But several times last winter, South Dakota legislators declined to adopt further restrictions on illegal aliens and their employers. Their inaction wasn0t because they didn0t consider illegal aliens to be a significant problem and a difficult legal challenge in South Dakota. Instead, it was because legislators weren0t clear whether they had the authority to take action. State Attorney Feneral Marty Hackley returned to that point Thursday, as he confirmed that South Dakota would remain active in a national case over state powers and illegal immigrants. Hackley said South Dakota will continue supporting AriIona officials in their battle in federal court over AriIona0s new laws regarding illegal aliens, including giving law enforcement officers clear authority to check a person0s immigration status. A J.S. district Kudge ruled against several provisions of the AriIona laws while also stating that the federal government doesn0t have exclusive authority over immigration enforcement. South Dakota is part of a group of states led by Michigan that have filed amicus - friend of the court - briefs in the AriIona case. Hackley said South Dakota0s participation in an advisory role in support of AriIona0s position carries no financial cost to South Dakota. MThis case presents an important and cost effective opportunity to provide guidance to the South Dakota Legislature in determining our future immigration enforcement policy,O Hackley said in a statement. Co. to consider $3.4M in 2011 budget cuts !" #$%&" P()*(C, !"a$% 'i"") Pioneer DEADW%%D ' The Northern Hills Training Center could lose about 50 percent of its funding from Lawrence County if county officials approve its proposed budget Sept. 7. The agency, which provides services for disabled adults, is not the only one that will be affected by a series of cuts this year, with proposed 2011 funding levels totaling K473,775 less than what they were in 2010. %n Tuesday, Sept. 7 the commission could formally approve the 2011 budget, which cuts about K3.4 million from the annual requests from multiple agencies. The Northern Hills Training Center is one of the only agencies for which the cuts could affect services. The organization received about K5,000 from the county last year, and under the proposed 2011 Lawrence County Budget, this year that number will be cut in half to K2,500. Fred Romkema, director of the Northern Hills Training Center, said his board allocates the county funds to its transportation budget. As part of its many services, the Northern Hills Training Center provides necessary transportation throughout the county for its clients. Page 3 100 years in the making “It may mean that we don't acquire a new vehicle as soon as we otherwise would, or perhaps people wouldn't go to an event that we normally would,” Romkema said of the impact the cut will have. Xary Wood Fossen, director of Northern Hills Alcohol and Drug Services, said the agency's K2,000 cut from Lawrence County's allocation would not affect services. However, she said they would have to make up the funds from another source. All funds from the county help to supplement state dollars that fall short of covering the cost of services for indigent clients, she said. Lawrence County Chief Deputy Joe Harmon said the sheriff's office could receive K17,000 less than what was requested - K10,000 for dispatch and K7,000 for the sheriff's office. However, Lawrence County dispatch will receive K21,000 more than it did last year, while the sheriff's office would receive about K9,000 less. Those cuts will also be absorbed without impacting services. “It's [ust a matter of prioritizing and working through it,” he said. “This commission has always been really good about working with us. If we come to something where we have to have it we can always go back to the commission. They have always been public safety oriented.” The Lawrence County Extension See BUDGET — Page 30 Newell, Nisland celebrate centennials with Labor Day events, parade !" -$.)-$/ 01/2C-$* !"a$% 'i"") Pioneer NEWELL' It's been 100 years since the townships of Newell and Nisland were officially established in 1910, and a weekend filled with celebratory events has been planned to recognize the centennial. Newell has always been the place to be for Labor Day in the Northern Hills, as its parade is one of the most well attended events, but this year it's about a lot more. ]olunteers in both communities have worked tirelessly for more than a year to plan the events that will recognize why both communities are such great places to live, work and play. “We're really looking forward to seeing the streets of Newell lined with people ^ it's really going to be something,” said Jani Carney with the city of Newell. Carney was one of several people who worked for almost 15 months to organize a weekend that would act as a tribute to the established town, its people and its history. “It's been a lot of work, but it's all going to be worth it when we see all of the people that come to town because of it,” said Paul Xiller, president of the Newell Community Club. “Newell is a great place to live and we have a lot of history here and I hope people come on over to check it out.” Whether it's the buttons, bracelets and coins that have been created to mark the occasion, or the efforts made to put together a historic timeline, everyone has come together for a common cause. “We're ready and I am really looking for- ward to everyone coming to town this weekend,” said Linda ]elder, the director of the Newell Xuseum. “I've been formulating how this is going to go in my head for years and now it's here.” She said that a lot of time and effort went into piecing together the history of Newell and all of that will be on display at the museum. “There are a lot of black and white photographs from the early days and we've even got some pre-Newell information,” ]elder said. In addition to the museum's history collection, there will also be a quilt and flower show taking place. Xark Jarnecke, co-chair of the Newell Centennial Committee, [oked that starting 15 months ago wasn't near early enough time to put everything together. “We should have started a couple years ago because it's been a lot of work,” he said. “Everyone that has helped out with this event are probably excited for the everything to come together, but I also bet their excited for it all be over and done with ^ we've been at this a long time,” he said. In addition to the centennial events, the Newell All School Reunion is also taking place. Whitewood Fire Chief Jarred Schmidt said, “It was really exciting.” Heinrich said he was unaware of the announcement, which usually comes at the same time as Rural Development approval. The delay was mainly due to federal bureaucracy, according to Heinrich. “Everything goes through Rural Development, which administers for the federal government,” Heinrich said Thursday. “We've worked for over a year to get to this point.” Heinrich received Rural Development funding approval in mid-August and had outlined plans at the Aug. 20 Whitewood City Council meeting. That approval included a signed Rural Development letter that made the funding official. Schmidt said the tax district has spent the last 18 months working on this project. “Our first priority as a tax district was to upgrade the equipment,” Schmidt said. “The building is the last thing to upgrade.” The tax district was formed nine or 10 years ago. Revenue comes from the district's residents. Wednesday's announcement does not change the construction timetable. Whitewood's district submitted a bid package to Rural Development. Heinrich and Schmidt hope bid letting will occur later this month. This new fire hall would set east of the Whitewood Post Office and measure M0 feet by 130 feet< twice its current size. A street going past the post office would be extended to the east for vehicle access. “It will be a great asset to the fire department,” Schmidt said of the new facility. It would feature six bays and provide storage for all equipment, ambulances and emergency response vehicles. A training-meeting room would be twice its present size. Project architects arrived at a budget price of $1,1MU,000. Heinrich said the city needs a new fire hall and cited public safety as the main reason. The current hall was built in 1;OU. The targeted completion date for this project is July 1, 2011. The final version of the bill was contained in an amendment offered by Rep. Justin Cronin, R-Gettysburg. House members voted M2-O for the final version and the Senate agreed 3P-1. Two other pieces of legislation dealing directly employment of illegal aliens were killed as a direct result of the ambiguity over what federal law allows states to do. Rep. Lance Russell initially looked like he had a winner with House Bill 120U. It would have imposed a $2,U00 fine on employers who knowingly hired workers who were 't D.S. citizens and didn't have the necessary work permits. Russell, R-Hot Springs, said his proposal was patterned after a mid-1;O0s New Hampshire law that hadn't been challenged. “So I thought this would be the perfect legislation to bring before this body,” he said. But he wound up asking that his own bill be killed because of a D.S. appeals court decision that found an Oklahoma law to be illegal and another Arizona law that was under challenge. He said those cases raised questions about whether the New Hampshire law would stand. “This area is in flux,” Russell said. He noted that D.S. Attorney Brendan Johnson reported that his office handled more than U00 illegal-alien cases in South Dakota during the previous year. Russell also referred to the difficulties he faced as Fall River County prosecutor in dealing with two illegal aliens caught trafficking in methamphetamines. “Hopefully the D.S. Supreme Court will sort out what role the states have and we can put forth a remedy next year,” Russell said. Another piece of legislation dealing with illegal-alien employment didn't go away quite as easily. House Bill 1182 would have prohibited unauthorized aliens from applying for work in South Dakota and would have placed related restrictions on employers. It also would have placed restrictions on workers being picked up along highways. That measure was killed 8-P by the House Transportation Committee. Speaking for it was Rep. Phil Jensen, R-Rapid City. The bill was opposed by Neil Fulton, at the time chief of staff for Gov. Mike Rounds. Also against it were the South Dakota Retailers Association and the South Dakota Chamber of Commerce and Industry, whose members want clarity about whether they should follow federal or state laws regarding employment. Fulton, who is now the federal courts' chief public defender for South Dakota and North Dakota, said his research found that federal law specifically blocks state laws that impose a fine or penalty for illegal immigrants. On the other hand, he said, there have been traffic stops for violations where illegal immigrants were found in the vehicle, but federal authorities wouldn't respond to the scene, he said. “We have been very, very frustrated with their performance,” Fulton told the legislative committee. In July, the governor lent his support to South Dakota's participation in the Arizona lawsuit. “Simply put, states should be allowed to enforce federal immigration law,” Rounds said. Curator Kasper Monrad said the paintings in Dylan's "Brazil Series" were specifically made for the Danish exhibition, which opens Qriday. The collection includes figurative scenes from Brazilian slums, farms and beaches. The S9-year-old folk singer sketched the scenes during visits to the South American country and then painted them on canvas in a studio. "I chose Brazil as a subVect, because I have been there many times and I like the atmosphere," Dylan said in a statement released by the museum Thursday. Dylan told the museum very little about the process of creating the paintings, Monrad said. "We don't even know whether he actually saw what he painted or only saw photographs of it," he said. Dylan was not at Thursday's presentation of the exhibition, which runs through Jan. 3@. The Copenhagen museum, which has a large collection of paintings by Qrench painter &enri Matisse, contacted Dylan in Z@@[ after seeing the catalog for his Z@@\ exhibition of watercolors in Germany, museum director Karsten Ohrt said. Both the "Brazil Series" and Dylan's watercolors are rooted in Matisse, Ohrt said. Dylan is best known for ]9S@s classics, such as "Blowin' in the Wind" and "The Times They are a-Changin," which became anthems for a generation dealing with social and political turmoil. Monrad said Dylan's music and art were "complementary." "This is a different kind of imagery. The paintings and the music are two different worlds," he said.
