Celebrating Excellence in front of 1,111

On November 11, 2011, the Apartment Association staged the
latest edition of Tributes at the Sheraton Downtown Denver. This
event, held every three years, offers the industry the chance to
celebrate the excellence of our peers and colleagues. And how fitting
was it that on 11/11/11, the final attendence number at Tributes was
1,111 people?
This issue contains plenty of pictures recapping the event, but I
thought I would also add my thoughts on a fantastic evening.
First off, I want to thank the multiple committees and volunteers
who worked so hard to pull off this event. I absolutely appreciate
the time and effort invested by all of you. I hope you all had a great
time as you definitely earned it. Secondly, I would like to thank
our sponsors. Community Interiors presented the event. Apartment
Guide, Apartment Book, and Lynett Brockman & Associates were
Platinum sponsors and Victor Sanchez Photography, FastSigns and Cort
Furniture Rental were Gold sponsors. The support of our sponsors is
critical to the overall success of this event.

For those of you involved with AAMD, you know that Rocky
Sundling from Camden Property Trust is a tremendous asset to our
success. Rocky won the Tribute for Most Outstanding Regional
Manager (more than 1,950 units) and I am very pleased for him.
I started off my evening by doing what it seems 90% of the
attendees did that night, checked into the Sheraton. I could not
believe how many of you all were in the check in line when I showed
up. However, and not to get to too sanctimonious, I respect a lot
of the attendee’s responsible decision to stay downtown. After the
event and the multiple after parties, I was definitely pleased with my
decision as I think many of you were.
On a personal note, I was also pleased to see Greystar take home
the award for Most Outstanding Model Home (Built in the 1980’s or
Prior) for Stratford Station. Stratford was the first place my husband
and I lived after we graduated college, so I am definitely pleased
to see Greystar doing such a good job keeping it up. Also, kudos to
Cherie Shaw and her team for winning three categories as well.
While all of the winners deserve congratulations and recognition –
and the full list is included in the write up of the event – a few of the
categories especially caught my attention.
Finally, as I will have another chance to do so prior to the
Holidays, I would like to wish everyone season greetings and all the
best for 2012. It is hard to believe I am almost halfway through my
term and I look forward to working with you all in 2012.
I have known and worked with Pat Hutchison for over 13 years
and I was thrilled to see her take home the Most Outstanding
Executive (greater than 3,500 units) award. Pat has been a friend
and mentor to me and many others throughout her career. Overall,
Legacy Partners had a very successful evening in winning three
other categories plus winning the Grand Tributes Award for Most
Outstanding Management Company.

Tatianna Gruen, Government Affairs Coordinator, is a Colorado Press
Association award winning photographer who covered political events, worked
for a U.S. Senate candidate and for the Republican National Committee’s
Get-Out-the Vote campaign in 2010. She served as legislative aide to Colorado
Senator Steve King and Representative Don Coram, and as a consultant to a
Colorado Springs mayoral campaign in 2011. A Colorado Springs native, Tatianna
attended UCCS where she majored in political science and psychology. She
currently resides in Denver with her two Springer Spaniels, Jake and Lily.
Whitney Hopp, Office Manager, is originally from Traverse City, MI (home of
the National Cherry Festival and the Traverse City Film Festival). She has a B.S.
in Management/Marketing and over 5 years experience in banking/management
and many years of customer service. Whitney lives in the Aurora/Denver area
and enjoys outdoor activities such as hiking, riding horses, boating and camping.
She loves spending time with her daughter, family and friends.
Adam Johnson, Local Government Affairs Manager, has had a career in Colorado
politics for the last decade. Having worked for numerous elected officials, political
issue committees, and candidate committees, his unique knowledge of the political
process will help further the goals of the Government Affairs department here at
AAMD. Adam is a 3rd generation Colorado native who lives with his wife and two
young boys in Aurora.
Tim Pepe, Events and Program Coordinator, received his B.S. in Business
Administration from Mesa State College in Grand Junction, CO where he was
a student-athlete on the football team. He has spent the past 5 years working
in the education and sports industries coordinating special events, as well as
coaching high school football. Originally from Castle Rock, Tim currently lives
in Lone Tree. He enjoys playing and watching sports, and spending time in the
mountains skiing or hiking.

Hannah Miller, Special Events Administrator has joined the staff part-time while
also working as a media relations intern for the University of Denver men’s hockey
team. She graduated from Miami University in Oxford, Ohio, in May 2011 with a
B.A. in Journalism and a B.S. in Kinesiology and Health. Hannah spent the last year
working in media relations for the Miami University (Ohio) men’s hockey team.
She is a Denver native and has worked as a sports production intern at the Denveraffiliate CBS news station and Kroenke Sports Enterprises.

If you’re not asking prospective renters to lease from you when
they visit your office you’re not only doing yourself a disservice;
you’re doing THEM a disservice.
Time is valuable. When is the last time you had an abundance
of spare time? I’m guessing you can’t remember a time like that. So,
put yourself in the shoes of your prospect. They’ve taken the time to
view your property (either online or in print), they’ve quite possibly
contacted you ahead of time to either clarify any questions they had,
find out your hours or to make an appointment; and they’ve taken
the additional time to visit your property.
They have put forth time and effort to learn more about your
community. And you disrespect them by *not* asking them to lease?
What’s up with that, anyway? Assume the sale - they wouldn’t be
in your office if they weren’t sincerely interested in living at your
community. Here’s the exception to that old rule regarding the
word ‘assume’.

CELEBRATING EXCELLENCE
Friday evening, 11/11/11, will go down as a memorable night for many reasons, but none
more special than the AAMD Tributes celebration held at the Sheraton Downtown Denver.
It was a perfect night in Denver and the Apartment Industry shined bright under the city
lights. Believe it or not, there were 1,111 people who attended Tributes 2011 and it was an
assembly like no other. It was a celebration of the best of the best - the cream of the crop those who make the multifamily housing industry great!
The Apartment Association, with the help of so many incredibly generous sponsors, gave
out 52 awards for excellence in marketing, management, leasing, maintenance, property
categories, as well as industry supplier categories, and the entire room came to their feet
for a standing ovation when a lifetime achievement award was presented to
Dr. Gordon Von Stroh.
Legacy Partners was presented with the Most Outstanding Management Company Tribute
for the third time out of the last four Tributes events. All the award winners are listed in
the following pages.

Strategies Towards Zero Resident Turnover

bviously, zero resident turnover is not actually possible, but
if we set our goal at the best possible outcome, we are more
likely to get further along than if we try to barely move the
needle. So let’s have some fun brainstorming how to move the dial
towards zero resident turnover!
Stop Pushing Residents Out The Door
Customer Service and Maintenance – If your residents have
lingering maintenance requests, or if your customer service is not up
to par, then you will easily drive them from your community.
Long-term Lease Contracts – Create alternatives to the standard
one-year lease that mitigate concerns over achieving rent increases.
Why do we constantly make our residents re-evaluate their living
situation year after year?
Apply Concessions Immediately – Obviously concessions
are not recommended, but if they must be given, have it applied
immediately to the first months of lease. Therefore, the lease renewal
isn’t coupled with a large increase in rent purely because of the
concession expiring.
Release the Bad Apples – With your residents consolidated in
such a small area, it is easy for one nuisance neighbor to make life
miserable for several others, such as noise disturbances, trash, and
other issues. Instead of placating these bad residents, we need to
have good solutions to actually enforce our leases and drive these
residents out the door. The key? Document, document, document!
Rent Increases Coupled With Benefit Increases – We obviously
want to capitalize on market conditions that allow for higher rents.
But honestly, we often get very lazy when it comes to the increase,
with the mentality of “Take it or leave it, we’ll find someone else to
lease your apartment.” But that means that although you have gotten
your increase, you have to offset it with the turnover cost. And
besides, residents rarely understand the market adjustment to begin
with. Sure, if they move out they will get similar rent elsewhere, but
then at least they get a freshly painted apartment with possibly new
carpet, etc. So if we are giving big increases, why not plan in some
benefits to soften the blow? By escaping the turnover cost, you can
easily afford some tantalizing renewal benefits if they take the large
rent increase.
Inspire Residents To Want To Stay
Establish Emotional Ownership – The more effort you put
into something, the more likely you are to stick with it. A great
example of this is Google+. So many people will not want to join
Google+ because they have already established their social circle on
Facebook, as well as putting so much effort into their profile. When
it comes to renting, however, customizing and making the apartment
their “home” is more difficult, although renewal upgrades are an
interesting concept.

Create a “Sense of Community” – This is another factor that
moves from pushing out residents through bad service to making them
actively want to stay. Human connections are incredibly powerful, so
we should be analyzing more direct strategies to foster them.
Resident Referrals – Not only do resident referrals provide new
leases, but they are inherently resident connections right from the
start. Plus, having friends in the community essentially means you
have an “undercover sales force”. If Jack’s friend is thinking about
moving, but Jack’s lease doesn’t expire for 7 months, he will actively
try to convince his friend to renew!
Identify Potential Long-Term Residents
Targeted Niches – A resident will more likely stay at a community
that ties in with their lifestyle in a focused way. For example, going
beyond just “pet friendly” to a dog paradise would create multiple
connection points beyond just having a “sparkling pool” and
granite countertops. An unbelievable dog park will actually inspire
someone to say, “Duke loves the dog park – I would hate to take him
away from that.”
Targeted Resident Traits – Some residents are predisposed to
living at one place for long periods of time. Effectively targeting
these types of residents can naturally lengthen the stay for the
average resident.
Tighten Up Resident Approval Process – Not only do you want
to proactively reach out to those who could be long-term renters,
but you also want to weed out those who surely won’t. Obviously
do not do anything that violates Fair Housing, but restrict residents
who are obviously more transient by requiring that they have stayed
at their previous residence for longer than X years. Also, increase
income requirements to lower chance of default.
Problem-Solve To Help Residents Stay
Help Residents Who Are On Hard Times - Your community
should have a list of every reason someone decided to move. In a
time of high unemployment, you will have situations where residents
want to stay but simply can’t because of finances. You can help in a
variety of different ways:

Roommate Finder – Create a program that helps residents
find roommates to help spread the cost of rent across
multiple people.
•
Job Finder – We already have Preferred Employer Programs
to get referrals from companies, but why not reverse the
situation? Work with companies to establish a job board and
special lead-ins for residents who have lost their job? Also,
provide events that will help with finding a job, such as a
resume development workshop.

Apartment challenges discussed at FCC
Wireless Coverage meeting
O
n October 28, the Federal Communications Commission (FCC)
held a Forum to address options for easing the “spectrum
crunch” in wireless broadband and cellular access, a top priority
for the Commission. Current demand for bandwidth already vastly
exceeds the available wireless spectrum, and growing demand for highspeed access will further exacerbate the problem for both businesses and
consumers, including apartment owners and residents.

Although the FCC has not yet initiated a formal rulemaking process
to address the problem, the Forum will likely influence the direction of
an eventual proposal that could impact apartment firms.
NAA/NMHC Press HUD on Bed Bug
Guidance
Speaking on behalf of NAA/NMHC, Lyn Lansdale (AvalonBay
Communities, Inc.) discussed resident expectations for WiFi and cellular
access in apartment communities, and the corresponding public
policies, market demands, and infrastructure/engineering challenges that
can prevent apartment owners from satisfying those needs.
NAA/NMHC continue to press HUD to rescind its Bed Bug
Guidance (Notice H2011-20, see the August 29 AIMS Update) because
of serious deficiencies contained within it. At a meeting with senior
HUD officials on November 3, NAA/NMHC followed up on a previous
letter about the scope of the Notice, which applies not only to federally
assisted properties but also to properties with HUD-insured loans. HUD
acknowledged our concerns and indicated that they will likely revise the
Notice rather than rescind it.
Solving that problem is challenging for apartment owners because
many factors may limit wireless reliability, including design and building
materials, and because a community may be served by multiple and
variable telecommunications providers. Lansdale also noted that local
mandates to ensure broadband access for police and fire department
communications have increasingly required costly building retrofits.
Congress Tackles Section 8 Reform
The decade-long effort to reform the Section 8 program continues.
Earlier this month, the House Financial Services Committee held a hearing
on a draft “Section Eight Savings Act (SESA)” bill. The not-yet-introduced
bill makes numerous NAA/NMHC-supported changes to the program.
An earlier draft of the bill would have eliminated multiple inspections
of units that have already been inspected for FHA financing or
participation in the Low-Income Housing Tax Credit and other assisted
housing programs. It would also allow biennial inspections, allow
occupancy before initial inspection if the unit has passed an inspection
in the prior 12 months and allow the use of alternatives to HUD’s
housing quality standards.
The latest version, however, only allows those flexibilities for
housing agencies that agree to participate in a new self-sufficiency
We are strongly recommending lawmakers reinstate the earlier
legislative language, noting that, as originally written, the bill was
estimated to save the government nearly $1 billion. The Committee is
likely to address this issue before the new year.
Officials indicated that they were open to refining the scope of
the document in light of the “unfair cost burden to owners of certain
properties.” As HUD’s portfolio shifts its concentration to market-rate
from subsidized properties, the Department says it needs to pay more
attention to the fundamental management differences that exist between
federally assisted and insured properties.
We have also discussed our concerns with the Guidance with
members of Congress. At our urging, Rep. Robert Dold (R-IL) has written
a letter to HUD Secretary Shaun Donovan “strongly urging him to work
with the apartment industry and others to develop an improved, more
balanced approach” to dealing with bed bug infestations.
A separate letter from Rep. Steve Stivers (R-OH) to Donovan also calls
on the Department to rescind the notice, noting the lack of an adequate
comment period for affected housing owners and the unintended
consequence the Guidance has created by limiting property owners’
options to deal with threats posed to properties by bed bug infestations.
Stivers also calls troubling provisions in the Guidance suggesting that
HUD-insured properties could be put in non-monetary default for bed
bug infestations, even when a property has an ongoing integrated pest
management plan in place.

House Republicans Hold Hearing on
Latest GSE Reform Bill
The House Financial Services Subcommittee on Capital Markets held
a hearing on November 3 on legislation offered by panel Chair Scott
Garrett (R-N.J.) that would create a robust private market for single-family
housing finance. The measure is aimed at eliminating the federal role in
guaranteeing mortgage finance.
The proposal would task the Federal Housing Finance Agency (FHFA),
the current GSE regulator, with developing and enforcing standards for all
residential mortgage-backed securities. It specifically calls on FHFA to
create several categories of mortgages with uniform underwriting standards
for each as well as uniform securitization agreements and representations
and warranties.
It would also repeal the “risk retention” provisions included in last
year’s Dodd-Frank financial reform law.
Although the bill is silent on multifamily finance, NAA/NMHC are
actively following it because of the indirect impact it would have on
the multifamily if, as expected, the House considers it in conjunction
with a comprehensive GSE reform bill previously introduced by Rep.
Jeb Hensarling (R-TX). Hensarling’s bill would completely privatize the
housing finance system over the next five years. Even if the bills do pass
the House, the Senate is not expected to act on them.
International Code Council Recognizes
NAA/NMHC’s Ron Nickson
On November 2, the International Code Council honored NAA/
NMHC’s Vice President of Building Codes, Ron Nickson, with their 2011
ICC Affiliate Award in recognition of his 30 years in the industry. The
Award is presented to a building industry professional who consistently
demonstrates the qualities of integrity, professionalism and dedication
through service to the profession.
Ron was also cited for his efforts in launching the Bob Fowler
Motorcycle Ride, a charity fundraiser named after Fowler who had the
vision to bring the three regional code groups together to create the ICC.
Funds raised in the ride support scholarships to help local code officials
attend code development hearings. This year the program supported 94
scholarship recipients.
Controversial Lease Accounting Rule
Changes Exclude Apartment Leases
In a victory for apartment owners, the Financial Accounting Standards
Board (FASB) and the International Accounting Standards Board (IASB) on
October 21 announced they would exclude commercial property owners,
including apartment firms, from controversial proposed changes to lease
accounting rules.
The now-jettisoned proposal would have required apartment firms
to account for all of the income for leases lasting longer than 12 months
on their balance sheets at the time of execution. Because the proposal
included leases with optional renewal periods, a large number of
apartment leases would have been covered. If effectuated as originally
proposed, apartment owners would have had to modify their lease
management tracking procedures and data management to facilitate the
new accounting treatment. Second, firms would have had to decide
whether to use two different standards--one for leases under a year and
one for longer-term leases.
The new FASB/IASB rules were supposed to be finalized in June 2011;
however, most observers now believe they will not be enacted until 2015
at the earliest. A final draft version is expected in the first quarter of 2012.
