An Act to amend the Racing and Betting Act 1954-1977 in
certain particulars
[ASSENTED TO 8TH JUNE, 1978]
BE IT ENACTED by the Queen's Most Excellent Majesty, by and
with the advice and consent of the Legislative Assembly of Queensland
in Parliament assembled, and by the authority of the same, as follows:1. Short title and citation . (1) This Act may be cited as the
Racing and Betting Act Amendment Act 1978.
(2) The Racing and Betting Act 1954-1977 is in this Act referred
to as the Principal Act.
(3) The Principal Act as amended by this Act may be cited as the
Racing and Betting Act 1954-1978.
2. Commencement.

This Act shall commence on a date appointed

3. Amendment of s. 36. Section 36 of the Principal Act is amended
by, in subsection (1), inserting after paragraph (b) the following
paragraph:L4
(c) in the Local Authority Area of the City of Mackay but subject
to the prior approval of the Minister and the Board having
been applied for and obtained, on any day other than a day
(not being a Sunday or Christmas Day or Good Friday) not
specified in subparagraph (i), (ii), (iii), (iv) or (v) of paragraph
(b) on which the registered club for special reasons satisfactory
to the Minister considers a race meeting for trotting horses
should be conducted ".
4. Amendment of s. 65 . Section 65 of the Principal Act is amended
by(a) inserting after subsection (1) the following subsection:" (IA) There shall be levied and charged additional totalisator
tax at the rate of 2 per centum of all moneys to which subsection (1)
applies, paid into a trifecta totalisator or trio totalisator.";
(b) inserting after subsection (3) the following subsection:" (3A) There shall be levied and charged additional totalisator
tax at the rate of 2 per centum of all moneys to which subsection
(3) applies, paid into a trifecta totalisator or trio totalisator.".
5. Amendment of s. 66. Section 66 of the Principal Act is amended
by(a) in subsection (2), in paragraph (a), omitting the words " five
shillings." and substituting the following wordsL[
(i) in the case of investments on a win totalisator or place
totalisator, $1;
(ii) in the case of investments on a totalisator other than a win
totalisator or place totalisator, 50 cents or such multiple
of 50 cents as the Minister in a particular case approves.";
(b) in subsection (4),
(i) in paragraph (a), omitting the words " not less than fifty-five
cents for each unit of his investment " and substituting the words:61
(i) on a win totalisator or place totalisator, not less than $1.05 for
each unit of his investment where the unit is $1;
(ii) on any other totalisator, not less than 55 cents for each unit
of his investment where the unit is 50 cents and where the
unit of his investment is a multiple of 50 cents, 55 cents for each
50 cents of the unit ";
(ii) in paragraph (b), omitting the words " fifty-five cents " and
substituting the expression " $1.05 or, as the case may be, 55 cents ";
(iii) in paragraph (c),
(A) omitting the words " fifty-five cents " and substituting the
expression " $1.05 ";
(B) omitting subparagraphs (i) and (ii);
(C) in the proviso, omitting the words " fifty-five cents " and the
words " fifty cents " and substituting in each case respectively the
expressions " $1.05 " and " $1 ";

(iv) in paragraph (d),
(A) omitting the words " fifty-five cents " and substituting the
expression " $1.05 ";
(B) omitting subparagraphs (i) and (ii);
(C) in the proviso, omitting the words " fifty-five cents " and the
words " fifty cents " and substituting in each case respectively the
expressions " $1.05 " and " $1 ".
6. Amendment of s. 69. Section 69 of the Principal Act is amended
by, in subsection (3)(a) omitting the words " win only totalisator, a place totalisator,
a quinella totalisator, a doubles totalisator or a forecast totalisator "
and substituting the word " totalisator ";
(b) omitting the words " any of such totalisators " and substituting
the words " that totalisator or any other totalisator ".
7. Amendment of s. 74. Section 74 of the Principal Act is amended
by, in subsection (1), in subparagraph (f), adding after provision (i) (B)
the following provision:(C) an event or contingency whereon the Governor in Council
(who is hereby thereunto authorized) has, by Order in Council,
authorized bets to be made by a bookmaker in the course of
carrying on the business of or acting as such at a race meeting
on such racecourse; ".
