SAR Scholarship Awardees
If you were fortunate enough to attend our June Main Meeting, you were probably
awestruck by the outstanding accomplishments of our scholarship recipients. Most
of the students selected had at least a 4.0 GPA; one graduated high school with a 4.7
GPA. Grade point average was not the sole selection criterion. Other considerations
were community involvement, extra curricular activities, career goals and financial
need. Many of us left the meeting feeling optimistic about the future, having been
introduced to the talented, committed young people who soon will be positive influences on various aspects of society.
SAR Scholarship Trustees spent countless hours on SAR’s Scholarship Program
this year. Their job included fundraising, reviewing applications, interviewing candidates and selecting awardees. SAR sincerely appreciates the efforts of Chair Perry
Georgallis, Peggy Adams, Nick LaPlaca, Sherri Rubly and Judy Schoer.
This year we also had a group of volunteers who spearheaded the scholarship
fundraising activities. Fundraising Committee Members were Jodi Ash, Sharon
Boatwright, Phyllis Hayashi, Alyssa Lozano, Rico Rivera and Izzy Y-Devine.

Nicholas Boliard is the nephew of SAR Member David Boliard. He is graduating
from Granite Bay High School and will be a double major in accounting and marketing at Santa Clara University. He is receiving a $750 SAR Scholarship.
Ian Schneider is the son of SAR Member Karene Schneider. He graduated from Bella Vista High School in 2010 and is now pursuing a degree
in Rhetoric and Media Studies from Willamette University. Ian is receiving
a $750 SAR Scholarship.
Molly Kearney is graduating from El Camino Fundamental High School. She will
be pursuing a medical career as a Doctor of Osteopathy and will be attending
Northern Michigan University. Molly is receiving a $750 SAR Scholarship.
Dedeshika Alabi-Mensah is graduating from Mira Loma High School
and will be majoring in computer engineering at American River
College. Dede is receiving a $750 SAR Scholarship.
Alexandra Brown is the daughter of SAR Member William Brown. She is graduating from Rio Americano High School and will be majoring in international relations
at San Diego State University. She is receiving a $750 SAR Scholarship.
C.J. Kobliska is graduating from Franklin High School. He is planning
a career as an EMT/firefighter and will be attending Cal Poly San Luis
Obispo. Clint is receiving a $750 SAR Scholarship.
Rebecca Shuey is the niece of SAR Member Sandi Geremia. She is graduating
from Folsom High School and will be majoring in graphic arts at the University of
Nevada, Reno. Rebecca is receiving a $750 SAR Scholarship.
Shen Ning is graduating from Mira Loma High School. She intends
on becoming an anesthesiologist and will be studying medicine at
the University of Southern California. Shen is receiving a $750 SAR
Scholarship.
Ashley Sawyer is graduating from Mira Loma High School. She will be studying
business administration with a goal of running a non-profit organization and
has been accepted to Cal Poly San Luis Obispo. Ashley is receiving a $750 SAR
Scholarship.
Hye Min Jung is graduating from Bella Vista High School. She plans on
becoming a registered dietician and will be studying nutritional science
at Cornell University. Hye is receiving a $750 SAR Scholarship.
Nina Assadi is the daughter of SAR Member Mary Assadi. She is currently enrolled at American River College. Mary will be transferring to
a UC campus in the fall and is majoring in international relations. She is
receiving a $750 SAR Scholarship.
Jon Lang is the son of SAR Member Jamie Lang. He is currently attending Sierra
College. Jon will be transferring to Sacramento State University in the fall. He is
receiving a $750 SAR Scholarship.
Adriana Rodarte-Reynosa is graduating from Del Campo High School. Her goal
is to become a pediatric oncology nurse. She is receiving a $750 SAR Scholarship.
Umna Khan is the daughter of SAR Member Tariq Khan. She is graduating from St. Francis High School and will be majoring in psychology at
George Washington University. She is receiving a $750 SAR Scholarship.
Jessica Pease is graduating from Laguna Creek High School. She plans
on becoming a cryptological mathematician and will be attending Cal
Poly San Luis Obispo. Jessica is receiving a $1,000 SAR Scholarship.
Nola Vlasek is graduating from El Camino Fundamental High School. She plans on
becoming a nurse and attending San Francisco State University. Nola is receiving a
$1,000 SAR Scholarship.
Markus Mar-Lin is graduating from C.K. McClatchy High School. He plans
on studying aerospace engineering and has been accepted to UC San
Diego and the University of Southern California. Markus is receiving a
$1,000 SAR Scholarship.

path by creating the Leadership
Academy program. I won’t say we make
it easy because it’s not. It is intense
and time-consuming. Every year, more
graduates move into positions of leadership by participating in leadership

The mission of the Sacramento Association
The theme of leadership is really
appropriate as we look at three regular
Spring/Summer occurrences at SAR.
First, it’s election time at SAR. We
have excellent candidates running for
the Board of Directors and for officer
positions. Unlike many similar organizations, SAR actually has contested elections. Some years the votes are really
close. The candidates have volunteered
to become leaders and are putting
their time and effort into the campaign.
It’s so great to see the candidates out
campaigning – that helps educate the

newsletter. Just consider than when 34
area students received $38,250 in col-
lege scholarships from the Sacramento
Association of REALTORS® last month,
they joined a group of students reaching back 49 years. Hearing about the
recipients really gives us faith in the
future, with these young people as
tomorrow’s leaders.
They are not the only ones who were
present at that Main Meeting, however.
Our scholarship trustees have demonstrated true leadership over the years,
keeping the program going and actually expanding it through all the ups
and down of the real estate market.
I am always amazed at the way our
Members step up and get involved. I
may be the elected leader this year, but
so many of you are leaders every day.

How long does a potential homebuyer have to wait after foreclosure?
Many factors combine to determine the time
required to elapse.
On conventional loans, the time lapse
must be three years or greater with
these additional requirements: The
property must be owner-occupied; the
loan must be a purchase transaction;
and there must be a maximum loan-tovalue ratio of 90 percent.
The borrower must contribute either
a 10 percent minimum down payment
or the minimum required for the loan
program, whichever is greater with no
gifts allowed.

after seven years, standard loan program guidelines can be followed.
There must be an underwriter’s written analysis fully detailing that the
applicant has re-established an acceptable credit history.
Re-establishing credit requirements after a
major derogatory event
After a bankruptcy, foreclosure, deedin-lieu of foreclosure, pre-foreclosure or
short sale, the borrower’s credit can be
considered to be re-established if the
loan receives an approval or acceptance
from the AUS and the borrower meets
traditional credit history requirements.
In addition, there can be no more
than two 30-day late payments on
installment or revolving accounts during the past 24 months. Past due payments of 60 days on such accounts
are not allowed. No past due housing
payments are allowed and there can be
no new public records of bankruptcies,
judgments or collections.
If the foreclosure was greater than
three years prior to the date of the application, and the risk decision received
from Automated Underwriting Systems
(AUS) is an “Accept”, the loan does not
need manual downgrading and foreclosure documentation is not required.
Be sure to consult with your loan professional on their specific requirements
for your client’s individual scenario.
FHA loans
A borrower whose previous residence
or other real property was foreclosed
on, sold through a short sale, or who has
been given a deed-in-lieu of foreclosure
within the previous three years is generally not eligible.

However, if the transaction is for a second home, an investment or a cash-out
refinance, the elapsed must be seven
years.
If it is determined that the buyer was
involved in financial mismanagement,
the time lapse is also seven years or
longer.
Other conditions apply to deed-in-lieu of foreclosures.
The lapse time is two years from the

Changing from a Great Specialist into a Future Leader
think differently – they will begin to wonder
how the entire organization and its specialists work together. They will begin thinking
several years out and how the components
of the organization will need to change in
order to meet their vision.
A great specialist is key to the success
of any organization. Their work is crucial
to the quality of the association’s performance and must be recognized as such.
A great specialist will ruminate about
their area of expertise, what they need to
learn and how they need to plan in order
to be as good a technician as they possibly
can. Their motivation is to make themselves, and the portion of the organization
for which they are responsible, excel.
A future leader will have the work ethic to
have done so as well. Then they will start to
This inclination to think in broader and
more general terms will create anxiety in
the future leader. After all, they will have
invested time and energy – even made
sacrifices – to become the technician that
they are. Now they need to give up that
certainty in their capabilities and move
from being a specialist to a generalist.
While they have developed a track
record in their specialty, they will have no
idea how to function as a generalist. They
will feel like they are letting go of their
professional identity and entering, with
some insecurity, a position where they
are now dealing more with other people
than with a familiar process. They will give
up the certainty of their end product and
begin questioning what concrete contribution they are actually making.
Yet they are motivated by the conviction that they have something to offer as
a catalyst, a developer of those around
them and a builder of teams.
The specialist can rely on their expertise. The leader can only rely on their
abilities to evaluate, decide and then
persuade others in order to build consensus on a vision for the future.
By assuming responsibility for the
development of others and for the overall direction of the organization, the
leader’s character will be put to the test.
And this is why there is, unfortunately,
some pathology in organizations.
If the leader is insecure to the extent
that they can’t select or work with specialists who are more capable than they
or who challenge them and question
their decisions, then the leader’s lack of
self-esteem will cause strife and even
block the progress of the organization
and its specialists.
On the other hand, if the leader can
leave personal agendas and insecurities at the door, then they can focus on
finding balance among the specialists
to develop them as individuals and ultimately as a team.

appointments on the second Tuesday
of each month. In a half-hour session at
SAR, he helps individual Members with

There is no charge for the sessions,
but it is only available to SAR Members.

Academy
How “involved” are you with your
Association? Do you attend the monthly
Main Meeting? The weekly Regional
Meetings? Maybe some of the educational
opportunities throughout the year? There
are more than a few ways to get more
involved, including serving on the many
SAR Committees and attending SAR fundraisers/events. If you are looking to take
your Membership a step further, the SAR
Leadership Academy is for you.
Interested candidates are required
to fill out an application and questionnaire which are reviewed and selected
by the, Academy Chair and Vice Chair.
This leadership development series was
created to expose SAR Members to the
wide variety of opportunities through
the Association for their personal and
professional development. Participants
will have the opportunity to learn about
the inner workings of SAR and attend
City and County events. Selected candidates are recognized as emerging leaders in the local real estate market. This
requires an 8-month commitment from
the candidates until the completion of
the Academy in December. The requirements of each candidate are listed below.

made a substantial deposit subject only
to Buyer C’s obtaining a mortgage on
terms and conditions not exceeding a
specified rate of interest within 60 days.
REALTOR® A assisted Buyer C by introducing him to officials of a lending
institution, and after processing of his
application for a mortgage, a written
mortgage commitment was made by the
lending institution which met the terms
and conditions of the sales agreement.
However, shortly after the mortgage
commitment was received by Buyer C,
REALTOR® A received a certified, return
receipt-requested letter from Buyer C,
advising that Buyer C had changed his
mind and would not go through with the
sale. REALTOR® A discussed the matter by
phone, but Buyer C said he would rather
forfeit his deposit and definitely would
not complete the sale, even at the risk of
the seller suing for specific performance.

Client B said REALTOR® A told him he had
some unexpected expenses and there-

related and further admitted that he
had not placed the deposit received
from Buyer C into an escrow account,
but had placed it in his general funds.
He said that unexpected expenditures
had caused a deficit balance in these
funds, and he would pay Client B as
soon as he could.
The Hearing Panel concluded that
REALTOR® A was in violation of Article
8 of the Code of Ethics and recommended that the decision, when final,

You have probably met or at least
heard of Perry
Perry Georgallis
Georgallis. He is
hard to miss, especially when there is
money to be raised for scholarships.
He is passionate about education and
firmly believes that these young people
are our future. He is always so excited
about the wonderful young people he
meets while serving as Chair of the
Scholarship Trustees.
Prior to real estate, Perry was a route
salesman with Falstaff Distributing
Company, selling beer. He began his real
estate career in 1957 and went to work
for Milano Realty. He soon convinced
another young man by the name of
Frank Bianchini to go into real estate. In
1974, Perry, Frank and Sophie Ciavarella
left Milano Realty & founded GBC,
REALTORS®. They were well respected
and involved in both their business and
their community. Perry became the sole
proprietor of GBC, REALTORS® in 2000
and joined Lyon Real Estate in 2008.
In his 54 years in this business, Perry
has trained and mentored many agents
to list and market real estate. Among
his many awards and honors he was
named “Mr. Lister” and “Mr. Multiple” for
SAR several times and was named SAR
REALTOR® of the Year in 2005.
On a personal note, Perry is an only
child, born and raised in San Francisco.
He was instrumental in starting the
Greek Food Festival in Sacramento and
continues to volunteer at this event
each year. He belongs to the Masonic
Lodge, Scottish Rite Temple and Ben
Ali Shrine. When he is not listing real
estate, Perry enjoys movies, fine dining
and traveling the world.

CO Detectors Prompt TDS Changes
Effective July 1, 2011 all single family
residences in the State of California,
must have at least one carbon monoxide (CO) detector installed as required
by California Health and Safety Code
Section 17926, et seq. Multiple dwelling units have until January 1, 2013
but a prudent landlord would get the
property in compliance as quickly as
possible. The only exceptions are for
dwellings that are not designed to
burn fossil fuels and do not have an
attached garage.

To advise buyers of compliance with
the law before close of escrow, the Real
Estate Transfer Disclosure Statement
(TDS) was revised effective January 1,
2011. Any non-exempt escrow for a
one-to-four unit residential dwelling
that closed after that date must have
the new TDS form as part of the disclosures to the buyer.
The new TDS has several changes.
1. On page 1, provisions were added
to disclose whether carbon monoxide detectors and/or security gates are
installed.
2. Page 2 contains a statement that
although a CO detector is installed it may
not be in compliance with current code.

3. On page 2 there were two provisions added to satisfy the need for a
seller to certify that the property is
in compliance with smoke detector
and water heater requirements. When
this form is used, a separate disclosure
form is not needed.
4.On page 3 there is a box to be
checked for the broker to refer the
buyer to a separate Agent Visual
Inspection Disclosure (AVID) form for
the broker’s disclosure. A prudent broker would only check that box and
sign the TDS and make all disclosure
comments on the AVID.
C.A.R. is currently sponsoring legislation that would further amend the
TDS effective January 1, 2012. The
purpose here would be to disclose to
potential buyers whether the property is equipped with water conserving
plumbing fixtures as required by separate law effective January 1, 2014 or
later. Watch for info on that legislation
later this year.

Most REALTORS® today have had ample
experience running about town collecting the necessary signatures on paper
documents to complete a real estate
transaction. Recently, and quite quickly,
another method of acquiring those signatures is becoming the new norm. It is
called the electronic signature or e-signature, and already most REALTORS® have
had some experience with them.
An electronic signature is an electronic
sound, symbol or process attached or
associated with a contract or other document and adopted by an individual with
intent to sign. While there are various
types of electronic signatures, a particularly secure type is the digital signature.
In the digital signature, a digital code is
either attached or embedded in the electronic document. It ensures the identity
of the signer and the contents of the document, and prevents alteration through
encryption. Once it has been signed, a
digital document’s integrity, including the
identity of the signer and the contents, is
protected. Current e-signature solutions
that function with ZipForm6 (our on-line
purchase contract forms) include zipLogix
Digital Ink, which is a free benefit to
members of the California Association of
REALTORS®, or DocuSign, which is offered
on a monthly or annual basis via a subscription paid by the zipForm user.
As for legality, both California and federal laws are on the books allowing the
use of electronic signatures, including
those stored on a computer or server, in
real estate transactions. More information
is available in the CAR Legal Q&A entitled
“Electronic Signatures and Records in Real
Estate Transactions.”
It doesn’t take much imagination to realize the advantage for all parties of the electronic signature. It contributes to conserving time, gas, paper, and ink. Documents
requiring multiple signatures are easily
routed to each signer. Transactions can
easily be tracked. Customers’ confidential
information is better protected. Signing
mistakes are reduced or eliminated. The
closing is faster. It’s easier to serve out-oftown clients. It’s state of the art and looks
good to the client.

Recognizing the importance of political involvement to protect our industry at the local, state, and
national level, SAR created a committee in 2009
charged with raising awareness of the importance of
investing in RAF, as well as the political battles we face.
Since this committee began, we have installed a “Wall
of Fame” installed downstairs at SAR recognizing Major
Donors. A fundraising contest was instituted to create
friendly competition between offices to raise money.
And we just hosted the second
annual RAF Spa Retreat
at the C.A.R. legislative
mid-year meetings in
downtown Sacramento.
The

received recognition
for its innovation at the
National Association
of REALTORS® midyear meetings in
Washington DC.
As many people know, supporting the REALTOR® Action
Fund is very important to me.
I believe that no matter what
someone’s thoughts are on
political questions, everyone
in our business should believe
in and support the REALTOR®
Party. Money invested in
the REALTOR® Action Fund is
used to support candidates
for office who believe in private property rights and
other causes important to our industry. This is a
non-partisan effort. We support candidates based on
their merit, not the party letter behind their name.
RAF also supports and opposes issues important to
REALTORS®. Locally, we have worked to expand flood
control throughout Sacramento.

C.A.R. is encouraging participation in the Golden
R program by sponsoring a contest for new and
renewing C.A.R. Golden Rs. Anyone who signs up
before September 22nd will be eligible to win an
Apple iPad, Southwest Airlines Gift Card or Barnes
and Noble Color Nook.
C.A.R. and NAR recently agreed that 2011 would
be the final year to sign up as a C.A.R. Golden R, and
that anyone who signs up, and those who are already
Golden Rs will be grandfathered in as NAR Sterling
Rs and C.A.R. Golden R’s at $449 per year. Beginning
in 2012, to invest in the REALTOR® Action Fund at
this level people will have to join the NAR Sterling
R program at $1,000 per year. The Silver Bear will
be the only remaining Major Donor program at the
California Association of REALTORS® level.
Currently, all C.A.R. Golden Rs also get credit as
NAR Sterling Rs. To become a C.A.R. Golden R takes
an investment of $1,549, followed by $449 to renew
yearly, whereas the NAR Sterling program is $1,000
every year. If you have already paid money to RAF
this year, these amounts could be less. The existing
C.A.R. Silver Bear program is $449 to join and $449 to
renew yearly.
There are some recent and upcoming changes to
the C.A.R. REALTOR® Action Fund Major Donor programs. The C.A.R. Sterling R went through a name
change, and is now known as the C.A.R. Silver Bear.
And, beginning in 2012, the C.A.R. Golden R will be
phased out. Which means now is a great time to sign
up if you have ever considered becoming a Major
Donor.
