Consultation Report – Addendum The Local Development Plan was submitted along with the accompanying documentation to the Welsh Assembly Government on the 20th May 2010. The Consultation Report, May 2010 was submitted at this time. Whilst there is no formal requirement within the Town and Country Planning (Local Development Plan) (Wales) Regulations 2005 for updating the Consultation Report following submission, this addendum has been drafted in order to record the consultations which have taken place since submission and also as a result of the hearing sessions during the examination. This addendum contains the outcome of the:Focussed Changes Consultation Additional focussed Changes Consultation Additional Alternative Site - Harlech Alternative Sites – Sustainability Appraisals a request for further information Matters Arising Changes Consultation Reserve Housing Sites Consultation Sustainability Appraisal Consultation. 1 1 1.1 STAGE 7 – ADDITIONAL FOCUSSED CHANGES CONSULTATION Focussed Changes This stage provided an opportunity for stakeholders and members of the public to comment on the Focussed Changes document. These were changes to the draft Local Development Plan and Maps which resulted from the deposit draft consultation responses. The Focussed changes were advertised at the same time as the Authority made the representations received during the deposit draft consultation period and the Authority response to these available to the public. The submission of the Local Development Plan and supporting documents to the Welsh Assembly Government was also advertised at this time. The document was made available for the public to view at various different locations across the National Park and locations adjacent to the National Park boundary. A full list of locations the document was made available to be viewed can be seen in Appendix 19. A letter or email was sent out to all the consutlees on the Local Development Plan database to inform them of the consultation (see appendix 36). A notice was placed in the local press (see appendix 37) and information was provided on the Authority’s website regarding the Focussed Changes consultation. The consultation period was from 21st May 2010 to 2nd July 2010. The Authority received 91 comments on the focussed changes from 13 respondents. A summary of the representations received with the Authority Response is contained within appendix 38 1.2 Additional Focussed Changes The additional focussed changes document contained minor textual changes that the Authority considered should be made to the deposit Eryri Local Development Plan. These changes were drafted as a result of the representations received as part of the deposit Local Development Plan consultation. The document made available for consultation can be seen in appendix 35 The document was made available for the public to view at various different locations across the National Park and locations adjacent to the National Park boundary. A full list of locations the document was made available to view can be seen in appendix 19. A letter was also sent out to the consultees on the Local Development Plan database to inform them of the additional focussed changes consultation (see appendix 39). Information regarding the consultation was also placed on the Authority website and a notice placed in the local press which can be seen in appendix 40. The consultation period was from 2nd September to 30th September 2010. The Authority received 13 representations on the additional focussed changes from 5 respondents. A summary of the representations received including the Authority Response is contained within appendix 41. 1.3 Alternative Site - Harlech Consultation Following the initial alternative site consultation, an additional site at Harlech was processed by the Authority which was consulted upon from 22nd October 2010 to 2nd December 2010. A notice was placed in the local press (Appendix 42). A letter or email was sent out to the individuals and organisations on the Local Development Plan 2 consultation database (Appendix 43). Documents relating to the consultation were provided in different locations around the National Park and bordering areas (list can be seen in appendix 19) and on the Authority’s website. As a result of this consultation we received 15 representations from 15 individuals and organisations. These representations were passed on to the Inspector. 2 2.1 STAGE 8 – ALTERNATIVE SITES SUSTAINABILITY APPRAISALS Alternative Sites – Sustainability Appraisals A request was made by the inspector for further information on the sustainability of sites or extensions to housing development boundaries which have previously been put forward by respondents to the plan. This was to provide an opportunity for respondents to prepare a sustainability appraisal in support of the alternative sites they had put forward. A letter was sent out to all individuals and organisations that had put forward an alternative site in order to inform them of the request for further information made by the Inspector with regards to sustainability appraisal information. Along with the letter a copy of the Authority’s Site Criteria Paper was sent out which was prepared by the Authority during the deposit draft Local Development Plan consultation in May 2009. The purpose of the paper was to assist proponents of sites with fulfilling the requirements for providing an SA/SEA when putting forward a site during this part of the process (further information about the site criteria paper can be seen in Stage 6 earlier in this document). 16 Sustainability Appraisals were received by the Authority following the request for further information these were passed on to the Inspector. 3 STAGE 9 – MATTERS ARISING CHANGES CONSULTATION There were three elements to this consultation which arose from issues during the examination into the Local Development Plan. The various consultations are outlined below. The consultation period ran from 9th December 2010 to 27th January 2011. A letter or email was sent out to all of the individuals and organisations on the Eryri Local Development Plan consultation database informing them of the consultation (appendix 44). A notice was placed in the local press which can be seen in appendix 45. Information regarding the consultation including consultation documents were also provided in various different locations across the National Park and in areas adjacent to the National Park boundary, a list of the locations these documents were available can been seen in appendix 19. 3.1 Matters Arising Schedule of Changes document This document comprised of the amendments being proposed by the Authority following the matters arising from the individual hearing sessions. Alongside the document were a number of new or amended background papers following matters arising from the hearing sessions. These included Additional Evidence for policy 21: Chalet and Static Caravan Sites Additional Evidence for green wedge designations Minerals Zones of influence and Settlement Capacity Study 3 Representations were received by the Authority from seven individuals and organisations with a total of 29 comments on the Matters Arising Changes. 3.2 Reserve Housing Sites Consultation A number of potential sites were discussed during the examination hearing sessions. These sites were suggested by the Authority as sites that could potentially be suitable as affordable housing exception sites if a local need should be identified within the settlement during the plan period. The reserve housing sites document available during the consultation period can be viewed in appendix 46. Eight individuals and organisations made representations on the reserve housing sites with a total of ten comments on the sites. These comments were passed on to the Inspector. Following the end of the consultation period the Authority had not received any representations from Welsh Water, Gwynedd and Conwy Highways. These agencies were then approached again individually regarding the reserved housing sites for their comments about the suitability of the sites. As a result, comments were then received from all the agencies regarding the reserved sites proposed. 3.3 Sustainability Appraisal Consultation As outlined above during the hearing sessions, the inspector considered the proponents of alternative sites previously put forward should be given another opportunity to submit information on the sustainability appraisal (SA) of their sites in line with the Site Criteria Paper provided by the Authority. This stage was outlined above (9.1). The sustainability appraisals received were then consulted upon during this stage of consultation. Comments were received by one organisation regarding the sustainability appraisal for one site only. Comments made at this stage can only address these proposed Focussed Changes. This is not an opportunity to add to previous representations, or to make new comments on parts of the original deposit Eryri LDP or Alternative Sites not subject to change, as the Inspector will not consider any such new representations. The Authority will not make a response to the representations on the Focussed Changes. They will be forwarded to the Inspector who will take these representations into account as part of the Examination process. 6 Archwilio. Converting a rural building for residential purposes which meets an identified local need is considered to be more sustainable and beneficial than leaving the building to deteriorate and takes into consideration the national park purpose of conserving and enhancing the built environment. Sustainability should not only be judged in terms of travel but also the overall sustainability of rural communities especially when combining employment and home. Home working offers the opportunity for creating new employment, re-using vacant buildings and reducing the need for vehicular journeys to work. Converting a rural building for residential purposes which meets an identified local need is considered to be more sustainable and beneficial than leaving the building to deteriorate and takes into consideration the national park purpose of conserving and enhancing the built environment. We hope, however, that the Plan is flexible enough to allow a planning application for 3 (number) houses if the need for that number is proven as part of the application and that the developer is able to prove that the building of 2 (number) houses isn’t cost effective. The settlement of Capel Curig comprises a scatter of properties stretching for a considerable distance along the A5. The properties are clustered in small groups separated by extensive stretches of undeveloped land. A boundary encompassing all of these isolated groups of properties would be very difficult to define. Many of the undeveloped sections fronting the A5 contain steep rock outcrop and therefore the settlement is very constrained. As a result Capel Curig has been defined as a smaller settlement and highlighting properties on the inset map will give some scope for limited additions and infilling within the settlement to meet the needs of the local community. It is envisaged that affordable housing to meet local needs will be delivered through individual self build / self managed units rather than developers investing in a site. Historically there haven’t been many units being brought forward in smaller settlements. The Authority will monitor how many come forward and the need in smaller settlements and will be reviewing the plan every 4 years. In some settlements if 2 units have been developed and there is evidence of arising local need the Authority will consider releasing land for further units depending on environmental capacity and landscape impact. 46 012 Arfon Hughes & Cerian Evans Hwylwyswyr Tai 001 40 We think that 2 units per settlement over the plan period is too low for some of the smaller settlements. Settlements in the Park are smaller, housing settlement boundaries are fairly tightly defined and generally there is less speculation and demand in the housing market. It will not be possible to control the rate the high level of existing commitments are distributed in line with the settlement strategy and will be sufficient to cater for general open market housing needs over the plan period without causing further adverse market pressures The background papers provide a fuller explanation for the distributions proposed relative to needs/constraints/ zones of influence, etc including the implications at the settlement level of commitments, allocations and windfalls. However, there would be benefit in having a spatial distribution comparison table summarising both past and proposed scenarios 48 of development of sites already with planning permission and 413 units identified in the five year land supply are counted in the Plan as existing commitments. However the currently depressed housing market is limiting the development on these sites. It should also be noted that there are 382 units with planning permission outside the five year land supply and not counted in the Plan as commitments. 334 of these units are located on one large site at Aberdyfi. Due to infrastructure and access difficulties it is not envisaged that development on this site will progress quickly and there is some doubt if all the site will eventually be developed. These smaller settlements do not have any key local facilities with very few community facilities; however the Authority would like to give the opportunity for affordable housing in these smaller settlements. The Authority will monitor how many come forward and the extent of arising need and consider whether the quota for smaller settlements should be increased. Summary of Rep Officer response The affordable housing changes and further background evidence/clarification address some WAG concerns. It appears Paragraph 5.17 does refer to the review of future affordable housing need through additional work carried out by the Local Housing Market Assessment and further Rural Housing Enabler surveys. This is also mentioned in the revised Monitoring Framework included in the Housing Background Paper. There would be no objections in including the overall estimate of need of 1200 within the Plan. The overall affordable housing target does not include a possible contribution from exception sites which potentially that the affordable housing included in plan targets will accord with the definition in TAN2. The plan approach should be compatible with the aims of the relevant Affordable Housing Delivery Statement/s. 52 Although FC 43 to the LDP text refers to a 5-year affordable housing need figure of 427 the Housing Background Paper indicates that need over the whole plan period could be between 960 – 3030 depending on the various surveys and suggests the best estimate could be about 1200. It is imperative that the plan includes a measure of affordable need over the whole plan period so that the degree to which the proposed affordable target (450500) responds to the level of need is clear. It could be flagged that further information from the LHMA and enabler surveys is anticipated and the figure will be refined in the Annual Monitoring Reports. Delivery of the affordable housing target in full appears to rely on bringing forward all the housing provision proposed for the plan including the contingency allowance. Further clarification would be beneficial. The reasons for the substantial difference between the target (450500) and the need over the plan period (c1200) have been made clearer, including the expected role of the settlements just outside the park in making up some of the shortfall. It is confirmed that this approach is accepted by neighbouring authorities whose 53 could boost housing delivery. In the past, rural housing enablers have identified exception sites which have/are being developed by Registered Social Landowners. The role of the enablers at the micro level in identifying land and landowners willing to sell land at an affordable price will be important in the future. It is likely that some of these sites will be exceptions. The estimated yield of 467 affordable units over the Plan period lies somewhere in the mid –range of the target 450-500 dwellings. To reach the full target figure of 500 dwellings it is likely that some of the contingency of 57 units would have to be used. The need to provide affordable housing has been explored in the background evidence. Whilst it is accepted that explicit consideration has not been made on the social and cultural consequences of not meeting the need in full, the Plan has also not considered non land use means of providing affordable housing such as making better use of the existing housing stock e.g. bringing empty properties back into use, homebuy schemes, potential mortgage deposit loan schemes etc. The Plan has sought to balance the overriding purpose of the National Park to protect and conserve the landscape and also the need to sustain social cohesion and cultural identity. Generally in national guidance there is an over reliance on targets and forecasts. Changing economic circumstances have a greater influence on the ability to meet plans for the relevant settlements are indicated to be compatible. While the environmental and delivery implications of trying to meet this level of identified need are considered the social and cultural consequences of not meeting it should have been explored. The plan indicates clearly that nearly all newly allocated sites and all windfalls are intended as affordable housing and the background papers, etc seek to confirm that this is realistic in viability and delivery terms. The papers also explain the relationship of likely provision to the distribution of affordable housing need. While the affordable housing viability study does not support the robustness of seeking almost 100% affordable on new allocations and small scale windfall/conversion consents, the papers explain that several sites deemed not to be viable are already in the process of development and others are owned by authorities/agencies likely to be receptive to the need to minimise land values. Efforts have been made to secure input from other stakeholders involved in the housing process (Viability BP 18) although further comment from Social Landlords currently involved in sites deemed 54 targets than best planning based estimates. With regard to viability the Authority has undertaken further research into the viability of smaller sites using the Three Dragons Toolkit (up to code 3 plus 6 credits standard) A workshop has also been held with planning agents, landowners and builders. The results of this further research will be published before the Examination. The National Park is confident that smaller sites and individual plots are viable when land values reflect an uplift from base agricultural value. It is known for example that the Forestry Commission has released land in Dolwyddelan at £5000 per plot to a Housing Association. Further information on exemplar sites is being obtained from Housing Associations. It is also proposed to prepare additional practical guidance on the delivery of affordable housing giving examples of cost, suitable standard designs and standard 106 agreements. This will be targeted to assist rural housing enablers, planning agents, small builders and individuals to understand procedures and show practical examples of delivery. Commuted payments will not apply to exception sites. It is recognised that all affordable housing on such sites should be affordable and there is nothing in the Plan or background evidence that says otherwise. Further information on likely tenure mix non-viable could be beneficial. Such an assessment would clarify how particular viability characteristics of specific types of scheme (especially self build/project managed single dwellings on exceptions sites) as these are likely to make-up a significant element of anticipated affordable provision. The impact of the cost of sustainable design requirements (Code3 plus 6 credits) should be assessed as should that of potentially higher costs of borrowing, etc for smaller builders undertaking commercial schemes SPG para 8.14 makes reference to the viability of conversions or oneoff single dwelling proposals and the use of commuted sums. It needs to be absolutely clear that any dwellings allowed on exception sites must be affordable (as per the definition in TAN2) and that commuted sums are not appropriate in these circumstances otherwise there is a danger the plan will not deliver on this issue. The anticipated tenure mix relative to Social Landlord views is not explained, nor is it made clear that affordable housing can be delivered across the plan period. Given the potential risks with the plan’s approach to affordable housing the implications of a failure to deliver have not been assessed adequately. 55 can be provided in discussion with Social Landlords. Affordable housing is currently being delivered and the progress report on the current Affordable Housing Deliver Statement indicates this ( this information will be provided in due course). Possible lack of funding through social housing grant is likely to have an impact in the Park and elsewhere in Wales, unless other forms of funding can be obtained by Social Landlords. The Authority is aware that lenders are currently risk averse on affordable housing schemes. Such challenges make it difficult to predict the rate of affordable housing delivery. It is also anticipated that there will be a period of familiarity with the new affordable housing policies leading to some delay and uncertainty. Affordable housing policies need to be applied consistently but flexibly over a longer period of time to influence the housing market and land values. Once landowners become aware that in some settlements all housing has to be affordable housing their expectations of land values will diminish and begin to reflect a more affordable land price value. This should be compared with base marginal agricultural land value. On this basis it is envisaged that in the first four years of the Plan development by Housing Associations will proceed on sites where grant has already been obtained and in the following four years smaller private schemes will come forward. It will be important to monitor the numbers coming forward and the Whilst there is a trigger point for review indicated in BP 7 Housing page 71, the flexibility of the strategy to respond to this scenario has not been explored. 56 constraints to development,- be these planning related or non-planning reasons. The National Park is not appropriate for large scale development sites where a percentage of affordable housing can be obtained. The consultation on the Focussed Changes is not an opportunity for a new alternative site to be put forward and considered for inclusion in the Local Development Plan. During consultation on the alternative sites, we made representation in our letter dated 2nd September 2009 that advised that if the site was to be included in the Deposit Plan, without a Flood Consequences Assessment, then the plan may be considered to be unsound. Further to this representation, you will be aware that a planning application has been submitted for this site, reference NP5/77/37K, with a Flood Consequences Assessment being submitted as part of the application. Our response to the application, copy enclosed (letter dated 25th May 2010), confirmed that the lifetime of the development is a key issue in whether permission should be granted for the development. The Flood Consequence Assessment indicates that the site would remain dry within 50 years including consideration for climate change, but would not remain dry when 100 years plus 76 Focussed Change 76 is not a housing allocation merely a logical rounding off of the Housing Development Boundary which includes a site with existing planning permission. climate change is taken into account. We recommend that the allowance for 100 years plus climate change is an appropriate lifetime for residential development. Given the extent to which use of narrow roads within the National Park is shared by vehicles, walkers, cyclists and riders there is a good cause for reviewing speed limits in some circumstances and the submitted LDP recognises that. If there is perceived to be a difficulty that SNPA is not a highway authority and speed limits are not governed by planning legislation, the sentence in question could be reworded rather than deleted, to recognise that safe and enjoyable use of shared road space is a critical consideration in relation to key LDP policies. Cymdeithas Eryri / Snowdonia Society has strong objections to the proposed replacement of "landscape" by "natural heritage". The term "landscape" is well understood and used extensively throughout the LDP. In contrast the term "natural heritage" is not defined and is not used anywhere else in the submitted LDP. The intention behind the substitution appears to be to undermine the protection the planning system provides against the erection of large industrial-type buildings that can have a very damaging visual impact on open countryside in the National Park. We urge that the Zones of Influence map in Appendix 5 should include all the mainline railways in North West Wales and the Ffestiniog and Welsh Highland Railways, not merely the Conwy Valley Railway, as is proposed. The A496 road is already shown on the map, as are all main roads. Coleg Meirion Dwyfor at Dolgellau is already mentioned in the relevant section of the text which accompanies the map, and it would be inappropriate and confusing to include that kind of detail in the actual map. If the former nuclear power station at Trawsfynydd is to be mentioned, that should also be in the text accompanying the map. Blaenau Ffestiniog should be mentioned as having connectivity to Llandudno, but the existing reference to the zone's connectivity to Caernarfon and the Llyn Peninsula must be retained. There is a good case for indicating on the map settlements which are a focus for tourism, but in that case it must be done consistently for all zones, not just for Blaenau Ffestiniog. There are three elements to this consultation on the Eryri Local Development Plan which has arisen during the Examination Hearing sessions into the Plan. Below I have sought to explain each individual element, where you can obtain information, how you can respond and by what date. 1. Matters Arising from the Hearings: Schedule of Changes. The Matters Arising Schedule of Changes comprise amendments to the Plan which are being proposed by the Authority following the matters arising from the individual Examination Hearing sessions. Any representations received will be passed on to the Inspector for her consideration. 2. Reserve Housing Sites. A potential reserve list of housing sites was discussed at the Examination Hearing Sessions. These sites were suggested by the Authority as sites that could potentially become available as affordable housing exception sites should a local need be identified during the Plan period, or be released pending a future review of the Plan. The Authority has undertaken a sustainability appraisal of these sites. At the Examination, the Inspector considered that in this particular instance proponents of alternative sites previously put forward should be given another opportunity to submit information on the sustainable appraisal (SA) of their sites in line with the Site Criteria Paper provided by the Authority (which identifies the SA objectives relevant to the LDP). Representations can be made on the further information submitted on these sites. Copies of the Matters Arising Schedule of Changes and a list of Reserve Housing Sites can be obtained from the Authority’s website, at the National Park Offices, at Public Libraries and at the Authority’s Tourist Information Centres. Representations can be made on the changes or on the reserve sites listed. These will be sent directly, via the Authority, to the Examining Inspector. Information on the sustainability appraisal of sites can be viewed at the National Park Offices during normal office hours. Any comments received on sustainability appraisals will also be passed on to the Inspector for her consideration. Comments made at this stage can only address the Matters Arising Schedule of Changes, the Reserve Housing sites and the Sustainability Appraisals of Alternative Sites.
