For Speciall Use Permits,, the City Cou uncil, upon re ecommendatio on from the P Planning and Zoning Comm mission, has the disc cretionary app proval of use es with unique e or widely-va arying operatiing characteriistics or unus sual site development features, subject to the terms and considerations set forth in the Ordinance or additionally imposed. The use is granted to the owner of the property and is not transferable with the sale of the property. For this Use Permit application, to sell antique furniture, at 1100 Manley Street, a specific use permit could be considered. The property is currently zoned for public use; however, it is privately owned and not generally compatible with the uses permitted by right in the zoning district. Nevertheless, the specific use would not transfer with the sale of the property. Conditions to the approval should require: • • • • • • • • • The Fire Code regulations for a paved 25 foot Fire Apparatus Access Road within 150 feet of all points of the building shall be applied. The property shall be connected to the City water and sanitary sewer. Hours of operation should be limited to daylight hours. Parking areas should be screened from the surrounding uses with landscaping. Defined entrance and exits shall be identified for the parking area. If the existing parking area is to be paved with concrete or asphalt, storm water management shall be required. Signage should be limited to one entrance monument sign. No outdoor sales or displays of materials shall be permitted. Sales shall be limited to the selling of antique furniture as applied for with the current application. The application notes that the auction is expected to attract 50‐75 people. Parking shall be provided for, at the Ordinance required rate of 1 space per 100 square feet for Exhibit Hall, or 174 spaces, if all 17,400 square feet are used for exhibit and auction. However the application note that a residential unit will be occupied within these two buildings and that square footage is not provided. The square footage for residential can be subtracted from this parking requirement and two spaces allocated to the residential use. Accessible customer parking, in accordance with the Texas Accessibility Standards, shall be provided. Please let me know if you have any questions regarding this review.
