Seller’s Disclosure Changes The Kentucky Real Estate Commission has approved several changes to the Seller’s Disclosure of Property Condition Form. The new form will be required as of July 1, 2005. The following changes have been approved: • • • • Inquire about roof repairs Inquire about the existence of mold and other fungi Move property address back to the top of each page Add buyer/seller/date/time initial line at the bottom of the form. The new forms will be available in the Realtor® store and online through IMS. Assisted in defeating a residential and commercial construction moratorium in the Portland Neighborhood. Assisted Louisville Metro Council in drafting fire alarm legislation. Worked with Bullitt County Government and their consultants in revising sign regulations in the Land Development Code. Interviewed all candidates for Louisville Metro races, and endorsed all winning Louisville Metro Council members in Fall 2004 elections. Assisted Commercial Realtors® in conveying concerns with Louisville Metro Corridors of Opportunity in Louisville (COOL) program. Monitor Land Development Code changes for issues concerning Realtors®. Passage of Senate Bill 35 - Home Inspector Licensure – 2004 Assisted in the defeating of the Lead Based Paint bill which would have shifted liability of lead paint litigation to homeowners and required home owners to certify their homes are lead free. Assisted in the defeating of the mandatory radon mitigation system bill, which would have required radon systems in all new homes in Kentucky. Analyzed the proposed Tax Modernization Bill for small business concerns and property tax changes. Please find an opportunity to support your GLARPAC this year. You now have a help section on the top menu of List-IT. It has answers to almost anything you are looking for on the MLS system, and is full of screenshots to help you along the way. There is also a search option in case your topic isn’t listed. From adding photos to creating CMA’s, the Help section can provide you the answers you need. It is required that a new listing be submitted within 48 hours of all required signatures being obtained. Should the listing be unable to be shown immediately, it should be disclosed in the MLS under Agent Notes with the day that it will be available. The rules are rather vague as to the length of time that it may not be viewed before placing a property in the withdrawn status, and the Board of Directors will look at that issue in their upcoming meeting. In the event the home has been active on the market and something comes up that prompts the sellers to take it off the market temporarily, it should be placed in the withdrawn status on a temporary basis. It would be prudent to disclose in the Agent Notes a probably length of time or even a reason for the status change. As the selling agent, should you have a buyer interested in that property, you may call the listing agent to find out why the status changed and/or when the house will be made available again. You may not contact the seller directly, as it is still under the listing agreement with that Broker. With the changes in paragraph 13 in the new sales contract, it is likely that a seller will wish to have their property remain on the MLS in the active status until the inspection contingency is removed. It is permissible to do so with the direction of the seller, and should be noted in Agent Notes as such. Disclosing the status of the property is a requirement to cooperating agents, and it would be simpler to disclose it in the MLS rather than continue to receive phone calls from selling agents. Once the property has closed the MSI rules state that the status should be changed in the MLS within 48 hours of the closing date. Under MSI rules, section 4.3 participants shall not solicit listings on properties until the current listing has expired. Only cancelled listings that are final may be solicited as well. Realtor® Night Out With the Louisville Bats GLAR is hosting a Realtor® night out with the Louisville Bats on Friday, June 24th, at 6pm. Bring your friends and family to this fun event and enjoy yummy food and lots of excitement. The game includes an appearance by Jake the Diamond dog and post-game fireworks, a favorite for fans of all ages. Ticket prices are $16.50 for adults and $10 for children and include reserved seating in the left field and a dinner buffet with BBQ pulled pork sandwiches, hot dogs, corn cobettes, watermelon wedges, popcorn and lemonade. The program recognizes Realtors® whose extraordinary commitment to volunteer work has helped make their community a better place to live.
