engineering services of the kind indicated. Engineering services are
defined as those performed for installations of the system, assembly, or product that are similar to those
indicated for this Project in material, design, and extent.
F.
Specialists: Certain sections of the Specifications require that specific construction activities shall be
performed by entities who are recognized experts in those operations. Specialists shall satisfy
qualification requirements indicated and shall be engaged for the activities indicated.

Requirement for specialists shall not supersede building codes and similar regulations governing
the Work, nor interfere with local trade-union jurisdictional settlements and similar conventions.
G.
Testing Agency Qualifications: An agency with the experience and capability to conduct testing and
inspecting indicated, as documented by ASTM E 548, and that specializes in types of tests and
inspections to be performed.
H.
Preconstruction Testing: Testing agency shall perform preconstruction testing for compliance with
specified requirements for performance and test methods.

Temporary Utilities: At earliest feasible time, when acceptable to Owner, change over from use of

General: Provide new materials. Undamaged, previously used materials in serviceable condition may be
used if approved by Architect. Provide materials suitable for use intended.

Portable Chain-Link Fencing: Minimum 2-inch 9-gage, galvanized steel, chain-link fabric fencing;
minimum 6 feet high with galvanized steel pipe posts; minimum 2-3/8-inch OD line posts and 2-7/8-inch
OD corner and pull posts, with 1-5/8-inch OD top and bottom rails. Provide concrete or steel bases for
supporting posts.
C.
Lumber and Plywood: Comply with requirements in Division 6 Section "Rough Carpentry."
D.
Gypsum Board: Minimum 1/2 inch thick by 48 inches wide by maximum available lengths; regular-type
panels with tapered edges. Comply with ASTM C 36.
E.
Insulation: Unfaced mineral-fiber blanket, manufactured from glass, slag wool, or rock wool; with
maximum flame-spread and smoke-developed indices of 25 and 50, respectively.
F.
Paint: Comply with requirements in Division 9 Section "Painting."
G.
Tarpaulins: Fire-resistive labeled with flame-spread rating of 15 or less.

PART 3 - EXECUTION
3.1
INSTALLATION, GENERAL
A.
Locate facilities where they will serve Project adequately and result in minimum interference with
performance of the Work. Relocate and modify facilities as required.
B.
Provide each facility ready for use when needed to avoid delay. Maintain and modify as required. Do not
remove until facilities are no longer needed or are replaced by authorized use of completed permanent
facilities.
3.2
TEMPORARY UTILITY INSTALLATION
A.

General: Engage appropriate local utility company to install temporary service or connect to existing
service. Where utility company provides only part of the service, provide the remainder with matching,
compatible materials and equipment. Comply with utility company recommendations.

Arrange with utility company, Owner, and existing users for time when service can be interrupted, if
necessary, to make connections for temporary services.
2.
Provide adequate capacity at each stage of construction. Before temporary utility is available,
provide trucked-in services.
3.
Obtain easements to bring temporary utilities to Project site where Owner's easements cannot be
used for that purpose.
Sewers and Drainage: If sewers are available, provide temporary connections to remove effluent that can
be discharged lawfully. If sewers cannot be lawfully used for discharge of effluent, provide containers to
remove and dispose of effluent off-site in a lawful manner.

Filter out excessive soil, construction debris, chemicals, oils, and similar contaminants that might
clog sewers or pollute waterways before discharge.
2.
Connect temporary sewers to municipal system or private system as directed by sewer department
officials.

A.
Environmental Protection: Provide protection, operate temporary facilities, and conduct construction in
ways and by methods that comply with environmental regulations and that minimize possible air,
waterway, and subsoil contamination or pollution or other undesirable effects. Avoid using tools and
equipment that produce harmful noise. Restrict use of noisemaking tools and equipment to hours that will
minimize complaints from persons or firms near Project site.
B.
Stormwater Control: Provide earthen embankments and similar barriers in and around excavations and
subgrade construction, sufficient to prevent flooding by runoff of stormwater from heavy rains.
C.
Tree and Plant Protection: Protect all trees and plants not otherwise scheduled for removal and/or
replacement. Trees and plants not otherwise scheduled for removal and/or replacement that are damaged by
construction activities shall be replaced and no cost to the Owner.
D.
Security Enclosure and Lockup: Install substantial temporary enclosure around partially completed areas
of construction. Provide lockable entrances to prevent unauthorized entrance, vandalism, theft, and
similar violations of security.

Barricades, Warning Signs, and Lights: Comply with standards and code requirements for erecting
structurally adequate barricades. Paint with appropriate colors, graphics, and warning signs to inform
personnel and public of possible hazard. Where appropriate and needed, provide lighting, including

possible, review proposed procedures with original Installer; comply with original Installer's written

In general, use hand or small power tools designed for sawing and grinding, not hammering and
chopping. Cut holes and slots as small as possible, neatly to size required, and with minimum

In the event that the Pool Consultant or his consultants conduct an inspection based on

shall be borne by the Contractor. Such costs shall be deducted from the Contract
Sum by appropriate Change Order prior to Final Acceptance and shall be paid by the
Owner to the Pool Consultant. The costs associated with the Substantial Completion
inspection and Final Acceptance reinspection normally required of the Pool Consultant and
his consultants for the work or designated portions thereof shall not be included.

MATERIALS
A.
Cleaning Agents: Use cleaning materials and agents recommended by manufacturer or
fabricator of the surface to be cleaned. Do not use cleaning agents that are potentially
hazardous to health or property or that might damage finished surfaces.
PART 3 - EXECUTION
3.1
FINAL CLEANING
A.
General: Provide final cleaning. Conduct cleaning and waste-removal operations to comply
with local laws and ordinances and Federal and local environmental and antipollution
regulations.
B.
Cleaning: Employ experienced workers or professional cleaners for final cleaning. Clean each
surface or unit to condition expected in an average commercial building cleaning and
maintenance program. Comply with manufacturer's written instructions.

Complete the following cleaning operations before requesting inspection for certification
of Substantial Completion for entire Project or for a portion of Project:
a.
Clean Project site, yard, and grounds, in areas disturbed by construction activities,
including landscape development areas, of rubbish, waste material, litter, and
other foreign substances.
b.
Sweep paved areas broom clean. Remove petrochemical spills, stains, and other
foreign deposits.
c.
Rake grounds that are neither planted nor paved to a smooth, even-textured
surface.
d.
Remove tools, construction equipment, machinery, and surplus material from
Project site.

Remove snow and ice to provide safe access to building.

Clean exposed exterior and interior hard-surfaced finishes to a dirt-free condition,
free of stains, films, and similar foreign substances. Avoid disturbing natural
weathering of exterior surfaces.
Restore reflective surfaces to their original
condition.
g.
Remove debris and surface dust from limited access spaces, including roofs,
plenums, shafts, trenches, equipment vaults, manholes, attics, and similar spaces.
h.
Sweep concrete floors broom clean in unoccupied spaces.
i.
Vacuum carpet and similar soft surfaces, removing debris and excess nap;
shampoo if visible soil or stains remain.
j.
Clean transparent materials, including mirrors and glass in doors and windows.
Remove glazing compounds and other noticeable, vision-obscuring materials.
Replace chipped or broken glass and other damaged transparent materials.
Polish mirrors and glass, taking care not to scratch surfaces.
k.
Remove labels that are not permanent.
l.
Touch up and otherwise repair and restore marred, exposed finishes and surfaces.
Replace finishes and surfaces that cannot be satisfactorily repaired or restored or
that already show evidence of repair or restoration.

Do not paint over "UL" and similar labels, including mechanical and
electrical nameplates.
m.
Wipe surfaces of mechanical and electrical equipment, and similar equipment.
Remove excess lubrication, paint and mortar droppings, and other foreign
substances.

Replace parts subject to unusual operating conditions.
o.
Clean plumbing fixtures to a sanitary condition, free of stains, including stains
resulting from water exposure.
p.
Replace disposable air filters and clean permanent air filters. Clean expos ed
surfaces of diffusers, registers, and grills.
q.
Clean ducts, blowers, and coils if units were operated without filters during
construction.
r.
Clean light fixtures, lamps, globes, and reflectors to function with full efficiency.
Replace burned-out bulbs, and those noticeably dimmed by hours of use, and
defective and noisy starters in fluorescent and mercury vapor fixtures to comply
with requirements for new fixtures.
s.
Leave Project clean and ready for occupancy.
C.
Pest Control: Engage an experienced, licensed exterminator to make a final inspection and rid
Project of rodents, insects, and other pests. Prepare a report.
D.
Comply with safety standards for cleaning. Do not burn waste materials. Do not bury debris or

excess materials on Owner's property.

A. Description of work included:

2. Submittals: Unglazed “porcelain” tile is specified. Pool Consultant /Owner shall verify before ordering tile

a. Deliver all products to job in manufacturer’s unopened containers with grade
seals unbroken and labels intact.

4. Environmental Conditions

after completion and furnish moisture protection as approved by the Pool
Consultant
5. Extra Stock
a. Supply extra 10 sq. ft. of each color of flat and trim in clean cartons for owner’s
use.

1. Surface medium-rough texture.
2. All surfaces to be tiled shall be free of dust, rust, and paint from oil or
other release coatings.
3. Provision for ladders and other embedments at proper locations.
4. Concrete true to line, level, plumb and curvature.
5. Width, depth and length will permit finished accuracy of markings and
dimensions.
6. Layout
A. Align all joints to give straight uniform grout lines.
B. Observe exact minimum lengths, per dimensions shown on “as built” drawings.
C. Observe maximum width tolerance of 1” over dimensions, shown on “as built”
drawings.
D. Observe +/- 1/16” maximum finish tolerance on all edges and surfaces.
E. Provide one (1) expansion joint minimum at center of each straight run of tile.
F. Shallow <5’ deep pool floor-flat plane to not pond water. Flatness shall not exceed ¼” in 10’.
7. Workmanship
A. Supply FIRST-CLASS WORKMANSHIP in all tile work. True and plumb tolerances of less than 1/16 of an inch, will be required.
B. Use all products in strict accordance with recommendations and directions of
manufacturer.
C. Proportion all mixes in accordance with latest ANSI Standard Specifications.
D. Smooth all exposed cut edges.
8. Cleaning
A. Clean & wipe tile surface as thoroughly as possible on completion of grouting.
B. As soon as cleaning is done, hose down thoroughly to completely remove all
traces of residual grout.
9. Protection of Tilework
A. Protect all newly tiled areas and keep moist until pool is refilled per adhesive
and grout manufacturer specification.
Verify moist cure to project Architect/Engineer.

E. Product Delivery and Storage
1. Deliver tile materials to site in unopened factory containers sealed with Grade
Seals bearing printed name or manufacturer and the words “Standard Grade”.
Keep the Grade Seals intact and containers dry until tiles are used. Keep cementitious materials dry until used.
F. Job Conditions and Guarantee
1. Inspect and verify job conditions. Report all defects in base surfaces for correction
before proceeding.
2. The manufacturer of adhesives grouts and mortars shall provide a written two-year
warranty for the installation which shall cover materials and labor.

I. Tile Materials
1. Standard Grade conforming to ANSI A137.1. Provide trimmer units as indicated
and specified, including special shapes as detailed or required. Tile patterns and
colors shall be as indicated and specified, colors of approved shades. Mesh
mounted or perforated paper backed tile is not allowed where the mesh of paper
remains as a permanent part of the installation.
2. Unglazed Porcelain Mosaic Tile: Porcelain type unglazed porcelain mosaic tile,
cushion or all purpose edges, 1 inch square. Provide at all locations for 1 in. x 1
in.
3. Trim Units: Provide tile trim units where indicated or necessary for complete and
finished installation. Provide bullnose units for external corners and angles. Internal corners shall be squared unless detailed for cove. Provide trim units of material and finish identical to adjoining tile.
4. Slip-Resistant (or Non-Slip) Unglazed Porcelain Mosaic Tile: Same as unglazed
porcelain tile except containing at least 7 ½ % of non-rusting abrasive aggregate.
Provide at floor locations as indicated on drawings and wall targets and end wall
swim lane areas.
J. Replacement Tile
1. Tile Contractor to provide owner 10 sq. ft. of replacement tile for each color and
type used.

Control Joints – Sealants:
During demo and tile prep: Remove existing control joint sealant and grout to an appropriate
depth. Clean and prepare surfaces ready for priming.
1. Below Water Joints: Control joints below water shall be furnished and installed by the Pool
Installer or an “approved” Specialty Contractor only. All surfaces shall be observed by the
Pool Consultant before sealant and applied only following proper bottom of St. Stl. IFRS
gutter cleaning and gunite surface preparation.
A. All grout removal shall be replaced with dry gun gunite finished to strike a uniform sealant
joint. Joint shall cure per sealant mfgr requirements.
B. The Pool Installer shall use a Sikaflex-2C NS Sealant, 2 part, meeting all of the Specifications TT-S-0227-E, and a companion primer shall be used manufactured by “SIKA”, product SIKA-FLEX #412, or approved alternate manufacturer.
2. Joint at Pool coping: Alternate: Expansion joint at Pool Coping shall adhere to requirements as noted above. Joint shall be tooled in slightly convex profile so as not to pond or
hold water.
A. The pool Installer shall use Vulkem 45 SSL Semi-self-leveling polyurethane sealant as
manufactured by Tremco or approved equal.
The Pool Installer shall verify current dates on all product packages for the Pool Consultant and
sandblast all joints before applying primers.
Pool Consultant shall approve sealant color and finish workmanship for the horizontal wall joint
and deck joint.
PART 3 EXECUTION
3.1
GENERAL

A. Prior to plaster demolition, contractor to remove all diving boards, slides and deck equipment
from pool environment, mask or remove lockers, scoreboard and other similar devices.
Mask mechanical diffusers and intake grilles, interior doors to Center. Access to the pool
environ shall be from the exterior during demolition operations. Contractor provided exhaust
fans shall be utilized during demolition operations.
B. The pool structure can be damaged if pool is drained and ground water below and behind
pool wall is not first removed. See O&M Manual for proper emptying of pool. Drain water
from underdrain first. Owner’s staff to provide draining of pool water prior to demolition operations and will fill drain and pool with Pool Contractor assistance.
C. Following existing plaster demolition and removal of materials and dust, inspect pool shell for
cracking, blistering, spalling and other deterioration requiring repair. Notify Pool Consultant
for repair recommendations for any significant deterioration to concrete surface or structural
concrete shell.
3.2
Following or during plaster demolition and best prior to plaster removal completion (to avoid
grease/oil type pool wall/floor contamination, work shall include:
A. Removal of Main Drain and IFRS gutter gratings and deck drain grating, broom clean bottom
of grates and IFRS trench.
B. Store gutter grating following cleaning to be installed following tile work completion. Protect
St. Stl. IFRS gutter from course work damage or stains.
C. The Contractor has the option when to install the “Sealant Joint” below IFRS gutter atop tile
walls and pool interior control joints. Note: joint surfaces shall be kept free of clean up
grease, wax and oil types of contamination. Apply joint sealants.
3.3 POOL RESTART
A. Reinstall Main Drains, cleaned and polished covers with approved anchors. Flush M.D. and
pool recirculating piping until clean- then fill pool.
B. Replace hydrostatic valves at each M.D. niche, promptly start pool refill (by Owner) with
“Temp Controlled” approved clean water.
C. Install Stainless Steel Deck Drain grates and IFRS grates and secure properly.
Reinstall Deck equipment. Remove all coverings on mechanical diffusers, vents, interior
doors, etc. Wash all pool areas and surfaces of dirt, dust and debris. Start-up pool recirculation, filtration, heating, disinfection and water level/chemical control with staff coordination
with Pool Contractor. Owner to provide water and chemicals for refill of pool.
