Approximately 46 percent of US electricity is derived from coal base load power plants. Coal is also by far the nation’s most abundant source of energy, constituting 94 percent of the nation’s fossil fuel resources. The United States has nearly 261 billion tons of recoverable coal reserves, according to the Energy Information Administration, which is a 249-year supply at current rates of use. The correlation between coal-fueled electricity and economic growth is near-perfect. For example, states that rely predominantly on coal generation are generally the states with the lowest electricity rates. Twenty of the twenty-five states with the lowest electricity costs rely upon coal generation for at least 40 percent of their electricity generation—and all have rates below the national average. It is no coincidence that these states also have the highest concentrations of manufacturing. Some lawmakers and politicians at the Environmental Protection Agency are over-reaching in their attempts to limit the use of coal for electricity generation. When they try to stop us from using coal, they attack the very foundations of our nation. But it doesn’t have to happen. Not if we stand up for keeping our electricity rates low and demand that we take advantage of our most abundant power-generating resource. Coal was the answer generations ago as we built this nation. It’s the answer today as we struggle to restore and renew our economy and make the lives of our people better once again. And, it’s the answer for generations yet to come. Therefore, we, the undersigned, do hereby petition our elected officials to pursue new policies and stop the costly and harmful pursuit of regulations and policies that threaten the benefits provided by coal-based electricity generation. Dubé, County Administrator Alexandra Dixon, Deputy Clerk September 4, 2012 Regional Legislative Program BACKGROUND Mr. David Blount, Legislative Liaison for the Regional Legislative Program, will be present to discuss the process for developing the program, to highlight some of the issues being considered for inclusion in the program, and most importantly, to receive input from the Board concerning items it would like to emphasize in the program. Page 1 Packet Pg. 8 1.3.a (Counties of Albemarle, Fluvanna, Greene, Louisa and Nelson & Charlottesville City) SECONDARY ROAD DEVOLUTION We are strongly opposed to any legislation or regulations that would transfer responsibility to counties for construction, maintenance or operation of current or new secondary roads. STATE/LOCAL FUNDING and REVENUES The state should honor its funding obligations to localities and resist cost-shifting to localities. Facing continuing budget woes and funding cuts to localities, the state should relax state requirements or provide flexibility for meeting requirements, and not further restrict local revenue authority. The state and localities should examine contractual relationships for services required by the state. PUBLIC EDUCATION FUNDING The state should fully fund its share of realistic costs of the Standards of Quality (SOQ) without making formula changes that shift the funding burden to localities. CHESAPEAKE BAY TMDL The state and federal governments must provide major and reliable forms of financial and technical assistance for comprehensive water quality improvement strategies. We urge fairness in applying requirements for reductions in nutrient and sediment loading across source sectors, and accompanying authority and incentives for all sectors to meet such requirements. We will oppose actions that impose monitoring, management or similar requirements on localities without providing sufficient resources. Any expansion of the Nutrient Exchange Program should be contained within and be relevant to a particular watershed. TRANSPORTATION FUNDING We request separate and dedicated state revenues for all transportation modes. The state should restore formula allocations for secondary/urban construction and provide stable and increasing dollars for cities and towns to maintain roads within their boundaries. LAND USE and GROWTH MANAGEMENT We request additional tools to manage growth without preempting or circumventing existing local authorities in this area. We support making the use of urban development areas optional for localities. COMPREHENSIVE SERVICES ACT We urge a better partnership between the state and localities in containing the costs of CSA, and in balancing CSA responsibilities. We support additional state funding for administering CSA, as localities foot the bill for most of these costs. For your information, I have attached a summary of the priority items from this past year. Specifically, I would like to come before the Board at its September 4th meeting. Earthquake Recovery Activity: - Continue to hold weekly meetings with volunteer case workers. The fund awarded $2,607.40 in July in grant funds to citizens for a total of $266,876 so far - Case workers continue to work approximately 31 active cases. - A tour was conducted with Larry Snead of Snead’s Mobile Home Service of several properties to inspect damage of doublewide mobile homes. It was determined that 5 homes could be re-leveled, 1 home needed minor block repair and 1 home was determined to be completely unsafe. The volunteers are working with these citizens and the committee to get the funds needed to make these necessary repairs. N. fowleri is a species of ameba that can infect humans. It is commonly found in warm freshwater. Infection with the organism can cause primary amebic meningoencephalitis (PAM), a rare disease that destroys brain tissue. Most people who have been infected with N. fowleri had contact with warm, freshwater prior to their infection. This contact typically occurred from swimming in natural recreational water bodies (e.g., lakes, rivers) when water temperatures were warm. In the US, infection is seen mostly in children and young adults. Most cases result when fresh water that contains the ameba forcefully enters the nose while the person is swimming or diving. Beyond water temperature, it is not clear what environmental factors may contribute to the presence or concentration of N. fowleri in water, or whether such factors are related to a higher risk of infection for swimmers. Are infections with Naegleria fowleri common? Naegleria fowleri infection is very rare. Prior to a recent N. fowleri related fatality in 2011, the last documented case of N. fowleri infection in Virginia occurred in 1969. Why is Naegleria fowleri being studied in Virginia? The Centers for Disease Control and Prevention (CDC) is collaborating with several state partners, including Virginia, to conduct ecological studies of N. fowleri in recreational waters using a new detection method. Reliable detection of N. fowleri in the environment is a critical first step in understanding environmental risk factors and developing prevention strategies. Who is performing the study? The study is being performed collaboratively with staff from the VDH Division of Environmental Epidemiology and the Water, Sanitation and Hygiene Laboratory at CDC. Other stakeholders such as the Department of Environmental Quality and lake associations may also contribute to this study. What will this study tell us? Data from this study will help health officials better understand the environmental conditions that contribute to the presence and concentration of N. fowleri in lake swimming areas. We will also learn if CDC can identify N. fowleri using a new detection method for environmental research in fresh water. What lakes were chosen and why? Several lakes including Smith Mountain Lake in Bedford County, Bear Creek Lake in Cumberland County, Twin Lakes (Prince Edward Lake and Goodwin Lake) in Prince Edward County, and Lake Anna in Spotsylvania County were chosen as study sites. VDH is working with CDC to determine when results will be made available. Because other states are participating in similar studies, we expect all data to be compared with other states’ data before results can be released. What are the limitations of this study? As the study will use a new N. fowleri detection method, it is not clear how the results should be interpreted or how generalizable these results are for Virginia or any other states. Sample sizes and number of analytical parameters will be limited due to an absence of funding for the study. This study will only provide a snapshot of the N. fowleri presence on the day of sample collection. It is important to remember that N. fowleri may always be present in freshwater during summer months and all recreational water users should take precautions. Although the data will enhance our ongoing efforts to learn more about N. fowleri, this study will not be used to support: o closures of swimming areas or lakes o signage that would indicate one lake has a different risk than another We do not recommend posting signs since it is not known if the amount of N. fowleri in the water is an indicator of infection risk. N. fowleri may always be present in freshwater during summer months, and the presence of signs at water bodies in the study may create a misconception that bodies of water without signs are safe. Recreational water users should assume the possible presence of N. fowleri and take appropriate precautions. This is a study of N. fowleri in the fresh water environment. The CDC’s new detection method is for detecting N. fowleri in fresh water. The test is not used for detecting N. fowleri in blood or tissue from humans or for diagnosing PAM. The study’s results will not be directly useful for clinical decision-making about the risk of human disease after recreational water exposure. How can I prevent N. fowleri infection? Use caution while taking part in warm freshwater during periods of high water temperature and low water levels. Hold the nose shut or use nose clips when swimming in bodies of warm freshwater. Programs Update: The new Parks and Recreation Leisure Times Program Brochure will hit the streets the week of August 27-30th. In addition to being distributed in the August 30th Central Virginian newspaper, and mailed to those who have asked to be on our mailing list, it will be distributed to all elementary school and middle school students, as well as many locations throughout the county. Youth Co-Rec basketball league has finished, and we will be starting girls’ softball League after Labor Day. KidzQuest afterschool program is being held at all four elementary schools. There are approximately 30 children attending each day at the Jouett and Moss-Nuckols locations, with closer to 40 children at the combined Thomas Jefferson/Trevilian location. 2. Events Update: Only approximately 250 people attended First Fridays in August. There were several other events being held that same night including the Ag. Fair and a high school band event. Mark your calendar: First Fridays in Louisa will be held at Walton Park on Friday, September 7th beginning at 6:00 pm. Class Act Band will be playing. This will be the final concert for the season. The Pooch Plunge will be held Saturday, September 29th at the Aquatic Center from 1:00 – 3:00 pm. Besides allowing the dogs to swim that day there are several contests, games and demonstrations planned. The fee is $5 for a dog and owner. 3. Administration Update: The Recreation Advisory Commission met at the Betty Queen Center on Wednesday, August 1st. The motor in the Scagg Turf Tiger mower, which we believe was approximately 13 years old finally died. The cost to repair is several thousand dollars, so at this point the crew is doing its best to get everything cut without it. 5. Aquatic Facility Update: The Aquatic Facility went to a reduced schedule when school started, opened only on weekends. Once school starts, attendance is very low, even on weekends. The pool will close for the season on Labor Day. 6. Tourism Update: Jane and Lisa met with representatives from Orange County and Fluvanna County to discuss the visitor center at Zion Crossroads. The group is in favor of continuing the visitor center and is looking to meet on a regular basis to explore ways to improve the effectiveness of the center. The group also discussed the Piedmont Crossroads Visitor Center website, which Bob Hard has been working on (making some great improvements) and the representatives are all to go back and try to update the information for their county. Lisa provided welcome packets for the Louisa Education Foundation to give to all new teachers before the start of school. Lisa will be representing Louisa Tourism the Southern Seed Exchange event at Monticello on September 15th. Jane met with representatives from the Lake Anna Guide and Lake Anna Breeze to discuss ways to share information about happenings around Lake Anna. She is also meeting with representatives from the LABP soon to also discuss upcoming events. Collections exceeded the forecast in all major state revenue source categories. The $448.5 million surplus includes $129 million in revenue collections above the estimates and nearly $320 million in savings from unexpended general fund balances and recoveries. →Among the targeted recipients of the excess funds are the following: $78.3 million for the Revenue Stabilization (“Rainy Day”) Fund; $16.9 million to the Water Quality Improvement Fund; $20.9 million to pay transportation for its share of the accelerated sales tax; $17.2 million to cover an increased state share for natural disasters; $30 million to the Federal Action Contingency Trust (FACT) Fund to mitigate consequences of sequestration and other potential federal actions; and $41.8 million is left for “discretionary reappropriations.” The budget surplus also will allow for a three percent performance bonus for state employees (costing up to $77.2 million), effective December 1. →In his remarks, the governor touted “new reforms that will lower total unfunded (VRS) liabilities by nearly $9 billion by 2031.” He did not mention the approved legislation that forced local employees to pay the 5% member contribution to VRS (in the past, paid by local employers) and required local employers to provide an accompanying 5% pay raise…...actions which do nothing to decrease the pension fund’s unfunded liability. →The governor also did not mention the ongoing reductions in “aid to localities” that continue in the FY13/14 state budget. Though the governor proposed, and the General Assembly approved, reducing the amount reverted from localities back to the state from $120 million to $95 million over the next two years, nonetheless, localities still are taking a $95 million hit at a time state officials are boasting of a “surplus” for the third straight year. →In his remarks, the governor cited the “dark cloud” of sequestration looming at the federal level in early 2013 and the impact of that on the Virginia economy. The federal Budget Control Act approved last year established a committee on deficit reduction to find $1.2 trillion to reduce the budget deficit over the next 10 years. That group was unable to reach an agreement, setting the stage for spending cuts to both defense and discretionary programs on January 2, 2013. In the first year alone, this amounts to a $109 billion reduction in federal government spending. Packet Pg. 78 Attachment: Thomas Jefferson Planning District Commission Legislative Newsletter - August 2012 (1969 : 9/4/2012 County Administrator's 4.7.v AOSS Examinations Move Forward →Two groups looking at state regulation of alternative onsite sewage systems (AOSS) are moving forward in their examinations. →The Housing and Environmental Standards Workgroup of the Virginia Housing Commission met recently to get updates on various items related to AOSS. One of the issues of focus concerned the frequency of inspections, now required to be done annually. It heard from representatives of Loudoun County, which has instituted an inspection and monitoring program in the county, that their data shows the benefit of annual inspection, even on fairly new systems, to be preventing future problems. →The cost for such an inspection also was raised. Workgroup chairman, Senator John Watkins, suggested that the State Department of Health (DOH) consider asking operators to report what costs are to the consumer for inspections (thought to be in the $200 to $400 range). →The DOH representative told the group there are about 60,000 AOSS systems statewide, but that DOH has only about 10,000 of those in its database; it hopes to have a complete inventory of systems by the end of 2014. About 1,600 permit applications for AOSS were received in 2011. He also noted that according to reports from AOSS operators over the past few years, the number of repair applications has been steady, while the statewide failing rate (that is, systems not performing properly and causing effluent to not be treated properly) was about 5.6%. →Concerning the frequency of inspection issue, the DOE representative indicated that since the current annual inspection requirement was part of the state’s Watershed Implementation Plan (WIP), a change in the frequency would probably draw the attention of the Environmental Protection Agency, to which the WIP was submitted. There also was an update on the efforts of a working group convened by Delegate Scott Lingamfelter (Prince William), who introduced legislation (HB 942) this past session to address AOSS maintenance standards. Work group members have been wrestling with ways to address challenges posed 1) when an AOSS owner refuses to correct deficiencies identified during an annual inspection, and 2) when an AOSS has failed and the owner cannot afford to repair or replace the system. There have been contending viewpoints about identified solutions regarding additional lien authority for localities in the first instance, and the use of a recovery fund, paid for with higher AOSS permit fees, in the second instance. That working group meets again in mid-September to work on reaching some consensus on possible legislation. Additional Commission on Local Government Mandate Reviews →The Commission on Local Government is continuing its coordination of the review of selected state and federal mandates. Analysis of the following will get underway this fall: Virginia Indoor Clean Air Act (Code of Virginia § 15.2‐2825, 35.1‐5 and 35.1‐14)--Local health departments must inspect restaurants for compliance with the Virginia Indoor Clean Air Act in the course of conducting regular environmental health inspections of restaurants. Assessment Period: September 1 to October 31. State Homeland Security Grant Program (Non‐Discretionary Condition of Aid)--Local governments receiving funds from the State Homeland Security Grant Program are required to comply with guidelines issued by the Department of Emergency Management and the U.S. Department of Homeland Security. These maps are scaled maps that may include topography and/or soil layers from the GIS of a particular parcel or parcels of land. Maps can be requested to be in paper or digital formats. UPGRADED GIS SYSTEM NOW ONLINE! Special GIS Projects: Special projects are request for GIS data in a format other than what we generally produce. All replacement housing will be provided within three (3) years of the commencement of the demolition or rehabilitation relating to conversion. Before obligating or expending funds that will directly result in such demolition or conversion, the County of Louisa will make public and advise the state that it is undertaking such an activity and will submit to the state, in writing, information that identifies: 1. A description of the proposed assisted activity; 2. The general location on a map and approximate number of dwelling units by size (number of bedrooms) that will be demolished or converted to a use other than as low/moderate-income dwelling units as a direct result of the assisted activity; 3. A time schedule for the commencement and completion of the demolition or conversion; 4. The general location on a map and approximate number of dwelling units by size (number of bedrooms) that will be provided as replacement dwelling units; 5. The source of funding and a time schedule for the provision of replacement dwelling units; 6. The basis for concluding that each replacement dwelling unit will remain a low/moderateincome dwelling unit for at least 10 years from the date of initial occupancy; and 7. Information demonstrating that any proposed replacement of dwelling units with smaller dwelling units is consistent with the housing needs of low- and moderate- income households in the jurisdiction. The County of Louisa will provide relocation assistance to each low/moderate – income household displace by the demolition of housing or by the direct result of assisted activities. Such assistance shall be that provided under Section 104 (d) of the Housing and Community Development Act of 1974, as amended, or the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended. (c) The identified Section 3 Business concerns shall be included on bid lists used to obtain bids, quotes or proposals for work which will utilize CDBG funds. (d) To the greatest extent feasible the identified Section 3 Business concerns and any other project area business concerns shall be utilized in activities which are funded with CDBG assistance. 4. Such listings shall be completed and shall be verified by site visits and employee interviews, crosschecking of payroll reports and invoices, and through audits if necessary. 6. The County of Louisa, its covered contractors, and subcontractors shall designate a Section 3 Coordinator to ensure compliance with this regulation. The Section 3 Coordinator for the Louisa County Earthquake Reconstruction Project shall be the Director of the Fluvanna/Louisa Housing Foundation throughout the course of this active CDBG agreement. 7. Section 504 states, in part, that "no otherwise qualified handicapped individual . . . shall solely by reason of his handicap, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance. . . ." Complaints should be addressed to: Director of Human Resources, Human Resources Department, 1 Woolfolk Avenue, Post Office Box 160, Louisa, Virginia 23093, (540) 967-0401, who has been designated to coordinate Section 504 compliance efforts. 1. A complaint should be filed in writing or verbally contain the name and address of the person filing it, and briefly describe the alleged violation of the regulations. 2. (Processing of allegations of discrimination occurring before this grievance procedure was in place will be considered on a case-by-case basis.) 3. An investigation, as may be appropriate, shall follow a filing of a complaint. The investigation will be conducted by the Director of Human Resources. These rules contemplate informal but thorough investigations, affording all interested persons and their representatives, if any, an opportunity to submit evidence relevant to a complaint. Under 24 CFR 8.53(b), the County of Louisa need not process complaints from applicants for employment or from applicants for admission to housing. 4. A written determination as to the validity of the complaint and description of resolution, if any, shall be issued by the Director of Human Resources and a copy forwarded to the complainant no later than 30 days after its filing. 5. The Section 504 coordinator shall maintain the files and records of the County of Louisa relating to the complaints filed. 6. The complainant can request a reconsideration of the case in instances where he or she is dissatisfied with the resolution. The request for reconsideration should be made within 10 days to the County Administrator. 7. ACTIVITIES: Housing rehabilitation and associated activities. Active program income: Active income is income received as a result of program activities prior to administrative closeout of the CDBG Grant Agreement. If the total exceeds $25,000 in any of the successive 12-month period of the CDBG Grant Agreement, the funds shall be used to reduce drawdowns for eligible project expenses. If the amount does not reach $25,000, it will be accumulated and used for eligible project costs in excess of the Project Budget with the permission of DHCD. Active income on-hand at the end of the project will be used to reduce drawdowns or returned to DHCD. Active income will be used for the same CDBG activities as approved in the CDBG Grant Agreement. Inactive program income: Inactive income is all revenue received as a result of CIG activities after Administrative Closeout. Income shall be used to continue the same eligible CIG activities as long as LMI households in the project area have unmet needs. After all needs are met in the project area, inactive income will be used for the following purposes: a) To rehabilitate owner-occupied homes, including any necessary construction, exceptions, CRSC expenditures; demolition and clearance/debris removal; Attachment: Program Income Plan (1975 : CDBG Program Income Plan) Grantee: b) Install well and septic systems when existing systems are substandard or failing. Associated costs may include, but are not limited to any necessary surveys, engineering designs, and rehab specialist work. All new wells will be drilled, tested and approved. Payment will be made for only one (1) well, regardless of the number of wells drilled. All old wells will be appropriately abandoned. Pump and haul systems will not be funded. Funds will not be used to install connections to mobile home parks without prior DHCD approval; c) Funds may be added to an existing housing rehabilitation as a loan and/or grant to subsidize any valid “change order” when the needed change order exceeds the DHCD cost limits; 1 Woolfolk Avenue ● Post Office Box 160 ● Louisa, Virginia 23093 (540) 967-0401 ● (866) 325-4131 Packet Pg. 112 4.9.h.a d) Funds may be added to an existing housing rehabilitation to cover the cost of additional temporary relocation costs with prior DHCD approval; e) Funds may be added to an existing housing rehabilitation for the purchase of DHCD-required insurance and VDH-required alternative septic maintenance agreements; g) When property becomes “Non-occupancy,” which means that the intended beneficiary or beneficiaries have vacated the unit for 3 or more consecutive months due to transfer of property, abandonment, institutionalization, death or any other reason; inactive program income will be used funds will be used to board up the house, pay the homeowner’s insurance, any required septic system maintenance agreement, and do those repairs necessary to maintain the integrity of the house until the heir(s) of the house can be identified. Afterwards, these costs will be the responsibility of the heir(s). If no heir(s) can be identified or if all heirs legally waive their claim to the house, funds can be used for these costs and those necessary to market the house so it can be sold to a new low- and moderate-income household who will assume the outstanding IPR loan. This is in addition to those costs identified elsewhere in the Program Income Plan to assist in the homeownership creation. It is assumed that homeownership creation will be done within six months; h) Inactive program income may be used for actual administrative costs. At the time the program income is expended, 10 percent of the expended program income may be allocated for administrative purposes; and i) Up to $5 per loan per month as a service fee to offset the cost of loan collection. Program income will be used only for applicants whose household incomes are at or below 80% of the County’s median income. 2. TIME FRAME: Briefly outline the TIME FRAME during which the project will be carried out and completed. Program income covered by this plan will be derived from a zero percent interest loan with repayment over an estimated average of a 15 year period for all rehabilitation and substantial reconstruction projects. Attachment: Program Income Plan (1975 : CDBG Program Income Plan) f) Funds may be loaned to first-time homebuyers for down payment assistance (up to 50% match), reasonable closing costs normally associated with the purchase of a home (including paying discount points to the lender), principal write-down assistance and mortgage insurance. Indicate where inactive program income will be spent after all of the needs in the project area are met. Research shows car seats reduce the risk of fatal injury by 71% for children younger than 1 and by 54% for children 1 to 4 years old. We also know they are most effective when installed and used correctly. Sadly, nearly three out of four car seats are not used or installed properly. NOW, THEREFORE, BE IT RESOLVED, on this 4th day of September 2012, that the Louisa County Board of Supervisors hereby authorizes a supplemental appropriation in the amount of $1,415.00 to the Louisa County Sheriff's Office for the purchase of a new dog for the K-9 program (GL # 4-100-31200-5876). Ms. Vaughn stated the internship program is a highly visible and successful program and is designed to be a representation of a real world experience, and was proud to be given the opportunity to offer the program to the students. Ms. Vaughn also thanked the sponsors for their willingness to challenge the interns, and the interns for meeting those challenges. Presentation - Employee Recognition Mr. Gentry recognized Louisa County Parks and Recreation for receiving VACo’s Best Achievement Award for their "Teen Quest Special Program". Employee Introduction Mr. Mullen introduced Gladys Yates the new Assistant County Attorney who came to us from Sands Anderson and prior to that she was the Assistant City Attorney in Lynchburg and Roanoke. Mr. Mullen stated Ms. Yates received her law degree from Washington and Lee and her B.A. in communications and rhetoric from the University of Virginia (UVA). Presentation - Recognizing Conner Waldron as the 2012 Educator of the Year in Louisa County Mr. Dubé recognized Conner Waldron for being awarded the 2012 Educator of the Year. The Board presented Ms. Waldron with a framed resolution of her achievement. CITIZEN'S INFORMATION PERIOD - 6:30 P.M. Betty Smart, Mountain Road District expressed her concerns with the amount of time it took the rescue squad to arrive to her place after placing a call of emergency for her husband who was experiencing severe chest pains. Ms. Smart stated that with the amount of time it took the rescue squad to arrive, and the preparation to get her husband into the vehicle, she could have already been at the hospital. Bill Murphy, Mineral District, addressed the Board regarding the excessive boat noise out at the lake and would like the Board to consider amending the Louisa County Code to include regulation of noise on the Lake. Minutes Acceptance: Minutes of Aug 6, 2012 6:00 PM (Minutes Approval) Mr. Dubé recognized Ms. Lori McLaughlin, Ms. Paula Groome-Turney, and Mr. Roy “Snake” McGhee for their years of service to the County. The Board presented each employee with a Certificate of Appreciation for their service. James "Jim" Kogle, Mineral District, also expressed his concerns with the excessive noise from water craft, but also had concerns with the noise of larger boats that seems to have increased over the past few years. Mr. Kogle encouraged the Board to revisit the County noise ordinance, so that one could be established for the lake. David Shalloway, Patrick Henry District, stated he operates a home business, after receiving a Home Occupation from the Zoning Department, which has grown into a full time job and would like to hire an employee, but the definitions within the Home Occupation do not apply to the expansion of his business, so he applied for a Conditional Use Permit (CUP). Mr. Shalloway stated the Zoning Department felt that the CUP was too much for his business so they requested Page 2 Packet Pg. 170 4.11.a Regular Meeting Minutes August 6, 2012 he propose an amendment be made to the Home Occupation definitions. Ms. Coretta Ezzell, Mountain Road District, addressed the Board regarding Dusty Road. Ms. Ezzell stated she has discussed some of the traffic and hazard issues on Dusty Road before to the Board, but is back to seek assistance on how the residents could bring the road into VDOT’s regulations. PRESENTATIONS (Continued) Dr. Pettit thanked the Board of Supervisors for offering the internship program to the students this year and recognizing Ms. Waldron for her achievement. Dr. Pettit addressed the Board to request the advertisement and hire of three teacher positions, if needed, for the 2012 school year. Dr. Pettit mentioned during the budget season they anticipated for a larger group of kindergartens coming into the 2012 school year, but at that time the number of students were not significantly larger than the previous school years, however, in the past two weeks a large number of kindergarten students have enrolled making it a greater need for the additional kindergarten teachers. The Board asked questions about the student to teacher ratio and discussed the appropriate needs of the additional teachers. On the motion of Mr. Barnes, seconded by Mr. Havasy, which carried by a vote of 7-0, The Board approved to hire three additional teachers, as needed. Presentation - VDOT Quarterly Update Mr. DeNunzio, Acting Charlottesville Residency Manager for VDOT, presented the VDOT quarterly update, which included a summary on special issues, current and future projects, construction and maintenance activities, and traffic engineering studies for the County of Louisa. Mr. DeNunzio reported that secondary and primary mowing operations are underway and the issues regarding the Route 522 pavement reflectors are currently being reviewed. Mr. Wade asked why the speed reduction on Range Rd., which was requested by the residents, was denied. Mr. DeNunzio stated that based off of the VDOT requirements, Range Rd. is not a candidate for a speed reduction. There were several questions and requests in regards to the safety of the roads in the county. PUBLIC HEARINGS - 7:00 P.M. Minutes Acceptance: Minutes of Aug 6, 2012 6:00 PM (Minutes Approval) School Presentation Regarding Kindergarten Numbers Resolution - To Approve Amendments to the Louisa County Zoning Ordinance for Telecommunications Regulations and Fees Mr. Holtzman presented the draft amendments for telecommunications regulations and fees which is intended to clarify allowed uses and height limits for wireless communications facilities; eliminate any provisions of the telecommunications article that may not be in accordance with federal law; and ensure that the Zoning Ordinance, including the Schedule of Fees, make it as simple and affordable as possible to provide wireless services in the county. Mr. Byers asked if this amendment would impact Dominion's review process. Mr. Holtzman stated if the structure were to cross over Dominion's easement, the review process would still be the same. OLD BUSINESS Discussion - Update - Future Planning Working Groups Mr. Dubé updated the Board on the Future Planning Working Groups and stated they did not receive the citizen engagement they had hoped for, so instead of seven working groups it has been amended to three. Mr. Dubé stated the three working groups are school and general county functions, public safety, and finance, and he is hoping to start scheduling these meeting in the near future. The Board discussed ways to encourage more citizens to become involved with the working group. Resolution - To Re-appropriate FY12 Funding for LCPS CIP Project Dr. Pettit stated the FY11 Capital Improvement Plan (CIP) included budget funding for the replacement of the Trevilians Elementary School gym floor in the amount of $40,000, however, the August 2011 earthquake forced a delay on the project and the funds were not spent and remain in the CIP fund balance. Dr. Pettit is requesting for those funds to be re-appropriated because the gym floor still requires replacement. Mr. Mullen stated there is a total of 53 county employees, 284 school employees, and 9 Human Service employees who are delinquent creating a total of $95,000 of uncollected taxes. The Boards discussed different type of methods on how to collect the delinquent taxes and some felt like it is the Treasurer's responsibility to implement a process on gathering the uncollected taxes. OTHER Mr. Dubé stated that there were monthly reports and correspondence included in the Board packet and reminded the Board of several upcoming events. The outdoor gathering would be a triathlon, to take place on the Boxley property adjacent to Kentucky Springs Road; on several roads in the area; and in the waters of the "warm" side of Lake Anna. Initially the applicant applied for this CUP with the intention of holding the event twice a year, once in the spring and once in the fall. However, Dominion advised the applicant that commercial events of this nature are not allowed in the waters of the warm side of Lake Anna. (The warm side is technically called the Waste Heat Treatment Facility.) Because the applicant only became aware of this rule recently, Dominion has agreed to allow the event, but only in October 2012. RECOMMENDATION Staff requests that the Board consider whether the conditions included in the attached resolution are appropriate. The reason for this request is that we had the run course all off road for this event which resulted in numerous complaints by the athletes about having to run on gravel. By moving the run course to the road, we can alleviate this but we would have to shut down this section of Kentucky Springs. Having this section of road shut down would make the bike course safer for athletes getting on and off their bikes at the entrance to the race site. Having both parts of the road shut down would allow us to put cyclists in the left lane from Eastham to just shy of Pottiesville to allow for the run course and bike course to be on the same section of road in the right lane. I have spoken with Lt. Roy (Snake) McGee of the Louisa County Sheriff’s Department and he believes doing a detour for these races would be both effective and easy to manage. We would route NW bound traffic on Kentucky Springs right on Eastham then left on Moody Town to then arrive back on Kentucky Springs. SE Bound Kentucky Springs traffic would be routed right on Pottiesville, then left on Frederick hall to arrive at the intersection of Frederick Hall and Bumpass 50 meters south of the intersection of Kentucky Springs and Bumpass. There are about 20 homes on this section of Kentucky Springs that would be affected by the detour. They would still be able to come and go from their homes, they would all just need to go NW on Kentucky Springs until they got to Pottiesville or Moody Town. We would secure an electronic message board to inform the public and would give all the residents on this section a flyer and a map a month out and a week out from the event. Assuming the draft amendment to the zoning ordinance is adopted by the Board the Board of Supervisors, recommendation of approval was made with the following conditions: 1. The outdoor gathering use on this property shall be limited to the triathlon as presented by the applicant. The triathlon has been presented as an event that will attract roughly 1,600 participants over a two-day weekend, plus a certain number of spectators. The event will be limited to one weekend in the spring and one weekend in the fall each year. At the conclusion of each event, temporary structures such as tents and restrooms shall be removed. 2. A site plan will not be required because this is a temporary event; the permanent use of the property will remain the same. 3. A maximum of 10 camping tents will be allowed to be set up for overnight camping as part of the event. 4. Events shall be coordinated as necessary with the following government agencies: Louisa County Health Department, Virginia Department of Transportation, Louisa County Emergency Services, Louisa County Sheriff’s Office, and Louisa County Community Development. Notification to all agencies shall take place at least one month prior to the event. The applicant shall notify residents, businesses and others likely to be affected by the temporary closing of a section of Kentucky Springs Road during the triathlon. Notification shall take place at least one week before the event. 6. All required County and State permits and approvals shall be obtained prior to any event. This includes any necessary Health Department permit for potable water and/or sanitary disposal. 7. The Planning Commission shall review the CUP after a three-year period to determine whether any changes are necessary. 8. The Board of Supervisors or their designated representative reserves the right to inspect the site at any reasonable time without prior notice. 9. Violation of any condition of this permit shall be grounds for revocation of the Conditional Use Permit. The property is located on the north side of Route 652 (Kentucky Springs Road), east of the intersection with Route 650 (Pottiesville Road). The property is further identified as tax map parcel 62-98, in the Jackson Magisterial and Voting Districts. You will be notified by certified mail of the date and time of the public hearing to be held by the Louisa County Board of Supervisors.
