Health board inspectors will be at the show all weekend ensuring artists comply with all rules. Health board inspectors will be giving one warning to artists breaking rules and will shut down booths that do not comply. Exhibitors are responsible for their own waste collection and removal. All artists must wash hands at supplied sinks before and after tattoo procedures. All artists must attend a short health talk at the main stage before being able to tattoo. Tattooists are to meet at the information desk at the front of the hall. Talks will be given from 10 am – 11:30 am Friday. Artist laminates will be handed out for the weekend after the talk. All artists must use supplied hand gels when degloving during tattoo procedures. No eating or drinking in the booth area. Artists must use supplied disposable wash bottles for tattoo procedures. No spray bottles or squirt bottles brought with you will be allowed to be used. No smoking in convention hall. Artists must use supplied bandages to bandage tattoos. No saran wrap allowed. All needles must be single use and 100% disposable (including bars). All tubes must be disposable. There is no sterilization booth available at the show No body piercing allowed at the show other than the one approved booth. All tattooists must wear disposable aprons while working. All equipment must be barrier wrapped including power supply, machines, clipcord and wash bottle. No personal music allowed at the show as it is a distraction to others. There will be overhead music provided. All gloves must be Nitrile or PVC during tattoo procedures. No latex gloves allowed. Nitrile gloves will be supplied. Release forms must be filled out by each client at the ink station. Aftercare sheets will be given out to each client at the ink station also. No tattooing anyone under the age of 18 years regardless of parental consent. No fresh tattoos wandering the hall or in public washrooms…fresh tattoos must be barrier wrapped with a dental bib or bandaged. No tattooing in the hotel rooms. Only two tattoo artists are allowed to tattoo in each 10 x 15 booth at a time. Only registered and approved tattooists allowed to tattoo in the booths. #9 SHOW SUPPLIES Most supplies needed for tattooing procedures will be available at the show at no charge. Each artist will be supplied with an Eikon pack which contains most of the supplies needed to tattoo. Each booth will have four chairs, a skirted front display table and a plastic covered table from which to work and two garbage cans. Due to health board rules, all tattoo artists must use the products supplied by the show. Please do not bring your Nalgene bottles to the show as we have disposable bottles supplied. This station will consist of full sets of Eternal Ink, & Dermaglo. Black ink at the show is supplied by Silverback. There will be suppliers at the show offering for sale: Disposable pre-made needles Disposable tubes Power supplies Tattoo machines Ink #10 SIGNS All booth signage and banners are to be professionally made and fit in the confines of your booth. Arrangements can be made to hang your banners from the ceiling if the facility permits. In this case a service fee will be charged to you for the lift cost and hanging. Exhibitors can order this service directly from the facility (please see forms section of this manual). Booth signage must not appear in adjacent exhibits. Any banners or signage deemed inappropriate by show management will be removed and any cost associated with the removal would be charged back to the exhibitor. All banners requiring to be hung from the ceiling must be done before aisle carpet is put down. #11 SHOW HOURS Friday Saturday Sunday 4pm – 12 Midnight 12 Noon – 10pm 12 Noon – 6pm There will be a shuttle running each day between the hotel and show venue starting at 9 am each morning. No tattoos are to be started in the last hour of the Show on either Friday, Saturday or Sunday. If there is no other alternative, the Artist will be billed for the additional security cost. #12 MOVE-IN Friday 8am – 4pm Show opens 4pm on Friday!! EARLY MOVE OUT WILL NOT BE TOLERATED If anyone is caught tearing down or packing up their exhibit materials before show close, they will be prohibited from exhibiting in any future Alberta Bound or Canwest produced trade show. #14 FORKLIFT SERVICE Forklift Service is available on a first come, first serve basis to offload/load shipments and stock. The forklift is ONLY available during move-in and move-out. If you have any unusually large or time consuming loads (Ie: hot tubs), please let us know in advance and we will schedule your move-in/move-out accordingly. #15 SPACE APPLICATIONS Please note: Children (under 16) are strictly not permitted on the Show Floor during Move-in or Move-out as per Safety Regulations. Show Management reserves the right to accept or reject applications at any time. Exhibitors may enter the exhibit hall 2 hours prior to Show opening, however all exhibits are to be setup by 4pm on Friday evening. Security guards will be posted at move-in doors. Painting, nailing, drilling, or screwing to the floor, walls or any part of the building is not permitted except by prior written approval of both Show Management and Building Management. **PLEASE NOTE: All pop-up tents must be fire retardant with ticket of approval/confirmation displayed.** #17 BOOTH CONSTRUCTION #13 MOVE-OUT Sunday night when show closes 6pm-12 Midnight The Hall needs to be cleared out by 12 Midnight Sunday after the show closes. Product and skids have to be packed up and removed from the hall by the end of move-out. If any product is left behind it is at the risk of the exhibitor and the facility may charge a handling/storage fee. Alberta Bound and Canwest Productions cannot be responsible for any arrangements post move-out. AS OF 12:01AM ANY EXHIBIT MATERIALS & SKIDS LEFT BEHIND WILL NOT BE THE RESPONSIBILITY OF ALBERTA BOUND AND CANWEST PRODUCTIONS OR SHOW MANAGEMENT. No removal or dismantling of exhibits or exhibit materials will be permitted before 6pm Sunday Official Show Closing. While Show Management will take all reasonable security measures to safeguard small items, immediate removal of such items will minimize the possibility of loss from pilferage. PLEASE NOTE the special instructions under the heading of “Insurance.” #16 ALTERATIONS TO BUILDING A. HEIGHT Inline booths may reach a maximum of 8’ in height. Island booths may be over 3’ in height. Perimeter booths may be 10’ in height. B. SIGNAGE Must be incorporated into your exhibit design and height of 8’. Signage must not appear in adjacent exhibits. C. DRAPE All booths will be supplied with 8’ high draping at the back and 3’ high on the sides. No draping is allowed on the aisle side of the booths. Any variation or changes in the standard draping are at the exhibitor’s expense. Nothing is to be pinned or stapled to the drape -“S” hooks are available from Canwest Productions. #18 EXHIBITOR BADGES Exhibitor Badges are generic, and will only be labeled with “Exhibitor”, not company name, or individual name. Exhibitor badges are required to gain access to the Show – and must be worn at all times. Please Note: Exhibitor Badges are for booth personnel ONLY. 1 artist shared booth – 2 passes 1 artist high profile booth – 3 passes 2 artist booth – 4 passes Vendor/Retail booth – 2 passes per 10x10 Exhibitor Badges will be provided per Booth when you check in at the Show Office. Staff can pick-up Show Badges at the front entrance during Show Hours. #19 ADMISSION PRICES Adult Day Pass Adult Weekend Pass Children 14 and under www.edmontontattoos.com $25.00 $50.00 FREE #20 SAMPLES, SOUVENIRS AND SOLICITING Soliciting of business and/or distribution of samples and souvenirs will not be permitted in the aisles, the parking lots or in another exhibitor’s booth, but must be confined to the exhibitor’s own space. #21 ELECTRICAL EQUIPMENT Regulations made by the Labour Electrical safety branch, provide that all electrical equipment operating at the show be approved. Equipment that is approved by the CSA and bears that association’s mark of approval is acceptable to the commission. #22 CUSTOMS Exhibit booths and equipment-from outside Canada, may be brought in for the purpose of the show only without payment of duty under standard procedure. Please consult with Canada Customs. Shipments will be accepted during Move-In. Please mention The Edmonton Tattoo and Arts Festival for special rates. #24 CLEANING ONLY the aisle carpet will be cleaned (vacuumed) at the end of each night – arrangements for your own booth can be made through Canwest Productions. Please see the attached forms. #25 HANDLING OF EXHIBITS, MATERIALS AND EQUIPMENT Should your display require the use of heavy duty unloading equipment, you are requested to notify management at least two weeks in advance of show time so that arrangement can be made to have it available. Costs of renting and operating such equipment must be borne by the exhibitor. Exhibitors who can supply their own trucks and dollies are urged to do so. Canwest Productions provides forklift service and a limited number of dollies on a first come first served basis. NOTE: Skids and packaging will be cleared from the aisles during move in. If your Skids & Packaging are not marked clearly for STORAGE, they will be recycled. #26 INSURANCE Show Management, Edmonton Tattoo and Arts Festival, Edmonton Expo Centre, and the City of Edmonton, will not be responsible for injury to persons, loss or damage of products, exhibits, equipment or decorations by fire, accident, theft or any other cause while in the show building or its environs. Alberta Bound and Canwest Productions recommend all Exhibitors have a $2,000,000 minimum in liability insurance and have proof of Insurance. To secure proof of insurance simply phone your insurance provider and ask for a certificate naming: Alberta Bound Productions and Canwest Productions Inc., the Show name, the current facility and city of the Show. There should be no additional cost from your insurance provider for this service. Please Note: This is an official request, if proof of Insurance is not supplied – Alberta Bound Productions and Canwest Productions Inc. will not be held liable. For more information, please refer to the Insurance & Indemnity clause on our Terms and Conditions sent with the application. #27 SECURITY Security guards will be on site 24-hours a day and in the building during the opening hours of move-in, show hours and move-out. Show Management, however cannot assume any responsibility for losses incurred from pilfering or any other causes. As an extra precaution, please do not leave valuables in your booth overnight. #28 FIRE REGULATIONS & FLAMEPROOFING All Exhibit material & tenting must be fire retardant, applicable tags and documentation are required. #29 DRAWS OR CONTESTS Exhibitors offering draws in-booth are required to provide their own entry forms, draw boxes and signage for their prize draws. Please Note, winning announcements will not be made over the facility sound system due to Seminars & Stage events. #30 PARKING Parking passes can be purchased onsite. #31 PRESS RELEASES AND PHOTOGRAPHS #35 STAGE & SEMINAR PERFORMERS Please note The Edmonton Tattoo and Arts Festival, Alberta Bound Productions and Canwest Productions accept no liability or responsibility in theft or injury, at or as a result of any seminar or stage act, presentation or performance. If you have any concerns prior to your performance, please contact an on-site Show Representative who will respond to the issue immediately. #36 ALCOHOL AND NUDITY Alcohol is strictly not permitted at your booth. Any Exhibitor caught with outside liquor will be asked to leave the premises. Please note nudity is prohibited by the facility. Please ensure patrons are covered accordingly. #37 HOTEL ARRANGEMENT EDMONTON Exhibitors are urged to provide Show Management with any information on new and exciting products and or features. This information will be forwarded to our publicist for possible media attention. (No guarantee of coverage). #32 ADMIT ONE Admittance Tickets Included with your Exhibitor Kit are ADMIT ONE Admittance Tickets ($25 value each). These free tickets are courtesy of Alberta Bound Productions and Canwest Productions and are meant for your client base & preferred customers only. *LAST MINUTE EXHIBITORS ARE NOT GUARANTEED ADMIT ONE TICKETS. Please Note: These tickets can be used for your Appointments at the Show. If you do not provide a free ticket to your client, they will have to pay admission. Resale or dispersing tickets on-site or during Show Hours is strictly prohibited. #33 WILL CALL Each company has been provided tickets for preferred customers and clients. Canwest shall not be liable for damages, losses or delays due to strikes, lockouts or work stoppages of any kind. 3. Canwest shall not be responsible for loss or damage due to water, windstorm, theft, fire, vandalism, acts of God, mysterious dissipation, common wear and tear in handling of equipment or other factors beyond their control. 4. Canwest shall not be held liable for damage to uncrated materials, materials improperly packed, glass breakage or concealed damage. 5. There may be a lapse of time between the placement of incoming shipment(s) in the booth by Canwest and the arrival of the Exhibitor’s represented at the booth. There is a possibility that some time may pass between the pick-up of materials from the booth for loading on a carrier and the completion of packing. It is understood that it these circumstances occur, the shipment(s) will be left in the booth unattended. If, after the placement of any goods, it is agreed that Canwest is not liable. The same is applicable if there is a loss or disappearance of any material from the booth prior to Canwest picking up the shipment after the show. As a result, where discrepancies exist on outgoing shipping documents, Canwest will make the necessary corrections upon pickup of material from the booth. 6. Canwest does not provide for full liability should loss or damage occur. Canwest is not an insurer; therefore, insurance should be obtained by the exhibitor. All materials should be insured from the time they leave the Exhibitor’s firm until they are returned after the show. All risk coverage can usually be arranged with riders to existing policies. Contact your insurance company to make arrangements for coverage during transit and return of the materials, during storage and at the show site. Any amounts payable by Canwest are based on the scope of the responsibility set forth herein and are unrelated to the value of the Exhibitor’s property. If Canwest is found liable for disappearance or damages to Exhibitor’s material, it is agreed that liability will be limited to that specific article only. Liability will be restricted to a settlement equal to $0.30 per pound per article, with a maximum liability of $50.00 per item or $1000.00 per shipment, whichever is less, as agreed upon damages and exclusive remedy. Compensations outlined in this paragraph shall apply if loss or damage occurs regardless of cause of origin, results directly or indirectly to property through execution or nonexecution of obligations imposed by the offering of services to Exhibitors or from negligence, active or otherwise by Canwest. 7. A minimum of 10 days notification must be given to Canwest in order to obtain any special equipment necessary to properly handle shipment for loading, placing or reloading. Canwest shall not be held responsible for any damages incurred unless written notification is issued within the time period stated above. 8. Canwest shall not be held responsible to any degree for any current, possible or anticipated loss of profit or revenues or for any related costs that may result from any loss or damage to Exhibitor’s materials which may it inconceivable or unfeasible to exhibit materials. 9. Claims for loss or damage must be submitted to Canwest by the close of the applicable show or event. No suit or action shall be brought against Canwest more than one year after the cause of action. 10. All parties agree relevant to receiving, handling, temporary storage and reloading of materials, that Canwest will provide these services as the Exhibitor’s agent. Canwest is not a bailee or shipper. Canwest signing of a delivery receipt, bill of lading or other document is done so as an agent of the Exhibitor only and the Exhibitor accepts all responsibility thereof. 11. Canwest shall not be responsible for shipments received without receipts, freight bills or specific piece counts on receipts or freight bills such as a courier or van line. Such shipments will be delivered to the booth without guarantee of piece count or condition. 12. Empty storage labels are available from Canwest service desk. Affixing the labels is the sole responsibility of the Exhibitor. It is understood that these labels are for Empty Storage Only. Canwest will not assume responsibility for loss or damage to contents while containers are in storage or for mislabeled containers. 13. If designated carriers fail to pick-up shipments on time, Canwest shall have the authority to change carriers in order to accelerate removal of goods from the show site. Where no arrangement is made by the Exhibitor, materials will be taken to a warehouse to await Exhibitor’s shipping instructions. The Exhibitor agrees to be responsible for payment of charges incurred with such handling and transporting to the warehouse. Canwest assumes no liability pertaining to such re-routing or handling. 14. The Exhibitor agrees that they will not withhold payment in any amount due to Canwest for material handling or any other service provided by Canwest as an offset against the amount of an alleged loss or damage to any material or equipment. The Exhibitor agrees to pursue any claim against Canwest independently as a completely separate transaction to be resolved on its own merit. Acceptance of the above terms and conditions will be construed upon consignment or delivery of a shipment to Canwest by an exhibitor or by any shipper on behalf of the Exhibitor. IMPORTANT- Please take care of immediately! RE: CERTIFICATE OF LIABILITY INSURANCE As you may know, as an exhibitor participating in a show, you must have adequate Liability Insurance with a minimum $2,000,000 limit to protect the Exhibitors, the attending public, the show organizer and yourself. Our insurance policy does not extend coverage to any exhibits and requires you to submit a Certificate of Insurance upon receipt of the exhibitor’s manual. TERMS & CONDITIONS These terms and conditions form part of the Internet Order Form (the "Order Form") for Internet Service delivery and/or Technical Support (the "Services"). The Order Form and these Terms & Conditions are hereinafter referred to as the "Agreement". 1. SERVICE REQUEST, CANCELLATION, PAYMENT AND REFUND TERMS 1.1 Service Requests 1. Complete information must be provided on the Order Form to ensure prompt processing of the order for the Customer's show or event (the "Show"). Incomplete information will delay processing. 2. Advance Rates as published in the Order Form will only be applicable to Order Forms received by NORTHLANDS at least 14 days prior to the agreed move-in date for the Show (the "Move-in Date"). 3. The Walk-in rate, as published in the Order Form, will apply to any requests for Services received by NORTHLANDS less than 14 days prior to the Move-in Date including, without limitation, any request for additional Services not included in a previously received Order Form. 4. The Walk-in rate will apply to any special requests or arrangements not listed on the Order Form. 5. Conditions for processing Order Forms: (a) Payment in full for the Services as set out in the Order Form must accompany the Order Form; and (b) For new or additional Services required at the time of your Show, please contact the Show Manager or visit the NORTHLANDS Show Office located on the floor of your Show during scheduled move-in times. Walk-in rates are 30% above the standard advance rates. 6. Customers must pay any outstanding balances from Customer's prior shows or events before the Services will be provided. WITHOUT EXCEPTION, current Show balances and any charges incurred for additional Services must be paid in full prior to the Move-in Date. 7. Rates listed for all connections include bringing the Services ordered to the location or locations requested by the Customer in the most convenient manner, and DO NOT include any additional equipment, special wiring, computer hardware/software/set-up/configuration or special placement of Services. 8. Northlands reserves the right to refuse installation and Services once a Show move-in has commenced, if: (a) (b) it is unsafe to do so; or it causes harm, hardship or inconvenience to other customers of Northlands or material handling companies. 1.2 Cancellation 1. Notification of cancellation must be received a minimum of seven (7) days PRIOR to the scheduled first move-in date of the Show. 2. A charge of 30% of the Advance Rate will be applied to every item that is changed, or cancelled within seven (7) days of the scheduled first move-in date of the Show. 3. There are no refunds for orders cancelled after Show opening or for Services installed and not used during the Show. 1.3 Payment 1. Prices are subject to change without notice. 2. Payment must be made at the time of the order. Northlands is not responsible for the payment transaction and does not retain any payment information. 3. NORTHLANDS reserves the right to require a full payment PRIOR to installation. 4. Refunds for overpayment will be processed by the NORTHLANDS Accounting Department 15-30 days after the Show closing date. 5. Unless otherwise stated or agreed, prices are in Canadian funds. 6. All invoices for any additional charges are due for payment upon receipt. Balances remaining unpaid thirty (30) days after the date of invoice shall bear interest at 1 % per month (18% per annum) calculated from the date of the invoice. 1.4 Refunds 1. All claims or disputes regarding Services must be brought to the attention of NORTHLANDS' Client Events Department prior to the Show closing date and prior to the disconnection of any applicable computer equipment. WITHOUT EXCEPTIONS, refunds will not be issued for defective Services not reported as required above or that have been impacted by the show or its clients. 2. Credit will not be given for Services installed and not used. 2. SERVICES AND EQUIPMENT 2.1 Services 1. Only an authorized NORTHLANDS technician or contractor is permitted to do any wiring in the facility (excluding in-booth cabling). The installation of 3rd party transmission lines is prohibited. 2. All devices will require a NORTHLANDS’ ip address to access services on the Internet. These addresses will either be automatically assigned by the NORTHLANDS’ infrastructure. Static ip addresses will be assigned and communicated to the client by the NORTHLANDS’ representative. 3. It is understood that if, after an ip address has been assigned and NORTHLANDS must change a pre-assigned IP address for any reason, the Customer shall have no claim or recourse for compensation whatsoever against NORTHLANDS. Every reasonable effort will be made to maintain the originally assigned address. 4. Unless specifically requested and will be billed accordingly on the Order Form, NORTHLANDS DOES NOT provide technical support for computer hardware or software related issues or for any issues related to the configuration of your computer equipment. 5. Due to the dynamic nature of the Internet, NORTHLANDS cannot guarantee any level of performance or accessibility beyond its gateway. 6. Without limiting the generality of section 2.01(5) above, NORTHLANDS will conduct appropriate infrastructure monitoring of traffic and bandwidth usage to ensure acceptable level Internet bandwidth is available. 2.02 Internet Service Requirements 1. It is the responsibility of the Customer to provide the following: (a) Computer equipment intended to be utilized by the exhibitor but it not outlined in the Order Form; (b) For wired connections: a standard 100/1000 baseT Ethernet Network Interface Card (RJ45 Interface); and (c) For wireless connections: devices to communicate in the 5.0 GHz frequency bands, 2.4 GHz frequency bands is unsupported and not recommended. 2.03 Equipment 1. The Customer will be fully responsible for the safekeeping of all material and equipment belonging to NORTHLANDS. 2. The Customer shall, within 24 hours from the close of the Show, return any material or equipment belonging to NORTHLANDS to NORTHLANDS' Show Management Personnel. Failure to return the equipment in a timely manner, or at all, will result in late charges and the Customer shall also pay to NORTHLANDS the replacement cost of any equipment not returned. This provision shall survive any termination of this Agreement. 3. Material and equipment furnished by NORTHLANDS for or as a part of the Services shall remain the property of NORTHLANDS. 4. Only NORTHLANDS personnel are authorized to modify system wiring or cabling. 5. Any equipment that is found to be causing disruptions to any part of NORTHLANDS' service infrastructure will be removed and not reinstated until the problem has been rectified to the satisfaction of NORTHLANDS' Business Technology Department. 6. The use of any computer infrastructure equipment such as, but not limited to: routers, servers, Wireless Access Points must be pre-authorized in writing by the Northlands’ Business Technology Department. Installation of such devices without prior written authorization will be removed immediately during the duration of the event. 3. REGULATIONS AND LIMITS OF LIABILITIES 3.1 Regulations 1. Customer shall not and shall not permit any of its users or other third parties to: (a) disclose private communications without permission to parties other than the intended recipient; (b) disclose any confidential information, including without limitation, any passwords or network keys provided by NORTHLANDS for the access of Services; (c) restrict or inhibit any other user(s) from using and enjoying the Internet; (d) post, transmit or allow to be displayed to the public, any unlawful, threatening, abusive, libelous, defamatory, obscene, pornographic, or profane information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, provincial, state, national or international law, including without limitation, export control laws and regulations; (e) create or distribute any junk e-mail, spam or any duplicative or unsolicited messages, surveys, contests or pyramid schemes; (f) post or transmit any information or software that contains a virus, worm, cancelbot or other harmful or disruptive component; (g) upload, download, post, publish, transmit, reproduce, or distribute in any way, information, software or other material obtained through the Internet which is protected by copyright or other proprietary right or derivative works with respect thereto, without obtaining permission of the copyright owner or rightholder; (h) access, without authorization, the computer of any other party; (i) abuse or fraudulently use the Internet in any way not specifically prohibited above; or, (j) make any other use of the Services which may cause damage or disruption to NORTHLANDS' network infrastructure, including, without limitation the unreasonable use of network bandwidth. 3.02 Contravention of Agreement 1. In the event that NORTHLANDS determines or suspects that the Customer or its users are in contravention of any term of this Agreement, NORTHLANDS may immediately discontinue the Services without refund or further liability. 3.03 Limitation of Liability 1. Customer understands that Customer and its users may access the Internet through the Services. Customer understands further that neither NORTHLANDS nor its Internet Service Provider operate or control the Internet in any way, and that all merchandise, information and services offered or made available or accessible on the Internet are offered or made available or accessible by third parties. 2. Customer assumes total responsibility and risk for Customer's and its users' use of the Services and the Internet. Neither NORTHLANDS nor its Internet Service Provider make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or noninfringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to any merchandise, information or service provided through the Internet, and neither NORTHLANDS nor its Internet Service Provider shall be liable for any cost or damage arising either directly or indirectly from any such transaction. It is solely Customer's and its users' responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services and other information, and the quality and merchantability of all merchandise, provided on the Internet generally. 3. Customer understands further that the Internet contains unedited materials some of which are sexually explicit or may be offensive to some people. Customer and its users access such materials at their own risk. NORTHLANDS and its Internet Service Provider have no control over and accept no responsibility whatsoever for such materials. 4. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NONINFRINGEMENT OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NO ADVICE OR INFORMATION GIVEN BY NORTHLANDS OR ITS INTERNET SERVICE PROVIDER OR THEIR AFFILIATES OR THEIR CONTRACTORS OR THEIR RESPECTIVE EMPLOYEES SHALL CREATE A WARRANTY. NEITHER NORTHLANDS NOR ITS INTERNET SERVICE PROVIDER WARRANTS THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE OR THAT ANY INFORMATION, SOFTWARE OR OTHER MATERIAL ACCESSIBLE ON THE INTERNET IS FREE OF VIRUSES, WORMS, TROJAN HORSES, CANCELBOT OR OTHER HARMFUL OR DISRUPTIVE COMPONENTS. 5. Under no circumstances shall NORTHLANDS or its Internet Service Provider or their affiliates or contractors be liable for any direct, indirect, incidental, special, punitive or consequential damages that result in any way from Customer's or its users' use of or inability to use the Services or to access the Internet or any part thereof, or Customer's or its users' reliance on or use of information, services or merchandise provided on or through the Services or the Internet, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission, or any failure of performance by NORTHLANDS or its affiliates or contractors. 6. The Customer expressly relieves NORTHLANDS of any liability for any direct, indirect, incidental, special, punitive or consequential damages that result in any way from the provision by NORTHLANDS of any technical support. 7. Without in any manner limiting the express limitations contained in this section 3.03, neither NORTHLANDS nor its Internet Service Provider shall be liable to Customer or its users or any other parties for any: (a) act or omission of a telecommunications carrier whose facilities are used in establishing connections; (b) disclosure of private communications to parties other than the intended recipient, or the disclosure of confidential information; (c) restriction or inhibition imposed by a third party; (d) posting, transmittal or receipt of any unlawful, threatening, abusive, libelous, defamatory, obscene, pornographic, or profane information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, provincial, state, national or international law, including without limitation, export control laws and regulations; (e) posting or transmittal of any information or software that contains a virus, worm, cancelbot or other harmful component; (f) uploading, downloading, posting, publishing, transmittal, reproducing, or distributing in any way, of information, software or other material obtained through the Internet which is protected by copyright or other proprietary right or derivative works with respect thereto; (g) infringement of patents or other proprietary rights; or (h) abuse or fraudulent use of the Internet in any way not specifically prohibited above. 4. MISCELLANEOUS TERMS 4.01 Miscellaneous Terms 1. Extended Meanings: Words importing the singular number include the plural and vice versa and words importing gender include all genders. 2. Governing Law: This Agreement shall be construed and governed in accordance with the laws of Alberta, Canada and the parties attorn to the exclusive jurisdiction of the Alberta Courts in connection with any disputes. The venue of any proceedings shall be Edmonton, Alberta. Severability: The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision hereof.
