City of Patterson City Council Special Meeting January 21,20t4 Minutes (Closed Session) NOTICE IS HEREBY GIVEN that the City Council for the City of Patterson, California will hold a Special Closed Session Meeting on Tuesday, January 21,2014 at 5:30 p.m. or shortly thereafter ion the City Council Chambers, located at l Plaza, Patterson, California. 1. Call to Order The special meeting of the City Council of the City of Patterson was called to order in the City Council Chambers at 5:33 p.m. by Mayor Molina. Present: Councilmembers Buehner, Novelli, Farinha, Lustgarten and Mayor Molina (5) Staff Present: City Manager Butler and Deputy City Attorney White (2) At this time, Mayor Molina announced the items listed to be discussed in Closed Session and opened the items to public comments. The city Council will adjourn to closed Session to address the following: 2. ' Conference with Legal Counsel, Potential Litigation pursuant to California Government Code Section 54956.9 ( c ) (6 cases) ' Conference with City Attorney, Pending Litigation pursuant to California Government Code Section 54956.9 (a) (2 cases) a. City of Patterson v. Patterson Hotel Associates, LLC et al. Stanislaus County Superior Court Case No. 670042 b. Westside Property Management v. City of Patterson Stanislaus County Superior Court Case No. 680554 Statements of Conflict Councilmember Buehner stated he had a Conflict of Interest with (2) Items in Closed Session (One Potential Litigation and Item b.) and therefore would not be participating in the discussions and/or votins on the item. 3. Items from the Public - there were no public comments. Pursuant to Government Code Section 5495a3(a), members of the public wishing to address the City Council may do so at the beginning of the meeting, and such comments shall be limited to the closed section meeting topic. 4. Adjourn to Closed Session There being no public comments, the Patterson City Council adjourned to Closed Session. 5. Report from Closed Session (if any) The City Council gave direction to staff. There were no items to report out from Closed Session. 6. Call to Order The regular meeting of the City Council of the City of Patterson was called to order in the City Council Chambers at7:21p.m. by Councilmember Farinha. Present: Councilmembers Buehner, Novelli, Lustgarten and Farinha (4) Staff: City Manager Butler, Deputy City Attorney White, Fire Chief Hall, City Engineer Irwin, Capital Projects Manager Jorristma, Finance Director Moreno, Public Works Director Willett, Public Works Administrative Manager Delgado, Human Resources Manager Tucci, City Planner Andrews, Recreation & Community Services Director Flanders, Police Sgt. Paul Yotsuya and City Clerk Vela (13) Excused: Mayor Molina ) Pledge of Allegiance 3. Statements of Conflict (l) Mayor Pro Tem Buehner stated he had a Conflict of Interest with Item No. 7.3 (Second Reading and Adoption of Ordinance No. 743,Patterson Logistics Project) and therefore would not be discussing or voting on the item. 4. Items from the Public Youth Action Committee (YAC) Teen Center Youths (Destin)r. McKenzie. Marcus) addressed the City Council updating the Council and Public on the remodeling of the Teen Center. The YAC Group to hold a grand opening event on January 31,2014. The YAC Group handed out invitations to City Council. The Youth Action Committee informed the Council of the days of operation at the center, age group at the center, and project and events taking place at the center. - Olga Cardenas. Patterson Branch Library - addressed the City Council on the current programs/events being held at the Patterson Library. Ms. Cardenas updated the City Council on a grant that was awarded to the Patterson Branch Library. Mary Bennett. 1447 Nubia Street" Patterson - addressed the City Council expressing her concerns over the Senior Center Board of Directors vacancies. Mrs. Bennett addressed the City Council on the item of senior center board being on their own, holding their own election, staff, having a more structured Senior Board, etc. Item to be placed on a future asenda for discussion. Any item may be removed from the Consent Calendar for separate discussion upon request from a member of the Public, Staff and/or Councilmember. 5.1 Motion to Waive Readings - All Readings of Ordinances and Resolutions, Except by Title are hereby waived. 5.2 Approval of City Council Meeting Minutes of October 8,2013 (Closed Session & Open Special Meeting), October 15,2013 (Closed Session and Open Regular Meeting), October 22,2013 (Special Open Meeting), November 5, 2013 (Closed Session & Open Regular Meeting), November 12,2013 (Special Open Meeting) and November 19,2013 (Closed Session and Open Regular Meeting) Councilmember Lustgarten addressed the City Council Meeting Minutes of October 8, 2013 Special Meeting (Open Session) page 2, correct sentence to read: Mr. Willett gave Mr. Salmon a copy of the August 12,2013 presentation. City Clerk Vela to correct the minutes as stated. 5.3 Approval of city Department Reports for the Month of December 2013 (Community Development, Fire, Public Works, Recreation & Community Services) 5.4 Approval of City Committee and Commission Reports for the Month of December 2013 (Beautification Committee, Parks & Recreation Commission. Planning Commission) 5.5 Monthly Update on Grant Writing Activities from California Consulting. 5.6 Award of Professional Services Contract in the Amount of $33,793 to Civic Plus (Icon Enterprises) for Web Redesign Services and Authorize Staff to Execute the Contract. Councilmember Novelli addressed the item of the need for more than 500 text message subscribers to the Notiff Me program. Request for staff to report back on the cost to add more messages in/out. Councilmember Novelli to work with City Engineer Irwin to address item. Councilmember Novelli moved to pull/table Consent Calendar Item 5.6 to the next City Council meeting (February 18, 2014) The motion was seconded by Councilmember Lustgarten and approved by a 4-0 roll call vote. 5.7 Accept the Certificate of Completion fbr the Arambel-KDN Business Park Project Reorganization to the City. 5.8 Approve Resolution No. 2014-02, Accepting the Public Improvements for the Del Puerto High School Offsite Public Improvements as Complete, Authorizing Staff to the File the Notice of Completion and Commence the Warranty Period. 5.9 Approve Resolution No. 2014-03, Accepting the Public Improvements for the Northmead Elementary School Offsite Public Improvements as Complete, Authorizing Staff to File the Notice of Completion and Commence the Warranty Period. 5.10 Approve Resolution No. 2014-04, Accepting the Public Improvements for the Patterson High School Offsite Public Improvements as Complete, Authorizing Staff to File the Notice of Completion and Commence the Warranty Period. 5.1 I Approve Resolution No. 2014-05, Accepting the Public Improvements for the Las Palmas Elementary School Offsite Public Improvements as Complete, Authorize Staff to File the Notice of Completion and Commence the Warranty Period. 5.12 Approve Resolution No. 2014-06, Accepting the Public Improvements for the Bank of the West Sidewalk Improvements as Complete, Authorizing Staff to File the Notice of Completion and Commence the Warranty Period. 5.13 Approve Resolution No. 2014-07, Rejecting the Claim of Lori Gonzalez in the Amount of $129.87 for Alleged Damages. Presentations and Public Hearings 6.1 Presentation: Update on Chevron Energy Solutions Energy Efficiency Project - Steven Ramirez, Project Manager Steve Ramirez with Chevron reviewed his stafTreport - power point presentation. JP Primo with Chevron reviewed his staff report - power point presentation. 6.2 Presentation: lntroduction of New City Employees City Manager Butler, City Engineer Irwin and Public Works Director Willett introduced the following New City Employees: - Christy Menchaca, Secretary, Building, Engineering & Capital Projects - Peni Basalusalu, Management Analyst, Public Works Ryan Hignite, Mechanic, Public Works 6.3 Presentation/ Action Item: Approve Professional Services Contract with Bartle Wells Associates in an Amount not to Exceed $40,000 for the Water & Sewer Rate Analysis and Prop 218 Validation Process and Authorize Staff to Execute the Contract. Public Works Director Willett reviewed his staff report. Public Works Administrative Manager Delgado reviewed her staff report presentation. - power point Doug Dove with Bartle Wells Associates reviewed his report. Staff to survey what other communities are doing in regards to sewer, water and discounts for low income residents/seniors/special needs residents, etc. Councilmember Farinha moved to approve the Professional Services Contract with Bartle Wells Associates in an Amount not to exceed $40,000 for the Water & Sewer Rate Analysis and Prop 218 Validation Process, including a budget adjustment for an additional $20,000. The motion was seconded by Councilmember Lustgarten and approved by a 4-0 roll call vote. 6.4 Public Hearing: Consideration of Ordinance No. 750 and751, Amending Chapters 1.32, 1.52 and 1.56 of the Patterson Municipal Code, Clarifuing Procedures for Abating Nuisances and Adoption of Resolution No. 2014-01 Establishing a New Nuisance Abatement Policy. Ordinance No. 750, An Ordinance of the City Council of the City of Patterson, Amending Chapters 1.52 and 1.56 of Title I of the Patterson Municipal Code to Establish Procedures for Nuisance Abatement Proceedinss. Ordinance No. 751, An Ordinance of the City Council of the City of Patterson, Amending Chapter 1.32, Chapter I .56 and Chapter 6.16 of the Patterson Municipal Code to Permit the Recovery of Attorney's Fees for Abatement Proceedings and Code Enforcement Matters. Resolution No. 2014-01, A Resolution of the City Council of the City of Patterson, Adopting a Policy for Nuisance Abatement Proceedings and Recovery of Abatement Costs. Deputy City Attomey White reviewed his staff report. Fire Chief Hall reviewed his staff report. At 8:53 p.m. Councilmember Farinha opened the Public Hearing to public comments. There were no public comments. Councilmember Lustsarten Read Ordinance Nos. 750 and75l and Resolution No. 2014-01. Councilmember Lustgarten moved to adopt Resolution No. 2014-01. The motion was seconded by Councilmember Farinha and approved by a 4-0 roll call vote. Councilmember Novelli moved to approve First Reading and Introduction of Ordinance Nos. 750, reading by title only, waiving further reading. The motion was seconded by Councilmember Lustgarten and approved by a 4-0 roll call vote. 7. Staff and Committee Reports 7.1 Cit), Manaeer a. Approve the City Council Meeting schedule for 2014. City Manager Butler reviewed his staff report. The City Council was in consensus to not hold a regular City Council meeting on Tuesday, November 4,2014 due to Election Day. b. Approval of a New Compensation Resolution Establishing Updated Salary Ranges for Employees in the Management and Mid-Management Classifications (Unrepresented Employees) The City Council was in consensus to remove/strike out section of severance pay because item was not discussed/approved by Council. Councilmember Farinha moved to approve Resolution No. 2014-08 with the removing/strike out of section in regards to severance pay. The motion was seconded by Councilmember Novelli and approved by a 4-0 roll call vote. 7.2 Engineering. Building and Capital Projects a. Provide Direction to Staff Regarding Proposed Improvements to Provide Access in Compliance with the Americans with Disabilities Act (ADA) at the Historic Downtown Center Building. City Engineer Irwin reviewed his staff report - power point presentation. City Building Official Daryl Willey reviewed his report. The Citv Council addressed the followins: Need for more lights. More lights shining up to the center of the building. Decorative Gas Lamp(s). Get professional services, architectural, structural, landscaper, adding lighted cross walks. Staff to check with Historical Society about modifications to the center building and checking with the State if any legal documentation needs to be frled. Review if there are any grants for modifications to the center building (historical building) Any wood being replaced to be fire suppressant wood. Install extra conduits. Get engineering all laid out for project - do project in phases. Itemized project and bring back to Council for reviedapproval on what to do and in what order. Item of Fire Suppression to be added in the engineering process. Review the roof in the process. Do project before the end of this year 2014. Start with wish list and bring back. Talk to Sword/Salmon about building. At 9:40 p.m. Councilmember Farinha opened the item to public comments. There were no public comments. By Adopting the Proposed Ordinances, the City Brings its Adopted Codes into Compliance with State Regulations, Legislation and the General Plan. The Cify Council addressed the item of how long can a train block the streets - Deputy City Attorney White updated Council about the 10 minute rule. Public Works Director Willett inform the Council and Public of watering days. Item of Water Conservation to be place in the City Newsletter, newspaper, web site, door to door to inform the public. Educating for the public. Staff to check with High School groups about helping. Staff to review the item of possibly removing Sundays from watering days. Councilmember Buehner addressed the item of the purple pipe projects in the works City well project. - Councilmember Lustgarten addressed the item of the Senior Meals Task Force, having served to date 3,000 meals to seniors.
