Buying at Waddington’s™
Condition:
All lots will be offered and sold subject to this Condition of Sale as well
as any Glossary and posted or oral announcements. By bidding at auction, bidders are bound by those Conditions and Glossary, as amended
by any oral announcements or posted notices, which together form the
contract of sale between the successful bidder (buyer), Waddington’s™
(auctioneer), and the consignor (seller) of the lot. Description or photographs of lots are not warranties and each lot is sold “as is” in accordance
with the Conditions of Sale.
Condition of Lots:
All of the items are to be considered, unless otherwise noted in the
description, in good condition. The definition of “good” when used in reference to condition, describes an object as having had no major damage
or repair but as with the nature of the material, may show minor surface
wear, discolouration etc., which indicates the acceptable wear that the
piece may acquire with age. If you are particular about minor flaws, you
should examine the pieces in person or have our staff answer any questions before bidding. Sizes are approximate. It is the sole responsibility of
the bidder to inquire as to the condition of a lot before bidding.
Condition reports are available upon request by phone, fax, email or in
person. You are advised to make any requests well in advance of the sale.
IMPORTANT
A buyer’s premium of 20% of the successful bid price of each lot up to and
including $50,000 and 15% on any
amount in excess of $50,000 is paid by
buyer as part of the total purchase price.
A charge of 6% GST (Goods and Services
Tax) and 8% PST (Provincial Sales Tax) is
applicable on the hammer price and
buyer’s premium, except for purchases
exported from Canada. In the case
where purchases are shipped out of the
province of Ontario, the PST is exempt.

Shipping:
The Auctioneers will not undertake packing or shipping. The purchaser

Auctioneers will, upon request, provide names of professional packers
and shippers but will not be held responsible for the service or have any
liability for providing this information. Reliable pre-auction estimates of

artist; from whom purchased by the family of the present Private Collection, Ontario in 1978
Note: The artist invented the technique called aquaprints as a new method of painting based
on an old Japanese method of marbelizing paper used in fine books. The artist controls the
flow of colours so as to reproduce the forms of nature and allowing for a detail of line and
colour combinations not possible in any other medium. The printed ground heightened with
pastel and watercolour allows for variations and are unique compositions , similiar to a
monotype.
Irvine exhibited aquaprints in several shows including the Lyme Art Association, the Curtis H.
Moyer Gallery, London in 1927, the Albert Roullier Art Galleries, Chicago and exhibitions held
in New York and Hartford, Connecticut.
Additional prints by the artist will be included in Waddington’s International Print auction to
be held in the Fall of 2008.

Note: Charles Thomas Croucher, grandfather of the present owner, was Managing Editor of

commissioned Fischer to paint this and the following canvas, lot #26 to illustrate a story that
appeared in the Canadian Home Journal.
This work and lot 26 were gifted to Croucher after completion of the assignment.

Note: Imhof was acquainted with Buffalo Bill Cody as a young man
and travelled to Europe with Cody’s Wild West troupe around 1890.
Imhof was Cody’s personal guest in Antwerp.
Iron Tail Sioux, the majestic subject of this portrait, was one of about
100 Sioux who travelled to Europe with Cody.
Although this portrait is undated, it was probably executed after
1907, long after Imhof and Iron Tail had returned to the United States
from Europe. The background in the work suggests a southwestern
setting, possibly Taos.

Gruau was born Count Renato Zavagli-Ricardelli in 1910 in Italy. By the age of 18, he was working as a fashion illustrator in
Milan. In the early 1930’s, he moved to Paris, the fashion center of Europe. Here he became close friends with many of the young
designers of the day including Christian Dior, Pierre Balmain and Jacques Fath. His fashion designs appeared in magazines and
newspapers such as Marianne, Le Figaro, Femina and Marie-Claire. During World War II, he worked in Lyons as sole illustrator for
Marie-Claire. He also began exhibiting his paintings in the local galleries at this time. During the 1940’s, Gruau moved to the
United States to work for Harper’s Bazaar, Vogue and later Flair magazine. He also frequented Hollywood to create portraits of
the rich and famous. By the 1950’s, the “Gruau Style” became highly sought after by the leading international haute couturiers.
Over the years, Gruau also created costume and stage designs for several plays in Paris and British theatrical comedies.

The collection of the Late Joseph and Margaret Rethazy, Hamilton,
Ontario, proceeds to benefit the Joseph and Margaret Rethazy
Charitable Foundation, Hamilton
The following lots, 290 to 299 inclusive, were likely acquired by the
Rethazy’s directly from the artist. Testimony of the friendship that
existed between the Rethazy’s and the artist is evident in the various
letters from Francois Gall and his wife that are held in the family
archives. Gall dedicated a copy of Andre Flament’s book, F. Gal, cited
below, to the Rethazy’s after visiting them in Canada in 1978. From
Paris, March 29, 1978, Gall writes: “A mes chers amis Margot et Josef
Rethazy en souvenir de mon merveilleux sejour a Hamilton et de mon
voyage inoubliable a Niagara Falls en leur chaleureuse compagnie”

The terms below are used in this catalogue for your guidance, with the meanings ascribed to them below. While
the use of these terms is based upon careful study they are not warranties; the auctioneer and the seller assume
no risk, liability or responsibility for the authenticity of authorship of any lot in this catalogue described by these
terms. In this regard, you are requested to read condition 1 of the Conditions of Sale.
Artist’s name or recognized designation: In our qualified
opinion, a genuine work executed by the artist.
Attributed to: In our opinion, probably a work by the artist
but less certainty as to the authorship is expressed than in
the preceding category.
Circle of: In our opinion, a work of the period of the artist
and closely related to his style.
Studio of: In our qualified opinion a work, by an unknown
hand, possibly executed under the supervision of the artist
School of: In our opinion, a work executed in the artist’s
style and possibly by a pupil or follower of the artist.
Manner of: In our opinion, a work executed in the artist’s
style and probably of a later period.
After: In our opinion, a copy of a work of the artist.

Signed/Dated/Inscribed: In our opinion, the work has been
signed/dated/inscribed by the artist. The inclusion of a
question mark indicates some doubt.

INFORMATION FOR BUYERS

A premium of 20% of the successful bid price of each lot up to and
including $50,000 and 15% on any amount in excess of $50,000 is
paid by the buyer as part of the total purchase price.
Ontario Retail Sales Tax is charged on all purchases, whether picked up
or delivered in Ontario, unless the buyer completes a valid exemption
form at the time of purchase. All lots are subject to Goods and Services
Tax on the hammer price and on the buyer’s premium, whether picked
up or delivered in Canada.
Bidding
To bid in person at the auction, you must register for a bidding
number by showing identification acceptable to the Auctioneer
upon entering the salesroom. Your number will identify you if you are
the successful bidder. You will be responsible for all lots purchased
on your bidding number. Banking information may be requested by
Waddington’s™ or Joyner™ Waddington’s.
You may submit an Absentee Bid Form if you are unable to attend
the sale. Please refer to this form in the back of this catalogue for the
appropriate forms and further information.
Bidding by telephone, in limited circumstances, can be arranged prior
to the sale. While we are pleased to offer absentee and telephone
bidding as a service to our clients, and take great care in their
commission, the Auctioneer will not be responsible for errors or
failure to execute bids.
The Auctioneer may also execute bids on behalf of the consignor to
protect the reserve. The reserve is the confidential minimum price
the seller is willing to accept for his or her property, below which it
will not be sold
Payment
Payment for purchases must be by cash, INTERAC direct debit (Cdn

Clients are advised that packing and/or handling of purchased lots by
our employees or agents is undertaken solely as a courtesy for the
convenience of clients.

Paintings, drawings, prints, furniture, jewellery and all forms of
decorative arts and collectibles may be brought to our Toronto office
where we can provide you with preliminary auction estimates and
consignment procedures. Please visit our website at

how to contact the specialists. We also accept mailed and emailed
requests for advice on the marketability of objects. A photograph
and phone number must accompany a full description of each item.
Our specialists regularly travel to major Canadian cities to meet with
prospective consignors. For further information, or to arrange an
appointment, please contact our Toronto office.
Property normally arrives at Waddington’s™ or Joyner™ Waddington’s
at least three months before the sale in order to allow our specialists
time to research, catalogue, photograph and promote the items.
Consignors will receive a contract to sign, setting forth terms and fees
for our services.
