German legal framework
• The permit authority is not the
Federal Aviation Administration
(Luftfahrt-Bundesamt LBA)
but the aviation authorities
of the 16 states.
• But: in June 2012
The MoT (BMVI) coordinated
the 16 civil aviation authorities
to harmonize and define a
framework of the administrative
action for granting civil operation
of unmanned aviation systems:
“Principles for granting permission
to fly unmanned aercraft systems
(Air Traffic Regulations (NfL I 161/12)).

German legal basis
• Rules concerning operations
Operation of RPAS is interdicted
• outside the range of VLOS and
• with a weight > 25 kg
(§ 15a III LuftVO (Air traffic regulation))
Other operation needs an ascension permission
(§ 16 I LuftVO (Air traffic regulation))
Exceptions (special authorisation) from the interdiction are
possible
