Agenda Number: DRC 13-01 MEETING DATE: February 14, 2013 REPORT TO THE DESIGN REVIEW COMMISSION SUBJECT: Appeal of an administrative interpretation of the Design Guidelines in a memo dated December 18, 2012, by R. Scott Henninger related to the review of a Site Plan modification exterior alteration application for Sunrise Chevrolet Buick GMC in the Houston Levee Business Center PD, Area 1. 1. 2. 3. Scott Henninger staff comments memo with attachments (12/18/13) Photos of existing legal nonconforming Sunrise Chevrolet Buick GMC compared to the proposed changes (2/6/13) INTRODUCTION: Doug Burris, representing 4. Sunrise Chevrolet, is requesting an appeal from staff interpretation of the Design Guidelines related to the Site Plan Modifications/Exterior Alterations at Sunrise Chevrolet Buick GMC in accordance with the new General Motors branding. The subject property is located on the southwest side of Houston Levee and 385 and is part of the Houston Levee Business Center, PD. The subject property is zoned SCC. BACKGROUND: The property was approved in 1998 as an automotive use for Bill Heard Chevrolet with a CUP from the Board of Zoning Appeals. In 2000 the Town removed the use “automotive dealership” from the Use Table for SCC and moved it to GC with added special Conditional Use Permit (CUP) conditions/design criteria (see attached) for new auto dealerships. For these reasons the Town reviewed the Sunrise dealership and its site and structures as legally nonconforming. In 2009, the Sign Ordinance was revised to allow multiple franchise signs. In 2011, the Town revised the Design Guidelines to allow Aluminum Composite Material (ACM) panels. Recent approvals for auto dealers that met the Design Guidelines were for Chrysler Dodge Jeep Ram in 2012 and Mercedes in 2013 (See the attachments for Exhibit 3 for the Chrysler and Mercedes). ISSUES: The issue is whether Mr. Henninger, on behalf of the Town, was in error or acted in an arbitrary manner in his determinations contained in the December 18, 2012 staff comments sent to the applicant’s representative. The Staff comments indicate that there are several proposed materials and colors proposed for the new GM image that are not appropriate in according to the Design Guidelines. It must also be noted that additions and changes must not add to the site or buildings nonconformance when compared to the current CUP standards in section 151.024 (J). See page 2 of Exhibit 3 for the list of standards that changes to this site must adhere to for approval highlighted in yellow. Below is a list of the materials noted by Mr. Henninger in the December 18, 2012 staff comments memo (See Exhibit 3 for the specific comments) about each of the materials that do not meet the Design Guidelines: 1) The Alpolic Blue and bright white ACM proposed for the entry does not meet the intent of the Design Guidelines. 2) The highly polished aluminum ACM panels do not meet the intent of the Design Guidelines. 3) According to Section IV of the Design Guidelines the use of white paint on the brick and EIFS does not meet the intent of the Design Guidelines. The Guidelines directs variation in materials, textures, patterns, colors and details to break down the mass and scale of the building, (Design Guidelines IV A) . The applicant’s request to paint all the buildings at Sunrise snow white creates a site with non-descript buildings and no variations as required. 2/8/2013 2:01:48 PM Page 1 of 3 Franchises must also meet these guidelines and blend with Collierville’s character. In recent years national retail chains have developed more options in their standardized designs. New franchise designs shall be modified as needed to follow the guidelines. DISCUSSION: The purpose of this request is for the Design Review Commission (DRC) to affirm or find error in staff’s decision regarding the list of materials used for Sunrise Chevrolet at 4605 S. Houston Levee Road. If the DRC affirms the interpretations in Mr. Henninger’s December 18th memo, then it would be appropriate for the DRC to direct the applicants’ representative as to what colors and materials would meet the Design Guidelines. In a recent application, the DRC did not approve the highly reflective material for the application for Chrysler, Dodge, & Jeep. In that case, the Design Review Commission recommended to the BMA proposed materials and colors that clearly followed the materials and colors allowed by the Design Guidelines. NEXT STEPS: If the applicant is not in agreement with the determination of the DRC an appeal can be submitted to the BMA for review of the appeal. If there is a disagreement with the Zoning Ordinance (signage, lighting, CUP conditions, etc.) the final appeal process is to the Board of Zoning Appeals (BZA). The BZA’s decision is final. If the applicants agree with the DRC decision, submit revised plans per the December 18, 2012 staff comments memo from Mr. Henninger Signage is not included in this approval. A sign permit application shall be submitted to the Planning Division prior to the erection of any signage. If Staff’s determination is affirmed then the plans must be revised and resubmitted with the required application to the Planning Department for review using materials and design that meet the Design Guidelines as noted in the Exhibit 3. EXAMPLE MOTION: To move to affirm (or overrule) the actions of staff’s interpretation of the Design Guidelines related to an Appeal of an administrative interpretation of the Design Guidelines in a memo dated December 18, 2012, by R. Scott Henninger related to the review of a Site Plan Modification/Exterior Alteration application for Sunrise Chevrolet Buick GMC in the Houston Levee Business Center PD, Area 1. If the DRC votes to overrule the actions of staff’s administrative interpretation as noted in the memo of December 18, 2012 regarding the Design Guidelines requirements, then the DRC will need to an explanation of the decision to the motion. If it is not an entire overrule the DRC will need to state the necessary revisions to the review of a Site Plan modification and exterior alterations to the application of Sunrise Chevrolet Buick GMC in the Houston Levee Business Center PD, Area 1. Your suggestions of color swapping are not helpful in item number 2 of your response. Please note, the design of the entry portal and signage for each are "branding items" designed by General Motors and have become their new image standards across the country and are not modifiable. Altering such an item is like asking McDonalds to lose or modify the golden arches. As I have said before, the entry portals are like bases for the signage or letters applied. The actual sign letters will comply with the 200 SF requirements that you have restated. But it is the "base" or "monument" that we are requesting you refer to as a "brand object" (similar to the golden arches example), that is part of the signage image. If you can view this object that way it gets us around the issue of it being part of the building and colors for the building that comes short of meeting your design guidelines. This last statement summarizes the entire basis of our argument. I ask that you and the board review it that way. I believe your repeated position on this issue is flawed and this is why we wish to discuss with the DRC. In regards to the conditional use permit that goes back to 1998 and due to the dropping of the automotive dealership guidelines in 2000 is a brand new conversation to me at this juncture. However, I will address some of the items you mentioned even though I do not believe are even applicable to this submission. Let me respond to them in the order you have in the following; • We wish to discuss the colors on the building with the DRC. • We are not proposing any changes to the glazing on this project and therefore this item does not apply. • We are not proposing any further architectural "style" changes. The existing building has clean contemporary lines and designs and the proposed new upgrades adds definition and interest to the façade or east face in the form of the entry portals that are free standing and not part of any building enclosure. • We are not decreasing any brick veneering on this structure. This comment does not apply. • We are only adding ACM panels to the existing fascia wall area above the brick veneer where existing EIFS occurs. This is an upgrade of finishes for this project. All other existing EIFS will be repainted to match the new ACM color scheme. All EIFS do age and discolor over time and we see this as an upgrade. We are not changing any landscaping or touching the site in anyway other than what the town has suggested we do. For pedestrian access from the mall and intersection the owner has agreed to add a sidewalk. We are also replacing some small shrubs around the existing dumpster with taller planting upon your request. As helpful "tradeoffs" these items were considered. Please let me clarify again, there are no building footprint changes or significant building changes, nor are there site modifications requested on this project. It is the owner's intent to do minimal demolition and reconstruction and wishing to implement the GM standards which mean new fascia cladding, painting the building and adding the free standing entry portals with new lettering. This owner implores you and the board for review it as cosmetic improvements and to not over complicate this simple building renovation. They are more than happy to consider common sense recommendations to better improve this community but please realize they have limited ability to change any branding elements.
