These addresses are available to citizens through two online registries: Florida’s Sexual Offenders and Predators Registry and Florida’s Career Offender Registry. When an offender fails to register, not only is valuable public safety information lost, but the offender is also sending a message that he/she refuses to abide by Florida’s laws. Fortunately, a new initiative between FDLE and our law enforcement partners is working to ensure offenders who fail to comply with their registration requirements are located and arrested. The initiative began last July and has already resulted in more than 100 arrests and 70 additional offenders being brought into registration compliance. If you’re not familiar with Florida’s Sex Offender and Career Offender Registrations, now is a good time to acquaint yourself with them. Both registries provide a quick and easy way to identify offenders living in your community. The Florida Sexual Offenders and Predators Registry allows citizens to search using the name of an offender or by using an address. You can also search facilities of higher education to determine if a registered sex offender is enrolled, volunteers or is employed at the school. All Internet identifiers, including email and instant message name searches, are available on this registry. You can even sign up to be notified when a registered sex offender moves into your neighborhood. Florida’s Career Offender Registry allows citizens to quickly search a name to determine whether or not someone is a career offender. Citizens can also search by address, county, city or zip code. Both websites mentioned in this article are below. Take a few minutes to familiarize yourself with this information and be safe. Am I being punked?” Mother’s reaction at overturned conviction of Kalil’s killer By Shirley Shaw Lynnette Roebuck was in California when a reporter from a local television station called to tell her Frederick Wade’s murder conviction in the death of Kalil McCoy had been overturned. “I couldn’t believe it,” she said. “I asked him if I was being punked and, if so, it was a malicious trick. He assured me it was true – the announcement had just been made – and my heart dropped.” Immediately thrust back to those horrible days nearly four years ago when she first received a call that her beloved daughter was missing, Lynette couldn’t believe she’d have to live through another trial. Hearing the details of how her daughter was shot in the head by Frederick Wade, a classmate driving the car in which she was a passenger, who objected to her rolling down the window. How he lied about the shooting being an accident. How he and the three other males in the car plotted to dispose of her body, possibly even burning her. How he finally decided to dump her at a relative’s daycare facility so the “family wouldn’t have to look for her so long.” How could this happen? She learned that the 1st District Court of Appeals had overturned the conviction, citing faulty jury instructions in the first trial; the Kalil McCoy judge had failed to explain the possibility of a lesser manslaughter charge. She wondered if Wade was out of prison, walking the streets. No, she was told, he’s in Duval jail awaiting the next trial scheduled for May. Thoughts of Kalil are always forefront in Lynnette’s mind; however, the dark days when her For Real? (Continued on page 4) Special Prosecution Unit By Angela Corey The Special P ro s e c u t i o n Unit, simply known as Special Pros here at the State Attorney’s Office, is responsible for the prosecution of public corruption cases, white collar crimes and other complex litigation. Special Pros handles many cases that deal with fraud which end up affecting people from across the country. Recently, Special Pros, led by Assistant State Attorney Joe Licandro, convicted a Jacksonville woman in a mortgage fraud scheme. Brandee Tumpkin, 29, was sentenced to two years in prison, followed by three years of probation, for her involvement in the scheme which dates back to 2009. Tumpkin was arrested in June of 2014 and pleaded guilty to four counts of Mortgage Fraud and one count of Schemes to Defraud in December of last year. What we found was that between June 2009 and January 2012, Tumpkin worked as a loan officer at Homeward Residential, which is a mortgage processing company. During this time frame, the Defendant added fictitious fees disguised as legal services to numerous short sale transactions. Fictitious fees collected from six of the transactions, totaling more than $23,000, were deposited directly into the account owned by the Defendant’s mother. We also found that fictitious fees collected from seven other transactions, which totaled more than $26,000, were deposited into the Defendant’s own bank account. Tumpkin’s victims were located all across the country. The company, Homeward Residential, paid the victims back once the fraud was discovered. Tumpkin has now been ordered to pay restitution totaling over $49,000 to her former employer. We are so proud of the work ASA Licandro did in this case. We also thank Detective William Fitzgerald of the Jacksonville Sheriff’s Office Economic Crimes Unit who served as the lead detective in the case. With the hard work of our local law enforcement partners we sought and received justice for these fraud victims. Love flows for lives taken – tossing roses into the river By Ann Dugger Mother’s Day. A special day that evokes varied emoa tions, bittersweet time for most of us. If we’re mothers, receiving flowers or gifts or being treated to a nice dinner by our children is a special treat. But if our own mothers are deceased, memories may be painful as we miss their loving presence. Nothing can take the place of a mother’s love. I pondered that last month when we observed National Victims’ Rights Week (VRW) here in Jacksonville. On Monday night of that week the Justice Coalition hosted its first Tossing of the Roses event at the Jacksonville Landing, where more than 150 family members joined us to honor their loved ones taken by violent crime. Each family was given a yellow rose which they later tossed into the St Johns River commemo- rating the ongoing flow of love and memories. I was saddened to see the young ones present who were grieving for their mothers. My heart was broken when I heard one child say “I miss my Mom” as he tossed his rose into the river, and others who expressed the same thing about missing their Dad. I think of the two young children whose mother was viciously slain in Middleburg, the young girl kidnapped and assaulted by the murderer. No matter what we do for them, nothing will ever replace the love of their mother. Then on the other side, there were the mothers, the parents, who were grieving the loss of their children. This Mother’s Day is especially painful for Lynnette Roebuck whom we are featuring in the lead story of the May Victims' Advocate. In May she and her family will be enduring a re-trial – all because of a minor technicality – of the man who killed her daughter, Kalil McCoy, in 2011. Many victims’ family members came to me and expressed their appreciation for this inau- gural event and hoped we will do it again next year. It was so gratifying to see the great turnout, even though the weather was threatening with storm alerts and trees being blown over in nearby neighborhoods. Janice Lowe, General Manager of the Landing, quickly made arrangements for us to use the Blue Room upstairs. We moved inside for the program which was emceed by TV personality Casey Black DeSantis (who did a great job), and by the time we went to the river to toss the roses the evening was beautiful. All the violence occurring in our country these days, especially here in Jacksonville, is so disturbing – and it brings with it a new group of grieving mothers. Raquel Gomez, Katani Pollydore, Angela Robinson and Shirley Johnson all lost a son or daughter in recent days/months. We need to pray that God will intervene in the lives of everyone – perpetrators who are causing the grief and victims’ families who are suffering the loss of loved ones – and bring peace to our city. Bowles Vocational Training Specialist Travis Bowles works at the prison where he provides training to inmates in such trades as welding and metal fabrication. He is recognized for his dedication in teaching these inmates a skill and for supervising projects that help support not only JSO, but other governmental entities. In 2014, Travis and inmates he supervises completed more than 140 projects – projects and repairs with the potential to be very costly if outsourced to private vendors, and which would most likely not be completed due to budget constraints. Examples of their work: •made repairs and renovations to JSO’s SWAT trailer; •helped build a new obstacle course for the SWAT team; •created gun lockers for the Community Transition Center; •worked with the Police Memorial Building’s facilities manager to create an awning at the entrance of the Police Evidence Warehouse. Travis also directed the inmates as they constructed ADA Cane Detector rails for the City of Jacksonville, saving taxpayers thousands of dollars. In addition, Travis and the inmates he teaches have assisted with projects at the Jacksonville National Cemetery, and they have also helped non-profit organizations such as the Police Athletic League and the Sulzbacher Center. Officer Larry Propper said, “Since my transfer to the JSO Firing Range, I have had the opportunity to observe the work Travis Bowles has completed for our department. He has gone above and beyond on many projects he has completed using his skills and talents to meet any needs or requests. Some projects he has worked on include: target racks, clearing barrels, rebuilding the yard trailer, ammo storage room security doors, interactive target stands, floor supports for office trailer, tractor brackets, and the access gate. With every task or project not only does he complete them on schedule, Travis uses his ingenuity to ensure the project is functional, often beyond our original request. He is a team player who is skillfully gifted and a pleasure to work with.” Six Pillars of Character Award Mike Pelletier Any JSO employee who goes “above and beyond” in demonstrating one of the Six Pillars of Character is eligible for this award. Those characteristics are: Trustworthiness; Respect; Responsibility; Fairness; Caring; Citizenship. Officer Mike Pelletier works in the Canine Unit where he patrols the streets of Jacksonville with his partner, Police Service Dog “Draco,” a three-year-old Belgian Malinois from Holland. Both are certified in narcotics detection and patrol functions. A dedicated member of JSO’s Honor Guard, Mike is recognized for Caring, Citizenship, Trustworthiness and Respect. Representing the JSO’s core value of being Community Focused, Mike assists with mowing the entrance to his subdivision and helps with beautification of the neighborhood by picking up trash or trimming trees – and much more, which has not gone unnoticed by his neighbor, Joel. On one occasion, Joel pointed out a nearby house with a lot of cars coming and going day and night. Mike alerted appropriate JSO personnel and soon the traffic flow stopped as the drug house had been dismantled. Last May a neighbor called 911 when he witnessed two people burglarizing a house in the neighborhood. Although Mike was off-duty he responded and searched the house with one of the responding officers. The suspects were never identified, but since then Mike regularly patrols the neighborhood with Draco before and after shifts, which has cut out a lot of unwanted and suspicious activity, according to neighbor Joel. He said, “Officer Pelletier is a trusted and valued member of our community and I personally have trusted him enough to share information with him regarding criminal activity, without fear of reprisal from the drug house…He is a great public servant who restores the community’s faith in the Sheriff’s Office.” Mike’s supervisor Sgt Charlie Byrd stated, “Officer Pelletier is one of the most recent members assigned to the Canine Unit. During his brief tenure, he and Draco have apprehended multiple violent felons and seized large amounts of illegal narcotics and currency. He is also a Senior Member of the JSO Honor Guard unit, and represents Law Enforcement Officers who lost their lives in the line of duty.” Corrections Officer of the Month Photo Not Available Donald J. Bowers Donald Bowers, currently assigned to work at the prison, for the past two years has served as a member of JSO’s Honor Guard, where he has proudly taken part in local, state, and National Police Memorial Week ceremonies. He has also participated in numerous funeral services for fellow officers. Before joining JSO, Donald served in the United States Navy and is a combat veteran of Operation Iraqi Freedom. He has previously been awarded the Humanitarian Medal for his part in search and rescue missions following the devastation caused by Hurricane Katrina. While assigned as Security Officer for the “F” building at the prison last November, Donald helped remove a makeshift weapon from one of the inmate dorms. Immediately following the completion of count in the building, he was closely observing inmate movement in one of the dorms when he observed an inmate attempting to conceal an item half-wrapped in paper. He directed the inmate to step out of the dorm, and that is when he observed the inmate attempting to place the unknown object under a mattress. After securing the inmate, Donald entered the dorm and conducted a search where under the inmate's mattress he located a five-inch sharp screw with paper around the head of the screw. Corrections Sergeant Catherine Wilson said, “Due to Officer Bowers being alert and observing this inmate, he secured a deadly weapon from the dorm and other inmates. This deadly weapon could have been easily used on a fellow corrections officer at any time.” Sheriff Rutherford said, “Donald, thank you for your keen eye and for assuring no one was hurt by this inmate and this makeshift weapon. Also, thank you for your service to this country.” MAY 2015 Police Officer of the Month James J. Carter James Carter, who works in the Emergency Preparedness Unit, is recognized for his invaluable help preparing for two accreditation assessments last year. Prior to becoming a Police Officer, James was a Corrections Officer and he previously worked in the Accreditation Unit (AU). In January 2014, after being injured while chasing a suspect, James was temporarily assigned to help the AU with preparations for the American Correctional Association onsite inspection. He updated files, compiled documentation and inspected every area of the Department of Corrections – and the JSO had an excellent ACA onsite inspection. James returned to his regular assignment, but just months later he was requested to assist the AU once again to help with preparations for the onsite inspection by the Commission on Accreditation for Law Enforcement Agencies (CALEA). JSO’s AU Manager Michelle Price said: “During both on sites (which equal two-thirds of the Triple Crown), he escorted assessors, answered questions, prepared assessor work areas, and ensured everything flowed smoothly. Carter did all this while preparing for the Georgia-Florida weekend and completing his regularly assigned duties. He did not hesitate to go above and beyond without complaint and his efforts are very much appreciated.” JSO received recognition for its seventh successful re-accreditation by CALEA at its Spring Conference this past weekend. Speaking of the Georgia-Florida preparations, James created a process to schedule and track all officers working the various events throughout the weekend. This process allowed him to keep a record of the hours worked, and whether or not the assets were on-duty or off-duty. Ultimately, he was the single contact for hundreds of officers assigned to work that weekend. Police Supervisor of the Month Daniel M. Shelton Zone 1 Patrol Sergeant Dan Shelton, who supervises a bicycle squad and serves as team leader for JSO’s Bomb Squad (the past two years), is recognized for his leadership during several deployments and for multiple Bomb Squad callouts. In 2014, he led the deployment to address panhandling in the downtown area, meeting with JSO’s Crime Analysis Unit and business owners in the River Walk and Hemming Plaza area to hear their concerns and gather valuable input. Devising a course of action utilizing the resources available to him, this deployment resulted in 12 arrests for panhandling and other arrests for unrelated charges. In late 2014, his bike squad was tasked with addressing an uptick in violent crime in the Springfield area. The squad met with JSO’s Crime Analysis Unit and with residents in the affected areas, and Dan then met with the leader of Zone 1’s Community Problem Response team to coordinate and (using his knowledge and resources) form an action plan. This deployment directly resulted in seven felony arrests; 36 misdemeanor arrests; 24 notices to appear; and the seizure of two handguns, three vehicles; 46 grams of marijuana and more than 28 grams of powdered and crack cocaine. Last, more than 20 field incident reports were written. In December now-retired Police Lt. Joe Medlin said, “After one month the citizens in the Bravo Sector are pleased with the enforcement action and increased police presence.” Sheriff Rutherford said, “Even when his squad was heavily focused on the Springfield area, Dan remained vigilant to what was occurring at the River Walk and Hemming Plaza. During that same timeframe two felony arrests, 11 misdemeanor arrests, 68 notices to appear and more than 65 field incident reports were filed.” Also, in late 2014 Dan assisted with the numerous protests in the downtown area and was credited for the professional manner with which they were handled. During this timeframe he successfully led his bomb techs through approximately two dozen callouts of various natures and supervised the squad at numerous special events. JSO’s Bomb Squad lends support to 13 local counties, so during a callout Dan may have to manage not only his team, but depending on the type of call he may have to direct members from various first responder agencies to ensure the execution of the plan and the overall safety of the operation. Last September Dan, along with the other Bomb Squad sergeant and several personnel, were recognized in a Letter of Commendation from JSO’s Intelligence Unit Lieutenant: “Their willingness to volunteer to work in hazardous environments which frequently place them in dangerous situations demonstrates a level of courage and valor second to none. They are all to be commended for their attention to detail, dedication to duty and professionalism shown.” Reserve Officer of the Month Klynt A. Farmer In 2006, Klynt Farmer, who started working as a Reserve Officer, volunteering his time to the JSO and the city of Jacksonville (as do all police reservists), is recognized for using his training during a stressful situation. At approximately 8:30 in the morning of Dec. 13 last year, Klynt had just finished eating breakfast with his family at a restaurant in Callahan when his assistance was requested. One of the restaurant’s patrons started choking while attempting to swallow a piece of bacon. Her friend tried to perform the Heimlich maneuver, but failed to dislodge the food causing her to choke. Klynt’s sister, who was visiting at that table at the time, immediately called for her brother to help, and he rushed to render aid. At that time, the victim was losing consciousness and the coloring in her face was fading. Klynt put his training from the Academy to good use that day as he performed the Heimlich maneuver, which caused the food to become dislodged from the victim's esophagus. While this commotion was taking place, other restaurant patrons called 911; however, after they saw she was okay they called back to cancel Rescue. The victim stated that she sure was glad Klynt Farmer was there eating breakfast that morning and saved her because she was in really bad shape. Bystanders stated they believe that without Klynt’s quick response the victim may not have survived by the time Rescue arrived. Sheriff Rutherford said, “I should point out that while compiling this information to nominate Reservist Farmer for recognition, one of our Police Sergeants spoke with the restaurant’s owner to discuss the importance of his employees being trained to handle such events. This is a good idea because a trained professional, such as Reservist Farmer, might not be around. The owner agreed and was working to setup basic CPR and Heimlich maneuver training for his staff.” THE JUSTICE COALITION’S VICTIMS’ ADVOCATE • 3 For Real? Ted Hires was the average businessman working 60 to 80 hours a week and looking out for himself until the day when he and his staff were robbed at gunpoint. As a victim of a crime, Ted found the crminal justice system worked harder for the criminal than the victim. As a result of his experience, Ted formed a (501(c)(3)), non-profit organization, Justice Coalition, which continues Ted’s mission of assisting innocent victims of violent crimes in the Fourth Judicial court system. Since 1995, the Justice Coalition has been fighting crime every step of the way. Fugitives captured are through a partnership with local law enforcement agencies, the media, and citizen involvement. The Justice Coalition’s Victims’ Advocate Continued from page 1 daughter was first killed have lightened somewhat. She’s grown stronger with God’s help, getting past the desire to end her own life. She tried to commit suicide three times, once with an overdose of prescription drugs, and twice when she tried to run her car off a bridge. The last time she attempted suicide, God told her that if she would trust Him, He would change the bad to good. And that has happened. She says her grandson saved her life. Lynnette’s oldest daughter was in Jacksonville with her one-year-old son during the time following Kalil’s murder. Seeing her mother’s despair, and how she loved her grandbaby, Shardea decided to leave the child with her when she returned to California. Loving and caring for him was what Lynnette needed to give her a reason to live. That and a renewed trust in God that He would give her strength and purpose. Through the Kalil McCoy Project (which she established) Lynnette gives motivational speeches, talking to young people about avoiding violence and making better choices in their lives. It is also a program to help families who are going through a grieving process, as she is. After Kalil’s death Lynnette felt completely alone. Friends she expected to help and comfort her did not come around; maybe they didn’t know what to say or do. But she knows what it’s like to be totally alone, to need someone to ask if she has food to eat, or if she would like help to clean up or perform other activities of daily living – to help her heal. She has forgiven the young men who participated in dumping Kalil’s body and has told them so. She believes in the upcoming trial she will have the opportunity to also tell Freddie Wade she forgives him, too, as well as his family, who never one time showed compassion to her or asked her forgiveness for the heinous crime committed by their son. Then she can be completely free to go on with her life and the plans she has in mind to honor her daughter. Kalil was a talented, beautiful young woman who loved to dance. Lynnette plans to open a dance studio and place her daughter’s lovely dance outfits in a glass case at the entrance. Kalil and her twin brother, Adil, planned to finish college (she had received a scholarship to BethuneCookman University in Daytona Beach) and work together. Kalil would be a psychiatrist, Adil a pharmacist, so she jokingly told her brother she would write prescriptions for her patients, and he could fill them. The family also had plans at the time Kalil was killed to open a combination hair salon and barbershop that would be called Twin Towers. Lynnette was attending school to learn this trade when she received the call about Kalil’s disappearance. Of course, these plans were not fulfilled, but the family has struggled to go on with their lives. Now they have to relive the painful tragedy that tore their hearts apart. Recently, a Miami case brought that question to a Florida appeals court. In July 2008, an individual visited a branch of the Bank of America in order to cash a check. A teller mistook him for a bank robber. In the ensuing events, the police responded to the scene and ordered all persons in the lobby to lie face down. The bank patron in question assumed a position in which one of his hands was located under his body and out of the view of the officers. When he failed to obey a command to show his hand, an officer used his toe to execute a “foot tap,” or kick to his head. The officer later explained that he was concerned that the suspect might have been concealing a firearm. The “suspect” was not a bank robber and subsequently filed a civil action against the bank for personal injuries. His complaint included allegations for battery, false imprisonment and negligence. The jury returned a verdict finding that the bank did not cause a battery to be committed upon him, nor did it cause him to be falsely imprisoned; however, the jury did award substantial damages for past and future medical expenses, pain and suffering, and punitive damages. Throughout the trial proceedings, the bank maintained that a party could not be liable in Florida for negligently calling the police to report a crime. The bank argued that the person making the crime report cannot be liable unless they acted maliciously – that is, acting intentionally and without just cause or excuse. The bank appealed the verdict against it. The appellate court reviewing the case explained that there were two legitimate and competing interests at odds in this case. On one hand, an individual should be protected from abusive accusations. On the other hand, people must feel free and indeed must be encouraged to contact the police to report suspected criminal activity. The public policy of Florida is to give wide latitude to an individual reporting a sus- to enpected crime in order sure a free flow of informa and tion between the people the police. Private citizens should be encouraged to become interested and involved in bringing the perpetrators of crime to justice and not discouraged under apprehension or fear of recrimination. The appellate court ex plained that a mistaken report to the police of the suspicion of a crime is not unless defamation it is done a miswith malice. Similarly, police the taken report to rises to the level of slander only if it is done maliciously. Valladares and was de cided July 7, 2014, by the Florida Third District Court of Appeals.
