Honored with National
Advocacy Award
The National Consumer Voice honored Margaret
Farley for leadership with the Toby Edelman Legal
Advocacy award. Farley was recognized for the
outstanding advocacy she has performed on behalf
of elders and better quality care. She was honored
at the NCV’s conference in Arlington, VA in
November. For more than three decades Farley has
been a dedicated advocate, providing leadership at
the national and state levels and on behalf of
individual elders harmed by poor care. Farley
pursued better elder care first as a bachelor’s level
nurse, and as both volunteer and executive director
with KABC. She provides leadership nationally on
various work groups, and served as President of
NCCNHR (now Consumer Voice) in the 1990s.
Farley, now a lawyer pursues justice for elders who
have suffered harm due to poor care.

Three long serving ombudspersons Cynthia Bailey, James
Grooms & Phylis Toumberlin retired this year. Two of
three staff positions are filled.

fellow Kansans. She covers Region 7,
southeast KS counties.
NEW - Sue Schuster,
former ombudsperson and long-time
advocate, serves Region 2, northeast
Kansas counties. Sue is excited to again
have the opportunity to work with
residents, families, ombuds volunteers,
and facility staff.
Gina Elliott had served the southeast
KS region. She has been transferred to
serve residents in Johnson, Wyandotte
& Leavenworth counties in Region 3.

The following list represents 64 Kansas nursing homes with 10 or more deficiencies for each of their THREE
most recent inspections. The number of deficiencies cited during the most recent inspection survey are
indicated here. The range in Kansas is 0 to 34 deficiencies. The average number of deficiencies in Kansas
is 8.4, and the national average is 6.8. In addition, those facilities in bold have been cited for actual harm,
immediate jeopardy, and/or deficiencies classified by CMS as “mistreatment” of residents during their
most recent inspection survey. Currently, 345 licensed nursing homes (NF/LTCU/NFMH) provide care in

inspections with zero deficiencies. The number of deficiencies cited on inspections in Kansas range from

Advocacy in Action - December 2015
The ever-growing State budget gap will be Priority
One when the legislature returns to Topeka
January 11. Options for filling the budget deficit
are few: further cuts to State programs vs. raising
revenues through changes in the tax structure.
Since the governor has said he is not interested in
making changes to the tax structure, we can
expect further discussion around cuts to service
programs serving elders, such as Medicaid.
Throughout the process, KABC will advocate for
policies that promote improved health outcomes
and quality of life for Kansas elders and
responsible oversight to assure safe long-term care.
KABC legislative priorities for the 2016 session
include:
1) Advocate for long term care services which
deliver improved health outcomes and quality
of life for older adults.
 Improving nurse staffing levels in nursing
homes remains KABC’s highest priority.
Legislation was introduced during the 2015
session to raise the Kansas nurse staffing
minimum to a safe care standard of 4 hours and
26 minutes to avoid injury, illness and death of
elders. The current standard of 2 hours/per
resident/day, is inadequate and has not been
updated since 1980. HB 2201, remains alive for
2016 in the House Children and Seniors
Committee. Adequate nurse staffing is central
to all indicators of quality nursing home care.
 Kansas ranks among the states with the
highest use of anti-psychotic drugs to
chemically restrain residents with dementia
related behaviors. The high usage of these
drugs is directly related to low staffing, making
it an important outcome measure of quality
care. Kansas is 47th worst in the U.S. in usage
of anti-psychotics drugs on elders.
 KABC stands for adequate funding of home
and community-based long term services and
closely monitors the KanCare/Medicaid
demonstration program. The State’s most

recently published Medicaid Assistance reports
show that 1500-1600 fewer older adults are
being served in nursing homes and at-home
through KanCare than were served prior to its
adoption in 2013. And, this at a time when the
older adult population is significantly on the rise.
2) Advocate for responsible government oversight
of long term care services serving frail elders.
 Vigorous oversight and enforcement of state and
federal laws which govern care in nursing home is
another measure of quality. KABC is raising the
concern of the continuously increasing lag time
between nursing home inspections. The State is
required by law to annually inspect every nursing
home every 12 months on average. The State’s
current average is nearly 16 months. Due to the
State’s tardiness in inspecting facilities, elders in
poor performing facilities suffer poor care and the
facilities avoid making corrections for an
additional four months. This quality indicator,
combined with a chronically understaffed
inspection unit causes serious concerns around
the quality and safety for nursing home residents.
KABC is calling for funding to assure adequate
staff to inspect nursing homes’ compliance with
federal and state law within the required
timeframes. Older residents’ health and safety are
at risk without compliance oversight and
enforcement.
3) Advocate for access to dental and mental
health services for older adults.
 KanCare and Medicare provide for limited oral
health care for adults but does not address the
specific needs of elders such as routine oral care
or for gum disease, maintenance or dentures.
Serious health conditions may occur due to the
lack of care, such as chronic, unchecked, infection
resulting in falls, confusion, delusion,
dehydration and malnutrition from the inability
to chew food.
 KABC works in coalition with mental health
advocates to assure access to affordable mental
health services.

The following information is reproduced from KDADS’ records, and is the most current made available to KABC as of Oct. 30,

Center for Medicare/Medicaid Services (CMS) and does not mean it is imposed or provider agreement’s are terminated. CMS

government does not regulate licensed adult care homes. The following information is reproduced from KDADS records. This listing represents
civil monetary penalties/CMP (fines), bans on admission, license revocation actions, orders of correction/CO and other enforcement proceedings
by KDADS against licensed adult care homes other than nursing facilities, and for nursing homes that are private pay (no Medicare/Medicaid).
