8 EXPRESS NEWS SERVICE EXPRESS NEW DELHI l FEBRUARY 5 l 2012 Our stand vindicated, BJP should say sorry: Sibal WHAT THE COURT SAID On the decision not to revise prices THE COMPETENT authority is always at liberty to decide in its discretion not to revise the prices or fee for any goods or services. The same entry fee/ spectrum charges continued even after 2007-08. Same is the case with dilution of equity by a company. It is not per se illegal nor was it prohibited at the relevant time. However, such acts may acquire criminal colour/ overtones when done with criminal intent. ‘Incriminating acts’ THE SUBVERSION of the process of issuance of letters of intent, UAS licences and allocation of spectrum included arbitrary fixation of the cut-off date, filing and procuring of applications for UAS licences on behalf of ineligible companies, violation of first-come first-served policy in the issuance of LOIs, UAS licences and allocation of spectrum and payment and receipt of bribe. All these incriminating acts were allegedly done by the minister/ officials of Department of Telecommunications, Ministry of I&B, Government of India and by private persons. ‘Taking decisions is not criminal’ A DECISION taken by a public servant does not become criminal for the simple reason that it has caused loss to the public exchequer or resulted in pecuniary advantage to others. Merely attending meetings and taking decisions therein is not a criminal act. It must have the taint of use of corrupt or illegal means or abuse of his official position by public servant for obtaining pecuniary advantage by him for himself or for any other person or obtaining of pecuniary advantage by him without any public interest. EXPRESS NEWS SERVICE Verdict will end ‘unrest’ in govt NEW DELHI I FEBRUARY 4 B ATTERED by a spate of unfavourable judgments in the last few days, the trial court’s verdict in Home Minister P Chidambaram’s case brought much-needed cheer in the ruling establishment, which described it as a vindication of its stand, and demanded apology from the BJP for running a vilification campaign against Chidambaram. “We always knew that our colleague (Chidambaram) was absolutely not culpable for anything in the allegations made by Subramanian Swamy. I know the Subramanian Swamy talks to reporters after the court verdict, in New Delhi on Saturday. OINAM ANAND evidence and sifted through the evidence and there is absolutely no responsibility that can be foisted on my colleague,” Telecom Minister Kapil Sibal said after Justice O P Saini dismissed Swamy’s petition seeking to make Chidambaram a co-accused in the 2G spectrum allocation scam. Attacking the BJP for repeatedly demanding Chidambaram’s resignation on this issue, Sibal said the BJP leaders must now tender a public apology to him. “In fact, they should go to his PUNE: Union Agriculture Minister Sharad Pawar on Saturday said the dismissal of the plea against Home Minister P Chidambaram will end “unrest in the government”. “There was a kind of unrest among members of the UPA. Chidambaram is a minister with a clean image and there was a concern when allegations were made against him,” Pawar said. “The decision of court should be accepted,” he said. ENS house and apologise to him.” In Kolkata, Finance Minister Pranab Mukherjee said, “It is a relief (for the government) because someone was unnecessarily being perse- cuted. Even in the Supreme Court judgment it is very clearly mentioned that the advice of the Finance Ministry was not heeded.” The Congress, which is running a poll campaign in UP on the graft issue, said Saturday’s verdict had settled the issue and the opposition parties must put a stop to their attempts to vilify Chidambaram and the party. “Political parties especially the BJP, owe an apology to the nation for the calumny, vilification and innuendo, which they have carried out over the past one year,” party spokesperson Maneesh Tewari told reporters. “Now that both courts have spoken, the Supreme Court and the trial court on substantively the same issue, the matter should be allowed to rest.” WHAT THEY SAID I am surprised ...very, very strong case (against Chidambaram).... I will go to another court. This order deserves to be reserved. I will certainly appeal against it. — SUBRAMANIAN SWAMY Janata Party president ●●● This verdict will not change the corrupt image of the government or the intensity of our campaign.... The issue of Chidambaram’s political accountability remains alive. — RAVI SHANKAR PRASAD BJP spokesperson ●●● This is a relief for the government. Someone was unnecessarily being persecuted. — PRANAB MUKHERJEE Finance Minister ●●● TIMELINE SEPT 15, 2011: Swamy tells court he will bring new facts that Chidambaram and Raja had a role in deciding 2G spectrum prices and entry fee SEPT 22, 2011: CBI defends Chidambaram in SC, blames Department of Telecom OCT 10, 2011: SC reserves order on Swamy's plea for a probe into the alleged role of Chidambaram in the 2G scam JAN 7, 2012: Swamy places on record certified copies of the documents in support of his private complaint against Chidambaram JAN 21, 2012: Special Court reserves order for February 4 FEB 2, 2012: SC refuses to ask CBI to probe role of Chidambaram in 2G case and leaves it to the Special Court to decide the matter FEB 4, 2012: Special Court dismisses Swamy's plea to make Chidambaram a co-accused PTI Will continue to target Chidambaram, says BJP EXPRESS NEWS SERVICE NEW DELHI I FEBRUARY 4 WITH Special CBI Judge O P Saini having taken the wind out of its campaign against Home Minister P Chidambaram, a disheartened BJP on Saturday harped on his “political accountability” in the 2G spectrum scam. Party spokesperson Ravi Shankar Prasad, who was extremely combative in attack- ing the government just two days ago following the Supreme Court’s order cancelling 122 telecom licences, said that the party would continue to seek “accountability” of Chidambaram and the government in the case. “This verdict is not going to change the corrupt image of this government. Neither are we going to bring down the intensity of our campaign against this corrupt govern- ment. The issue of political accountability of Chidambaram remains as alive as ever,” he said. “We will raise this matter in Parliament and also with the people outside,” he said. Prasad said the order of the trial court was not the final word on the issue in any case. “This is the decision of a lower court which would be appealed. The High Court is there, the Supreme Court is there. This is not over,” he said. “We cannot lose sight of the fact that the Supreme Court has cancelled 122 licences because it was a scam and there was corruption. The licences were allotted arbitrarily and through manipulation,” he said. “We are very clear that there is enough evidence against Chidambaram in public domain.... The BJP shall continue to pursue the matter before the people of the country. The nation seeks a reply,” he said. Senior party leader Jaswant Singh agreed that Saturday’s order was disappointing for the party but said this was not the end of the story. “But nobody in this government is still ready to answer on the loss of moral authority and credibility they have suffered,” he said. It is premature to conclusively say who is wrong and who is right. — SUKHENDU SEKHAR ROY Trinamool Congress ●●● All irresponsible individuals and political parties who obstructed Parliament... should now apologise to the nation, then to the Congress, then to Chidambaram. — ABHISHEK SINGHVI Congress spokesperson Congress’s first list out, all ministers in EXPRESS NEWS SERVICE MUMBAI I FEBRUARY 4 Suresh Kalmadi arrives at Pune airport on Saturday.
