President’s Message
Dear Members:
As I reflect on the work we have done this past year to put in
place a continuous stream of activities that improve the level
of practice in our federal court, I am proud of everything we
accomplished, but mindful that still there is much work to be
done. Whether we continue to offer monthly conferences on
substantive and procedural matters of interest, or transition to a more structured
but less recurrent system of CLE seminars, our mission remains the same. We
strive to help all federal practitioners become better at their craft.
Many challenges lay ahead for the in-coming Board, but one in particular warrants
mention: our membership count. Presently our membership hovers around the
six hundred mark. Eyeing the National Convention to be held in Puerto Rico in
September 2013, our goal is to increase our membership count to one thousand.
We hope to reach that mark by continuing to appeal to your interest in the Chapter
by offering seminars, conferences, and networking activities that foster your
professional growth. Look for a conference on summary judgment in the labor and
employment context in August, and we have other conferences on the pipeline
that I am sure will be to your liking. We are planning to offer a conference on
evidence and courtroom techniques that will be useful to beginners and seasoned
attorneys alike. Also, we are planning to offer a conference on mediation, its upside
and its downside, how to approach it, and what to expect from the process.
These and other conferences we will offer are an excellent reason to join or renew
your membership.
But there are other reasons. The Court is always instrumental and the Judges
and Clerk’s Office are very helpful with our activities, as are our long standing
members. Membership with the Chapter is an excellent way to further develop
your relationship with all of them.
This is an excellent time to become a member of the FBA or renew your
membership. I hope you will do so!

The Foundation of the Federal Bar
Association Holds Meeting in San Juan
The Fellows of the Foundation of the Federal Bar Association
held a series of meetings in San Juan in February of this
year. This marked the first time that the Foundation holds
a board meeting in Puerto Rico. The event was organized
by Foundation board member and Life Fellow, Néstor M.
Méndez.
The meetings were capped off by a Fellows’ dinner at
Morton’s of Chicago at the Caribe Hilton hotel. Two new
Life Fellows were inducted during the event: Gustavo A.
Gelpí, Sr. and Oreste R. Ramos. Alfredo Castellanos, who
already had been a Fellow for several years, became a Life
Fellow. Mr. Gelpí, who is Counsel with McConnell Valdés
LLC, is a very accomplished trial and appellate attorney as
well as Judge Gelpí’s father. Mr. Ramos, who is the FBA’s
Puerto Rico Chapter President Elect, is a Capital Member of
the litigation practice group of Pietrantoni Méndez & Alvarez
LLC. Mr. Castellanos is a past Puerto Rico Chapter President
of the FBA as well as a very accomplished trial attorney who
has represented high profile clients, not only in Puerto Rico,
but also stateside.
During the Fellows’ dinner, Mr. Luis Alvarez, a board member
of the Fundación Histórica del Tribunal Supremo de Puerto
Rico, gave a presentation on La Fundación’s mission and
accomplishments.
Among the guests at the Fellows’ dinner were Foundation
President Dennis J. Clark, Fellows Chair ex officio Carl
Gilmore, Judge Gustavo A. Gelpí, Judge Juan M. Pérez
Giménez, Judge Daniel R. Domínguez, Puerto Rico
Supreme Court Justice Roberto Feliberti (who is also a
Fellow of the Foundation), and First Circuit Settlement
Counsel Charles Cordero, as well as several members of
Manuel Pietrantoni, Oreste Ramos, Gustavo A. Gelpí, Judge
Gustavo A. Gelpí, Jr., Alfredo Castellanos, Néstor Méndez and
Russell del Toro.

the Board of the Puerto Rico Chapter, both current and past,

The FBA Mid-Year
Meeting

The FBA Mid-Year Meeting was held in Washington DC on
March 30 and 31, 2012. In attendance were several members
from our Chapter, including the FBA National’s Treasurer
Hon. Gustavo A. Gelpí, Fellow Néstor Méndez, Fellow and
Past Chapter President Ricardo Casellas, and Fellow and
Chapter President Manuel A. Pietrantoni. While the meeting
was a success, the highlight was a ceremony sponsored
by the Foundation of the Federal Bar Association honoring
U.S. Supreme Court Justice Clarence Thomas, held in the
Supreme Court. Justice Thomas spoke eloquently about the
role each attorney plays in the administration of justice, and
about the importance of protecting the legal process. The
ceremony was a rousing success.

The Stolen Valor Act
Addressed by Professor John M. Greabe
On March 16, 2012, Professor John M. Greabe from the
University of New Hampshire School of Law offered a
seminar to members of the Puerto Rico Chapter at the
Clemente Ruiz Nazario Federal Courthouse on United States
v. Álvarez. Professor Greabe spoke about the Supreme
Court’s consideration of the Ninth Circuit’s decision to strike
down a federal statute known as the “Stolen Valor Act”
on First Amendment grounds. The Act imposes criminal
penalties for falsely claiming to have been awarded the
Congressional Medal of Honor. The issue framed by the
Ninth Circuit’s decision was whether the First Amendment
permits Congress to penalize false statements of fact.
Professor Greabe led a lively discussion regarding the issue
addressed by the amicus brief he co-authored, i.e. whether
the statute could be seen to perform a trademark function
and thus be evaluated under a different level of scrutiny.

16, 2012, the Chapter will continue
its Lecture Series with “Summary
Judgment in Labor and Employment
Cases” featuring Hon. Daniel R.
Domínguez, U.S. District Court Judge
for the District of Puerto Rico. The
lecture will start at 2:00 P.M. and will
be held at the Clemente Ruiz-Nazario
U.S. Courthouse in Hato Rey. The next lecture of the series will be a
panel discussion on evidentiary issues
at a date to be determined. Please

Induction Ceremony

On Friday, April 13, 2012, the Honorable Raymond L. Acosta Puerto Rico Chapter of the Federal Bar Association (“FBA”)
held an induction ceremony for members of the Student Division of the University of Puerto Rico School of Law, the
Interamerican University of Puerto Rico School of Law and the Pontifical Catholic University of Puerto Rico School of Law.
The ceremony was held at the Old San Juan Federal Courthouse and was presided by the Honorable Gustavo A. Gelpi,
United States District Judge, the Honorable Brian K. Tester, United States Bankruptcy Judge, and the Honorable Roberto
Feliberti, Associate Justice of the Puerto Rico Supreme Court.
After taking their oath, the three judges addressed the new student members congratulating them on their decision to
join the organization and expressing how their own individual memberships in the FBA had helped them in achieving their
professional goals. Judge Gelpi went into great detail to highlight the benefits of belonging to the FBA as students and
as practitioners. Judge Tester as well as Justice Feliberti narrated their own individual experiences as members of the
organization before being appointed to the bench.
In all, the Judges, the students and the family members in attendance enjoyed very much their participation in the induction
ceremony.

Human Trafficking:
Governmental and Non-governmental
Organizations’ Efforts

O
n March 27, 2012, members of the PR Chapter
Student Division at the Interamerican University
Law School organized a conference on the subject
of Human Trafficking. The objective of the conference was to
educate the audience and bring awareness to this relatively
unknown problem. The guest speakers were Agent Joseph
González of the Federal Bureau of Investigation, Agent José
L. Viera of the Department of Homeland Security, Maritza
González of the U.S. Attorney’s Office, and Karla González
from the Caribbean Coalition against Human Trafficking.
Karla González began the conference with an introduction
to the topic. It became clear that much of the audience, like
much of the population, was unaware or misinformed as
to the issue of Human Trafficking. Ms. González taught the
audience the correct terminologies and showed them the
alarming statistics. One could see the horror on the faces of
those present when Ms. González told them of the reality
that some of these atrocities were actually occurring here
in Puerto Rico. Karla González gave real life examples of
how easy becoming a victim can be. Next up were agents
Joseph González and José L. Viera who talked about some
of the investigative methods used by the government. They
explained that the biggest obstacle is that there are many
victims who won’t speak to the government agencies that are
trying to save them because their handlers have brainwashed
them into believing that they are only concerned with hurting
them or putting them in jail. Without their cooperation it
becomes difficult to build a case as Assistant United States
Attorney Maritza González explained.
The activity was a success as many of the students were
very attentive and eager to ask questions at the conclusion
of the conference. At the end of the conference students
had an opportunity to get to know the guest speakers over
cold beverages and hors d’oeuvres. It was a very informative
and eye-opening lecture and a great experience for all those
involved.

The 2012 Moot Court Appellate Arguments
at the U.S. District Court

For the fifth straight year, the U.S.
District Court for the District of Puerto
Rico hosted the visit of 40 first year
law students from the Interamerican
University, School of Law who,
together with their friends and
relatives, appeared for a moot court
appellate argument as part of the Legal
Research, Analysis and Writing two
semester course taught by Roberto
Abesada-Agüet and José De la Cruz.

After one year of hard work, the
students were grateful and proud of
this engaging and realistic experience.
The students, faculty and general
audience highly appreciated the
recommendations of all of the
judges who, out of their very busy
schedule, took the time and effort
to study the briefs carefully, make
pointed questions and comments and
contribute to the enhancement of the
legal profession. Indeed, the lessons
learned in this daunting advocacy
experience will never be forgotten by
the students.

The Effective Oral Argument

On Friday, April 27, 2012, the first year Interamerican University Law School students enrolled in Professor Roberto AbesadaAgüet’s Investigation, Research, and Analysis class presented their first oral argument. As is customary of Professor
Abesada’s class, his students argued their cases in front of a panel of three judges at the Clemente Ruiz Nazario U.S. District
Courthouse located in Hato Rey.
On the Tuesday, April 24, 2012, in anticipation of the students’ then-upcoming oral arguments and with the help of the
Hon. Raymond L. Acosta Puerto Rico Chapter’s Federal Bar Association Student Division at the Interamerican University of
Puerto Rico School of Law (“Student Division”), Professor Abesada organized and hosted in the theatre of the Interamerican
University of Puerto Rico Law School an activity titled, “The Effective Oral Argument.” In addition to Professor Abesada,
U.S. District Judge Daniel Domínguez and U.S. Magistrate Judge Marcos López participated in the activity, which was open
to all Federal Bar Association members. Using a PowerPoint presentation, Professor Abesada gave tips and techniques for
delivering an effective oral argument as well as tips on oral argument etiquette. As Professor Abesada went through the
slides of his PowerPoint presentation, Judge Domínguez and Magistrate Judge Marcos López provided commentary and
gave their own personal insight and tips.
The activity finalized with a brief Question and Answer session in which Judge Domínguez and Magistrate Judge López
answered the members’ questions and addressed the concerns they expressed. Once the activity concluded, Judge
Domínguez, Magistrate Judge López, Professor Abesada, and the members that were in attendance stepped outside the
theatre to fraternize with one another as they enjoyed hors d’oeuvres that the Student Division supplied for the night’s
activity.

The Federal Criminal Justice
System in Puerto Rico From the
Point of View of a Prosecutor
and a Public Defender
The Student Division of the PR Chapter at the University of
Puerto Rico Law School was honored to invite as guest speakers
U.S. Assistant District Attorney, Dina Avila, and Public Defender,
Hector Ramos. These two speakers gave a thorough overview of
the criminal justice system from opposing points of view, that of a
prosecutor and that of a public defender.
Attorneys Avila and Ramos provided a detailed explanation of the
inner workings of the criminal justice system from the investigative
phase up to the sentencing phase. Each speaker provided insight
into the challenges each side faces at different steps.
Students also received valuable advice related to ways of becoming
involved in the Federal Criminal Justice System, as each speaker
explained the process of becoming either a federal prosecutor or a
public defender in Puerto Rico.
We reiterate our appreciation to both speakers for the time and
knowledge they shared in this activity!

Employment Opportunities in Federal
Court: A Talk With Litigation Attorney

Currently the Career Development
Office at the University of Puerto Rico
Law School provides opportunities for
students to apply for positions in local
law firms of all sizes and practices, as
well as state and federal courts.
Although clerkships in Federal Court
are available, obtaining information on
the application process has been more
limited.
This school year the FBA-UPR Chapter
hosted a conference for students to
learn more about federal clerkships in
Puerto Rico.
Britt E. Arrieta Rivera, Esq. of
McConnell Valdés, LLC was invited as a
guest speaker to discuss employment
opportunities in the federal system.

She was very informative, and spoke
about her own experiences in the
federal court system, particularly her
clerkship with District Judge Pérez
Jiménez.
She encouraged students to work with
a judge, as the experience provides a
terrific learning opportunity and a solid
background in the inner workings of
Puerto Rico federal courts.
Additionally, she encouraged students
to visit OSCAR the government run
website used to apply for positions in
the Federal Court system in order to
learn more about the process.
This activity was a great success and
had an excellent turnout!

On Patent Wars:
Oracle Corp. v. Google, Inc.

O
n May 31st, 2012, the U.S. District Court for the
Northern District of California issued its opinion and
order in the Oracle Corp. v. Google, Inc. 3:10-cv03561 (WHA) case, effectively creating the first casualty of
the patent wars. In this case, Oracle asserted a copyright
claim against Google over 37 of its Application Programming
Interface (API) packages found in Oracle’s JAVA program.
Google counter-argued that it did not copy the source code
for those 37 API’s, but rather wrote its own software for
the Android platform that performed the same function as
those API’s. Thus the central question before the Court
was to what extent could one party copy the very same
functionality encompassed in the source code made by
another.
To those wondering what an API is, Judge William Alsup
provided an excellent description of the programming code
object, stating:
An API is like a library. Each package is like a
bookshelf in the library. Each class is like a book
on the shelf. Each method is like a how-to-do-it
chapter in a book. Go to the right shelf, select the
right book, and open it to the chapter that covers
the work you need.
Recognizing that no prior court had dealt with the issue at
hand, Judge Alsup preceded his ruling by a lengthy recount
of Copyright law and computer programming, ultimately
concluding that:
As long as the specific code written to implement
a method is different, anyone is free under the
Copyright Act to write his or her own method to
carry out exactly the same function or specification
of any and all methods used in the Java API.
Contrary to Oracle, copyright law does not confer
ownership over any and all ways to implement a
function or specification, no matter how creative
the copyrighted implementation or specification
may be. The Act confers ownership only over
the specific way in which the author wrote out
his version. Others are free to write their own
implementation to accomplish the identical function,
for, importantly; ideas, concepts and functions
cannot be monopolized by copyright.

Visit from Colombian and
Mexican Judges
�On May 8, 2012, Chief Judge Delgado-Colón welcomed
a delegation of judges from Colombia and Mexico. As part
of their visit, they attended various proceedings before
Chief Judge Delgado-Colón: a status conference in a multidefendant narcotics prosecution and a plea and sentencing
hearing.
They also observed a criminal trial before District Judge
Francisco A. Besosa, and a suppression hearing before
Magistrate Judge Silvia Carreño-Coll. Clerk of Court, Frances
Ríos de Morán, Esq., demonstrated the state-of-the-art
courtroom technology available throughout all courtrooms.
Court Security Study Tour for
Indonesian Supreme Court Delegation
On April 23, 2012, Chief Judge Aida M. Delgado-Colón
received a group of a high level Indonesian delegation,
including judges of the Indonesia Supreme Court, as part
of a Court Security Study Tour hosted by the United States
Department of Justice Office of Overseas Prosecutorial
Development, Assistance and Training (OPDAT). The
delegation first travelled to Washington, D.C., to focus on
policy issues and examine legislation. During their visit
to Puerto Rico they witnessed first-hand how security is
maintained in the courtrooms and other court facilities.
A delegation of judges from Colombia and Mexico visited
the U.S. District Court for the District of Puerto Rico.

Middle School
On May 31, 2012, a group of students and parents from
Antilles Middle School visited the Court. Chief Judge
Delgado-Colón welcomed the group and spoke to them
about the federal court system, what happens in the federal
court on a daily basis, and the jobs of those who work in the
courts. U.S. Marshal Orlando Rivera guided the students in

a tour of the cell block facilities, and gave them an overview
of the U.S. Marshals Service and its position in the federal
justice system. The students also visited the U.S. Probation
Office, and also had the opportunity to observe court
proceedings.

Students Visit Magistrate Judge Silvia
Carreño-Coll’s Courtroom
As part of the Court’s educational outreach program, United
States Magistrate Judge Silvia Carreño-Coll has conducted
several student activities in her courtroom. Students had
the unique opportunity to view live Court proceedings, and
also learned about the composition and work of the U.S.
Probation Office and the U.S. Marshals Service: American
Military Academy’s 2012 Seniors, accompanied by Teacher

2012 Seniors, accompanied by Teacher Dorisa Vizcarrondo
(April 30, 2012). American Military Academy’s eighth
graders, accompanied by teacher Zilkia Rivera, visited the
Court on May 9, 2012, and conducted a mock trial. On June
15, 2012, Magistrate Judge Carreño-Coll also received
the visit of summer interns from the McConnell-Valdés
law firm. In addition, on Feburary 10, 2012, Colegio Mater
Salvatoris’ Troop 42 (Boy Scouts of America) staged a mock
drug trial before Magistrate Judge Carreño-Coll during
which they learned about different aspects concerning
legal representation and trial advocacy before the Federal
Courts.
Increases to the Miscellaneous Fee
Schedule
Effective June 1, 2012, the
Judicial Conference approved
minor
changes
to
the
Miscellaneous Fee Schedule
for the District Courts. The
fee for exemplification of any
documents was increased to $21, and the fee for conducting
a search of the district court records (per name or item
searched) was increased to $30. The fee for conducting a
search of records applies to services rendered on behalf of
the United States if the information requested is available
through electronic means.
Appropriate Use of Restricted Filing
and Viewing Levels in CM/ECF
Restricted filing and viewing levels are a useful tool which
facilitate ready-access to electronic filing while, at the same
time, protecting the privacy of certain information offered
by filers. However, the general rule is that access to judicial
records and proceedings shall not be restricted absent good
cause. Thus, prior to selecting a restricted filing and viewing
level, CM/ECF users are encouraged to ascertain whether
the restriction is absolutely necessary.

Clerk’s Tidings
New Mileage Rates
Effective April 17, 2012, the reimbursement mileage rates
for privately owned automobiles increased as follows:
automobiles $0.555 per mile; motorcycles $0.525 per mile;
and, airplanes $1.31 per mile. These fees apply for official
travel performed on or after the effective date.
Applicable Fee for Returned Checks
Members of the bar are reminded that
Local Civil Rule 67(d) gives notice of the
Clerk’s Office policy concerning acceptance
of personal checks. The Clerk’s Office
accepts personal checks up to the amount
of $1,000.00, from those payors not included in the Court’s
list of payors having issued a check with insufficient funds.
Payments in excess of $1,000.00 shall only be accepted
by the Cashier if made in cash, or by an Official Manager’s
Check, Money Order, or Certified Check payable to “Clerk,
U.S. District Court.” Personal checks are accepted by the
Clerk of Court subject to collection. Pursuant to the current
District Court Miscellaneous Fee Schedule, 28 U.S.C. §
1914(b), a fee of $53.00 is due to the Clerk of Court for any
check paid returned for lack of funds. Substitute payments
will be accepted only upon payment of the applicable fee

Increase to PACER Fee Effective
April 1, 2012
An increase in the electronic public access (EPA) fee, from
eight cents to 10 cents per page, took effect on April 1,
2012.
The Judicial Conference of the United States authorized the
increase to the federal judiciary’s electronic public access
fee in response to increasing costs for maintaining and
enhancing the electronic public access system. The change
was needed to support and improve the Public Access to
Court Electronic Records (PACER) system, and to develop
and implement the next generation of the judiciary’s Case
Management/Electronic Case Filing system.

The EPA fee had not been increased since 2005. As
mandated by Congress, the EPA program is funded entirely
through user fees set by the Conference. The Conference
was mindful of the impact such an increase could have
on other public entities and on public users accessing the
system to obtain information on a particular case. For this
reason, local, state and federal government agencies have
been exempted from the increase for three years. Moreover,
PACER users who do not accrue charges of more than $15
in a quarterly billing cycle would not be charged a fee. (The
former exemption was $10 per quarter.) The expanded
exemption means that 75 to 80 percent of all users will still
pay no fee.
New Chief Judge for the U.S.
Bankruptcy Appellate Panel for the
First Circuit
Effective June 1, 2012, the First
Circuit Judicial Council approved the
appointment of the Hon. William C.
Hillman to serve as Chief Judge of the
U.S. Bankruptcy Panel for the First Circuit,
substituting the Hon. James B. Haines.
The Bankruptcy Appellate Panel (BAP)
consists of bankruptcy judges appointed
from the five districts in the First Circuit and, from time
to time, bankruptcy judges from other circuits sitting by
designation. The BAP judges, sit in three-judge panels to
hear appeals from the decisions of the bankruptcy courts
in the districts of Maine, Massachusetts, New Hampshire,
Puerto Rico and Rhode Island. Currently appointed, from
the U.S. Bankruptcy Court for the District of Puerto Rico,
are the Hon. Enrique S. Lamoutte, the Hon. Brian K. Tester,
and the Hon. Mildred Cabán-Flores. For more information,

Use of CM/ECF Mandatory in the Court
of Appeals for the First Circuit
In a recent Press Release, the Office of the Circuit Executive
announced that the Clerk’s Office for the Court of Appeals
for the First Circuit will be contacting attorneys appearing
in said court who have not registered for the court’s
electronic filing system (CM/ECF). Attorneys who intend
to file document in a case or future cases must register
immediately with PACER for an appellate ECF Filer account.

Electronic Notification Now Available
in Cases of Interest on Appeal
Members of the bar are advised that it is now possible to
register for the sole purpose of receiving electronic notice of
docket activity in cases of interest to them. Bar membership
is not a requirement. If you do not need electronic filing
privileges but wish to receive immediate electronic notice
of docket activity, you can select the option “other (not a
public filer)” when you register. Attorneys who select this
option will automatically receive electronic notification
of docket activity in their active cases and in cases they

Federal Rulemaking
The following amendments to the Federal Rules of Practice
and Procedure were approved by the Supreme Court and
transmitted to Congress on April 23, 2012:
 Federal Rules of Criminal Procedure: Rules 5,
15, and 58; and, new Rule 37.
 Federal Rules of Bankruptcy Procedure: Rules
1007, 2015, 3001, 7054, and 7056.
These amendments will take effect on December 1,
2012, unless Congress takes action to reject, modify, or

In Memoriam—Court Mourns Passing
of Former U.S. Magistrate Judge John
M. García-Nokonechna, Esq.

John M. García-Nokonechna, who served the United States
Judiciary with distinction as United States Magistrate Judge
for the District of Puerto Rico from 1972 to 1977, died on
March 21, 2012.
Mr. García-Nokonechna was the first full-time Hispanic
United States magistrate judge to be appointed under the
Federal Magistrates Act of 1968, which abolished the office
of the United States Commissioner. A 1970 graduate of the
University of Puerto Rico School of Law and member of
the Law Review, prior to his appointment as United States
Magistrate Judge he served as a law clerk to the Honorable
Hiram R. Cancio, United States District Judge (1965-1974).
He further served the Judiciary as a member of the Advisory
Committee on Rules for the United States Court of Appeals
for the First Circuit from 1995 to 1997.

community to help each other (and their family members, staff personnel, etc.) in a wide array of
situations. All FBA Chapters are encouraged to join this very important project, thus expanding

For more than 50 years, the Hon. Raymond L. Acosta Puerto Rico Chapter of the
Federal Bar Association has been instrumental in the advancement of the science of
jurisprudence in our District and Circuit. The Chapter owes its success to its active
membership.
Your support has been key in allowing our Chapter to receive the highest recognition
awards at the National level. In recent years, the memberships of many professional
associations have decreased as a result of the hard economic times the Nation has
undergone. The FBA and our Chapter are not immune from this reality. However, the
FBA believes that the value its Chapters add to its membership far outweighs the cost
of membership.
In recent years, Members of the FBA have benefited from great programs and events,
many of which have been free of charge or at a reduced cost for them. Seminars,
conferences, and social gatherings are offered almost on a monthly basis in the past
