Evidence of climate change stronger than ever
Experts say the evidence is stronger than ever that
climate change is happening, and it comes with devastating
consequences for Ohio and the rest of the country. According
to a new draft of the National Climate Assessment, which was
recently the effects of climate change, including extreme weather events, are becoming more apparent. Former White House
director of Climate and Energy and EPA administrator Carol
Browner says those impacts will increase as global emissions
continue to rise. “This new assessment really confirms what the
scientists have been telling us and what our eyes are telling us.”

State Sen. Nina Turner was recently appointed
to the Ohio Ballot Board which is responsible for the presentation of content for referendums and other ballot issues.
The board is chaired by Ohio Secretary of State Jon Husted.
Turner will replace fellow Democrat Fred Strahorn, and her
four-year term will begin on February. 5. The ballot board is
responsible for certifying ballot language for proposed constitutional amendments and referendums. Turner, has been a
vocal proponent for voting rights and a critic of GOP-supported election reform legislation.

Report on chase due

Black on Black Crime, Inc. held a vigil on Monday, January 7, at Well Fashion clothing store, 14303 Kinsman Road, for owner Abou Kane, 54 years old, who was shot and killed on Saturday, January 5, during a robbery
attempt. Family members and friends have set up a memorial site in front of the store with candles and different
stuffed animals to honor the memory of Kane. Kane owned and operated the clothing store for eight years. According
to Kane’s brother Ismael Kane, arrangements are being made to ship the body to Senegal where his family will bury
him.

Inc. held a vigil on Monday, January 7, at Well Fashion clothing
store, 14303 Kinsman Road, for
owner Abou Kane, 54 years old,

home,” said his brother, Ismael

According to Ismael
Kane, the store is closed and no
suspects have been arrested for
the crime. A make-shift memori-

adorn the locked storefront.
Art McCoy who heads
Black on Black Crime, Inc. is
seeking justice for Kane who
owned and operated the clothing
store for eight years. According
to McCoy, Kane had worked as a
street vendor at various street festivals before being able to open
his own business.
“ The sad part of it is that
he (Kane) like so many Africans
fled their homeland and immigrated to America, the land of the
free, land of the brave, for a better
life. It is a tragic ending,” McCoy
said.
Kane was the second
homicide followed a few hours
later by Brian Wilson, 41, who was
found fatally shot at 4067 East 67th
St.
Nathan Brown, 42, who
was found shot to death at 10101
Hilgert Ave. two hours after the
start of the New Year was the first
homicide of 2013.
All three men were killed
by guns. According to the FBI,
there were 97 homicides in Cleveland in 2012, and 93% of the homicides involved gun violence.
A Chagrin Falls man,
Thomas Thomas, died as a result of
a car accident at Harvard Avenue
and East 155th Street. He was the
first vehicular homicide in 2013.
East Cleveland lays - off police officers

Unless East Cleveland
City Council restores the 1.2
million that they voted to cut
from the police budget, Mayor
Gary Norton has been forced to
layoff 10 police officers and 10
dispatchers/ records clerks.
Slashing the police
budget by more that 25% will
result in the loss of the warrant,
traffic, and narcotics investigation units.
According to Norton,
the loss of the warrant and traffic
units will cost the city more than
$700,000 in revenue from court
fees and fines.
The layoff will leave
only 4 of 14 officers on the
streets. Norton said that the police layoffs would have a ripple

When Norton took office
in 2010, State Auditor David Yost
notified him that the city was $5.8
million in debt from the previous
administration.
Norton was able to pay
that debt partly with the funds
from the Cleveland Clinic funds.
East Cleveland City
Council members and the mayor
are blaming each other for the financial problems that face the city.
The city layed-off 38 police officers in 2011 due to budget
cuts.
According to the 2012
Census, the population of East
Cleveland is 17,843.

Tuesday, Cleveland Police Chief
Michael McGrath and Public
Safety Director Martin Flask
reassured residents that a review
of the use of deadly force by
Cleveland police officers is under investigation.
A report on gun residue
is due to be released at the end of
the month to answer questions
as to what happened the night
of November 29, when a highspeed Cleveland police chase
ended in the deaths of Timothy
Russell, 43, and Malissa Williams, 30.
The Bureau of Criminal Identification is assisting
local law enforcement departments to determine why the police chase that allegedly began
when Cleveland officers heard a
gunshot outside the Justice Center ended with officers firing 137
rounds into the car killing both
passengers.
Dorothy Sigelmier, the
aunt of Malissa Williams, wants
answers, and she said that the
family has hired attorney Tyron
Reed.
“There was no gun, no
shell casings. There was no reason for her to die like this. She
(Malissa) was buried on December 15 and we still have no
answers why this happened,”
Sigelmier said.
Donald Williams and
Paul Ctristallo are representing
the Russell family.
According to attorney Donald Williams, the family is waiting and wanting the
premilinary report by the Cleveland police.
“ We would hope that
there are no questions left unanswered. We hope that the hands
and the clothing are tested.” he
said.

There is some speculation
that an undercover vehicle in the
area may have been following Russell, but Cleveland police have not
confirmed the story.
Michelle Russell, the sister of Timothy Russell, did not believe that her brother had a gun and
that he rammed a police cruiser.
“I don’t believe the story
that is being told to me by the police,” Williams said.
While Cleveland Mayor
Frank Jackson said that a thorough
review will be done to ensure that
the police followed proper procedure for use of deadly force.
Community activist Art
McKoy of Black on Black Crime,
Inc. held a prayer vigil, attended
the public forum on the incident,
and will follow the case until there
is justice for the two families.
“If there is no gun, no
gun shots, no casings, no residue,
the public needs answers,” McKoy
said.
According to McKoy, the
first officer involved who started
the chase began with an incident
outside of a homeless shelter not
the Justice Center.
He questioned the chain
of command that allowed 50 police
cars to follow in pursuit before 13
police officers opened fire unloading over 100 rounds into two unarmed Clevelanders.
Russell and Williams had
criminal records. Williams had a
history of mental illness, and had
a warrant out for her arrest for
missing a court date. Russell had
a prior incident of running from
police.
The Cleveland branch
of the NAACP sent a letter to the
U.S. Justice Department asking
them to investigate the shooting.

the Southeast Seventh Adventist
Church, 16602 Tarkington Ave.,
will hold a City-Wide-Prayer to
remember Timothy Russell and
Malissa Williams on Tuesday,
January 15, at 7:00 p.m.
The Williams’ family
members and others wonder if
race might have played a role. According to McGrath, of the 13 officers involved in the shooting, 12
were white and one was Hispanic.
The Cleveland Police
Department had recently settled
a suit for $900,000 in connection
with a 2009 confrontation between police vice squad members
and prison guards in which the officers used excessive force.
Council reappoints Ken Johnson to seat

Cleveland City Councilman Ken Johnson retired
and is collecting a pension
while he is also remaining on
council, having been reappointed, at a salary of $74,000.
Johnson was reappointed by council members
on Monday night to represent
Ward 4, the seat which he vacated when he retired on December 31,2012.
The move allows him
to ‘double-dip,” and he will
collect retirement pay while
also collecting a salary.
In a statement, Johnson said that it is about representing his constituents.
“With me it’s not
about the money. It’s about
finishing what I started back
when I was elected,” Johnson
said.

and Matt Zone were absent.
Johnson, 65, said that
changes to the state’s pension
system prompted his retirement
before the end of 2012 so that he
would not lose his yearly costof-living adjustment to his pension.
Polensek was vocal in
his opposition to the reappointment. He felt that an election
should be held for the vacant
seat.
“The voter should be allowed to decided who will represent them not council,” Polensek
said.
According to Johnson’s
office, he will serve the remainder of his term and he plans to
run for re-election in 2013.

In an effort to
rebuild their tarnished
reputations, the nations
biggest banks are touting
their charitable contributations and community

(NCRP) has examined
the contributions of four
megabanks during five
years. Report author Sean
Dobson says the banks
include their employees’
volunteer hours and making low-interest loans

when tallying their charitable giving, but overall,
they spend only fraction
of 1 percent of their total
revenue on philanthropy.

Leaders call for action to address housing crisis
The National Association of Real Estate Brokers, Inc. (NAREB), recently
held a press conference to
release its 2012 Post-Recession Housing Recovery
Policy Paper that focuses on
the high rate of foreclosures,
neighborhood blight, and disparities in disaster recovery
that are currently impacting,
and will continue to impact,
minority communities across
the United States. The press
conference and a State of
Housing in Black America
(SHIBA) Solutions Forum
were held on the historic
campus of Texas Southern
University (TSU).
At the press conference, Rep. Sheila Jackson Lee (TX-18th District)
lauded the quality, content,
and scope of the report and
praised NAREB for its ongoing leadership in a national
movement to ensure affordable housing for all people of
color.
“NAREB’s foresight in identifying the problems, doing the necessary
research, developing realistic solutions with industry
experts across the country,
and keeping members of the
Congressional Black Caucus (CBC) apprised of their
progress, is both timely and
commendable” Lee said. “I
want to congratulate you on
this effort.” Kevin Dancy,
District Director for Congressman Al Green (TX-9th
District), speaking on behalf of Rep. Green, stated
that “the Congressman, who
sits on Financial Services,
the premiere committee that
deals with housing issues, is
concerned about the housing
crisis in Black America and is
committed to doing whatever
he can in his capacity, and on
that committee, to help solve
the issues.”
Representative Lee
also presented the Houston
Black Real Estate Associa-
tion (HBREA), Houston’s
local chapter of NAREB,
with a U. S. House of Representatives Certificate of
Congressional Recognition
for its commitment and dedication to promoting equality
in housing and enhancing the
quality of life in urban neighborhoods.
The SHIBA Solutions Forum was held immediately following the press
conference and was open to
the general public, TSU students and faculty, and real
estate industry professionals
from Houston and surrounding areas.
“There are a lot of things
that have occurred in the African American community
and other communities of
color relating to the housing
crisis that many people are
not aware of,” said NAREB
President, Julius Cartwright.
“That’s why we were anxious
to share all of our research
and have a productive dialogue with the public, so that
people will understand the
ongoing impact in African
American communities and
in other ethnic minority communities, across the nation.
Thus, the Houston SHIBA
Solutions Forum highlighted
the Report of our Findings.
Our proposed ‘solutions’
focused on preservation of
homeownership, as well as
the creation of sustainable
homeownership for individuals and families trying to
achieve that dream. Not only
has an incredible amount of
wealth been lost as a result of
the mortgage crisis, but it is

Pennies, presented by Olive
Garden and benefiting The
Leukemia & Lymphoma Society (LLS). Thanks to the efforts of students nationwide,
$10.7 million was raised
through Pasta for Pennies
this year, bringing the total
raised since 1994 to more
than $70 million.
In northern Ohio,
more than 109,000 students
at 211 elementary, middle
and high schools in 19 counties filled collection jars and
boxes in their classrooms
with spare change during a
three-week period during the
school year.
The top fundraising
class at each participating
school received a pasta party
from their local Olive Garden restaurant.
Spare change raised
through Pasta for Pennies
helps fund blood cancer research and provides much
needed services and support
to leukemia, lymphoma and
myeloma patients and their
families.
“We congratulate
all of the students who put
forth such an amazing effort
in support of The Leukemia
& Lymphoma Society,” said
John Caron, president of Olive Garden. “Through Pasta
for Pennies they have come
to understand that even the
smallest donation can have
a significant impact on their
local community. The Leukemia & Lymphoma Society is
moving closer to a cure because of their efforts.”
The top fundraising schools in northern Ohio
include: Brecksville Broadview Heights Middle School
in Brecksville with $13,764
collected; Walter G. Nord
Middle School in Amherst
with $12,107 collected; and
Hubbard Elementary School
in Hubbard with $11,801.

more than 4,000 new blankets that are being distributed to 30 major non-profit
social service organizations
in Cuyahoga, Geauga, Lake,
Lorain and Summit counties.

year, SVDP Cleveland’s
Blanket Sunday Drive has
become a significant resource
for supplying low-income individuals and families with
seasonal items - such as blankets and winter hats, gloves,
socks and scarves - to help
them stay warm in inclement
weather, said John Litten, the
organization’s executive director.
“It’s especially difficult for those in need during
the colder months, as many
are struggling with the high
cost of heating bills and have
little or no discretionary income to purchase these types
of necessities. We are grateful that the generosity of others enables us to provide for
our neighbors in need,” Litten said.

those who are defenseless or
voiceless, the society is a local Catholic human service
and welfare organization
of neighborhood volunteer
groups from its 60 participating parishes (“Conferences”)
throughout the Diocese of
Cleveland’s
eight-county
area.
Last year alone, approximately 167,000 individ-

million in aid via food donations from SVDP’s four Ozanam Food Pantries, clothing

It was just before New
Year’s and the Gracious Mistress
of the Parsonage and I were relaxing after a busy week of toil
and labor. Not paying much attention to my surroundings, I
had immersed myself in a favorite book.
As far as I am concerned, nothing compares to a
favorite book when you are trying to relax and unwind. I turned
the page and happened to notice
on the other side of the room my
wife was all a twitchy. I have
seen this behavior before and
I knew she was anxious to say
something. I pretended not to
notice.
Finally, it was as if she
exploded. “I can’t wait for the
New Year. Aren’t you excited?”
I answered in the affirmative to
try to keep the conversation as
minimal as possible.
“No, I mean aren’t you
really excited about the New
Year?”
I knew if I was going
to get back to my book I would
have to let her say, what was on
her mind. According to her, the
approaching New Year was going to be spectacular. Everything
old, she explained to me, would
be new again.
We have been in this
New Year for a couple of weeks
now and, I will not contradict
my wife, at least aloud, but this
New Year looks suspiciously
like the Old Year.
I am not quite sure
what she thought would be different this year, but to me it is
just the old year run through
again. And, that is good with me.
I am not one of these persons
that needs the latest flash in the
pan. I quite prefer the tried and
true.
It was about two
weeks after the New Year and
my wife said, “I’ll be back in
an hour or two, I’m going shopping.”
It did not dawn on me
at the time but about 10 minutes later, it did. The reason my
wife was so excited about the
New Year was that she was going to go out and buy some new
clothes.
After all, according to
her calculations, the New Year
deserves new clothing.
I smiled as I thought
about her going to the store trying on dresses, seeking one that
would fit her both in size and
in fancy. As for me, I am quite
comfortable in my old clothes.
They fit me just fine, thank you.
Women have to look
fine all the time. Men, on the
other hand are not that particular about what they wear. I can
wear the same shirt for days on
end and feel just as comfortable
as the first day I put it on.
My clothing does not
make me feel any younger. I go
along with the saying that says
you are only as old as you feel.
Of course, I do have some of
those Methuselah moments.
Everything old was
once new and if new last very
long it ends up being old. Therefore, whatever is old was once
new and whatever is new will
one day be old. This is where
most people make their mistake.

as our culture pretends to be
youth oriented, it does everything to get old while looking
young. I often have this conversation with my wife. I am not
old, I am just getting older and
my plans are to get older and
older and older.
The great object in life
is to get as old as you possibly
can while looking and feeling
new. Nothing to me is sillier
than a 40 year old trying to act
20. The mind may say 20, but the
body really knows it is 40.
If people would put
the money they spend to look
young in a 401(k) their golden
years would truly be golden.
How much money is spent each
year on plastic surgery? What
I want to know is, who in the
world do they think they are
fooling? Their mirror?
Right after the New
Year’s celebration, I got up one
morning feeling terrific. There
was a bounce in my step, a giggle on my tongue; I was feeling
like I was 20 something. I had
not felt this good since I cannot remember how long. Then it
happened.
No matter how good
you might feel some day, there
is always something or someone
who can undermine that and put
you in your proper place.
My mistake was going into the bathroom. There in
the bathroom for all the world to
see, especially me is this ghastly
object called a mirror. When I
looked into the mirror, I was
shocked to see I was not alone. I
thought I had come into the bathroom by myself but there in the
mirror was this old guy I hardly
recognized.
My first reaction was
to ask him to leave the bathroom and then I noticed something. That person in the mirror
was me! All of those exhilarating feelings dissipated as reality grabbed hold of my soul and
soundly shook me.
In my Bible reading that morning, I read what
the apostle Paul said. “And be
renewed in the spirit of your
minds; and that she put on the
new man, which after God is
created in righteousness and true
holiness” (Ephesians 4:23-24
KJV ).
Only God, in His wisdom, can create in me something

their ability to perform:
Salaat (obligatory
prayers), the second pillar of
Islam, Zakat (obligatory tax),
the third pillar of Islam, Sawm
(fasting), the forth pillar of
another succeeded him. But
no prophet will come after me;
only caliphs will succeed me.”

numerology, an obsession
which has misguided many
different people throughout

Khalifa alleged that
the Qur’an contained a mathematical code which revolved
around the number 19.

of removing two verses from

to him “the word ‘God’ ..is not
a multiple of 19, unless we
remove it [it],” and the “sum
of all verse numbers where
the word ‘God’ occurs is...

LaRon Brown was
injured in 2003 while working for a company called
Johnson Controls. Five years
after his injury, Brown was
fired for violating the company’s attendance policy. His
subsequent filing of a claim
for temporary total disability compensation (“TTC”)
brought his case before us —
the Ohio Supreme Court.
The
attendance
policy at issue gave employees such as Brown 16 hours
of unpaid leave every three
months. These hours were
deposited into a “bank” and,
with a supervisor’s approval, could be used as needed.
Generally, the exchange rate
was one to one — an hour of
bank time for an hour’s absence.
The use of bank
time to cover illness was
different. When an illness
resulted in consecutive days
off, an employee would be
charged only eight hours of
time for the entire absence if
the employee called in each
day of his absence and produced a doctor’s slip upon
return.
Employees were
prohibited from using more
bank hours than they had on
account. The policy specified that violators would be
fired, and Brown signed an
acknowledgment form indicating that he had received a
copy of the attendance policy, had read it, and understood its contents.
In the first quarter
of 2008, Johnson Controls
charged the following withdrawals to Brown’s bankhour account: three hours on
Jan. 30; eight hours on Jan.
31; eight hours on March 10;
and eight hours on March 11.
Because Brown had exceeded the number of hours that
he had on account, he was
fired.
In a grievance
filed with his union, Brown
claimed that Johnson Controls had miscalculated the
number of bank hours used,
but he did not prevail.
Brown later filed
a motion for TTC, alleging
that after his dismissal, he
had become temporarily and
totally disabled by injuries
suffered while working. At
the hearings before the Industrial Commission of Ohio —
which handles such matters
— the character of Brown’s
termination was debated.
Johnson Controls maintained
that the dismissal constituted
a voluntary abandonment of
the former position of employment. If a person voluntarily abandons his position,
it bars the awarding of TTC.
The company argued that Brown’s discharge
was similar to the situations
in two other cases decided by
our court, because Brown’s
discharge arose from his violation of an acknowledged
written work rule. Brown
denied that his discharge
amounted to a voluntary
abandonment. He insisted
that he had not violated the
work rule at issue because
his withdrawals had in fact
not exceeded his account
balance. Brown claimed that
Johnson Controls should not
have charged three hours to
his account on Jan. 30 because he was at a companyordered medical exam related
to his claim. He also argued
that he should have been
charged just eight hours total
for March 10 and 11 — not
Johnson Control’s 16 — because those sick days were
consecutive and the form that
he produced requesting TTC,
signed by a doctor, served as
the required doctor’s slip.
Return of those 11
hours would bring his quarterly withdrawal to 16, equal
to the number of hours he
had in his account. Johnson
Controls didn’t challenge
Brown’s claim on the Jan. 30
hours, but it stood by its assessment on the 16 hours for
March 10 and 11.
Brown alternatively
tried to disavow understanding the bank-hour protocol.
Relying on Brown’s signed
acknowledgment that he
had read and understood the
attendance policy, a Commission staff hearing officer
rejected this argument and
devoted her discussion to that
issue. There was no mention
of the eight disputed hours:
the order from the staff hearing officer simply concluded
that Brown had violated the
rule in question.
Brown then turned
to the court of appeals, alleging that the Commission
had abused its discretion
in finding that his termination barred TTC. The court
of appeals concluded that
the Commission had an affirmative obligation in every
termination case to evaluate whether just cause for
discharge had existed and
recommended that the case
be returned to determine
whether Brown’s bank-hour
withdrawals had been properly calculated. The court
held that the deliberate misconduct necessary to support a finding of voluntary
abandonment could not be
imputed to Brown unless it
was clear that he had actually
violated the policy.
After that, Johnson
Controls filed an appeal that
brought the case before us.
In previous, similar cases
we have determined that an
employment separation is
deemed voluntary when it is
initiated by the claimant for
reasons unrelated to the industrial injury.
Although it is the
employer that formalizes
the employment separation
when a worker is fired, when
a claimant voluntarily misbehaves, he tacitly assents to
the consequences.
Brown argued that
his discharge couldn’t be
considered voluntary because he didn’t engage in
prohibited conduct or didn’t
do so knowingly. At his
Commission hearing, Brown
asserted that his bank-hour
withdrawals exceeded his
available balance only because Johnson Controls improperly charged him with
16 hours for consecutive
sick days.
This
argument,
in turn, raised the issue of
whether a previously submitted disability form was
a valid doctor’s excuse for
purposes of the consecutivesick-day exception to the
bank-hour policy.
The issue of the disability form was critical for
two reasons. First, if the form
was found to be a valid doctor’s excuse, it would support Brown’s assertion that
he satisfied the requirements
of the consecutive-sick-day
exception and should have
been charged just eight
hours for his absence. This
determination would affect
Johnson Controls’ bank-hour
calculation.
Second, even if the
disability form were found
to be inadequate, a goodfaith belief that it satisfied
the rule’s requirement could
support Brown’s alternative
claim that his violation of
the rule was neither knowing
nor deliberate.
The Commission’s
hearing officer, however,
discussed none of this in her
order. The omission is unacceptable. In previous cases
we have held that it is “imperative to carefully examine the totality of the circumstances” in such situations.
Because such an
examination did not take
place, we concluded — by
a seven-to-zero vote — to
vacate the Commission’s
order and return the case for
further consideration and an
amended order.

According to a recent survey by the Federal Deposit Insurance Corp. and the
U.S. Census Bureau, 17 million American adults now live
in “unbanked” households,
while another 51 million are
considered “underbanked.” In
other words, over 28 percent
of households either have no
traditional checking or savings
accounts (unbanked); or their
basic financial needs aren’t being met by their bank or credit
union so they also rely on alternative lenders like check-cashing services or payday loans
(underbanked).
There have always
been millions of Americans
who are either unable to – or
choose not to – conduct their
financial transactions through
a bank. Common reasons cited
include:
Don’t have enough
money to need an account.
Don’t write enough
checks to justify monthly fees
and minimum balance requirements – just buy money orders
when needed.
Lack of proper identification.
Denied accounts due
to bad banking track record and
language barriers. Bad previous banking experience or lack
of trust in banking institutions.
Big retailers and other alternative financial services
providers have rushed to fill the
void for customers who can’t –
or won’t – use banks or credit
card issuers. For example,
Bankrate.com lists dozens of
prepaid cards that offer many
of the same functionalities as
regular credit or debit cards,
including direct deposit, online
purchases and bill pay, ATM
access, etc. Other businesses
provide such varied services as
check-cashing, money orders,
wire transfers, and payday,
pawn shop or car-title loans.
However, charges for
these services can quickly add
up. After you’ve paid a fee to
cash your paycheck and bought
money orders to pay your
monthly bills, you probably
will have spent far more than
the $5 to $15 a month a regular checking account typically
costs.
Although monthly
checking and savings account
fees at large banks have risen,
you still may be able to find
free or low-cost accounts at
banks and credit unions. To

High fees aside,
there’s also a safety risk factor to being unbanked. Carrying or storing cash at home
tempts robbers; also, money
can easily be destroyed in a fire
or other natural disaster. Plus,
money deposited in FDICinsured banks is insured up to
$250,000 per account (similar insurance is available to
credit union accounts through
NCUA). It’s also more difficult
for unbanked consumers to improve their credit scores due to
lack of access to credit-building products like credit cards
and loans.
To help bring unbanked and underbanked people into the system, an increasing number of public/private
programs like Bank On (www.
joinbankon.org) are being
formed. These voluntary partnerships between local or state
governments, financial institutions and community-based
organizations provide lowincome un- and underbanked
people with free or low-cost
starter or “second chance”
bank accounts and access to
financial education.
In addition, many
financial education resources
are available, including:
MyMoney.gov. the
government’s website dedicated to teaching Americans the
basics about financial education (www.mymoney.gov).
FDIC’s MoneySmart
program of financial education
workshops (www.fdic.gov/
moneysmart). Practical Money

program run by Visa Inc.
There’s no law that
says everyone must have a traditional banking relationship.

media is more than just a fad.
Social media is being used
worldwide to connect old acquaintances, make business
referrals, and market and advertise products and services.
Chances are a vast majority
of a company’s employees,
customers, potential customers, and competitors access
a social media site on a daily
basis. Because social networks amass such huge audiences, social media is quickly
becoming a preferred way for
businesses to tout products
and services.
Q: Who regulates the
use of social media as an advertising mechanism?
A: The Federal Trade
Commission regulates the use
of endorsements and testimonials in advertising through its
published Guides Concerning
the Use of Endorsements and
Testimonials in Advertising.
These endorsement guides,
which have been in effect for
more than 20 years, address
endorsements by consumers,
experts, organizations, and
celebrities. In fact, FTC revised its endorsement guides
in 2009 to include blogs and
social networking sites.
Q: What qualifies as
an endorsement?
A: Under the guides,
an endorsement is “any advertising message (including
verbal statements, demonstrations, or depictions of the
name, signature, likeness, or
other identifying personal
characteristics of an individu-
al or the name or seal of an
organization) that consumers are likely to believe reflects the opinions, beliefs,
findings, or experiences of
a party other than the sponsoring advertiser, even if the
views expressed by that party are identical to those of the
sponsoring advertiser.”
Q: What is the purpose of the FTC’s endorsement guides?
A: The FTC’s aim is
to ensure that endorsements
are truthful and not misleading. Under the guides, endorsements must reflect the
honest opinions, findings,
beliefs, or experiences of the
endorser, and not the marketer of the product. To help
further this principle, “material connections” between
marketers and endorsers that
might affect the weight or
credibility of the endorsement, such as connections
that consumers would not
normally expect, must be
disclosed.
Q: Don’t these updated regulations only apply
when a sponsoring advertiser
pays a blogger or spokesperson, like a famous celebrity,
to tout its products online?
A: No. If there is
any relationship between the
endorser and the marketer of
the product that might affect
how consumers evaluate the
endorsement, the FTC regulations apply and the relationship should be disclosed.
For example, the regulations
would apply if a company’s
receptionist wrote on her
personal Facebook page a
glowing review of a new
product just launched by the
company. Because the con-
nection between the endorser
(the receptionist) and the seller of the product (the company) might affect the weight
or credibility of the endorsement, the receptionist’s employment must be clearly and
conspicuously disclosed on
her page. If the receptionist
fails to disclose her relationship with the seller, her post
would violate the FTC’s endorsement guides.
Q: What can a business do to avoid violating the
FTC’s endorsement guides?
A: To avoid violating FTC regulations, businesses should educate their
employees about what they
can and cannot say and do
online. An easy way to educate employees on how to
properly use social media for
business purposes is to adopt
a clear, well-written social
media policy.

Crew re-signs Danny O’rourke for 2013
The Columbus Crew recently announced that the club has
re-signed Danny O’Rourke for the 2013 season. Per Major League Soccer and club policy, details of the agreement were not disclosed. With
eight years of MLS experience playing defensive midfield and along the
backline, O’Rourke’s return brings versatility and leadership to the Crew
ahead of next season. O’Rourke appeared in 21 games for the Crew in
2012 following an injury-plagued 2011 season that limited him to just
six matches. 2013 will be O’Rourke’s seventh season with the Crew. The
Columbus native played an integral part in the Crew’s back-to-back Supporters’ Shield victories in 2008 and 2009, and the club’s MLS Cup win in
2008. O’Rourke joined the Crew in a trade with Toronto FC that brought
William Hesmer and O’Rourke to Columbus in exchange for partial allocation following the 2006 MLS Expansion Draft.

Boxing contender Johnny Lira dies at 61
The city of Chicago has produced its share of outstanding professional
fighters. One of them was a tough as nails lightweight who campaigned in the late
1970′s and early 1980′s. He was Johnny Lira and he fought his way into the top
echelon of the lightweight rankings.Lira died Saturday at the age of 61. Lira turned
pro in 1976 and quickly gained notice by winning his first 12 fights. In 1977, he
drew with Manuel Lopez but defeated Lopez in a return bout. Lira hit the big time
in 1978 when he received a shot at the United States Boxing Association lightweight
title. His opponent was the highly ranked southpaw bomber Andy Ganigan. Lira
was a decided underdog going in but he shocked the boxing establishment by stopping Ganigan in round six. Lira then went to New York’s Madison Square Garden
to outscore the talented Larry Stanton. Lira was now high in the ratings and in 1979
he received a shot at the World Boxing Association’s version of the lightweight title.
Their champion was a hard-hitting bomber from Venezuela named Ernesto Espana.
It was a gruelling fight but Espana emerged victorious stopping Lira in nine rounds.
Lira would suffer a broken jaw for his gallant effort.
Cavs win two games in a row against Bucks and Wizards
The Cavs recovered from a 3rd quarter to
forget at home against Indiana to take two-in-a-row on
the road.
They had to do it
without Anderson Varejao,
who leads the NBA in rebounding. As of this writing, the Cavs have won
three games at Quicken
Loans Arena and four on the
road.
In the loss at home to
Indiana,Roy Hibert, who
scored 18 points, led six
Pacers who hit in double
figures. The Cavs played
the Pacers pretty even in
quarters 1, 2, and 4, but that
3rd quarter was the turning
point. Gerald Green had
four steals which led to easy
buckets as Cleveland was
outscored by 11 points.
Kyrie Irving had
17 points on just 5 of 16
shooting, while committing six turnovers. Tristan
Thompson, who had nine
rebounds and 12 points on 5
of 9 shooting,said, “We let
them jump out on us right
after halftime. Otherwise,
we played them pretty well.
We’ll see what went wrong
and correct our mistakes, so
that we can bring home a
Varejo
win next time.”
Fortunately, the Cavs
seemed to learn from their
mistakes as they took the
next two, with a three day
Irving
respite for the Christmas
Holiday falling in-between.
The day after the
loss to the Pacers, the Cavs
beat the Bucks in Milwau-
kee, 94-82.
Thompson scored
14 points and pulled down
14 rebounds. Dion Waiters
scored 18 points. Monta Ellis scored 37 points to lead
Milwaukee.
The day after Christmas,
the Cavs traveled to Washington and won their second
straight game, 87-84.
Although the Wizards are not a good team
- winning only three times
all year - it was still the first
time the Cavs had won twogames-in-a-row all year.

was a woeful 1 of 10 from
the field in the 2nd half.

‘Bad’ Bennie Briscoe deserved to be a champion
There are certain
boxers from my past that in
retrospect would be champions today. One such boxer
was tough enough to be nicknamed “ Bad “. He was Bennie Briscoe from Philadelphia
and brother you better bet he
was just that, “ Bad “. He
was probably the most feared
middleweight of his era and
it was a tough time just be
a middleweight in Philly. If
you were bad there, you were
bad everywhere.
Briscoe turned pro
in 1962 and would win his
first 15 contests. Among his
victims were Charley Scott
and Percy Manning. In a return with Manning in 1965,
Bennie would suffer his first
setback. That year he would
also lose to Tito Marshall and
Stanley “ Kitten “ Hayward.
In 1966 Bennie would halt
the highly respected George
Benton.
Bennie was now
among the middleweight
elite. The year 1967 would
see him lose two decisions
to the great Luis Rodriguez.
Sandwiched in between those
losses was a draw in Argentina with a fella named Carlos
Monzon. In 1968 he would
lose to future light heavyweight titleholder Vincente
Rondon. He would knock out
Rondon in a 1969 rematch.

In 1970 Briscoe
Bennie began to make his
march to a shot at the world’s
middleweight title. He won
11 straight fights until he
was upset by Luis Vinales in
1972. He would stop Vinales
in a return match. Finally in
November he would meet the
reigning middleweight champion of the world, Carlos
Monzon. Again they would
be fighting in Argentina. This
time Carlos clearly deserved
the decision the retained his
title but he was rocked to his
heels by Bennie in the ninth
round of that fight. Monzon
would always have a great
respect for Briscoe.
Briscoe would regroup in 1973. He destroyed
Art Hernandez in three
rounds. He also stopped Billy “ Dynamite “ Douglas of
Columbus, Ohio. Billy’s son
Buster would shock the world
in 1990 when he took apart
Mike Tyson. Brisco closed
the year by losing a decision
to Rodrigo Valdez. These two
would create some history together.
Briscoe put himself
right back into the thick of the
title picture in 1974 when he
took out the streaking Tony
Mundine of Australia. Later
he would again meet Valdez
for the WBC version of the
title that had been taken away
from Monzon.
In a stunning display of punching power the
vastly under rated Valdez sent
Brisco down and out in round
seven. Brisko came back but
finished the year dropping a
points call to all time great
Emile Griffith.
Briscoe would then
go undefeated in his next 13
bouts. He won nine and drew
in four. In this span he would
beat Eddie Gregory ( a.k.a.
Eddie Mustafa Muhammad
). He would draw with the
dangerous Eugene “ Cyclone
“ Hart. In a return go Brisko
blasted out Hart in one round.
Brisco also drew in a return
with Griffith.
In 1977 after Carlos Monzon had officially
retired, Briscoe was again
matched with Rodrigo Valdez
for vacant title. Again Rodrigo had Bennie’s number and
won a very close decision.
Starting with a decision loss to future champion Vito Antuofermo, Briscoe would lose nine of his
last 17 fights.
Later that year
Briscoe would drop a verdict
to another future champion
named Marvin Hagler. At
this stage of his career any
middleweight who dreamed
of becoming the champion
had to go through Briscoe
first.
By the early 1980’s
Briscoe was becoming a
stepping stone for young,
talented fighters like Vinnie
Curto. After a 1982 loss to
Jimmy Sykes at the famous
Blue Horizon in Philadelphia, hometown boy Briscoe decided to hang up the
gloves.
He left a legacy of
96 fights against many of
the toughest welterweights
and middleweights of his
day. He won 66 fights and
an amazing 53 of those by
knockout.
He was stopped
only once in his career. His
record reads like a who’s
who of boxing in that era.
If ever a fighter
who was never crowned a “
world champion “ deserved
to be elected in to the Hall
Of Fame, it is none other
than Bennie Briscoe.

R&B artist Bobby V to perform at Rock Hall
To celebrate the
legacy of Dr. Martin Luther King, Jr., the Rock and
Roll Hall of Fame and Museum will once again open
its doors to the public free
of charge on Monday, January 21 in a celebration of
community spirit and civic
pride.
This marks the
12th year that the museum
offers free admission to the
public. The Rock Hall’s
Community Festivals are
sponsored by KeyBank.
The Rock Hall
will be open from 10 a.m.
until 5:30 p.m. Visitors to
the museum will have the
opportunity to tour the facility free of charge until
closing. Throughout the
day an array of entertainment will take place at the
museum, including a continuous film screening in
the Foster Theater of the
complete “I Have a Dream”
Valentino
speech from August 28, 1963.
Music will begin on the main
stage shortly after the museum
opens and will include performances by the Distinguished
Gentlemen of the Spoken
Word, all-female band Women
in the Spirit, girl group cover
band Tra-la-la, the Antioch
Spiritual Arts Choir, solo R&B
artist Diamond Carter and
multi-platinum artist Bobby
V (formally known as Bobby
Valentino).
The event will be
emceed by Jason Walker of
Terry Macklin Entertainment.
R&B recording artist Bobby V (formally Bobby Valentino) has had No. 1
singles, platinum and gold
albums, has toured the world
and he has appeared on songs
with Lil Wayne and Ludacris.
Five years into a remarkable solo career, Bobby
V has experienced the best
the music industry has to offer while working with some
of the industry’s most successful artists.
Bobby V scored a
hit when he was only 15 years
old with as one-fourth of the
1990s R&B group Mista with
“Blackberry Molasses,” a
tune produced by Organized
Noize (OutKast, TLC) that
became a Top 20 R&B hit.
Even with this success, Mista
dissolved.
Bobby V then enrolled at Clark Atlanta University, where he graduated
with a communications degree and developed a keen
business sense.
His debut solo album, 2005′s Disturbing Tha
Peace Presents Bobby Valentino, earned the No. 1 spot on
Billboard’s Top R&B/HipHop Albums chart.
In 2007, Bobby V
returned with Special Occasion, which featured the Timbaland produced hit, “Anonymous,” and Rodney Jerkins
produced, “Turn the Page.”
His third album,
2009′s the Rebirth, featured
the hit “Beep” and was the
first album released on his
own Blu Kolla Dreams imprint, in conjunction with
Capitol Records, which debuted at Number 1 on the
Billboard Hip Hop and R&B
chart.
His latest album,
Fly on the Wall, released in
October 2012, is filled with
stories of his remarkable experiences. With production
handled by Tim & Bob (Boyz
II Men, Michael Jackson),
the Pentagon (formerly the
Underdogs [Beyonce, Justin
Timberlake]), LOS (Usher,
the Dream) and Jazze Pha
(T.I., Ciara), Fly On The Wall
contains the type of polished
production accented by live
instrumentation that has become Bobby V’s signature.
As his career continues expanding, he makes
a point to give back to those
who are less fortunate.

jazz and formed a high school
ensemble.
By 1960, he was performing in Chicago jazz clubs
with Coleman Hawkins and Donald Byrd. Hancock joined
Byrd's group and moved to New

recording session with Byrd, he
was signed by Blue Note and
made his recording debut
with Takin Off in May 1962,

Hancock joined the
Miles Davis quintet in 1963 and
remained for five years, creating

Leading his own sextet
from 1971-73, Hancock melded

After his Headhunters
album, Hancock produced
more commercialized music
