Time limits stated in the Contract Documents are of the essence of the Contract. ARTICLE 5 LIQUIDATED DAMAGES If Contractor fails to complete the Work within the Contract Time, Contractor shall pay to University, as liquidated damages and not as a penalty, the sum of $1,000 for each day after the expiration of the Contract Time that the Work remains incomplete. After Substantial Completion, the rate for liquidated damages shall be reduced to the sum of $500.00 per day. University and Contractor agree that if the Work is not completed within the Contract Time, University's damages would be extremely difficult or impracticable to determine and that the aforesaid amounts are reasonable estimates of and reasonable sums for such damages. University may deduct any liquidated damages due from Contractor from any amounts otherwise due to Contractor under the Contract Documents. PROCEDURES A. Unit prices include all necessary material, plus cost for delivery, installation, insurance, applicable taxes, overhead, and profit. B. Measurement and Payment: Refer to individual Specification Sections for work that requires establishment of unit prices. Methods of measurement and payment for unit prices are specified in those Sections. C. University reserves the right to reject Contractor's measurement of work-in-place that involves use of established unit prices and to have this work measured, at University's expense, by an independent surveyor acceptable to Contractor. D. List of Unit Prices: Specification Sections referenced in the Schedule of Unit Prices, if any, contain requirements for materials described under each unit price. The applicability of, measurement methods for, documentation of, and the final adjustment of the Contract Sum for unit price items of Work shall be determined by University’s Representative. B. After performing unit price item of Work #1as directed by University’s Representative, Contractor shall take necessary measurements in the presence of University’s Representative and shall submit calculations of quantities to University’s Representative for approval. Contractor shall notify University’s Representative at least one day in advance of taking measurements. 3.2 A. SCHEDULE OF UNIT PRICES Unit Price Item #1: Battery Cell. The plans call out for a 200kW/400kWh system with (11) cells at 18kW each, based on information provided by STEM. The Contractor shall provide unit price for each cell with associated kW rating, based on information provided by the selected manufacture. Since we have no control over this will the university look at this as a compensable delay? This is not a new design to SDG&E. It is a modification to a previously approved system so no SDG&E review and compensable delay should not be in consideration. At the job walk it was discussed potential time lines for job award, NTP and completion. Please reiterate those dates and or timelines Notice of Selection (NOS) is issued three (3) days after bid protest period begins. NTP issued after the NOS documents are returned (Awarded contractor will have ten (10) days to return NOS documents). The size of the battery system (>100 kW) and the pre-existing / operating PV system may trigger SDGE to conduct both a circuit level review and then possibly a follow up distribution circuit review. These reviews follow internal SDGE guidelines, policies and procedures that do not have identified timelines before approval is given. These can cause indeterminate delays in the storage system interconnection and final Permit to Operate.
