Highley, Et Al, in Bath Circuit Court, Division ll, Civil Action No. 09-Cl-90148: and WHEREAs, the Bath Circuit Court entered a Judgment and Order of Sale on 2 October 2009 with the real property subiect to this action being sold by the Master Commissioner of Bath County at public auction; and WHEREAs, said real property was sold on 9 January 2010\nd the Report 2 of Sale was entered on 13 January 2010 by the Master Commissioneriand Wxeaels, an Order were entereci by the Baih Circuit Couri on treu. '{ 2010 confirming the sale and directing the Master Commissioner of Bath county to execute a Deed of conveyance conveying the subject real property to the purchaser, OwtNGsvtLLE BANKING CoupnnY of P.O. Box 575, Owingsville, Ky 40360 NOW, THEREFORE, WrrNEssErH: That the GRANToR for and in consideration of the sum of Ore HUNDRED Sevetw Tttouseto AND No/l00 ($170,000.00) DoLLARS, pursuant to the order of the Bath circuit court, the receipt of which is hereby acknowledged, has granted, bargained, and sold, and by these presents does hereby grant, bargain, sell and convey unto the said GRANTEE, Ownesvtt-le BANKING Cotuperuv, in fee simple, the following described real property located in Ellioft County, Kentucky, to-wit: A certain tract or parcel of land, lying and being in Elliott County, Kentucky and more particularly described as follows: b) located in Elliott County, Kentucky, to wit: Tract l: No. 1 "BEGINNING at a walnut near the branch; thence up the branch with the lsom Adkins line to a willow at the Clyde Lewis line; thence with said line an East course up the hill to a set stone, know as the Clyde Lewis and Emory Adkins corner; thence a straight line down the hill to the beginning corner. Containing six acres, more or less. No. 2 Beginning at two twin peach trees near the branch; thence a straight line down the branch, a North course to a willow marked; thence across main branch a West course with branch to two twin walnuts, marked; thence a straight line to a mulberry standing in the field on top of the point; thence from said mulberry around the flat, a South course to Lee and Wrigley line; thence an East course with said line to a rock; thence around the hill North course to twin Chestnuts; thence down the hill a West course to a Black Oak standing at the head of the drain; thence with said drain to the beginning corner. Containing 20 acres, more or less." Tract ll Based on the North by the lands of A. S. Gibson, bounded on the East by the lands of A. S. Gibson and Hamie lson; bounded on the South by lands of Noah Osborn; bounded on the West by the lands of David Adkins and Will Brickley' and containing one hundred acres, more or less'" The cabin located on the property conveyed herein belonging to Mark Stevens is specifically excluded from this conveyance, and shall remain the separate property of Mark Stevens. Additionally, GRANTORS reserve the right of ingress and egress to and from said cabin, over and through the property herein conveyed, for the use and benefit of Mark Stevens. This Deed is made subject to and to conform to all reservations and exceptions that have been made and set out in previous deeds in related to the mineral rights and all other rights that may be reserved and excepted in any previous deeds. GRANTORS shall retain all tobacco base poundage on this farm, and as such, none of the tobacco base remaining on the real property subject of this conveyance, if any, is hereby conveyed. The above described property is the same property that was conveyed to Mike Highley, a married person, via a deed of conveyance from Marty Stevens and Lois Stevens, husband and wife, said deed being dated August 17,2005, and now Elliott Coun$ Page of record in Deed Book Clerk's Office. -, c) located in Elliott County, Kentucky, to wit: -, A certain tract or parcel of land lying and being in Ellioft of Little Fork Middle of the waters County, Kentucky, on the Sandy River, and more particularly described as follows, to wit: BEGINNING at the mouth of a drain and running North with the Kevin Gilliam property line to a marked hickory tree at the corner; thence in an East direction with the property line of Granville Moore to a stake at the corner of Granville Moore, Michael Highley and this property; thence in a West direction with the meanders of the branch to the mouth of a drain, the point of beginning, containing 44 acres, be the same, more or less. The above description was provided by Donny L. Gilliam and Jose Gilliam, his wife and was accepted by Michael B' Highley and Rita L. Highley, his wife. The above described land is subject to any and all legal and existing easements, including, but not limited to utility easements, if any, affecting same. The above described land is all and the same land conveyed to Michael B. Highley and Rita L. Highley, his wife by deed from Donnie L. Gilliam and Jose Gilliam, his wife, dated March 9, 2006 and of record at Deed Book 103, Page 43' Ellioft County Clerk's Office. The parties hereto state the consideration reflected in this Deed is the full consideration paid for the propefi. The GRANTEE joins this Deed for the sole purpose of certifoing the consideration pursuant to KRS 382. Said conveyance is made by the Master Commissioner only in his official capacity and does not imply any personal liability therefore. This Deed of Conveyance passes, extinguishes and conveys all interest, whether legal or equitable, of all parties to the above-described action. lN TESTIMONY WHEREOF, the said Hon.
