It went on to state that some policymakers even suggest that homeownership and housing choice should no longer be national priorities. This is in conflict to what I have always held dear, and thanks to a recent NAHB national survey, also in conflict of the beliefs of most Americans. President HBA of South Carolina The survey makes it clear that owning a home is still very much a part of the American Dream. Americans believe that homeownership is the single best investment for middle class families and helps provide for their retirement and their children’s education. They also believe that a strong housing industry means more jobs and more money in our communities. Mike Lowman Key Survey Results • 75% of voters say that owning a home is the best long-term investment they can make. • 73% of voters who do not currently own a home say it is a goal of theirs to eventually buy a home. • 71% of voters oppose proposals to eliminate the mortgage interest deduction, and 63% oppose proposals to reduce it. The majority also oppose eliminating the deduction for interest paid on home equity loans, eliminating the deduction for interest paid on a second home, limiting the deduction for those earning over $250,000 per year, or limiting the deduction for home owners with mortgages over $500,000. • 95% of homeowners say they are happy with their decision to own a home, and believe that owning their own home is important. The survey has also demonstrated that there would be a hostile voter reaction to any attempt to end government tax incentives for homeowners. In fact, 73% of all voters thought that homeowner tax incentives should be continued, including 71% of Republicans, 68% of independents, 79% of Democrats, and even 68% of those who support the tea party movement. When asked about requiring a 20% down payment to purchase a home, respondents split evenly, with 49% supporting such a threshold and 49% opposing it. But among those most likely to be affected, mortgage holders and renters ages 18 to 54, opposition was strong, with 58% of younger mortgage holders and 59% of younger renters opposed to adding that hurdle to buying a home.” I believe that the results clearly state that Americans, of all political leanings, want to own their own home. I’m glad that my core beliefs remain true and the American Dream is alive and well. William E. “Bill” Sandifer (right). he South Carolina Housing Hall of Fame trustees inducted Representative William E. “Bill” Sandifer and John Templeton into the prestigious honor society recently for their work in and support of South Carolina’s home building industry. Both men were presented the trademark medallion and plaque during a ceremony on July 14 at the Myrtle Beach Marriott Resort & Spa at Grande Dunes. “We couldn’t have asked for two better nominees than Representative Bill Sandifer and Mr. John Templeton because of their unwavering efforts to protect home builders and the American dream of homeownership,” said Kenneth E. Ormand, Jr., chairman of the S.C. Housing Hall of Fame Trustees. “The South Carolina home building industry has been fortunate to have these two champions working for the benefit of our citizens.” Representative Bill Sandifer is one strong champion of housing who has had a remarkable affect on the housing industry. He recognizes the impact which the housing industry has on the economy and has worked tirelessly to protect it. Rep. Sandifer’s efforts have been instrumental in keeping home prices affordable so that all South Carolinians will have a chance to realize the American Dream of home ownership! John Templeton has had a long career in developing quality housing opportunities, which has added to the quality of life for a large number of S.C. families. His professional career led to his passion to advocate for property rights and affordable housing and his founding of the S.C. Landowners Association. Mr. Templeton has been a leader in the effort to preserve and to even restore the right of South Carolinians and people around the country to control their own property. We’ll cater to your needs. www.norandex.com www.hbaofsc.com • South Carolina Builder Journal • 2011 9 G o v e r n m e n t A f f a i r s Government Affairs T Legislative Gains in Difficult Year by Julian Barton, director of government affairs he 2011 session of the SC General Assembly will be remembered for many things – long, disjointed, contentious, confrontational and moderately successful. It just depends on your prospective! Legislators addressed a number of topics from tort reform and redistricting to voter ID and school funding. However, there were two major issues that permeated the 2011 session: the state budget and redistricting. There were no other issues that consumed as much time and energy. The debate began last fall, lasted all year, and ended up being resolved at the very, very end of the legislative session. They came very close to not passing a state budget and had to come back in late July to work out a congressional redistricting plan — location of the new 7th SC Congressional District. The “no holes barred” street fight between the various political segments of the General Assembly sucked the air out of the legislature. Without the Governor’s participation, even less would have been accomplished. Despite all the political drama, a surprising number of bills were passed this session that will have a positive impact on the home building industry, reduce regulatory/legal barriers for home builders, keep homes affordable in South Carolina. Construction Supreme Court Case Reversed In the continuing saga of Crossmann Communities vs. Harleysville Mutual Insurance, Governor Nikki Haley signed the bill (S. 431) into law. This ensured that the legislation was final prior to the SC Supreme Court’s rehearing of the Crossmann case scheduled in late May. In short, the bill returns the construction industry essentially to where it was prior to the Crossmann decision last January. First, it makes it crystal clear what an “occurrence” – the trigger for insurance coverage - is in regard to a construction general liability insurance policy. Secondly, it applies these coverage decisions retroactively. Builders in litigation will not have to fear that their insurance company will walk out the door leaving them fully exposed, as a result of the Crossmann case. This bill reduces the risk of building in our state, which is good for the building industry, property owners and economic development. It was a major victory for our industry, and it was accomplished in a very short period of time! The next chapter in the saga will be judicial review. Going forward, the law is very clear; however, it is unclear whether the SC Supreme Court will reverse its decision on the Crossmann case. The Court has yet to report its findings from the May 23 rehearing. There is also a pending legal action by Harleysville Mutual Insurance that challenges the retroactivity provisions in court. However, the courts now have a clear understanding of how the General Assembly expects the construction law to be interpreted. Tort Reform Expanded During the last week of the session, Governor Haley signed the tort reform bill (H. 3375), which includes: 1. A cap on punitive damages modeled after the State of Florida's financial cap. 10 South Carolina Builder Journal • 2011 • www.hbaofsc.com 2. An appeal bond cap. 3. A tightening of the statute of repose for construction cases. 4. Requires the Attorney General to approve civil actions by circuit solicitors. 5. Requires disclosure of insurance policy limits for personal auto policies in accident cases. The bill builds on the tort reform bill the HBA helped pass in 2005 and reduces the litigious environment in our state. As a result, South Carolina is now competitive with its neighboring southern states in regards to its litigation environment, and its attractiveness for new businesses. This will help attract 21st century businesses to our state! For the building industry, the biggest positive in the bill was the tightening of the statute of repose. Trial attorneys can no longer use a simple building code violation to exempt builders from the statute of repose protections. Unemployment Insurance Premium Relief The Governor signed the unemployment insurance bill (H. 3762) into law. The bill includes (1) a reduction in state benefit weeks from 26 to 20 and restriction of benefits for seasonal workers, and (2) it makes other minor technical corrections. Additionally, there is $146 million (state money) in the 2011-12 state budget to assist in paying down the $933 million debt that South Carolina owes to the federal government for loans made to our state during the recession. The money to subsidize the unemployment insurance will be spread equally over all insurance rate classifications (2-20). These two measures combined will provide approximately 25% insurance premium relief to all employers for one year. How will this work? Employers will receive a credit on their insurance premiums as early as the fourth quarter. This should significantly reduce the remaining insurance payments for the July 2011 – June 2012 fiscal year. The rebate will be given to rate class 2-20 and will be based on a percentage; so the higher the premium class, the bigger the rebate. Copper Theft Bill – Thieves Beware A bill (H. 3660) that should stop the scourge of copper and metal theft in the state received final approval in the General Assembly and was signed by the Governor. The bill sets up a permit system for people who want to sell copper to recyclers. Individuals selling less than 10 pounds of the metal would be allowed to obtain a free, 48-hour permit up to twice a year by calling their local sheriff's office. Those wanting to sell more than 10 pounds of copper in excess of twice in a year would be required to apply in person at a sheriff's office for a free, long-term permit. The bill covers copper products, catalytic converters and stainless steel beer kegs to the list of permit-required items. The bill would also require the metal recyclers to apply for a purchasing permit at their local sheriff's office at a cost of up to $200. Also, instead of giving out cash, recyclers would only be allowed to pay customers with checks for their copper and metal purchases. He has played vocal rolls in reducing the statute of repose from 13 to 8 years, fighting to oppose the mandate for sprinklers in houses; as well, he has met many times with lawmakers throughout the discussions of the Crossman case involving general liability for builders. According to Earl McLeod, Executive Director of the HBA of Greater Columbia, “Frank Norris started his company more than 25 years ago with the tenet to provide the tools and service to make those in the building industry successful. A goal he continues to practice every day for the benefit of our community, industry and Association.” Frank continues to be an active supporter of the Columbia HBA; has given his time serving on the board for the local chapter of the National Association for Mental Illness; and also serves on the board for Sharing Precious Memories, a non-profit organization that provides trips for families of special needs children who otherwise could not afford to travel. I B u i l d e r by Stacey Tetloff t might be the fact that Steve Tilton has spent his entire life in the building business. Or, it might just be that it’s who he is. Whatever the reason, the care he puts into creating friendships with his customers has been the secret to his success as a homebuilder. “My clients become my friends,” Tilton explained. “We’ve worked hard to build that culture in our business, and we focus on taking care of one another.” Don’t Wear Out Your Welcome That commitment to care extends after the home building process, and Tilton takes pride in continuing relationships with clients long after the building process has finished. It’s been good for business; Tilton Group Signature Homes has not only built a loyal customer base, but has also had to rely very little on advertising and marketing. “Our work comes from word of mouth. We have created a sales force among our previous clients in all of the different communities we have worked in,” Tilton explained. In fact, the longer Tilton Group builds a community, the more business that comes their way. It’s something that not every builder can say. Tilton and his team don’t wear out their welcome. Instead, the establishment of friendship creates a long-term relationship with the entire community. A Lifelong Career Tilton joked that he and his father always say, “We don’t know anything else … we have to be builders.” Working in the business since he was 10-years-old, nothing could explain his experience better. His father was one of the original Hilton Head builders, establishing in the area in 1964. “I grew up in the building business,” Tilton said, “and I have been around building my entire life.” In addition to his father, several family members are also builders, and most of his childhood friends were sons of builders. Building Community After obtaining a degree in architectural engineering from Southern Polytech State University, returning to the Hilton Head area and building his own business was the culmination of his life’s experiences. Tilton is now in his 18th year in business, founding Tilton Group Signature Homes in 1994. The business builds custom homes all over Beaufort County, and in communities around the lowcountry. The commitment Tilton has for his business and his friends extends to all parts of the communities in which he 12 South Carolina Builder Journal • 2011 • www.hbaofsc.com builds and lives. He currently serves as chairman of the Greater Bluffton Community Fund of the Community Foundation of the Lowcountry, is a long standing Rotarian in the Rotary Club of Bluffton, chairs the board of directors for Coastal Carolina Hospital, and heads the advisory board for BB&T Bank. Tilton has also been a member of the local home builders association, Hilton Head Area Builders Association, for many years. His father, in fact, was one of the founding members of the association back in 1965. For the past seven years, Tilton has been very active, serving this year as the HHAHBA's president. “Keeping up with current affairs and being involved in all of the issues that affect our industry is one of the most important benefits of active membership,” Tilton explained. He also emphasized that education is a must-have to be successful in building, and there is no better place to get that education than through the programs offered by the home builders associations. Tilton’s own designation as a Certified Master Builder exemplifies his commitment to training and education to positively represent the building industry. Surviving the Challenges Without question, Tilton feels that the recent recession has been the biggest challenge he has ever had to overcome. In spite of the economic downturn, he is optimistic about the present and the future. “We’ve survived because of our strong relationships with our subcontractors and vendors,” he explained. A lot of those relationships go back a long way, when the fathers of Tilton’s subs and vendors worked with his own father. That has been an enormous asset to everyone, and everyone has worked as a team to help each other get through the recession. Tilton’s five employees are also an integral part of his ability to survive the economy. Ron Boshaw, general manager, Edward Welch, project manager, Michelle Mroczka, client care coordinator, Melissa Fleury, business development, and Holly Davidson, controller, each bring expertise to the business that Tilton needs to be successful. “Michelle,” Tilton explained, “is also an interior designer, and that has also been a major asset. Not every builder has an interior designer on staff.” In addition to his team, Tilton is also supported by his family. He has two daughters, Bridget and Meg, and a stepson, Tom, with wife Maureen. Meg, the youngest, is looking forward to following in her father’s footsteps. “I’ve encouraged her to look at other options, but she’s already committed to it, and she loves the business,” Tilton said.
