named Lyman, which was the name of a brother to this
Celinda, and her son was named Henry, also the name
of a brother to this Celinda. No other likely Celindas
have yet been located through NEHGS or internet genealogy sites. Stephen was a carpenter, having billed
the county for constructing Branch County’s first jail.
There has been no will located, nor place of burial. His
death date of 04 March 1848 is listed in his father’s
family Bible.
His children as listed in his father’s will are: Esther
(1817-1906) who married William Timlos Van Benschoten; Francis 5 (1818-02 March 1884) who married Lois
Herrington; Harriet (b. 1821), Terry Ambrose Bates,
M.D.; Joshua (11 Nov. 1825) who married Susan Charity Wood 09 August 1844 in Michigan, and Henry Bates
(b. 1830).

STEPEHN 6 By Howard Snooks: Stephen 2 (Stephen 1,
Francis, Francis, Francis, Francis, Abraham) was born
08 Oct 1791 in Pownal. He most likely moved the same
time as did his father and mother to Otsego County, NY
and was in Branch County, Michigan by 1839 when he
bought 35 acres of land in Ovid, next to his brother Francis. His marriage is not recorded in his father’s family Bible, but the 1850 census for Ovid names his wife as Celinda (a granddaughter is also named Celinda). Celinda is
likely the daughter of Sheffield Harrington and Ruth Richmond. If so, she joins a number of Harrington’s who descended from 1630’s immigrant Benjamin Harrington and
Elizabeth White of Providence and married into this Bates
family. Primary source evidence that Stephen’s wife Celinda is the same as this Celinda is not definitive but includes the following: Celinda is a relatively unusual
name, she is in Otsego County at approximately the correct age, in a county with a very small population, at the
same time as Stephen Bates, Jr. Her grandson was
Francis 5 (8) (Stephen 2 (7), Stephen 1 (6), Francis
5, Francis 4, Francis 3, Francis 2, Francis 1, Abraham) was born in 1818 in Otsego County, NY, and died
02 March 1884 in Michigan.
He married Lois
Herrington (1815-1906) 26 October 1836 in Jackson
County, Michigan, the daughter of Noel Herrington,
who was born in Rhode Island (he may descend from
Benjamin Harrington and Elizabeth White as did several other Harrington/Herrington family members who
married into this Bates line). Lois was born in New
York. Francis was a carpenter. Lois Bates applied for
a “Pension of a Mother” on 17 May 1889 as a result of
their son Lyman’s death by disease while serving in the
Civil War in Company K, 9 th Regiment, in Knoxville,
TN. The application was very informative, in that she
stated that she qualified for the pension because her
husband Francis abandoned her and their five minor
children and “had not aided in any manner in their support since February 1865”. She received $12.00/month
for fifteen years until her death at the age of ninety-one,

living with her son Harvey and his
family. Francis apparently married
Hannah Eldred sometime after
1865, because he is located with
her as his wife in the 1870 census
for Berrien County, Michigan. In
1880, he is located as a boarder,
and divorced, in Branch County,
Michigan.
Francis and Lois had six living children (according to the Pension application, there were eight children
born). They were: Anna Olive (27
March 1837—16 December 1894);
Harvey (b. 1844); Lyman (b. abt.
1848-d. 19 Jan 1864); Celinda (b.
1850); William (b. 24 April 1855),
and James (b. 22 Aug 1860.
Anna Olive Bates (8) (Francis 5
(7), Stephen 2 (6), Stephen 1 (5),
Francis 4, Francis 3, Francis 2,
Francis 1, Abraham) was born 27
March 1837, probably in Washtenaw County, Michigan. She married Samuel Snook about 1856 in
Leonidas, St. Joseph, Michigan.
He was born about 1817 in Pennsylvania, the son of John and
Susannah Snook. In about 1873,
he drowned in Lake Michigan, and
Anna married Oliver Skinner before
1880. She moved to Bayfield, La
Plata County, Colorado where her
sons Samuel and Francis had
moved in 1890. It is not known if
she divorced Oliver Skinner, he
died, or if she simply left him, but
she died 16 December 1894 and is
buried in the Bayfield cemetery as
Anna O. Snooks. They apparently
had no children together, although
Oliver was a widower with children.
Anna and Samuel had five children:
Louise Amelia (27 March 1857 in
Leonidas—20 October 1921 in
Leonidas); Helen (b 1860, d. in
North Falton, Michigan); Mary Etta
(b 1865, d. Battle Creek, Michigan);
Francis (23 May 1869—16 May
1957 in Oregon); and Samuel Otis
(20 May 1871-05 May 1957 in Durango, La Plata County, Colorado).
Samuel Snooks moved to Du-

rango, La Plata County, Colorado in
1890 from St. Joseph County,
Michigan, and soon after began
ranching east of Durango.
He
changed his name to Snooks in
order to distinguish himself from
Benjamin Franklin Snook, who was
not related but lived in the same
general area. He married Josephine Nelson (1878-1958) 25 December 1897 in Pagosa Springs,
Archuleta County, Colorado. She
was the daughter of Danish immigrant Henry Nelson and Harriet
Dailey, and was the first non-native
American female born in the Pine
River Valley in southwestern Colorado. Her grandparents, Dennis
and Juliette Green Dailey, were
among the very first pioneers to
Colorado, having moved to land
given to them by Chief Niwot of the
Arapaho tribe twelve miles northeast of Boulder in 1859. Samuel
and Josephine owned a general
store and managed a post office in
the store, in addition to ranching
and mining coal from a mine on
their property.
When the store
opened, the Pagosa Springs Sun
proclaimed him “The Merchant
Prince” of Beaver Creek. Samuel
was also known for his hunting of
bear and mountain lions.
Samuel and Josephine had three
children: Otis Henry was born 05
September, 1898 in Piedra, La
Plata County, Colorado on the family ranch. He married Gladys Irene
Knorr (b. 1899 in Chicago, raised in
Farmington, New Mexico, and d.
1987 in Bayfield).
She was a
teacher. Otis was a rancher and
served as Justice of the Peace for
the Bayfield community. A newspaper article in 1957 in the Durango
Herald documented his pioneer
family’s life. Otis and Gladys had
five children, of whom four are still
living. Hattie Anna was born 06
September, 1907 on the family
ranch, and died 14 December, 2005
in Buckley, Washington where she
spent the last years of her long life
living with her youngest daughter.
She married (1) Bert Leonard Fosberg (1902-1968), and with him she
had four children. She married (2)
Frank Earl Kingsley (1906-1962)
and with him she had one daughter.
Three of her children are still living.
Ilvah (Babe) was born on the family
ranch on 14 December 1912. She
married James (Ed) Mosby (19041967), and had one child who died
in infancy.

Jeffrey Owen Bates sent a very interesting article about the above
Charles Bates: Charles and son
Frank and their families, came to
Missouri in the fall of 1840. The next
spring, 1841, Charles and son went
with an ox team to the territory of
Iowa to look at land to purchase.
They crossed the Des Moines River
near Keosauqua and traveled to the
trading post at Eddyville. While on
the trip they met a tribe of Indians,
including Chief Wapello. They were
very friendly, and Charles traded a
spear he had made, with the Chief
for a pair of buckskin moccasins, and
pants. Charles lay grant to 160
acres of land, five miles south of
Eddyville, which had been given him
for services rendered in the war of
1812-14. After a few days they returned to MO., where they remained
till Nov. of 1841, and then came back
to the Eddyville trading post and

stayed till first of Mar. 1842. During the winter he again met Chief
Wapello. The Chief left his spear
at Eddyville as it was too burdensome to carry across country.
(This spear was made out of four
pieces of iron, as iron was scarce
in the territory at this time, and was
riveted and welded over a wood
fire, as coal was not made use of
at that time. The rivets were made
by hand and counter sunk by a
blunt instrument, not smooth like at
present time.) Frank came to Iowa
in the fall of 1846. Some years
later, Charles and son Frank and
Grandson C. H. Stevenson, went
to Gishes Mill and C. H. found the
spear lying on the ground. Charles
recognized the spear as the one
traded with Chief Wapello. C. H.
held the spear for 50 to 60 years
and then presented it to the Wapello County Historical Society.. It
was presented not for it’s beauty or
simplicity, but as the county carries
the Chieftan’s name and it’s soil
contains his last resting place and
dust. NOTE: The Historical Society had the letter, that was with the
spear, but no longer had the spear,
perhaps it went into storage or lost
to fire or demolition?

Lydia Bates was married to Joseph
Morse Sr., son of Valentine Morse of
Coventry, Rhode Island. Lydia
(Bates) and Joseph Morse had two
children: Phebe Morse born in 17731774 married 1st. to Rufus Cook,
2nd. to William Rice. Joseph Morse
Jr. 6., born May 21, 1775, married
1st. Renuia Greene, 2nd. to Esther
Rogers Keyes.
Lydia's husband Joseph Morse Sr.
died about 1779. We don't know
exactly when or where. Family records suggest that he possibly died
in Vermont, and that after his death
Lydia and her children returned to
Rhode Island where her grandfather,
Randall rice deeded her a piece of
ground dated August 24, 1779, referring to her as Lydia Morse, widow
and relit to Joseph Morse, deceased.
Lydia and her family remained in
Rhode Island until the winter of 1817
-1818, when she left Rhode Island
with her son Joseph Morse Jr. and
his wife Renuia Greene Morse and
ten of their eleven children along with
a group of people from the New Light
Christian Church led by Rev. Douglas Farnam. They went to central
Ohio, settling in Madison County
(later Union Co.) The trip was made

by ox cart and supposedly took 49
days. Samuel Rice, who owned the
Rice Tavern in Rice City, Rhode Island in western Rhode Island was
sent to Ohio earlier to purchase land.
The land he chose was named Rice
Town. It was rich land with tall
grass. Everything was fine as long as
the tall grass was burned off each
year to control the mosquito's. As
the settlement grew, the practice of
burning the grass stopped for fear of
burning homes. In 1822 malaria hit
the area and many of the group died.
Lydia Bates Morse died in September 1822 at 80 years of age. Joseph
Jr.'s wife Renuia died in 1826. All
are buried in Hathaway Cemetery
near where they lived.

Chapter Nine
“Continued Wanderings”
Levi had a full life, raising two complete families, being
a County Commissioner, and as a farmer who started
four different farms. However, he never lost the urge to
search for something that was more and better from
within him. Something was missing even though he
had no idea exactly what it was. Even though his farm
in Long Pine was the envy of his neighbors, he still felt
he needed something else in his life.
He made two separate trips via train in the 1890’s to
the Walla Walla, Washington area to visit with his
brother James, who moved there following the shootout
at the Bates School House in Seward. James R. Bates
was an original pioneer to that area having arrived
there in 1881. He homesteaded land along the Blue
Creek area of Walla Walla. Levi and his entire second
family really liked the area and tried to find land to start
a new life there but never were able to finally choose a
place for the family to move. Everyplace he looked at
had promise and the land was everything James had
said it was but that special location in Washington
eluded Levi.
When he couldn’t find land in Washington, more time
passed and Levi knew that his medical condition was
getting worse. In 1901 he and the family made another
train trip. This time they went to California under the
hopes that the warmer weather would help Levi’s medical condition improve. Just like the search in Walla
Walla, he never found any place in California that
would prove more inviting to them than their farm along
Pine Creek, so the family returned home to Long Pine,
Nebraska.
Following Thanksgiving of 1903, Levi had another serious bout with his pleurisy. He was pretty much confined
to bed by his physician. Levi’s twenty year attempt to
forget the past was lost as he lay in bed with nothing to
do but to think. He began reminiscing about his past
and shared many of his feelings about his life with Columbia and his children Mark, Manley, Maggie and
Count. They learned how he had walked from New
York to Illinois as a teenager, and during the Civil War
he walked from Illinois throughout the Mid-West until he
was discharged from Military service in Cincinnati,
Ohio. His walking continued to Nebraska. While he
visited states from one coast to another, he only saw
the Pacific Ocean, as his family had never gone to the
Atlantic Ocean when he lived in New York.
Levi spoke about much that occurred in his life but he
never shared his innermost thoughts regarding the

shooting of his brother at the Bates School House. His
dreams about that unfortunate event became more and
more frequent. The dreams were in slow motion as if he
was removed from his body and watching the melee occur all over again from an on-lookers perspective above
the fracas. Levi began to get upset with himself at having
not taken the threats more seriously. He should have
gotten word to Sheriff Sullivan so that the Sheriff and
deputies could have been present. That may not have
stopped the fight but it might have stopped the murder of
his brother William. Even if it wouldn’t have stopped the
murder, at least there would have been lawmen present
to testify that Gus Thomas had committed cold blooded
murder of an unarmed man. Surely then, justice would
have been served! Columbia and his children had trouble discerning his ranting about the shooting but they
could tell he was troubled and angry.
The family also heard Levi wondering aloud why Israel
and he had such a disagreement that they never spoke
or kept contact after they both left Seward. Sure, Israel
expelled the students. They deserved to be expelled but
why hadn’t he discussed the matter with Levi before he
took action. Levi stated in these dream states that he
knew that Israel felt that had Levi not retrieved the revolver hidden by William that public sentiment would
have swayed clearly in their behalf against the Thomas
and Donaldson families. Columbia could tell that Levi’s
biggest regret in his life was he never patched up his difference with Israel over this matter. Their riff was solely
based upon it being easier to blame the other for what
occurred than focusing on forgiving each other for their
mistakes. After all Columbia rationalized, the bible
clearly states such ideal behavior but neither of these two
proud men had been willing to accept any personal culpability in the matter.
Levi’s ramblings tried to analyze why the Coroner’s Jury
and the subsequent Grand Jury did not bring an indictment against Gus Thomas for the murder of William or
the Assault with a Deadly Weapon that occurred against
Israel. For that matter, why wasn’t Hillery charged with
Assault against Luther and himself after both had been
struck in the head by Hillery’s cane. What about the fact
that James had attempted to kill him by shooting at him
twice? At the time all of those events took place, not a
Bates brother had a weapon in their possession. Any
action taken after that point should have been considered as being in self defense. At least, Levi reasoned,
most prudent individuals with common sense would
come to that conclusion.
Why then weren’t the charges made and retribution for
the crimes resolved through the Court system? Could
the community of Seward have been so concerned following the riots of the previous year that this time, more
than just a temporary barracks to house a murderer

might be demolished? No one wanted another large mob
to gain control over the fate of the community again.
Hadn’t a similar crowd comprised of primarily local residents raised similar concerns when they heard the competing proposals from speakers concerning which railroad would be chosen by the County Board of Commissioner’s? While violence did not come to fruition that day,
the commotion raised clearly only let one side of the story
be heard. The subsequent attacks at all of the Commissioners and the County Clerk’s Office, was yet another
example of individuals within the community of Seward
making certain that they would stop at nothing to get their
way and they did not care who stood between them and
what they wanted.
Just the fact that over 100 witnesses were called to testify
in the various Court proceedings and that most of those
individuals were not in attendance at the actual Church
service the night that William lost his life had to, by sheer
volume, taint the results of the findings. Because Coroner and Grand Juries are held behind closed doors, the
victim’s and law enforcement Officer’s could not be present to hear testimony given. Since many of the witnesses were not present at the Bates School House,
most of their testimony regarding the actual facts of what
occurred that night were speculative in nature and should
have had little weight. Levi could never get his hands
around the real rationale why these crimes went unpunished. Not knowing the precise reason for such a clear
disregard for the law, drives reasonable people to believe
in conspiracy plots against them.
Levi’s dreams began taking a different form when the
family heard him talking out loud to his brothers William
and Charles, who had preceded him to the afterlife.
When the family would sit with him he also was noted to
be having conversation with his father, Stephen Lyman
Bates and his mother, Catherine. Columbia, who was
extremely religious, took these conversations as a sign
that his past departed brothers, father and mother were
angels, who had come to guide Levi to the promised
land. Levi took his last breath on December 27, 1903
when he was 67 years old.
While Levi never completely resolved the dilemma of the
shooting at the Bates School House or his riff with Israel,
he went to his maker having lived a full live. He raised
two families, started four farms and watched them all
flourish. He served his country as a soldier during the
Civil War and he was a two term elected official. Most of
all he was an honest man, who was not afraid to work
and gave all endeavors in life his full attention.
Levi was buried on the family farm north of Long Pine in a
cemetery lined with a white picket fence. The cemetery
is surrounded on three sides by Pine Creek and the small
lake that sits on what used to be the Levi Decatur Bates
farm. A more peaceful and serene place would be diffi-

cult to find. Resolution to the shooting of his brother may
have escaped him while alive and caused him to search
internally for answers that were not forthcoming. It is only
fitting that he was to have a restful place in death after
having such an active life!
FRONTIER JUSTICE?
POSTSCRIPT
Readers of this story may not have made the connection
that William had been shot in the head first during the
Battle of Shiloh in the Civil War and later at the Bates
School House. Hopefully, the humor in this situation is
not lost, as after all, the Bates clan has long been accused of being hard headed. This was the proof needed
to confirm hard headedness in that it takes two shots to
the head to kill a Bates. Not many families can back up
such claims with actual proof!
The reader should know that the entire issue surrounding
the two separate proposals for the second rail road line
into Seward proved problematic for the County. While
accusations were quick to fly regarding bribes following
the award of the contract, the local resident’s whole purpose behind wanting a second line was to provide competition in order to reduce costs. As it turned out, within a
short time after the Bates family departed from Seward,
the original railroad line into Seward, the B. & M., purchased the Atchison and Nebraska line negating the
competition so readily desired but lost. In retrospect, the
second line was much ado about nothing.
Levi’s wife, Columbia Ann Mills, was only 37 years old
when Levi passed on to the after life. She leased the
farm out and moved her children to the Lincoln, Nebraska
area where she enrolled the children in the Wesleyan
Academy, one of the best schools in the state. She could
not cope with the loss of her husband and by 1910 had to
be hospitalized in the Nebraska State Hospital where she
resided until her death in 1945. Rather than leaving the
farm to her children, Columbia donated the farm to the
Methodist church. The church later sold the farm to a
very large farm, who in turn re-sold the property to a conglomerate farming corporation as part of over 35,000
acres that is still farmed today. Access to the land by
relatives to visit the gravesites of both Seth R. Bates and
Levi Decatur Bates has continued to be graciously allowed by the current owners.
Half of the children of Levi’s first marriage to Helen Marie
Whitwood-Bates never remained in Nebraska. Luther
Levi Bates initially had the farm north of Bassett. He later
moved his family to Tulsa, Oklahoma. Hiram Hendrick
Bates first had the farm in the Winfield, Nebraska area.
He ended up moving to Walla Walla, Washington. Ella
Susan Bates married Joseph Elliott and lived in Polk

County Nebraska for the rest of her life. Jenny Blanche
Bates married Edward Arthur Rickard and lived in the
Long Pine area for the rest of her life.
The children of Levi’s second marriage, which was to
Columbia Ann Mills-Bates, all departed Nebraska. Mark
General Bates married Ollie May Deweese. They moved
to Walla Walla, Washington. Manley Benjamin Bates
married Florida M. Deweese. She died in child birth before he moved to Walla Walla. Margaret Ellen Bates
married Alexander DeBolt and moved to Walla Walla.
Count Claude Bates married Crystal Brinkerhoff. They
later moved to Saratoga, California.
Without Levi having a second family in his late 40’s, this
author and his entire family would not exist today. The
author, Stanley Francis Bates, is the son of Edward Mark
Bates and the Grandson of Mark General Bates. Normally the author would not support the disparity in ages
that Levi (47) and Columbia (17) had when they were
married but in this particular case, it is essential to his
existence. He is “Thankful” for the New Beginnings they
provided!

as her vast knowledge was paramount to making the
story as real as possible. James T. Rickard of Fremont,
Nebraska was the first person to make the author aware
of the shooting incident and added much support to the
research as well as to the accuracy of information contained in the story. James also visited the Seward County
homestead and Long Pine farm before enticing the author to conduct a joint visit. Without his camaraderie and
guidance, it is doubtful this story could ever have been
told by this author. As a further point of interest, the
Rickard family intermarried with the Bates family on three
separate occasions from the 1860’s through the 1880’s.
The author also wants to thank his wife, Sandi, who traveled with him in his search for the answers, and gave him
the opportunity to dig through old records trying to find
out what happened! The author wishes to express his
appreciation to his daughters, Sandra and Amber, for
their proof reading and creative writing tips in putting this

the Seward County Genealogical Society (SCGS) did not
