The 2013 Korea-Thailand Copyright Forum “Copyright Policy and Licensing in Digital
Era: Korea’s and Thailand’s experience” is an important international forum for the
professionals and specialists in the Thai and Korean creative industry. The major aim of the
Forum is to share valuable experience and strategies for promoting creative industry through
effective copyright protection system. The speakers would present the selected interesting issues
regarding copyright protection and business promotion strategy, especially in the digital era
which the technology is rapidly growing as well as the development of copyright infringement via
internet and online channels.The Forum would contribute fruitful idea in order to developing the
effective solution for copyright protection to industry, which reflect to the development of
creative industry of the nations.

KOREA COPYRIGHT COMMISSION (KCC)
The Korea Copyright Commission, the single
authentic institution of Korea in the field of
copyright and an affiliate to the Ministry of
Culture, Sports and Tourism of Korea, has
been making its best efforts to build up a fair and balanced copyright system since its
establishment in 1987 under the Copyright Act of Korea. The KCC aims to encourage authors to
create works and build up a fair and balanced copyright system in order to contribute to the
development of culture an copyright industry in Korea. Three major areas that the KCC
concerns are creative environments for legitimate use of copyrighted content; education and
publicity on copyright issues; and overseas promotion of copyrighted content.
Roles and Responsibilities of KCC
Copyright deliberation and conciliation
Operating the copyright registration system
Education & training to foster human resources in the field of copyright
Promotion and publicity to enhance the public awareness on copyright protection
Appraisal services with regard to copyright infringements upon requests by courts or any
investigative institutions
Conducting diverse in-depth research
Enhancing international cooperation
KCC BANGKOK OFFICE
Established in May 2007, the Korea Copyright Commission Bangkok Office is responsible for promoting
and protecting Korean copyright in Southeast Asian countries.
Bangkok Office’s Role and Responsibilities
Facilitating smooth communication between Korea and Southeast Asian countries by providing
information about the Korean copyright system
Offering in-depth information by conducting research on the legal system, licensing practices,
industry technology, current issues and trends in the field of copyright in cooperation with
academic research centers and local correspondents in Southeast Asian Countries
Encouraging partnership with local authorities and cultural industries through various networks
to promote public awareness on copyright
Assist to facilitate copyright licensing through consultation on the local copyright system and
information about cultural industry trends

MINISTRY OF COMMERCE & DIP
MINISTRY OF COMMERCE
The Ministry of Commerce is in charge of trade, prices of important
agricultural goods, consumer protection, entrepreneurship, Insurance,
Intellectual property protection, exports and representing Thailand at the
World Trade Organization. The Ministry was founded in 1892 by King
Chulalongkorn (Rama V), by separating the ministry from the Ministry of
Agriculture and Cooperatives. The Ministry moved to its present premises
in Nonthaburi in 1989. The current Minister is Mr.Niwattumrong
Boonsongpaisan and the Deputy Ministers are Mr.Nattawut Saikuar and
Mr.Yanyong Phuangrach.
The main missions of the Ministry are;
- To generate country's income and value added for products and services
- To strengthen domestic economy & trade and create opportunities for
entrepreneurs
- To ensure free & fair trade and strengthen consumer & producer protections as
well as enhance intellectual property
- To develop and manage trade system to efficiently support trade competitions
DEPARTMENT OF INTELLECTUAL PROPERTY (DIP)
Department of Intellectual Property (DIP) was established in 1992.
It takes over missions relating to the administration of intellectual
property from the Department of Commercial Registration (Now has
been changed into “the Department of Business Development”)Ministry of Commerce.
The structures of the Department in reorganized several times during 1999 until now as
to facilitate the adjusted roles, mission and strategies aiming as higher efficiency and
effectiveness in the protection of intellectual property and to becoming a leading
agency in enhancing the competency in intellectual property protection and service, as
its vision.
DIP has the major missions as follows;
1. Encouraging creation of intellectual property
2. Promoting management and commercial exploitation of intellectual property
3. Developing services thoroughly and efficiently
4. Developing intellectual property protection system towards comprehensive efficiency
5. Putting force fair use of intellectual property right and suppressing right infringement
6. Developing network both domestic and foreign countries.
The organization of DIP includes Patent Office, Copyright Office , Trademark Office,
Office of Prevention and Suppression of IPR Violation , Legal Affairs Division and IP
Promotion and Development Division-which also including the internal functions for
promotion of IP product of Thailand.

Digital will drive growth and will account for 47% of global E&M spend by 2017
Within the global E&M market, digital will be the main driver of growth in the next five years, with revenues
increasing at a CAGR of 13.1%. By 2017, digital revenues (including consumer spending on digital content, digital
advertising spending and spending on Internet access) will account for 47% of the total up from 34% in 2012.

2. KoreaKorea- Significant creator of intellectual property
Korea provides strong intellectual property rights (IPR) protection and enforcement.
• Korean government places the importance on IPR protection, a development that has accompanied
Korea‟s shift to becoming a significant creator of intellectual property.
• The 2009 amendments to Korea‟s Copyright Law include measures to deter copyright infringement via
file-sharing platforms on the Internet.
• In 2010, the Korean government imposed sanctions against serial infringers under the “three strikes” law,
and in 2011 it passed a law requiring online high-volume storage lockers (“webhards”) to register with the
Korea Communications Commission to address technical challenges related to online copyright
enforcement.
• On December 2, 2011, Korea‟s National Assembly passed an amendment to the Copyright Act closing a
sound recording protection gap for works produced between July 1987 and June 1994. This change
expanded copyright protection for these works from 20 to 50 years, the same level of protection afforded
for all other works.

3-3. The new rules of music licensing in Korea
The new rules of music licensing in Korea from 2013
• The new rules raise the price of music services and allocate the revenue share over 60% to the copyright holder.
• The new hold-back system does not include the new song titles for the monthly subscription service.
• The new rules lower the discount rate of download packages and it promote the benefit of the copyright holder.

4-1. Korea’s digital home video market will rise over 4 times in 10 years
Korea’s digital home video market will expand at a projected 12.2 percent compound
annual rate. Spending will rise from $99 million in 2007 to $417 million in 2016.
• Growth in digital cable and telephone company services are expanding the potential video-on-demand market.
• Providers are promoting video-on-demand to attract subscribers via a convenient ancillary service.
• South Korea and Japan are the dominant countries, together constituting 76 percent of 2011 total spending in
Asia.

5-3. KakaoTalk is a strong platform for game developers to publish their games
• Launched in March 2010, KakaoTalk has around 70M registered users and 27M daily unique visitors as of
December 2012.
• Average weekly usage of 302 minutes in November 2012, up from 175 minutes in July 2012, around the time it
launched Kakao Game.
• The platform has brought in substantial revenue for the company. It currently draws 20% of the income earned
by game developers on its platform.
