Toll Delegates met to discuss the ongoing campaign against WorkChoices
Around 50 Delegates and Officials attended the last Sydney Sub-Branch meeting, held at St Mary’s Band
Club in the city’s west. Delegates heard from Senior Officials as well as Chris Walton ACTU Assistant
Secretary and Tony Burke former Shadow Minister for Immigration. NSW & National Secretary Tony
Sheldon spoke about the fight ahead and why it is crucial to remain united to ensure WorkChoices is
declared dead and buried.
Tony Burke affirmed that "the Labor Party will not extend the controversial 457 visa to the transport
industry." This is a vital point in the battle to keep our roads safer, and Australian jobs in Australian hands.
There is a long way to go - WorkChoices is still the law until it has been repealed and it is vital for
members to stand united against unfair and unsafe work practices.

2008: A New Era for Transport Workers

This year the Transport Workers Union will be working closely with
the newly elected Rudd Labor Government to ensure that the
rights of working Australians are at the forefront of the agenda.
You have set a clear mandate for the new Rudd Labor Government:
your conditions at work DO matter, and you are prepared to fight
for them.
The Transport Workers’ Union will continue to fight for safe and
fairer rates for all transport workers, will continue to push for the
end of 457 visas, and will make sure the 2008 EBA negotiations
deliver the best result for you.
We have been suffering under the harshest industrial relations
system our country has seen in recent years: and the recent federal
election has proven that unionism is well and truly alive.
We will be calling on the Rudd Labor Government to support our
initiatives to make the transport industry safer, and to bring back
fairness to the Australian workplace.
In 2008 your great union turns 120 years old and we will be
celebrating the protection of transport workers and their families.

Safety: Priority

The first weeks of 2008
brought some tragic news to
the transport industry, with 2
separate truck crashes in NSW
claiming the lives of two truck
drivers and a truck driver and
his twelve year old son.
All too often, fatal truck
incidents are the result of
fatigue caused by clients
pressuring drivers to travel
too far, too fast.
This year the TWU will
continue to fight for client
accountability through Chain
of Responsibility legislation
– making clients realise they
are responsible for drivers
delivering their goods.

TWU CONTINUES FIGHT
TO STOP 457 VISAS
Your union took the fight against
457 visas to Northern NSW late
last year - holding a number of
community forums to help people
understand the devastation they
could cause if extended to the
transport industry.
From Tamworth to Tweed Heads,
Australians were unimpressed with
the idea of trucking companies
hiring foreign drivers for less money
than their Australian counterparts.
Locals expressed concern about
drops in safety standards, wages,
and less job opportunities for their
children. TWU Delegate Steve
Rowe said "I'm concerned that
there is going to be a drop in safety
standards, wages, and less job
opportunities for our kids."
Your TWU took your concerns back
to the Trucking Industry Working
Group - a body established to
analyse the worthiness of the 457
visa in the transport industry.

Pay rates tabled under the former
Howard Government show that
foreign truck drivers would be paid
$20,000 less than Australians, and
have little training before getting
behind the wheel of a big rig.
Late last year, Labor’s former
immigration spokesman, Tony Burke
said "The Labor Party will not extend
the 457 visa into the transport
industry." Your union is now talking
with Senator Chris Evans, the new
Minister for Immigration, about
upholding this promise.

Just a few months ago at UPS Mascot employees working in the accounts section were told that the company was
planning to outsource their work to India. This was to be the first stage in the company’s outsourcing plans.
This was an area of the company which was not highly unionised, but when the employees were told what was going
to happen to their jobs they quickly contacted the union and began to mobilise.
When the company saw that the employees were prepared to be union and stand together they soon stood down
and said that for technical reasons the outsourcing was put on hold. Those who work at UPS have said that they know
the real reason why the plan to outsource labour was stopped - because they were union and they stood together!

During November delegates and union
officials went to the Qantas Annual
General Meeting to ask the Board to
guarantee your job security and working
conditions in the event that the company
is split into four.
Another dividend paid
to Ansett Workers
The TWU has fought a long battle
to see that all former Ansett workers
receive 100% of their entitlements.
We are proud to have led the
campaign for affected workers, such
as the Gate Gourmet workerforce,
whose campaign to receive their
entitlements is now settled.
Ian Sherwood, delegate and long
standing Qantas employee said "we
didn’t get a straight answer from the
board. We went because we care about
the company and its’ future.
A pre-Christmas dividend paid to
Ansett workers means that they
have now received approximately
89 cents in the dollar of their overall
entitlements.
"All we are asking for is that our jobs
won’t be lost when the company is split
into four," said Ian.
Your union also took this opportunity to
question the board on the company’s
safety record and strategy to maintain
its strong reputation for safety and
standards.

brought to the board’s attention the
consequences of this work intensification
on safety in the workplace, standards

Victory for TWU Mack Truck
Drivers Across Australia
Safety First: TWU Members
and delegates protest at
Readymix/Rinker Moorebank
Fifteen Mack Truck drivers from Concrete
Company Readymix/Rinker proved that by being
union you can win.
Delegates Ray Childs and Ian Barnaville and
TWU Officials organised 15 owner drivers from
Readymix/Rinker Moorebank to blockade Mack
Truck, Chipping Norton, over their refusal to fix a
faulty truck part.
All of the owner drivers have experienced
cracking along their cross member brackets,
meaning their trucks are unsafe and not roadworthy. Despite this being an obvious design
fault Mack Truck at first refused to pay for repairs.
However following the blockade, Mack
management agreed to pay for the parts and
part of the labour costs as well as extending
the 12 month warranty for those drivers at
Readymix/Rinker Moorebank.
Flying high: by standing united members achieved a
great result for drivers across Australia
The TWU has campaigned for all drivers with
affected cross member brackets to be fixed free
of charge by Mack. The TWU applauds Mack's
decision to fix the faulty part.
Delegate Ian Barnaville said, "This is a great result because as owner
drivers we have enough overhead costs to worry about without
being concerned and out of pocket over a design fault. Thanks to
Readymix/Rinker and all the guys for standing together."

Bus Industry look to fight ahead
Late last year Bus industry
delegates met to discuss the
current wage negotiations
which are just underway.
During the meeting discussions
were had regarding the role that
Workchoices has played on the
bus industry and the importance
for members to be active and
ready for the fight ahead.
Rock throwing attacks were
also discussed and a reminder
went out to all drivers to remain
vigilant and report any incidents
to their employer, and union
delegate. Following violence
towards bus drivers in January
and boycotts by drivers the TWU
will continue their campaign to
protect the safety of drivers.

finally been able to reach
agreement on running time
and rosters that are suitable for
the majority of drivers.
Across the world on the16th of
October transport workers stood
up for the rights of fellow unionists
in Iran.
Congratulations to Jim
Bowman, Peter Pascoe and
Wayne Houssenloge for their
outstanding work.
Mr Osanloo has been held in prison
since July 2007 and has been the
target of several violent attacks for
simply being a union member and
taking industrial action.

TWU and Central Coast Convoy
for Kids making a real difference
Convoy for Kids:
a great day for families

The Central Coast Convoy for Kids has raised much
needed funds for various children’s charities on the
Central Coast since it began in 1996.
With the support of the Transport Workers’ Union, the
Central Coast Sun Weekly and an enthusiastic group
of volunteers the Convoy has been able to donate
$20,000 to the charity Life Without Barriers.
Among the latest recipients was four year old Lachlan
King who received a Special Tomato Soft Touch Sitter,
which is a special super soft wheely chair.
His mum Megan wrote to the Transport Workers’ Union
to say thank you for all the support the union has
given to the Convoy. Megan said "this chair is going
to be fantastic for Lachie as we can wheel him around
the house in it and take him outside, while at the same
time still giving him he support he requires. It’s a great
alternative to his wheelchair and gives him more freedom
to enjoy some relaxing time with our family."
Strength in standing together!
Late last year dozens of TWU members at Toll In2Store in Yennora stopped work for a number of hours
in support of a mate who they believed had been unfairly dismissed.
Just a few hours after they returned to work 11 of the activists who were employed through a labour
hire company who participated in the stoppage were told that they were no longer required to work at
that site.
Within 24 hours the TWU had entered into talks with the company and your union officials and
delegates took the case to the NSW Industrial Relations Commission. The Commission did not accept
Toll's decision regarding the labour hire employees and directed that they were to be re-instated. It was
with the support of all employees that we achieved this great result.

McArthur Express
campaign still strong
The Transport Workers’ Union is
currently in talks with the new
Minister for Workplace Relations,
Julia Gillard regarding McArthur
Express. The TWU is hoping that a
speedy resolution for the owner
drivers of McArthur Express can
be agreed upon.
This has been a fight on behalf of
all drivers, employees and owner
drivers. Winning early payments
for many employees was only the
beginning of this campaign. Dave
Johnson, ex-McArthur Express
owner driver said "since McArthur
Express collapsed I started working
for a unionised company. I now
understand the difference between
a union and non-union yard. Not
only do I get proper lunch breaks
but the improvements in my general
working conditions is amazing."

The TWU stands by our commitment that we will continue to fight for the
hard working Aussie families who have been left out in the cold from the
shocking collapse of McArthur Express.

CHANGE THE FACE OF MEN'S HEALTH
TWU JOINS MOVEMBER
During November, a number of TWU Officials joined in the fundraising effort "Movember", which
aims to raise money for men affected by prostate cancer and depression. Every year in Australia 2,900
men die of prostate cancer which is equivalent to the number of women who die from breast cancer
annually and one in six men experience depression at any given time but most don’t seek help.
The union raised thousands of dollars last year and with your help we aim to raise tens of thousands of
dollars this year. Congratulations to all those who raised money for what is a very worthwhile cause.

TWU MEMBER FIGHTING
FOR MORE THAN HIS RIGHTS!
Michael Nicholas (Nicko) from
Toll Tasmania participated in his
first amateur boxing competition
during October.
Nicko went 3 rounds in the Heavy
Weight division and knocked down
his opponent in the first round for
a standing 8 count. Nicko was in
command for the first round and
half of the second. The rounds were
closely scored with the decision
going to the opposition which was
hotly contested by Nicko’s trainer.
Nicko’s next fight will be in March
and in order not to give away too
much in weight and reach, Nicko
will be training hard to get down to
Cruiser Weight.

DHL Agreement Finalised
The DHL Express and DHL Express Gateway agreements at Sydney domestic airport
have been finalised.
The Union Collective agreement allowed for a 3% per year for 3 years increase and a productivity bonus of
1.5% per year for 3 years based on weekly targets.
The DHL Express Gateway agreement included a site agreement which allowed for delegates entitlements,
delegates training, union picnic day, the right of a union representative to meet with all new employees and
right of entry. Thanks to Dave Vella delegate at DHL Express
who was instrumental in negotiations.
These agreements were negotiated at a time when DHL
workers at Matraville were placed on a substandard
agreement negotiated by another union. This placed
significant pressure on our negotiations with DHL. Your union
is fighting to have this sub standard agreement overturned
to ensure that workers at all DHL yards achieve the best
conditions possible.

TWU MEMBER CELEBRATES
60 YEARS OF BEING UNION
Nearly 6 decades ago, a young man called Eric Taylor
joined the Transport Workers’ Union after his employer
refused to give him a holiday after a year of work.
Leaving that job, Mr Taylor began working for John
Hannon at Peakhurst, which was unionised and stayed
there for 38 years.
Mr Taylor has kept financial for the past 60 years –
becoming one of the Union’s longest ever members. Last
month Mr Taylor celebrated his 90th Birthday, and was
sent a TWU jacket, cap, t-shirt and special certificate for
being such a loyal member.
NSW & National Secretary Tony Sheldon: "It’s inspiring to
see a member still passionate about his union, 60 years
from when he first joined. It’s now more important than
ever to be union, and I commend Eric for being a loyal
unionist."

International Day of Action
During December the
International Transport
Federation (ITF), in co-operation
with the Union Network
International, organised an
international action day called
"Organising Globally, Fighting
for our Rights-Together we
have Power."
Across Australia, the TWU used the
action day to hold wage reportback meetings as part of national
negotiations.
The union met with members at
DHL, TNT, UPS and FedEx. Union
activists handed out leaflets to
raise awareness of the international
union network that the TWU
is building with the ITF and its
affiliates.

refused to go down the path of AWA’s, with Mr Byrne describing
them as "unfair for Linfox employees."
TWU Delegate Mick Miller from Linfox NBC Eastern Creek said
"It was great to see that despite WorkChoices we were able to
work with Linkox management to reach this agreement."
TWU Assistant State Secretary Wayne Forno, was the national
chief negotiator and said "congratulations to the Linfox
Negotiating Committee and all of those who work at Linfox
– you should be proud to be union."

Victory for TWU Members at TNT
TNT AGREEMENT WITH THE TRANSPORT
WORKERS’ UNION OF AUSTRALIA
DECEMBER 2007 – DECEMBER 2010
In February this year the hard fought negotiation of the agreement between
TNT and the Transport Workers' Union of Australia was finalised.
TWU New South Wales Assistant Secretary Wayne Forno said "The TNT
agreement was particularly challenging considering that the company had a
history of lobbying and supporting the radical and anti worker Workchoices
legislation. By establishing a national negotiating committee made up of rank
and file representatives on behalf of each State and Territory the union was
able to show the company that we are united and strong. This resulted in a
stunning victory for members at TNT."
Jeff Payne, employee driver at TNT McPhee was a NSW representative on the
national negotiating committee. Jeff said "When negotiations began I knew
that TNT was pro Workchoices, management made that very clear.
"By standing together at a national level we were so
much stronger than I could have ever imagined."
Tony Matthews, owner driver from TNT Enfeld said "We were unified and the
company knew it. By the end of the negotiations we had ensured that all
existing conditions were maintained despite Workchoices."
The signing of this agreement was a victory for TWU members within TNT right
across Australia, and showed that we can win by standing together.

file members. At this meeting
members fully endorsed the
heads of agreement negotiation.

and working conditions are
protected.

Road Tragedy: TWU Calls for Full Inquiry
The shocking deaths of three truck drivers
and a 12 year old boy in two separate truck
crashes in January has hit the trucking
industry hard.

A 12 year old boy and his father were killed
when two semitrailers collided on the
Newell Highway near the NSW-Queensland
boarder. The driver of the second crash also
died.
Your union believes that these tragedies highlight the dangerous
nature of long distance driving, and are a symptom of an industry
under a huge amount of stress.
The TWU has called on WorkCover NSW to investigate these crashes.
Your union believes that until regulatory authorities start looking
behind the scenes of what goes on, and not simply the carnage on the
side of the road, we will not see anything change.
TWU FIGHTS FOR TRUCK STOPS

The TWU continues to campaign for the greater provision of truck
stops across the country. Your union understands that truck stops
provide a crucial resign place for truck drivers to take a break and
manage their fatigue.
The current shortage earns that many drivers who are fatigued and are
desperate to pull over and rest simply can’t. Barry Grimson has been a
truck driver for over 40 years and says "there have been times when I
have been so tired and unable to find a truck stop, or even pull over on
the side of the road that I have considered stopping in the middle of
the road." There should be no doubt that the shortage of truck stops is
a national safety issue.
The TWU is committed to keeping up the fight to ensure that truck
drivers have a safe place to stop and rest.

CO-DELEGATE ESCAPES
INFERNO IN CENTRAL WEST
Les Oakley, a co-delegate from Linfox
FCL in Orange, escaped death and
serious injury on the Mitchell Highway
near Molong after a car crashed into his
semi-trailer on the 29th of October.
It’s believed the car exploded on impact
after crossing to the wrong side of
the road, killing the driver of the car
instantly.
Transport Workers’ Union Official Mark
Bell said Les was lucky to walk away
with just a few burns. Les said, "I was
a truck driver for 25 years, and this is
every driver’s worst nightmare."
The Transport Workers’ Union would
like to offer our deepest condolences to
the family of the man killed, and to Les
for this tragic ordeal.

Waste Workers Campaigned
Against WorkChoices
Bernie Banton
A True Hero
We lost a true Australian hero
with the passing of Bernie
Banton.
Pictured here are local TWU waste industry workers with
other TWU members after a day of doorknocking in the
Central Coast seat of Dobell. Transport Workers’ Union
Waste industry workers campaigned hard during the lead
up to the federal election. These waste workers recently
fought their own campaign to ensure they got a fair go
under a new council contract.
Vets Get Behind the
Wheel with a Message
Bernie courageously pursued
justice for sufferers of asbestos
related diseases and their
families and we all owe him a
debt of gratitude.
Mr Banton was praised by Kevin
Rudd in the the Prime Minister's
election victory speech, just
a few days before Mr Banton
passed away.
Mr Rudd lauded Mr Banton
and the unions that had
supported him in his fight for
compensation for asbestos
disease sufferers.
"Bernie Banton, you have been a
beacon and clarion call for what
is decent and necessary in life
and I salute you."
He was a man of integrity who
came to symbolise his cause. He
was loved, respected and will be
greatly missed.
Retired?
TWU Vets Brian Thomas and Steve Whittick had a message
for Joe Hockey during the Federal Election campaign. This
type of campaigning led to victories along the way for the
McArthur Express workforce, such as many employees
receiving fast-tracked payments which would not have
been possible without the hard work of the Vets.

Union Strength
at the Ballot Box
The 2007 federal election sent a clear
message that working families are
prepared to stand up and fight for their
working conditions.
However, the fight is far from over. Until July
working families are still faced with a Senate
controlled by conservatives. This means that
we need to remain united and strong and
continue the fight to ensure that the new
Industrial Relations system delivers fair and
safe working conditions for Aussie families.
The new IR system will be implemented
through two acts of parliament. Among
other things it is proposed that the first
Act abolishes AWAs and the second Act
establishes Fair Work Australia.
We need to continue our fight to ensure
that Workchoices is dead and buried and
that a new Industrial Relations system which
delivers for working families is implemented
without delay.
