I’m kind of like an old bear, enjoying the “winter hibernation” season tucked back in the country with a roaring fire in the fireplace and a good book to read! But this January has certainly been different! On January 8th, Deb Zeren and I attended the installation of Tina Owens as President for the Wayne Homes Association. On January 14th, Deb, Lenny Lawrence, and I attended the installation of Steve Merkle for the Akron Cleveland Association, as well as Carol Foote at Portage County Association on January 29th. We all attended the OAR winter meetings in Columbus January 17-19 and we’re proud to announce that Lenny Lawrence was Get to Know nominated to run for District 3 Vice President. We also watched Beth! our own Donna Allen be installed as the State of Ohio WCR Secretary! Our old friend, Sara Calo, was installed as our 2016 State • Beth has 2 horses that she takes to OAR President and her installation event was well attended and equestrian shows. quite nice! Our very first Membership Meeting was help on January 27th, with guest speaker Janet Creighton, Stark County Commissioner. Toby Hoy also gave a short presentation. A nice door prize was won by Donna Wilson of Another Listing and each attendee received a free car wash gift card! Watch for notifications of our next meeting in April. • Beth and her husband Terry own a small mini-farm. •She enjoys swimming, water skiing, camping, refinishing furniture, and target practice. And for those of you in attendance who noticed my very pregnant daughter Sarah sitting at our table, she gave birth the next day to my grandson, Jackson Alexander Miller. Will review potential additional legal liability insurance policies. Committee Reports For a full list of when committees meet, click here Affiliate Committee What does our committee do? We make recommendations to the Board of Directors on how to enhance membership. This is done by budgeting and managing the incoming sponsorship funds and looking for opportunities to encourage membership participation. We support existing programs as well as plan and organize events. Our ultimate goal is to develop communication between all Affiliate and REALTOR® members. On February 16th we will have our SHAKER. This is a program started two years ago as a “New Member Mixer” and has attracted REALTORS® of all tenure, resulting in great success with attendance. Our plan is to organize a quarterly event that welcomes all SCAR membership and is focused on getting back to basics and actually talking with each other! Another upcoming event is our 3rd annual Chili Cook Off held on March 8th. If you haven’t attended either of these events, you are missing out! Thank you to the committee members in attendance at the January meeting. Communications/Technology Committee Greetings, members! We want to give you a brief overview on what exactly we do during our monthly meetings. Last year, we began making some changes such as accepting proposals for new websites; we also implemented Mailchimp for E-Briefs. We will also be working on improving marketing strategies with creating a new company logo. With so much modernization in today’s world, we are continually finding new ways to advance. Feel free to join the committee (we meet the second Monday of every month) so others can hear your ideas, or e-mail commtech@starkrealtors.com. Thank you! Consumer Outreach Committee The Consumer Outreach Committee is coming on strong in 2016 with the “Welcome Home Basket” project. This is possible with the continued financial support of SCAR members and affiliates. Cash donations (suggested is $25-$100) will allow this to continue. The support in 2015 allowed us to participate in three very moving and powerful Habitat for Humanity Key Ceremonies, presenting over 20 Gift Baskets to date. We want to take this time to thank all who donated, some multiple times! These baskets are represented as a gift and show support from our entire Association. They have been extremely well received by the recipients and those in the community who support Habitat and attend these ceremonies. We take pleasure in knowing that many families just celebrated Christmas as owners of their own decent, affordable home. Legislative Affairs Committee Legislative Affairs met and discussed the ways they could educate the REALTORS® about the Legislative Process and how it affects their daily business. They also talked about educating how RPAC donations work with the legislative process. They will be working with the RPAC subcommittee to develop donation events to meet their goal this year, which is still to be determined. Professional Services Committee The Professional Services Committee met on January 11, excited to kick off the New Year with lots of great educational and fun classes. We will be offering core classes with great speakers such as Peg Ritenour, Alec Hagerty, and Jackie Cassara! Our hope is to offer classes that will enrich your business in order to better serve your client’s needs. “Building from the Ground Up” class will be offered again at the Parade of Homes along with a “Dusty Shoe” tour for all members. Breakfast in the Park and R-Day will also be in the planning stages in the coming months. We value your ideas and thoughts. Wagoner Moving Systems Ethics Case 1-21: REALTORS® Purchase of Property Listed with the Firm Mr. and Mrs. A visited REALTOR® B’s office and explained they had owned a four-bedroom ranch house nearby for thirty years but since their children were grown and Mr. A was retiring, they wanted to sell their home and tour the country in their motor home. TOR® B was not entitled to a commission. The letter went on to demand that REALTOR® B refund the commission that had been paid by Mr. and Mrs. A. REALTOR® B and Mr. and Mrs. A entered into an exclusive listing agreement. REALTOR® B conducted an open house, advertised in the local paper, and took other steps to actively promote the sale. REALTOR® B politely, but firmly, refused to refund the commission. Four weeks after the property went on the market, REALTOR® B received a call from REALTOR® Z, a broker affiliated with the same firm who worked out of the firm’s principal office downtown. REALTOR® Z explained that she had seen information regarding Mr. and Mrs. A’s home in the MLS and was interested in the property as an investment. She indicated she was sending an offer to purchase to REALTOR® B through the firm’s inter-office mail. When REALTOR® B met with Mr. and Mrs. A to present REALTOR® Z’s offer, he carefully explained and presented a written disclosure that REALTOR® Z was a member of the same firm although he was not personally acquainted with her. Mr. and Mrs. A, being satisfied with the terms and conditions of the purchase offer, signed it and several weeks later the sale closed and a commission was paid to REALTOR® B. Mr. and Mrs. A filed a complaint with the Board of REALTORS® alleging that REALTOR® B’s refusal to refund the commission constituted a violation of Article 1 of the Code of Ethics. REALTOR® B, in his response, agreed with the facts as stated in Mr. and Mrs. A’s complaint but indicated that he had faithfully represented the best interests of Mr. and Mrs. A and had no obligation to refund the commission. The Grievance Committee concluded that the matter should be referred to a Hearing Panel of the Board’s Professional Standards Committee. At the hearing, Mr. and Mrs. A repeated the facts as set forth in their written complaint and, in response to REALTOR® B’s cross-examination, acknowledged that REALTOR® Z had not influenced their decision to list the property with REALTOR® B or their decision as to the asking price. They also agreed that REALTOR® B had carefully Several weeks later, REALTOR® B received a letter from ® Attorney T, representing Mr. and Mrs. A. Attorney T’s letter disclosed that REALTOR B had represented their best interests throughout the transaction. Their only disagreeindicated that since a member of REALTOR® B’s firm had ment with REALTOR® B, they stated, was that since their purchased the property, in Attorney T’s opinion, REALhome had been purchased by a member of REALTOR® B’s firm, they should not have been obligated to pay a commission and REALTOR® B’s refusal to refund the commission violated Article 1. The Hearing Panel concluded that REALTOR® B had promoted Mr. and Mrs. A’s interests; and had carefully disclosed that REALTOR® Z was a member of the same firm; and that REALTOR® B’s refusal to refund the commission did not constitute a violation of Article 1. Ohio Association of REALTORS® (OAR) Columbus, January 18-21 January 17-19, a group of dedicated OAR Directors representing Stark County Association traveled to Columbus to attend the OAR Winter Conference. Have you ever wondered what is an OAR Director and what do they do? Let me share the details of this important position. OAR’s Board of Directors is an extremely important part of the Association. OAR Directors, for the most part, are chosen by the individual boards/associations. Directors help position OAR for the future, by acting on many items including: taking positions on pending legislation, creating and amending policies, approving budgets, task force reports and committee recommendations. OAR’s Code of Regulations provides the Directors with authority over all OAR’s activities and programs. The OAR Board of Directors is made up of the following members: • Board Presidents • Each local Board is entitled to 1 OAR Director for every 150 REALTOR® members (we have 5) • OAR Past Presidents (we have 1) • OAR Committee/Forum Chairs • OAR Executive Committee • OAR DSA Recipients (we have 1) • Up to 5 Director At-Large positions appointed by the OAR President • State Chapter Presidents of NAR Affiliated Institutes, Societies and Councils • Local Board Executive Officers (ex-officio without right to vote) OAR provides SCAR with information necessary to report their next year’s Officers and Directors to OAR. All appointed OAR Directors are to attend all OAR Director Meetings to weigh all recommendations coming before the Board and act on those recommendations in the best interest of OAR. They discuss issues coming before the Directors with their Local Board to get their input. They attend Member & Director Forums held during the Tri-Annual meetings to obtain information relating to actions coming before the Board of Directors and ask questions where necessary. After the conclusion of Board of Directors’ meetings, our OAR Directors report back to our local Board of Directors issues that were acted on by the Board of Directors. Our OAR Directors and other members of our Association also can be involved on OAR committees. Here is a summary of what our members learned during this conference….. Legal Issues Forum – This forum actually had 1 ½ hours of continuing education attached to it (which isn’t normal). Anne Petit, the Superintendent for the Ohio Division (ODRE) and the Ohio Real Estate Commissioners led this session on how the licensee disciplinary hearing process really works. They gave details on the process on how eleven staff investigators go through approximately 400 active complaints per month. They told how there are three potential outcomes from all investigations: an advisory letter, No further action (which is appealable), or Charges Issued – which leads to a hearing. After a hearing there are five potential disciplines in found in violation: public reprimand; education; suspension; revocation; any combination of the previous four. They held a mock hearing with the commissioners to truly see how a hearing is played out. Continued on Following Page Dee Matthews, Debi Zeren, and Beth Campbell at the Ohio Association of REALTORS® Ohio Association of REALTORS® (OAR) Columbus, January 18-21 NAR REALTOR® Party Committees – Heard from NAR First Vice President Elizabeth Mendenhall (she will be the NAR President in three years) how the process of getting involved on a NAR committee works and how each incoming President chooses their Chairmen. The group was introduced to those from Ohio who will serve either as chairmen or committee members on NAR committees. Combined Strategic Planning/Communications Committees – These two groups worked together last year to conduct a statewide communications audit. It was a method of research that determined how OAR’s core audience perceived the Ohio Association of REALTORS® various communications. The objective was to improve future communications by developing a strategic plan to determine where gaps exist which need to be bridged. 400 surveys were completed in November and December of 2015 to add to this report. Research Advisory Committee – This committee identifies, gathers, analyzes and disseminates information that will position the REALTOR® organizations and its members as definitive authorities on the real estate industry in Ohio. They will survey the membership in the coming months regarding global real estate and the membership’s interest in this topic. Association Executives Committee – This committee is only for local Association Executives. The committee heard from Don Flynn of Realtor.com about the free bio page for our members as well as the options they have when it comes to reviews. They discussed Professional Standards and poured over three hypothetical complaints. Professional Standards Forum – This forum held a mock mediation that turned into an arbitration. After the hearing outcome, the forum participants discussed how they would have voted. Political Activity/RPAC Fundraising – This committee discusses how local boards across the state are raising RPAC dollars and educating their member of the importance of these donations. They talked about the possibility of grant dollars for events local associations will have and how NAR has initiated a “Phone A Friend” telethon that will start with sign-ups at the spring conference. This telethon is primarily for those who have not given in the past. Ohio’s RPAC goal is $700,000. They hope to increase Major Investors (those who give $1,000 or more yearly) to 200; and to increase the President’s Circle to 20 (currently at 15). OAR is challenging local boards/associations to have a 40% membership participation. For SCAR that would mean approximately 300 SCAR Members or better! In 2015 we had 188 members participate and raised $12,000.00. Enlarged Legislative Committee – In 2015 the majority of Legislators worked on the Budget. In the Fiscal year 2016-2017 they will be working on the operating budget with no sales tax on commissions and no increase on CAT. Gov. Kasich is still talking about future tax reform. Be prepared to see the marijuana issue come back before the voters as a medical option only. March 15, 2016 is “Super Tuesday”. More information will come from leaders speaking at the OAR Spring/Legislative Conference. Learned about the REALTOR® Safe Harbor program from the Arkansas Association of REALTORS®. An app was voted in that is free for the members. Lisa Yelichek, Beth Campbell, and Debi Zeren at the Ohio Association of REALTORS® General Membership Meeting Report Stark County Commissioner, Janet Creighton, reported on the "State of Stark County" at our 1st 2016 SCAR Quarterly Meeting January 27. Janet updated us on the many improvements completed and underway throughout the County. Stark County is looking good! Attendees at the SCAR 1st Quarterly meeting. We had two speakers cover an update on the County & a 90 day review on TRID and tips to help the REALTORS®. 2016 "Member Benefit" program kicked off by President Beth Campbell was passed out to all in attendance. It shows you just how “mobile” Matrix is along with how to do all of the basics you need from your MLS system. It also will introduce to you where to go to configure your Header and Banner for your Clients Portal and will explain what exactly a Client Portal is. You will learn how to create an Auto Email that will automatically email your client new listings that meet their criteria along with many little tips and tricks to help with your searching needs! Good has been an active member of the Stark County Association of REALTORS® (SCAR) for more than 50 years, serving as secretary-treasurer, president- elect and president in 1983. She also served as President of the Stark County Chapter of Women’s Council of REALTORS® in 1980. Norma has been a member of the Professional Services Committee for more than 20 years, chairing the committee for three separate years. Norma initiated the real estate exam review class for SCAR, taught GRI classes for the Ohio Association of REALTORS® (OAR) and was Real Estate Coordinator at Malone University. At Malone, she supervised 12 instructors, taught all the pre-license classes and the 10-hour post licensure course, along with numerous continuing education courses. OAR recognized her as Educator of the Year twice. In 1989, she earned the first Distinguished Real Estate Instructor (DREI), from the National Real Estate Educators Association, for the state of Ohio. If I return my license to the Ohio Division of Real Estate, can I get a refund of the “unused” portion of my dues? A. Association policy states “There shall be no refund of Stark County Association of REALTORS® dues after January 31 of each year. Q. How long after I turn in my membership application can I do business using the term “REALTOR®”? A. As soon as we get your application and application fees you are considered a conditional REALTOR® member. You will have access to CRIS within 24 hours. Q. Why is my member number wrong on invoices? A. For some members, your member number is not necessarily the same as your file number. Additionally, since the Rapattoni member number field is one digit short, SCAR staff leaves off the second digit (always a zero) in our files.
