The Waihora, or more recently renamed, Focus Goudies Romney flock has been in operation for 40+years and is a pure Romney flock. The ‘genesis’ of this flock was based on the collective foresight of Landcorp and their precursor (NZ Lands and Survey), Dr Geoff Nicoll and other key personnel. The operation has been and continues to be in the very capable hands of Goudies Station manager, Ken Burt. The driving objectives of this flock are: Highly efficient and profitable sheep production Facial eczema tolerant sheep Performance in varied and often challenging farming environments Nationally spread Scientifically driven to guarantee objectively assessed progress Continually reviewed to ensure current and future industry requirements are proactively implemented (NB: this is done by independent review/audit) The Focus Goudies Romney rams supply the basis for NZ’S largest North Island commercial Romney ewe flock of approximately 220,000 breeding ewes (Landcorp). These genetics have been widely and successfully used by farmers for many years across New Zealand. Dr. Richard Lee Sheep and Deer Programme Manager Focus Genetids 3 Selection Process The rams put up for sale today are from a group of 2774 ram lambs born in 2014. They have been run as a common group of ram lambs, hoggets and rising 2ths until 1 st October. They have undergone full and comprehensive recording for 98+ % accurate parentage via DNA and are recorded at the highest level to fulfil all SIL requirements for a SIL registered Dual Purpose Maternal flock. These rams are from the very highest level of SIL Dual Purpose Overall (DPO) Index, within flock and within cohort that are commercially available at Goudies. Specific selection points for this group of rams Many of these rams are ranked (within flock) at the similar level as our selected sire keepers. The reason that they have become available is via full or half sibling relationships. All rams catalogued are from sire and grandsires that were Facial Eczema tested and all rams have half-siblings that have been Facial Eczema tested. Some of the rams have Sheep5K information available. All rams catalogued have undergone full genotypic selection on DPO index firstly and close phenotypic scrutiny secondarily. Health All of these rams (and all rams available for sale from Goudies) have undergone and passed: Physical selections throughout the year for functionality Full pen ambulatory selection to view conformation, structure and mobility Full conveyor selection to view all 4 feet and soles, mouth, jaw, teeth and genitalia All rams are from an accredited Brucella Ovis flock All rams have a full and historically documented Anthelmintic Resistance status where all drench families are effective i.e. > 95% efficacy All rams are fully vaccinated for Clostridial disease including C.sordellii All rams are quarantined drenched on exit with a new active Anthelmintic as a client service All rams are guaranteed free of footrot at time of sale. There has been no footrot detected in annual hoof examinations of every sale ram Guarantees All rams sold are fully guaranteed for any proven genetic defects or genetic issues that may appear on the provisions of a veterinary certificate provided by the purchaser. Claims for potential ‘genetic issues’ must be registered within 12 months of purchase. All rams are guaranteed fertile at the time of purchase and for the following 6 months. This effectively covers ram fertility up to 1st mating or 1st May 2016 whichever comes first. In the event of proven infertility via a veterinary certificate provided by the purchaser, Focus will provide a ram of similar genetics to cover imminent mating requirements. If the infertility is permanent and arises within this 6 month period then a full replacement or credit will be provided. No cash refunds will be provided. All rams will be sold Footrot and Ovine Interdigital Dermatitis (scald) free. NB: All purchasers are recommended to insure their purchases for death or misadventure. FMG are available on-farm to provide insurance facilities. Please speak with the representative on the day. 4 Ram Selection Using Data and Index How are breeding values derived? An animal’s genes determine its true genetic merit for any given trait. This genetic merit reflects the animal’s genetic value as a parent and this is passed onto its offspring. We can never know exactly what the true genetic merit is. Actual records on an animal only show the end effects of the many interactions between its genes plus the multitude of environmental influences experienced by the animal. However, we can estimate an animal’s true genetic merit – calling it an Estimated Breeding Value (eBV). To calculate an eBV, the statistical procedure looks beyond the animal’s own performance. Most eBV analyses are based on an animal’s individual performance, the performance of all its relatives (sire, dam, half-sibs, grandparents etc), and if available, the performance of any progeny. The more data, the more accurate the eBV. Basically, the performance information is statistically adjusted for non-inherited effects such as age at recording, birth rank, etc, and then the BV-estimation software is run to calculate the trait eBV. Industry recording systems do this automatically in their BV-estimation software – SIL for sheep (Sheep Improvement Ltd), DEERSelect for deer, and BreedPlan for beef cattle. eBV’s are expressed in the units of the trait they relate to. For example, an eBV for weaning weight in sheep is expressed in kg (eg, +7.3 kg or -1.26 kg). The positive or negative sign relates to an arbitrarily assumed “base” year of the eBV analysis, where the BV is set to 0.0. It’s against this base that every animal is compared. In most cases, the base year is at least 10 years previously. Genetic Trends 5 Facial Eczema Programme Overview The Goudies Romney stud has been using the official national FE tolerance testing programme Ramguard for 20+ years. This has been driven by Landcorps’ requirement for a genetic solution to widespread FE in upper north island sheep flocks. Genetics, as opposed to management solutions and risk mitigation, was the option of choice providing certainty around additive and incremental gain in tolerance, and the peace of mind in knowing that disease protection was there when challenge was unclear. Vigorous selection, testing ram hoggets, spread over a large number of sire groups so not all from one family line, testing in late summer prior to that years mating so that those ram hoggets with the best results could be used that year, use of genetic predictions as EBVS to select these new sires (as opposed to actual test results which is a less accurate genetic predictor) have all combined to ensure that the Goudies Romney FE programme is delivering the very best FE tolerant genetics in New Zealand. This fact has been reinforced with regular first placings and finalist nominations in the Beef+Lamb Genetics New Zealand Sheep Awards. Annually there are 150 plus rams tested at Goudies. Current sporedesmin test levels /dose rate is 0.6mg/kg. This is FE GOLD level. 6 Performance Data Glossary DPO Index The rams in the catalogue are listed on the SIL Dual Purpose Overall Index (DPO). GGT eBV FE tolerance is expressed with the GGT eBV and is related to the GGT response 21 days after the sporidesmin dose (the smaller the GGT response is, the better). Therefore, a good eBV for FE is a negative one, i.e. the more negative the value the more FE tolerant the animal. GGT eBVs can range from -1.05 to +0.55 and is expressed in IU/L. FE Tested Each year 5-6 ram hoggets per sire are tested (total of 150 ram hoggets across 12-15 sires), which means the sires are progeny tested. All the rams in this catalogue have been either FE tested as an individual or 5-6 of their half-siblings have been tested. In addition, all the sires and grandsires of these rams have undergone FE testing. The eBV for FE takes this information of FE testing of the individual, all its half-siblings, sire, grandsire and other relatives into account. Thus, even if a ram might not be tested himself, his FE eBV is still very accurate due to the fact his half-siblings and other direct relatives have been tested. 5K This season, 200 of the top ram hoggets have been Sheep5K to derive molecular breeding values (mBV). Sheep5K uses 5000 DNA markers to generate mBVs for up to 22 traits. The mBVs in combination with eBVs enable us to make more accurate decisions for ram hogget selection in our breeding programme. NLB eBV Numbers of lambs born is an indicator of the reproductive performance of adult ewes and is based on pregnancy scanning data. A good eBV for NLB is a large value and is expressed in lambs. Dam NLB History Dam NLB history is based on the dam’s actual pregnancy scanning data during her life time. For example, “.21” – means that the ewe was not mated as hogget (“.”), had twins as 2-tooth and single as 4-tooth or e.g. “0.21” – means that the ewe was mated but barren as hogget, had twins as 2-tooth and single as 4-tooth. WWT eBV Weaning weight of the lamb is a good predictor of growth from birth to weaning. This eBV is expressed in kg and a good WWT eBV is a large value Carcass weight of the lamb is also a predictor for growth of the lamb post-weaning. Carcass weight is derived from live weight of the lamb at 6 or 8 months of age. This eBV is expressed in kg and a good CW eBV is a large value. CW eBV EWT eBV Adult live weight of an ewe (the potential replacement) is related to growth. Many of the genes that make lambs grow faster also make adult sheep bigger. Therefore the aim is to keep ewe size “under control” and a good eBV for EWT is a smaller value and is expressed in kg. FW12 eBV Fleece weight is based on the fleece weight of the animal around 12 months of age. This eBV is expressed in kg and a good FW12 eBV is a large value. 7 Focus Genetics Standard Terms of Sale TERMS OF SALE These Terms of Sale and any additional terms on any applicable Livestock Sale Docket, sale or delivery note, receipt, invoice or other relevant document prepared by Focus in relation to any sale apply to the supply of Goods by Focus, whether such sale is completed by written agreement, electronic record or oral communication unless stated otherwise by Focus. 1. DEFINITIONS 1.1 “Focus” means Focus Genetics Limited Partnership and includes each of its subsidiaries. 1.2 “Goods” means all goods, livestock and services, and is deemed to include all goods, livestock and services described or referred in any invoices, statements or other records prepared by Focus (and the description or details set out or referred to in any such records). 1.3 “Purchaser” means the Purchaser, any person acting on behalf of the Purchaser, or any person purchasing Goods from Focus. 2. APPLICATION 2.1 Terms of Sale: By placing an order for the purchase of Goods from Focus, the Purchaser acknowledges and accepts these Terms of sale. 2.2 The Purchaser cannot cancel any purchase order for Goods accepted by Focus and is bound to pay the quoted price. 3. TERMS OF PAYMENT 3.1 Unless Focus specifies otherwise, the purchase price and any commission and associated charges, plus GST, must be paid by the Purchaser to Focus as follows: A. Livestock and grazing; within 14 days of purchase; B. Other Goods; within 14 days of invoice date. 3.2 All amounts payable to Focus shall be paid in full without any set-off or deduction. 3.3 Any “Buy Now” price will be forfeited to the list price if the Goods purchased at the “Buy Now” price are not paid for by the due date. 3.4 Interest on overdue payments may be charged from the time of purchase on a daily basis at the rate of 1.5% (one and one h alf percent) per calendar month. 3.5 Focus may in its discretion allocate any payment received from the Purchaser towards any invoice that focus determines and may do so at the time of receipt or at any time afterwards and on default by the Purchaser may reallocate any payments previously received and allocated by Focus. In the absence of any express allocation by Focus, payment shall be deemed to be allocated in such manner as best preserves the maximum value of focus’ security interests in goods supplied by it to the Purchaser. 4. PERSONAL GUARANTEE OF COMPANY DIRECTORS OR TRUSTEES 4.1 If the Purchaser is a company or trust, then in consideration of Focus entering into this agreement at the request of the directors of the company or the trustees who sign this agreement (“the Signatories”), the request for which the Signatories acknowledge, the S ignatories also enter into this agreement in their personal capacity and jointly and severally personally undertake as principal debtors to Focus the payment of all monies now or hereafter owed by the Purchaser to Focus and indemnify Focus against non-payment by the Purchaser. To avoid doubt, the Purchaser and the Signatories are jointly and severally liable as principal debtors under the terms of the agreement and for payment of all sums due hereunder. 5. RISK AND DELIVERY 5.1 All Goods are at the Purchaser’s sole risk in all respects: A. In the case of livestock, upon crossing the tailgate of the Purchaser’s carrier; and B. In the case of other Goods, from the point of loading on to the carrier or Purchaser’s vehicle. 5.2 Focus shall be in no way liable for any delay in the date of delivery of any Goods. Where the Purchaser does not take delivery of the Goods by the delivery date specified, the Purchaser shall pay reasonable grazing or storage costs until such time as the Purchaser uplifts the Goods. 6. SUPPLY FOR BUSINESS PURPOSES 6.1 The Purchaser agrees that where any Goods are acquired for the purposes of a business the Consumer Guarantees Act 1993 will not apply. 8 Focus Genetics Standard Terms of Sale 7. FOCUS’ LIABILITY 7.1 Breeding rams are fully guaranteed to remain alive until the earlier of three months post-delivery or the date on which the ram first mates with one of the Purchaser’s ewes. Breeding rams are fully guaranteed against any Genetic faults that are discovered within twelve months of delivery. 7.2 If a ram dies or displays a genetic fault within the guarantee periods outlined in clause 7.1 then, upon provision by the Pur chaser of a veterinary certificate Focus will credit the Purchaser’s account to the value paid for the ram. 7.3 Breeding bulls are fully guaranteed against any faults in the bull’s disposition or Genetics that are discovered within t hree breeding seasons. If a bull has a Genetic fault then compensation by way of credit against the Purchaser’s next purchase from Focus will be given. The quantum of compensation will be reasonable, taking into account the number of seasons it has done less the salvage value of the bull. 7.4 Any compensatory credits issued pursuant to clause 7.3 will be at dollar values as opposed to unit value. Once a credit has been approved it will sit in Focus’ system to be offset by the Purchaser’s next purchase. 7.5 No cash refunds are given. 7.6 Focus’ maximum liability under this clause 7 shall never exceed $25,000.00 in relation to any one animal. 7.7 Focus does not warrant that it will provide the requested quantity of Goods. The acceptance by Focus of an offer to purc hase a quantity of goods is an agreement to provide such quantity not exceeding the requested quantity as Focus can reasonably supply. Focus is not liable for any shortfall and the Purchaser must take delivery of and pay for the lesser quantity that Focus is able to supply. 7.8 Focus shall not be liable for any direct or indirect loss or damage (including, without limitation, loss of profits or savings or for any indirect or consequential loss or damage), however caused, arising out of or in connection with the supply of Goods by Focus, exc ept as is set out in clause 7. 7.9 No action, including but not being limited to a claim for compensation under clause 7, arising out of the supply of Goods by Focus, may be brought more than six months after the Purchaser becomes aware, or reasonably ought to have become aware, of the circumstances giving rise to the claim, regardless of the form of the action or claim. 8. INTELLECTUAL PROPERTY 8.1 The Purchaser agrees and acknowledges that Focus owns all intellectual property associated with the Goods sold under this agreement. The Purchaser will not do anything which may prejudice or infringe Focus’ intellectual property in the Goods. 8.2 The Purchaser acknowledges that all goodwill resulting from the Purchaser’s use of Focus’ intellectual property in the Go ods and/or any of Focus’ trademarks shall accrue solely for the benefit of Focus. 9. RETENTION OF TITLE AND THE PERSONAL PROPERTY SECURITIES ACT 1999 9.1 Ownership of and title to all Goods shall remain with Focus and not pass to the Purchaser until they are paid for in full in cleared funds. 9.2 Until title passes to the Purchaser the Purchaser shall hold the Goods as Bailee of Focus. 9.3 The Purchaser grants to Focus a security interest in all Goods supplied or to be supplied by Focus to secure all payments under these Terms of Sale. The Purchaser will do all things necessary for Focus to register a financing statement and to ensure the secu rity interest is a first ranking perfected security interest over the Goods and their proceeds. Focus may at its sole discretion register a sec urity interest on behalf of Focus (where it is acting as agent). 9.4 Nothing in sections 114(1)(a), 117(1)(c), 133 or 134 of the Personal Property Securities Act 1999 (PPSA) applies. The Pu rchaser’s rights in sections 116, 119, 120(2), 121,125 to 127, 129, 131 and 132 of the PPSA do not apply. 9.5 The Purchaser gives irrevocable authority to focus to enter any property occupied, in whole or in part, by the Purchaser, or on which any Goods supplied by Focus to the Purchaser are situated, at any reasonable time after default by the Purchaser, or before defau lt if Focus believes a default is likely, and to remove and repossess any Goods. Focus shall not be liable for any costs, damages, expenses or losses incurred or assumed by the Purchaser to any third party as a result of this action, nor liable in contract or in tort or otherwise in any way whatsoever unless by statute such liability cannot be excluded. The Purchaser indemnifies Focus and its agents for all costs and liabilities incurred in connection with the repossession, grazing, storage and/or resale of the Goods (including any shortfall from resale at a lower price). 9.6 The following shall constitute defaults by the Purchaser: A. Non-payment of any sum by the due date. B. The Purchaser intimating or threatening that the Purchaser will not pay any sum by the due date. C. Any Goods are seized or the seizing of them is threatened by any other person. D. The Purchaser is bankrupted, put into receivership or liquidation, enters into voluntary administration, or makes a compos ition with the Purchaser’s creditors. 9.7 Any material adverse change in the Purchaser’s circumstances. 10. MISCELLANEOUS 10.1 Enforcement: The Purchaser will pay Focus on demand all costs (including legal costs on a solicitor/client basis) incurr ed by Focus in connection with any default by the Purchaser. 10.2 Entire agreement: These Terms of Sale (and any incorporated document including any formal credit arrangements) are the entire agreement between the parties, and replace all representations, agreements and other communication made by Focus. 10.3 No waiver: Focus shall be deemed not to have waived any right to do anything unless that waiver is in writing and signed by an authorised manager in Focus. 10.4 Severability: If any part of these Terms of Sale is illegal, unenforceable or invalid, that part is to be treated as modified or removed to the extent required to make it effective.
