Newsletter 2016-13 April 1, 2016 AWARDS PRESENTATIONS, LEGISLATIVE RECAP TOPICS AT CAWV STATE MEETING The 2016 CAWV State Meeting, held March 23 at the Charleston Civic Center, honored CAWV member firms for their commitment to safety on the jobsite and excellence in concrete construction, and future leaders of West Virginia’s construction industry. Over 200 CAWV members and guests, including federal and state contracting officials, attended the meeting, held in conjunction with the West Virginia Construction & Design EXPO. Fourteen contractors in the Building, Highway, Utilities, Industrial, Specialty and Associate divisions received safety awards based on their commitment to jobsite safety. Seven students received a total of $17,500 from the CAWV Scholarship Foundation to further their studies in construction-related curriculums. (See both articles below). Two firms were honored for excellence in concrete construction. (See this week’s Highway Bulletin). GUBERNATORIAL CANDIDATES GIVE THEIR VISION FOR STATE Members also joined the opening session of the WV Manufacturers Association’s Marcellus and Manufacturing Development Conference (MMDC) where they heard from U.S. Senator Shelley Moore Capito. Many CAWV members listened to the four major party candidates for governor when they spoke at Thursday’s MMDC program. Former U.S. Attorney Booth Goodwin, businessman Jim Justice, state Senate Minority Leader Jeff Kessler and state Senate President Bill Cole all spoke, separately, at the Charleston Civic Center. Goodwin spoke first, stressing growing the state’s economy. He listed his priorities if elected governor. First up is repair and build West Virginia’s infrastructure. “We must make a substantial investment because building infrastructure is key to providing immediate and longterm diversification of our economy,” he said. He proposed funding projects through bonds, public-private partnerships and using Rainy Day funds. Attacking the state’s illicit drug problem ranked high, as did reinventing the state’s coal and oil and gas industries and free tuition at public colleges and universities. Justice spoke second and stressed his business success, love of West Virginia, ability to promote the state and electability. “I’m a marketer. I’m a marketer in chief. That’s what I am. Really and truly,” he said. “We don’t need to be taxing our people more,” he said, but “we cannot possibly cut our way out of this mess.” He said higher revenue will come with more job growth and he has the background to create jobs through his business acumen. Kessler touted his years in the state Senate and spoke in detail of the legislative accomplishments. “Fixing problems, that what I’ve done,” he told the audience. “We fixed medical malpractice, an out of control workers’ compensation program and made sure our unemployment compensation program is not in a crisis. We also created Tax Increment Financing that created economic development projects such as Cabela’s in Wheeling, Pullman Square in Huntington and the ball park in Charleston.” He said his campaign if focused on investing in people – through education and drug treatment – and investing in infrastructure – roads and broadband – both of which will require tax money. “You don’t fix roads and fix potholes on wishes and spit,” he said. “You need to have asphalt and that costs money.” The final presenter was Senator Cole who stressed that West Virginia must be open for business and that the Legislature has passed bills to make the state attractive to business. He noted tort reform, reducing regulatory burdens and right-to-work legislation as a good start but the budget must be revamped. “We need a governor that will go in with a scalpel that will reshape, reform, modernize state government,” he stated. “We can’t do draconian cuts across the board and slash good programs.” Cole spoke repeatedly of “the old status quo bunch” that has run the Legislature for more than eight decades. “I promise you I will be there for the right reason, if elected,” he told EXPO attendees. LEGISLATORS STILL CONSIDERING BUDGET OPTIONS Governor Tomblin and legislative leaders still seem at odds on how to balance West Virginia’s 2017 budget which, as projected now, has a $270 million funding shortfall. Senators voted for a budget which included a $1.00 per pack increase in the cigarette tax to help balance a $120 million shortfall in the Public Employees’ Insurance Agency and over $300 million for the West Virginia Division of Highways. The House refused to go along with increased revenue for PEIA and highways by not taking up the Senate’s revenue bills. Lawmakers learned at the end of the session that the state’s budget shortfall had grown by another $92 million, causing the governor to send lawmakers home without passing a budget. House leaders continue to argue that state government is too large and that reductions in spending are needed to balance the budget, not increased revenue. Others note that there can be no balanced budget without both spending cuts and tax increases. Governor Tomblin earlier this week provided a “worst case scenario” for cuts that may have to be made if the new state budget is approved without tax increases and the entire “$270 million shortfall is addressed with funding reductions only. Those possibilities included the following: A four percent, or $63 million, reduction to public education spending, leading to layoffs of 800 school teachers and 500 service personnel; an eight percent, or $28 million, reduction to higher education, translating to closures of institutions or their branches; and the removal of $47.5 million from the Promise Scholarship program, ending the scholarship program. Tomblin Administration officials claimed the kinds of cuts needed would, hypothetically, eliminate all General Revenue funding for the Commerce Department, the Department of Education and the Arts, the Department of Revenue minus the Tax Department, the Department of Veterans Assistance and State Police. At press time, it was not clear when lawmakers could be called into a Special Session to finalize a budget. 2016 CAWV SCHOLARSHIP FOUNDATION AWARDS $17,500 TO FURTHER CAREERS IN CONSTRUCTION The 2016 scholarship award winner, Paige Thewes, was announced at the CAWV State Meeting in conjunction with the West Virginia EXPO. The civil engineering student from Marshall University was awarded $6,000. “As a third generation bridge builder, I have a passion for structures and designing them,” said Thewes. “I chose civil engineering because highway and bridge design and construction have always been interesting to me. I enjoy watching the different stages of projects come together to form the final product. Each semester I fall further in love with engineering.” In addition to Paige, the Foundation presented seven other scholarships totaling $11,500. Students receiving scholarship awards were: Justin Smith, West Virginia University; Robert Tennant, West Virginia University; Ben Goffin, Bluefield State College; Meredith Stains, West Virginia University; James Cole Anderson; Fairmont State University; Eric Starliper, West Virginia University; and Jason Bryan, Marshall University. Look for a complete story on the scholarship awards in the May/June issue of West Virginia Construction News. 2015 CAWV SAFETY AWARDS ANNOUNCED AT STATE MEETING During this year’s CAWV State Meeting, the Safety Committee presented the 2015 Safety Awards. Annually, the committee recognizes contractor and associate members who have exhibited excellence in safety at the workplace. Less Than 50,000 Manhours: New River Engineering CAWV HAS SUCCESSFUL BLOOD DRIVE – OVER 50 UNITS DONATED DURING EXPO The CAWV hosted its fourth blood drive on March 23 and 24 at the Charleston Civic Center during the WV EXPO in memory of Cynthia Snyder, the late wife of Past CAWV President Lee Snyder. The Memorial Blood Drive successfully obtained 52 units and a grand total of 312 units over the past four years. March 23 was the first time obtaining 100% of goal for the day. The CAWV would like to thank the Red Cross of Central West Virginia, all donors, participants, and volunteers for making this such a successful event. A very special thanks to BB&T / Carson Insurance for providing volunteers for the canteen and registration areas throughout the two days. EXPO WRAPS UP 37TH SHOW The 37th Annual West Virginia Construction and Design EXPO wrapped up last week at the Charleston Civic Center. Scissor lifts aren’t just used in warehousing; they also are common in the construction, retail, entertainment and manufacturing industries, among others. OSHA points out that over a one-year period it had investigated 10 fatalities and more than 20 other serious injuries it termed preventable involving scissor lifts. OSHA says it found that most of these injuries and fatalities were the result of employers not properly addressing fall protection, stabilization and positioning. OSHA reminds employers that only trained workers should be allowed to use scissor lifts, and employers should make sure that those workers show that they can use a scissor lift properly. Training must at a minimum include manufacturer’s instructions for operating and moving the lift, handling materials on the lift, including weight limits, and other worksite hazards workers could encounter, such as contact with electrical wires. OSHA stresses that training must cover reporting any equipment defects or maintenance needs. Employer obligations include making sure the equipment is properly maintained, manufacturer’s instructions are followed, personal protective equipment is worn, and safe work practices are practiced. To avoid falls, lift platforms must have guardrails, and employees should be trained to check to make sure a guardrail is in place, only stand on the work platform, never stand on the guardrails, and keep work within easy reach to avoid leaning away from the lift. To assure stabilization OSHA notes that manufacturer instructions for safe movement usually rule out moving the lift in an elevated position. Isolate the scissor lift or implement traffic control measures to ensure that other equipment cannot contact the scissor lift, the agency says. Also select work locations with firm, level surfaces away from hazards that can cause instability, such as drop-offs, holes, slopes, bumps, ground obstructions, or debris. Use the scissor lift outside only when weather conditions are good, OSHA adds, noting that scissor lifts rated for outdoor use are generally limited to wind speeds of less than 28 miles per hour. OSHA cites the example of a student employee of the University of Notre Dame who was killed in 2010 while filming a football practice from a scissor lift. Untrained, he chose to raise the lift more than 39 feet, and winds gusting more than 50 miles per hour blew the lift over. “Positioning the scissor lift to avoid electrocution, arc flash and thermal burns is important for safely using scissor lifts near energized power lines,” OSHA warns. “Since electricity can arc or jump from the power line to the scissor lift or worker, electrocution can occur even if neither the scissor lift nor the worker touches the power line.” Although rare, the collapse of scissor lifts can be prevented if employers ensure that safety systems designed to stop collapsing are maintained and not bypassed. Never allow the weight on the work platform to exceed the manufacturer’s load rating. Never allow equipment other than the scissor mechanism to be used to raise the work platform—including using a forklift to lift it. The grants were presented recently to Jackson County Commissioners, County Clerk Cheryl Bright, Northern Jackson County Public Service District representatives and representative of the Trace Fork Water Committee. Gov. Earl Ray Tomblin presented a $704,000 Small Cities Block Grant to Commissioners Dick Waybright, Mitch Morrison and Mike Randolph and representatives of the NJCPSD and Trace Fork Water Committee toward a $1.28 million project to extend water service to 54 new households along Trace Fork Road. The project will provide reliable water service to area residents who currently rely on private wells and other water collection methods. Commissioner Morrison called the receipt of the grant a great day for Jackson County and for Trace Fork residents. Gov.
