Costa Introduction The cost of filing and protecting patents in the European Union is substantially higher than in other industrial countries and businesses organisations have consistently complained about the fragmented and inconsistent decisions handed down by European courts. Companies often have to fight legal actions in several European countries at once. The proposal to create a single patent court will make litigations cheaper and faster. Another problem for innovative businesses is the high costs of translating patents into all European languages. Patent reform has been on the EU agenda for several years but attempts to streamline a complex system have failed repeatedly. That is why Belgium which holds since July 1, 2010 the EU Presidency made the creation of a single EU Patent a top priority issue. The aim of creating an EU Patent is to give inventors the option of obtaining a single patent which is legally valid throughout the European Union. The expected advantages of this system are a substantial reduction in patenting costs (in particular those relating to translation and filing), simplified protection of inventions throughout the territory of the EU thanks to one single procedure, and the establishment of a single centralised system of litigation. they are made of and how they are made. In general, the exclusive rights of a patent owner to exploit the invention commercially last for a maximum of 20 years, subject to the payment of regular renewal fees. Anyone else wishing to use the invention while it is still patented must request authorisation from the patent holder and may have to pay a licence fee. In return for this exclusive right, the details of how it works are published. In this way, the scientific or technical know-how that made the invention possible is made public allowing others to further their own research. As a general rule the patent renewal fees increase over time. This means that only the most commercially viable patents are maintained for the full period. At the end of the twenty years, the patent lapses. Present situation Purpose of the patent A patent protects new inventions. It can cover how things work, what they do, what Today in the European Union (EU), patent protection is currently provided by two systems (neither of which is based on an EU EURO COSMETICS 21 Special Issue 2010 legal instrument): the national patent systems and the European patent system. Member States have their own patent offices which deal with applications for national patents. The protection conferred by a national patent is limited to the territory of the State concerned. If the applicant chooses to apply for a European patent, the application will be dealt by the European Patent Office (EPO), based in Munich. The EPO provides a single procedure for granting patents in Europe. It is an intergovernmental organisation covering presently 37 European countries (the 27 EU member states+10 other European countries not belonging to the EU). On the basis of one single patent application processed in one of the three official languages of the EPO (French, English or German), inventors or businesses can obtain a European patent. If the EPO grants a European patent, the full text of the patent, known as the “specification”, is published in the official language of the EPO chosen by the applicant as the language of the proceedings. At this stage, the applicant must also provide a translation of the part of the patent that defines the scope of protection the claims - into the other two EPO languages. This is not enough for the European patent to take effect in the Contracting States to the EPC. Indeed, the patent proprietor must choose the countries in which he/she wishes to have protection and validate his/her European patent in these states. A number of different validation requirements may apply. For instance, the patent propri- etor may have to pay a fee to the national patent office, to comply with various formal requirements and to provide a translation of the patent into the official language(s) of the State concerned. Although the Munich Convention creates a single system for granting patents, there is still no patent belonging to the EU legal order. Main features of the EU Patent The EU Patent is unitary and autonomous, i.e. it has equal effect throughout the European Union. It may only be granted, transferred or declared invalid for the whole of the Community. Latest proposals for the adoption of an EU Patent To overcome the present difficulties, the European Commission proposed an EU system still discussed at the level of the European Parliament and the EU Council of Ministers. The aim was to provide for a single patent title applicable in all Member States. The Regulation will supplement the Munich Convention. The EU patent will be issued by the Office as a European patent, specifying the territory of the European Union instead of individual Member States. Implementation of this Regulation will require the EU to accede to the Munich Convention, and a revision of that Convention to enable the Office to grant an EU patent. Once this Regulation has been adopted, the external jurisdiction for the EU patent will come under the exclusive jurisdiction of the European Union. The translation system for the EU patent would form part of a separate Regulation proposed by the EU Commission on 1 July, 2010. The EU Commission proposed a special arrangement for Member States where German, French or English are not official languages. The Office examines the application and publishes it and the patent, if granted, in the Register of EU Patents and/or the EU Patents Bulletin. Effects and Limitations of the EU Patent The EU Patent confers on its proprietor the right to prohibit, without his consent: ● the direct use of the invention, in particular making it, offering it, putting it on the market, importing it, etc.; Special Issue 2010 22 EURO COSMETICS ● the indirect use of the invention, through supplying it, etc. The rights conferred by the EU patent do not extend to a number of areas detailed in the proposal for a Regulation, such as acts done privately and for non-commercial purposes. Moreover, these rights do not extend to acts concerning the product covered by the patent carried out within the territories of the Member States, after that product has been put on the EU market by the proprietor of the patent or with his consent, unless there are legitimate grounds for doing so. The rights of the patent do not apply to the prior use of the invention. Therefore, if a person, in good faith and for business purposes, uses the invention or makes effective and serious preparations before the filing date, this person has the right to continue such use or to use the invention as planned during the preparations. Licensing The EU patent may be licensed in whole or in part for all or part of the European Union. These licences may be exclusive or non-exclusive. The rights conferred by the EU Patent may be invoked against a licensee who breaches any restriction in the licensing contract. The proprietor of a Community patent may authorise any person to use the invention, as a licensee, in return for appropriate compensation as fixed by the Commission. This authorisation is given, and can also be withdrawn, by written communication to the Office and this entails a reduction of annual fees for renewing the patent. The Member States are not empowered to grant licences of right in respect of the EU Patent. The Commission may grant a compulsory licence for lack or insufficiency of exploitation of an EU patent or in the case of depen- dent patents. It can also authorise the use of a EU Patent in some specific situations: in times of crisis, in other situations of extreme urgency, or in a situation where it is necessary to remedy a practice deemed after a judicial or administrative process to be anti-competitive. Renewal of the EU Patent Annual fees must be paid to the Office to renew EU patents. The amount of these fees will be fixed by means of an implementing regulation on fees, which will be adopted by a regulations committee. Surrender of the EU patent The Community patent may be surrendered only in its entirety. Surrender must be declared in writing to the Office by the proprietor of the patent, and only takes effect once entered in the Register of EU Patents. ● Lapse of the EU patent The EU Patent is valid for twenty years, calculated from the date of filing of the application. The patent will lapse if the renewal fee or any additional fee has not been paid on time. Invalidity of the EU Patent The grounds for invalidity include the following: ● the subject-matter of the patent is not patentable, ● the patent does not disclose the invention EURO COSMETICS 23 Special Issue 2010 in a manner sufficiently clear and complete for it to be carried out by a person skilled in the art; the subject-matter of the patent extends beyond the content of the application as filed. The patent is invalidated retroactively, except in decisions on infringement which have acquired the authority of res judicata and been enforced prior to the invalidity decision; nor does the retroactive effect of the invalidity affect contracts concluded and performed prior to the invalidity decision. However, in certain circumstances, it is possible to claim back sums paid under the relevant contract. Any person may initiate invalidity proceedings, except in the case where the right of the proprietor of the patent to obtain the patent would be contested. In this case, the initiator of the application must be the person entitled to be entered in the Register of EU Patents as the sole proprietor of the patent or by all the persons entitled to be entered as joint proprietors. courts. Any proceedings pending before a national court at the end of the transitional period should continue to be subject to the transitional regime. Request for limitation Invalidity proceedings may be brought even if the EU Patent has lapsed. The patent may be invalidated either in whole or in part. Single European Patent Court Presently companies often have to fight legal actions in several European countries at once, and national courts regularly come to conflicting conclusions on identical cases. The proposal providing for the creation of a centralised Patent Court to guarantee unity of law and consistent case law will make litigation cheaper and more predictable This court will comprise chambers of first instance and appeal. The allocation of judges should be based on their legal and technical expertise, linguistic skills and relevant experience. The centralised court will have exclusive jurisdiction for some actions, including disputes relating to the infringement and the validity of the EU patent. The court will deal in particular with disputes between private parties and will be empowered to impose sanctions and award claims for damages. Infringement action An action for infringement must be based on a presumed infringement of the rights conferred by the patent. This action may be brought by the proprietor of the patent or, in some cases, by the beneficiary of a licence. During a transitional period, not lasting more than 5 years, proceedings for infringement or for revocation of a European Patent may still be initiated before the national At the request of the proprietor, an EU patent may be limited in the form of an amendment to the claims, the description or the drawings. The request is only admissible with the agreement of a person who has a right in rem or a licence recorded in the Register of EU Patents. The Commission’s capacity to act before the EU Patent Court The Commission has the power to act if the EU’s interest is at stake. It may refer an action for invalidity of a patent to the court and intervene in any proceedings brought before the court. Sanctions and claims for damages The EU court may impose various sanctions. If a EU patent has been infringed, the court may issue the following orders: ● an order prohibiting the defendant from continuing with the acts which infringed the patent; ● an order to seize the products resulting from the infringement; ● an order to seize the goods, materials, etc., which enable the invention to be used. Jurisdiction of the national courts The national courts will only have jurisdiction which does not come within the exclusive jurisdiction of either the Court of Special Issue 2010 24 EURO COSMETICS Justice or the EU Court. The national courts will therefore deal, for example, with: ● actions relating to the right to a patent over which an employer and an employee are in dispute; ● actions relating to levy of execution on the EU Patent. Conclusions The adoption of Regulations creating an EU Patent would provide for a single patent title covering all EU member States. Once granted, there would be no need to validate the patent in different countries. Discussions on the EU patent started in the year 2000 with a text published in the Official Journal N° 337E of 28. 11. 2000, but the patent system has never been agreed by Member States. Now that Belgium took over the EU Presidency on 1 July, it seems that the Regulations creating a single EU Patent could be adopted before the end of 2010. The EU Patent would make the existing European system much simpler, much less burdensome and expensive for inventors. It would end the complex validation requirements, and in particular the very expensive full translation requirements which exist in many Member States. An EU patent would thus stimulate research, development and investment in innovation helping to boost growth in the EU. An EU patent would also protect inventions better as under the current system, because of the prohibitive costs involved in the national validation of European patents, many inventors only patent their inventions in very few countries. This means inventions are less valuable and they are not protected in other countries allowing them to be copied easily, and diminishing the economic value of European inventions. Also the European cosmetics industry cannot afford any longer a “single market” in which the same invention is subject to ❘❘❙❙ twenty-seven different legal systems!
