I hope all are well. By now everyone has had the opportunity
to break out the golf clubs, the boat, the motorcycle or even
the lawn mower. Spring has definitely sprung. It is a beautiful time of the year out here in western South Dakota on the
prairie with the miles upon miles of rolling hills and green
grass.
It is also the time of year that some of our members head
to Washington D.C. to participate in the Call on Washington.
Unfortunately, this year I was not able to attend as I have
been dealing with some family issues. My mother had back
surgery and cannot lift over five pounds for two months, so
being the closest child to their home, I have been busy helping with their daily activities. But I want to touch base on how
important this trip to Washington really is. This is the one time each year that our state association has
the opportunity to meet with the ATA staff. They usually brief us on the current status of the issues
at hand and also advise us on the best way to approach and educate our congressional delegates
so we can then encourage them to vote in our favor on federal trucking issues. The meetings have
been very fruitful in recent years. But I would like to remind everyone that out of the 534 members of
Congress, South Dakota has only three. So when it comes time to vote on important trucking issues,
our state has only .0056 percent of the total vote. With that said, I would like to reiterate on some
statistics I have talked about in the past and why I believe it is so important to become involved with
more than just the Call on Washington to try and change things on Capitol Hill. The ATA is the largest
trucking association in America. They have more than 2,400 members and more than 400 people
on the staff. Large carriers, more than 20 trucks, make up 85 percent of the membership. Ironically,
small carriers, less than 20 trucks make up 85 percent of the total trucks across the nation. It is very
obvious that in many cases small carriers and large carriers do not always agree on the issues and
potential laws and regulations that are created by the FMCSA and other government agencies. So here
is how this normally works. The ATA meets twice a year, once for the Spring Leadership Meeting and
again in the Fall for the Annual MC&E Convention. The ATA is comprised of several committees and
sub-committees, filled with members of the ATA, which cover all aspects of the trucking industry. Issues are discussed, comments are made, then they vote and a decision is made. The committee then
reports its decision to the full board, which is made up of one ATA Vice President from each state and
the full board votes. Usually by this time, there is very little discussion or comments as all the work
has been done in the committee meetings. Now the ATA staff is directed by the association to go back
to the Hill and lobby for the issues and decisions that the association has made to all the members of
Congress. The ATA has some power on the Hill because through their PAC contributions from members
as they raise more than a million dollars a year. Remember what I have said before, he who has the
most money wins. That my friends is how things happen in our world. So take ELD’s for example. I
think the majority of small carriers are opposed to them. The majority of large carriers pushed to
make ELD’s a federal rule. That’s why it is here and here to stay. Imagine if the ATA membership was
85 percent small carriers and 15 percent large carriers how different the outcomes of these major
issues might be. I am a small carrier and I am not saying I am against large carriers. What I am saying
is if we are going to move our industry in a direction that is fair for both large carriers and for small
carriers, we need to know how politics work. I understand that we as small carriers are very busy. We
do everything from the dispatching, to the maintenance, to the safety, to the bookkeeping and even
to driving the truck with little time to take off to go to these meetings and get involved. But keep in
mind folks, this is how it works and complaining about all the issues we disagree with will not change
them simply because we are complaining. The ATA is not our enemy as a small carrier. We have the
same power and rights as anyone else in this industry, but we need to increase our numbers. We need
to engage and get involved. I hope this message gives everyone some important insight to how our
industry works politically.

Regulatory issues are never lacking when you think about the trucking industry. This again became rather obvious when your
Immediate Past Chairman, Mr. Rick Hoogendoorn and I recently attended the American Trucking Associations (ATA) Leadership
Meeting. The list of challenges seems to be growing rather than shrinking. Rick and I did not attend the same committee meetings
in order to avoid duplication and also to better represent the interests of the SDTA Members. In the remainder of this column, I will
highlight a few of the issues that are currently on the horizon.
Hours of Service: It appears there is a positive flavor in Congress to fix the technical glitch created by a stipulation in the 2016
Consolidated and Further Continuing Appropriations Act which was not the intent of Congress. If we do not prevail with this technical change, it will put the entire trucking industry and the entire country on tilt! Law enforcement, shippers, receivers and trucking
companies will need to completely retool if we do not get this fixed.
Entry Level Driver Training Proposal: The Federal Motor Carrier Safety Administration (FMCSA) has proposed that all drivers
seeking a Commercial Driver License (CDL) take a comprehensive training course designed to improve safety and awareness. The
training should consist of both classroom and behind the wheel training. Following classroom instruction, students would begin
behind the wheel training. To successfully complete this portion, drivers must spend at least 30 hours behind the wheel. this time
would be spent between time on the range and on the road. My take on this issue is quite simple; we can’t find drivers now, making
obtaining a CDL more difficult will certainly not help our industry.
New Technology: During technology discussions, the committee talked about speed limiters, electronic logging devices (ELDs),
rear and side guards, forward collision & mitigation braking systems and connected vehicles. Although I consider myself a techie
and both interested and intrigued with new technology, it seems to me that some of this technology is very futuristic and it will
take many years if not decades to implement. We will need to stay vigilant and watch as these issues unfold. The main item in this
list is speed limiters and what I heard is the final number has not yet been agreed on.
The majority of the calls I get from SDTA Members are with regard to hours of service, ELDs and speed limiters. I hope this information will help answer some of those questions - if not, please keep calling. Please take the time to review the “Dates to Remember” on page 20; we have a busy schedule for the next month. I hope many of
you get a chance to participate in one or more of these events.

Every spring breakup I ask myself the same question, What am I going to do with all this
time off?” Then I get started and question if everything will be done before it is time to
return to work. I am certain most of you find yourselves in the same scenario. This year
the list seems to be long or I am just getting older and it takes me longer to get everything done: the Log haulers seminar, the 2015 survey, regular maintenance, preventive
maintenance, updating, of course the “honey do” projects that have been put on hold for
the last year and preparing for the Call on Washington. I just cross them off one by one
as they come or as I get them done.
Everyone has said they enjoyed the seminar, which is good. After all, it is put together for
your benefit. We already have suggestions for next year, so if you have additional ideas
let them be known.
The 2015 survey results are in and it sounds like we had an excellent return. All of the information will be evaluated and the
results will be available soon.
It is likely that we will find ourselves outside of the 100 mile air radius in order to acquire enough log inventory to keep the
mill yards full. With the Electronic Logging Devices (ELDs) becoming mandatory by December of 2017, I have started to do
some research. The advice you get from nearly everyone is not to wait until the last minute. I am certainly finding that to be
true. I hope to have a system installed within the next year or maybe sooner. Especially if I find myself having to keep a log
book rather than a time card. I strongly suggest if you think you could run into that same situation, start researching your
ELD needs. Be mindful of the system you select, as FMCSA does NOT regulate the manufacturers to assure they are fulfilling
FMCSA’s requirements.
The Call on Washington, which is probably where we are as you read this, has plenty of issues to deal with. Some of the topics
we plan to address are Federal Excise Tax, FMCSA issues, CSA issues, sleep apnea, hours of service, 33 foot double trailers,
central states pension, states collecting business tax from interstate carriers, F4A issue (truckers working in interstate commerce under one set of rules rather than individual state laws and regulations) and the 2016 presidential election. There
always seems to be plenty of issues here to deal with. New ones always seem to arise and the old issues seem to be forever
changing.
This is the first year that the SDTA West River Golf Event will be incorporated with the logging industry. Our SDTA staff and
Phillip Christian have put a lot of effort into this. We have the potential to turn this golf outing into a grand annual event.
We all need to promote this outing amoungst fellow loggers — the only way most of us in the logging industry will know of
this is word of mouth. The golf event takes place Sunday, June 26th at 9:00 at the Tomahawk Golf Course, in Deadwood. If you
have any questions I am certain Phillip will answer them or you can call the SDTA office. SEE YOU THERE!
Myron spoke at the Neiman logging contractors meeting this year and it sounds like it went very well. This gives everyone a
better understanding of the challenges and limitations we all face in the industry. This
type of effort with all entities of the industry will insure the success and well-being of
all involved.
To end on a sad note this month I would like to recognize an old friend and colleague
Donald Butterfield, or as most all of us know him, Butter, was killed in a trucking accident in Colorado on April 14th. He was one of the original founders of the BHLH Association. For many years he hauled logs and had a lot to offer to the industry. Although
Butter will be deeply missed, he will surely not be forgotten.

IMPROVING THE HUMAN CONDITION
DOT EXAM CHANGES: What It Means For You
In order to keep your job, the DOT exam is part of the requirements. Last month, the Federal Motor Carrier Safety Administration (FMCSA) made
changes to the exam form that must now be followed by medical examiners (ME), such as myself and the rest of the team at Sanford OccMed.
Here’s what you need to know before your next DOT exam:
• The ME must give you (if you qualify) a paper copy of the new Medical Examiner’s Certificate (MEC) form to provide to your employer and
government enforcement officials.
• A new status has been added to the exam: Determination pending.
- This status allows the ME up to 45 days to get more medical information to determine if a driver
is physically qualified to operate a commercial motor vehicle (CMV).
- If you have this status, you can still drive a CMV if your MEC is valid.
- If the requested information and/or examination results are not completed and provided to the ME within
45 days, your exam is no longer valid. You would need to schedule a new examination in order to obtain
the new MEC form.
• The ME or staff must record what type of government-issued photo ID you used to verify your identity (e.g. CDL, driver’s license, passport).
• You are required to have a new examination when your MEC expires, regardless of the length of the MEC.

FMCSA Slates Roundtable on Broker/Forwarder Financial Responsibility

meeting is part of the agency’s

UNDERSTANDING THE UNIFIED REGISTRATION SYSTEM (URS)
IMPORTANT FACTS FOR MOTOR CARRIERS, BROKERS, AND FREIGHT FORWARDERS
WHAT:
The Unified Registration System CURS) is a single online registration system. URS replaces multiple forms and the registration functions of several systems
-such as the Licensing and Insurance System (L&I) and Motor Carrier Management Information System (MCMIS)- that businesses use to register and update
their information with the Federal Motor Carrier Safety Administration (FMCSA).
WHY:
URS helps raise the safety bar while improving efficiency through:
• Simplified processes and elimination of multiple forms.
• Reduced paperwork and errors.
• Electronic screening of all applications to identify high-risk carriers, including potential reincarnated carriers.
WHO:
The URS rule applies to all interstate motor carriers (including private and for-hire passenger and property motor carriers), freight forwarders, brokers, intermodal equipment providers (IEPs), hazardous materials safety permit (HMSP) applicants/holders, and cargo tank manufacturing and repair facilities under
FMCSA's jurisdiction. Mexican-domiciled carriers conducting long-haul operations are exempt.

URS is being implemented through December 2016. See the URS Rollout at a Glance chart for details. Key dates include:
WHAT’S CHANGING FOR YOU?
• When fully implemented, everyone subject to the URS rule will use the online application to register and update their information with FMCSA.
• All businesses subject to the rule must have a FMCSA portal account before September 30, 2016. Visit http://www.fmcsa.dot.gov/urs. The
portal provides instructions and support for obtaining an account.
• The USDOT number will become the sole identifier. MC, FF, MX and other FMCSA-assigned numbers will no longer be issued, and FMCSA will no
longer accept them as references for filings or other matters. FMCSA will issue numbers to registered businesses without a USDOT number (e.g., small motor
carriers, freight forwarders, and brokers) before September 30, 2016.
• New and existing hazardous materials motor carriers and exempt for-hire carriers must
provide financial responsibility (insurance) filings beginning September 30, 2016 (there is a
grace period for existing hazardous materials motor carriers and exempt-for-hire carriers, with enforcement deferred until December 31, 2016).
• Beginning September 30, 2016, all new applicants must select a process agent to file the
Form BOC-3 on their behalf before their registration will be granted. A process agent ensures the FMCSA
and injured parties can serve legal papers to motor carriers, brokers, or freight forwarders in any state
where the registered entities operate. The BOC-3 form must include all states for which process agent
designations are required. FMCSA will deactivate USDOT numbers for companies that fail to designate a
process agent (there is a grace period for currently
registered businesses, with enforcement deferred
until December 31, 2016).
• A new fee schedule will be implemented on
September 30, 2016.

ATA Pleased by Decline in Truck-Involved Crashes
New Safety Data Shows Some Yearly Gains and Continuation of Long-Term Trend
Arlington, Va. – Today, American Trucking Associations officials said they were pleased by the announcement today by the Department of Transportation that fatal truck crashes fell 3.7% in 2014,
continuing the decade-long improvement in safety the industry has experienced.
“It is a tragedy whenever there is a fatality on our highways, but the trucking industry is pleased to
see that it is a tragedy that fewer and fewer Americans are experiencing,” said ATA President and CEO Bill Graves. “While the
one-year decline being reported by the Federal Motor Carrier Safety Administration is positive, the long-term trend is of paramount importance, and that trend is impressive. The number of crashes involving large trucks had fallen 39% since 2004 and,
while there is much more to do, that is a figure our professional drivers, our safety directors, our technicians and our safety
partners in federal and state law enforcement can be proud of.”
There were a number of important findings in today’s release of FMCSA’s Large Truck and Bus Crash Facts 2014, including:
• The injury crash rate for large trucks (0.29 per 100 million miles) continues to be roughly half the rate for passenger vehicles (0.58 per 100 million miles);
• The number of large trucks involved in fatal crashes fell 5% to 3,744 from 2013 to 2014, and is down 23.6% since 2004;
• The number of miles traveled by large trucks rose by 1.5% in 2014, which coupled with the decline in truck-involved
crashes, dropped the truck-involved fatality rate to 1.40 per 100 million miles, a 2.9% decline from 2013 and a 40.1%
decline since 2004.
• Speed, an issue where ATA has urged action at both the state and federal level for more than a decade, continues to be the
number one driver-related factor in fatal crashes.
“For 10 years, ATA has advocated for return to a national maximum speed limit of 65 miles per hour, and for mandatory use of
electronic devices to limit the top speed of large trucks,” said ATA Executive Vice President of National Advocacy Dave Osiecki.
“Today’s FMCSA report, coupled with recent research by the Insurance Institute for Highway Safety linking rising speed limits to
increased highway fatalities, underscores the need for DOT to quickly advance a rule limiting top truck speeds, and for states to
re-think the setting of higher and higher speed limits.”
“Today’s announcement of a decline in truck related fatalities and crashes is significant,” said ATA Chairman Pat Thomas,
senior vice president of state government affairs for UPS Inc. “It shows the continuation of the positive long-term trend, a trend
made possible, in part, by our industry’s continued investment in safety tools and technologies.”
