Supreme Court Upholds Religious Liberty O Hobby Lobby wins case against Obama Administration n June 30, the Supreme Court ruled that the government cannot force people of faith to fund drugs that cause abortions. The name of the case is Burwell v. Hobby Lobby, and it is the biggest victory for religious liberty — and the right to life — in decades. The Hobby Lobby case began when the Obama Administration ordered the Green family, who own and manage Hobby Lobby Stores, to pay for abortion-inducing drugs as part of their employee health plans. The Greens refused on pro-life grounds: they are devout Christians, and they could not in good conscience participate in the taking of innocent human life. The Obama Administration told them to get over their convictions about life or face $1.3 million in fines — a day. I am one of the attorneys who represented Hobby Lobby at the Supreme Court, and this spring we asked the justices to put a stop to this radical assault on religious freedom which is, at its core, a radical attempt to impose the Administration’s pro-abortion agenda on every business person in America. On June 30, the Court did. The Court’s ruling means that Americans of every religious background are free to take their faith with them into the workplace, and free to make their religious beliefs a part of how they run their business. Contrary to the Obama Administration, you don’t have to agree with the government’s moral priorities in order to do business in Josh Hawley America. Our Constitution has long protected our right to live out our religious convictions peaceably—at church, at home, in the workplace, and everywhere. Indeed, that freedom is essential to what makes us Americans. That right won a great victory on June 30. Josh Hawley is a constitutional lawyer, law professor, and religious liberty advocate. He represented Hobby Lobby at the U.S. Supreme Court. Josh is an associate professor at the University of Missouri School of Law. He is also the president of Missouri Liberty Project (www.libertyprojectmo.com). Victory for Pro-Life Speech at the U. S. Supreme Court On June 26, the U. S. Supreme Court issued a victory for pro-life sidewalk counseling in the McCullen v. Coakley buffer zone case. In the decision, the U. S. Supreme Court struck down a Massachusetts law that made it a crime for Eleanor McCullen and other pro-life counselors to peacefully offer pamphlets to women about abortion alternatives and the humanity of the unborn child within 35-feet of an abortion facility. Chief Justice Robert’s majority opinion in striking down the buffer zone law was joined by Justices Ginsburg, Breyer, Sotomayor, and Kagan. While the Justices disagreed as to whether the law was “content neutral,” all nine Justices agreed that the law is unconstitutional on the ground that it burdens more speech than is necessary to serve the Commonwealth’s asserted interests. - from The Bioethics Defense Fund - Law in the Service of Life, www.bdfund.org Your prayers . . . they cause miracles! 2014 Legislative Victories Together, we are making a difference and saving lives! A Susan Klein, Legislative Liaison Yo u Successes for the 2014 Legislative Session did • Extending the 24-hour reflection period before an abortion to 72 hours – Sponsors Rep. Kevin Elmer and Rep. Keith Frederick and Sen. David Sater. • Raising the cap from $2 million to $2.5 million on tax credits for contributions to Pregnancy Resource Centers and Maternity Homes. These became omnibus benevolent tax credit bills that included other social services. Sponsors Rep. Kevin Engler and Sen. Gary Romine. • Increased funding for the Alternatives to Abortion Program. Sponsors Rep. Rick Stream and Sen. Kurt Schaefer. Gov. Nixon vetoed a significant portion of the increase. • Continuation of pro-life protective language in the Department of Economic Development Appropriation Bill on the one line item of state monies given to the Missouri Technology Corporation. Monies in this one line item cannot be used or given to life science research businesses that could do human cloning and embryonic stem cell research. Sponsors Rep. Rick Stream and Sen. Kurt Schaefer. • Defeat of the Early Stage Business Economic Development Bill specifically for Life Sciences Research and the Missouri Technology Corporation (MTC) with no pro-life protections. Sponsor Rep. Noel Torpey and handled by Sen. Bob Dixon in the Senate. • Requirement for the Dept. of Health and Senior Services to set up collection and transportation sights across the State of Missouri for umbilical cords to be delivered to the St. Louis Cord Blood Bank. This bill was sponsored by Rep. Jeff Roorda, but did not pass; however, the language was amended on to the Senate’s Omnibus Public Health Bills which did pass. Sponsors Sen. Dan Brown and Sen. David Sater. • Approved the Show-Me Healthy Babies Insurance Program for insurance for unborn babies of low-income mothers. Two stand-alone bills sponsored by Rep. Jeff Grisamore did not pass; however, the language was amended on to the Senate’s Omnibus Public Health Bills and passed. Sponsors Sen. Dan Brown and Sen. While there were some disappointments, especially no passage of the abortion clinic inspection bill, there were great successes! We applaud the Missouri House and the Senate members who stood with Missouri Right to Life on pro-life legislation this year as well as those who stood against open-ended funding for human cloning and embryonic stem cell research in economic development bills. Senate Sub for HB 1495 a Disqualifying Vote for Endorsement The Early Stage Business Development Bill (HB 1495) specifically for Life Sciences Research and the Missouri Technology Corporation (MTC) had no pro-life protections. At MRL’s request, the bill was amended in the House by Rep. Steve Lynch on March 5, adding the pro-life protections. On May 12, Senator Bob Dixon led the effort in the Senate to strip the pro-life language and replace it with the faulty definition of human cloning from the 2006 Amendment 2, now in the state constitution. With this change in language, the Senate voted to fund human cloning and embryonic stem cell research with your tax dollars. Because of MRL’s strong opposition to the anti-life Senate Sub of HB 1495, the bill died on its return to the House. The Missouri Right to Life Political Action Committee considered a vote for the final version of HB 1495 with the Senate Sub a disqualifying vote for endorsement.
