A Lifemark Partner Agency LTC IN ILITS AND ACCELERATED DEATH BENEFIT RIDERS By Andy Kalinowski RHU, CLU, CFP With all the changes in the market place that impact inforce life insurance, now is a good time to review insurance con tracts, to be certain that they will continue to meet client’s expectations. This is especially important for TOLI contracts because of the prudent man rule and trustees’ fiduciary responsibilities. When replacing or purchasing new life insurance in an ILIT; can that life insurance policy also provide protection from potentially devastating longterm care costs? The idea of combining LTC protection with the benefits of life insurance in an ILIT using accelerated death benefit riders is an interesting concept. The question is what, if any are the pitfalls and can it be done without destroying the integrity of the trust? Can either fixed UL or VUL products be used? The second question is easy in theory, so I’ll answer that one first. As we know, an ILIT can own any type of life insur ance contract, regardless of its features and benefits. We are now beginning to see multiple carriers designing life insurance contracts with Accelerated Death Benefit Riders. Using a policy with this type of rider can be a great idea, but you need to be careful that the contract you select does not have a rider that destroys the integrity of the trust. This is exactly what an LTC reimbursement type rider will do. Should your client elect this type of rider, a chain of events is created that provides direct monetary benefit from the trust to the insured, which can destroy the integrity of the trust. With these plans, the trust (that owns the policy) submits bills for LTC expenses. The insurance company then pays the nursing home or care provider on behalf of the insured. This meth odology creates the chain that causes the problem and precludes the use of reimbursement type accelerated death benefit riders in ILITs. On the other hand, an accelerated death benefit rider that uses an indemnity approach can work inside the trust. In this sce nario, the trust arranges to verify that the insured qualifies for LTC benefits. The LTC benefit is paid to the trust as the owner of the policy. The LTC benefit is actually adding additional funds to the trust. The trust then writes a check to the beneficiary of the trust (assuming a properly crafted trust). The beneficiary then writes a check to the LTC provider. This avoids a taxable gift and will not create a taxable event. The insured must never have had the money in hand, or a claim against the trust for such monies. Using this structure, the chain of events is so indirect it cannot be linked back to the trust. In addition, there is nothing to actually force the trust beneficiary to pay the nursing home bills. This is a great idea to call to the attention of your ILIT clients. RAIFA HAS ADOPTED A SOLDIER With everyone’s busy schedules it is difficult to plan community service events at a time when a majority of you would be able to participate. We received very positive feed back about the concert we organized at the Canandaigua Vet eran’s Hospital this past Memorial Day. We have tried to think of something that RAIFA could do while staying supportive of the folks that truly support us. With that said, we have gone through all the required channels (homeland security is very interest ing to work with!) and adopted a soldier. At this time we don’t know the soldiers name or gender. We have started the process and are currently going through some red tape and could hear some thing from our soldier within the next couple of weeks. So what does RAIFA do for the soldier? I am hoping that RAIFA members will make donations throughout the next year. That will allow us to send care packages to our soldier and maybe with others in his/her unit that have not been adopted by a family or organization. Please forward your resume to lalberts@lifemark.com. 13 WRAPFEE ACCOUNTS AND MUTUAL FUND 12b1FEES ARE COMING UNDER ATTACK by Bruce Moar Two key engines of recurring revenue for brokerdealers and registered reps are coming under heavy scrutiny by factions within the financial ser vices industry. As a result, wrapfee accounts and mutual fund 12b1 fees are clearly un der review by the Securities and Exchange Commission. Much of the regulatory concern focuses on the confusing relationship between the fees charged and the services provided to the client. The clear industry trend is toward more fee transparency and less conflict of interest. Industry concern over wrapfee accounts centers on the client’s inability to understand all the charges being levied and who benefits from the various fee components. Mutual fund 12b1 fees are being attacked on the grounds that they are essentially feebased payments to brokerdealers and are special compensation, thus constituting a possible violation of the Investment Advisors Act of 1940. As these two areas continue to be challenged, client interests may at times be better served through an investment advisory relationship. In an advisory relationship, the investment advisor’s interests and the client’s interests are more aligned. There is less potential for conflict of interest. When acting in an advisory capacity there is a direct, clear relationship between the services delivered to the client (direct money management) and fees charged. Furthermore, investment advisors are held to a higher standard than is usually the case with traditional brokers. Advisors have a fiduciary responsibility to act in the client’s best interest. This inherent transparency suggests that an investment advisory relationship, in addition to aligning both the client’s and the advisor’s interests, may be more consistent with evolving industry trends as well. Assets under management for SEC registered Investment Advisors are expected to grow rapidly in the next five years. The average advisor is expected to increase assets under management by 256% to $1.6 billion by 2012.
