1 2 3 April 19, 2016 City of Minneola Council Meeting Minneola City Hall 6: 30 P.M. 4 5 6 7 8 The City of Minneola Council Meeting was called to order by Mayor Pat Kelley. Also present were Vice Mayor Pam Serviss, Councilor Lisa Jones, Councilor Kelly Price, Councilor Joe Saunders, Scott Gerken ( City Attorney), Mark Johnson ( City Manager), and Christina Stidham City Clerk). 9 10 A moment of silence was observed, and the Pledge of Allegiance was led by Vice Mayor 11 Serviss. 12 13 AGENDA REVIEW 14 15 No changes. 16 17 PUBLIC COMMENT 18 19 20 Lynn Anoa' i presented a donation on behalf of the WXW Wrestling Family to the City Council for the Gilliam family. 21 22 Afa Anoa' i mentioned their program for community groups raising money selling tickets for 23 wrestling events. 24 25 Platt Loftis & 26 Rick Chancey, Waste Pro representatives, presented a proposal for the solid waste service franchise including upgrades, new equipment, and new services. They requested 27 permission to move forward with the franchise agreement. 28 29 Mark Johnson confirmed that he was satisfied with the present service, the rate discussed, and 30 the benefit of consistency for the residents. 31 32 City Council discussed the proposal and determined that Waste Pro has reached the City' s 33 expectations. 34 35 Wally Szkwarko (resident) spoke about Waste Pro' s services. 36 37 Scott Gerken explained that the City will move forward with the ordinance adoption for a short 38 term extension. In the meantime, we can complete the contract negotiations. 39 40 CONSENT AGENDA 41 42 ITEM 1: City Council Meeting Minutes from April 5, 2016 ITEM 2: City Council and P & Z Workshop Minutes April 12, 2016 43 44 45 April 19, 2016 City Council Meeting Page 1 of 6 1 MOTION by Councilor Jones, SECONDED BY Councilor Price, to approve the consent 2 agenda. 3 4 AYE: Serviss, Jones, Kelley, Price, Saunders 5 6 NAPE: None 7 8 MOTION PASSED: 5 -0 9 10 COUNCIL DISCUSSION & ACTION ITEMS 11 12 ITEM 3: Planning and Zoning Commission Reappointment 13 14 15 MOTION by Vice Mayor Serviss, SECONDED by Councilor Jones to reappoint Ms. Debbie Flynn to the Planning and Zoning Commission. 16 17 AYE: Serviss, Jones, Kelley, Price, Saunders 18 19 NAYE: None 20 21 MOTION PASSED: 5 -0 22 23 ORDINANCES AND RESOLUTIONS 24 25 ITEM 4: Ordinance 2016 -01 —Tree Protection —1st Reading 26 27 Scott Gerken read Ordinance 2016 -01 by title only. 28 29 30 31 32 33 34 35 Scott Gerken explained the Planning and Zoning staff and Commission have recommended some changes including: Any tree greater than 6 inches D.B. H. must have a permit or a written determination from the City stating they are exempt from a permit Clarify language regarding property improvements to protect trees when possible Clarify that when a tree permit is obtained properly, no replacement trees will be required if there are adequate trees on the property for code compliance 36 37 Councilor Jones asked for definitions to be included in the ordinance. 38 39 Mayor Kelley suggested having alternatives to tree replacement on lots. 40 41 42 Councilor Saunders commented that trees add a lot to the community, but this has become a complicated issue for residents including property rights concerns. We are over reaching with the 43 requirements of trees on private property and the permit requirements to remove trees are too 44 complex. 45 April 19, 2016 City Council Meeting Page 2 of 6 I Vice Mayor Serviss agreed with Councilor Saunders regarding tree removal. 2 3 PUBLIC COMMENT 4 5 6" Resident Wally Szkwarko spoke regarding the tree issue and suggested making Minneola a Tree City" in the future. 7 8 9 10 Scott Gerken mentioned that the Planning & Zoning Commission had discussed ways to find a balance between private property rights and the community' s desire to have trees. He said they felt this proposed tree protection ordinance would be a good balance. 11 12 Councilor Jones commented that trees are a crucial part of the ecosystem and should be 13 protected. 14 15 Vice Mayor Serviss said we need to make the process to get a tree removal permit easier. 16 17 Councilor Saunders suggested leaving the current tree ordinance the way it is. 18 19 Nathan Focht, Lake County resident, spoke about water consumption and protecting the water 20 table. 21 22 ITEM 5: Ordinance 2016 -02 — Outdoor Vending Machines —1st Reading 23 24 Scott Gerken read Ordinance 2016 -02 by title only. 25 26 27 Scott Gerken stated it was the opinion of Planning & Zoning Commission that outdoor vending machines should be prohibited and should be placed only within a structure or building. 28 29 Councilor Saunders commented that there should be a balance between convenience to the 30 residents, profitable business, and the appearance of the City. 31 32 Mayor Kelley mentioned buildings being designed to house vending machines within the 33 business. 34 35 Vice Mayor Serviss suggested moving all of the vending machines inside the businesses. 36 37 38 Councilor Jones was concerned with the current businesses not having room to house the vending machines inside without having to remove other items. She suggested permitting outside 39 vending machines rather than prohibiting them. 40 41 42 • 43 • 44 • More discussion ensued regarding the placement of vending machines including: Grandfathering in vending machines already within the city A moratorium on standalone vending machines Requiring outdoor vending machines have an annual permit and /or business tax receipt 45 April 19, 2016 City Council Meeting Page 3 of 6 1 PUBLIC COMMENT 2 There were no comments. 3 4 ITEM 6: Ordinance 2016 -03 — Right of Way Maintenance Responsibility —1st Reading 5 6 Scott Gerken read Ordinance 2016 -03 by title only. 7 8 Scott Gerken explained that this ordinance requires non -residential property owners must 9 maintain the adjacent right of way. 10 11 Council discussed the ordinance and requested that business owners not be responsible for 12 sidewalk maintenance unless they damage the sidewalk. 13 14 ITEM 7: Ordinance 2016 -04 — Urban Backyard Chickens —1st Reading 15 16 Scott Gerken read Ordinance 2016 -04 by title only. 17 18 19 Scott Gerken explained this is a first step in allowing urban chickens within the City of Minneola. There are currently less than a dozen properties identified as meeting the 5 acre 20 requirement to allow chickens. No roosters will be allowed. 21 22 PUBLIC COMMENT 23 24 25 Nathan Focht, Lake County resident & local chicken farmer, stated offered his expertise to answer any questions regarding this subject. he has 850 chickens and 26 27 Wally Szkwarko, resident, suggested a permit, maximum number of chickens, and coop 28 location setbacks be required. 29 30 31 Scott Gerken explained that this ordinance addresses requiring a permit, the number of chickens allowed, and the location of the coop on the property. 32 33 ITEM 8: 34 Reading Ordinance 2016 -06 — Interlocal Service Boundary Agreement Amendments —1St 35 36 Scott Gerken read Ordinance 2016 -06 by title only. 37 38 39 40 Scott Gerken explained that nothing changes for the City of Minneola, but this ordinance allows Howey -In- The -Hills and Groveland the ability to annex some additional properties within their area. 41 42 FINAL PUBLIC COMMENT 43 44 There were no comments. 45 April 19, 2016 City Council Meeting Page 4 of 6 I REPORTS /COMMENTS 2 3 Mark Johnson reported: 4• The Kicking Cancer Kickball Tournament raised $ 3, 000. 00 for the families and $ 400 for 5 the Greater Clermont Cancer Foundation 6• Hideaway Court residents requested to plant shrubs in the City' s right of way Councilor Price is coordinating with Minneola Elementary 4th graders to plant a butterfly garden in the community garden and a cleanup Trailhead Park project on Friday, April 7• 8 22nd 9 10 • Requested May 2nd off to attend an event in Tallahassee o Vice Mayor Serviss suggested Mr. Johnson take off May 3' as well A staff member having difficulty with child transportation is requesting an exception to the vehicle policy offering to sign a liability release Oak Valley water rate update 11 12 • 13 14 • 15 16 17 Vice Mayor Serviss suggested moving the date of the May 19th° so the City Manager and Mayor Kelley could attend. 3rd meeting to May 10th or May 18 19 After Council discussion, it was decided that the meeting be held on May 3rd as scheduled with 20 the absence of Mayor Kelley and Mark Johnson. 21 22 23 Councilor Jones commented that the kickball event was absolutely phenomenal, and she was so happy we raised so much money. She is looking forward to next year and the upcoming 24 dodgeball event. 25 26 Councilor Saunders asked about the April 14th Code Enforcement Hearing. 27 28 29 30 $ 31 32 Mark Johnson explained this was the first meeting with the Magistrate. He allowed The Surf restaurant 90 days to either obtain a variance for the boat or remove it. On the 91 St day fines of 125. 00 a day will begin if it is still out of compliance. The Magistrate also gave The Surf restaurant 30 days to remove the other two signs. If these are not removed a $ 125. 00 per day fine will be assessed on the 31St day going forward until removal. 33 34 35 Scott Gerken asked if Council wanted all of the ordinances read at this meeting to still be scheduled for the second reading on May 3rd. 36 37 It was the consensus of Council that the ordinances stay on schedule for 2nd readings on May 3, 38 2016. 39 40 41 Vice Mayor Serviss thanked everyone including Lt. Patton for their help with the kickball event and said they are now working on the Kid Connect event. 42 43 Mark Johnson commented that Lt Patton' s sister took around 500 pictures at the event. 44 45 Councilor Jones thanked residents and Nathan Focht for attending the meeting.
