NavSim Technology Inc. BoatCruiser Software License Agreement BEFORE INSTALLING THIS PRODUCT, PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF THIS AGREEMENT CAREFULLY. THIS IS A LEGAL AGREEMENT BETWEEN YOU AND NAVSIM TECHNOLOGY INC., HEREINAFTER REFERRED TO AS “NavSim™,” AND THE TERMS OF THIS AGREEMENT GOVERN YOUR USE OF THIS SOFTWARE. INSTALLING THIS PRODUCT WILL CONSTITUTE YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS OF THIS AGREEMENT. 1. GRANT OF LICENSE The application, demonstration, system and other software accompanying this License, whether on disk, in read-only memory or on any other media (the “Software”) and the related documentation are licensed to you by NavSim™. NavSim™ as Licensor, grants to you, as Licensee, a non-exclusive right to use and display this copy of the Software on a single computer only at one location at any time. To “use” the Software means that the Software is either loaded in the temporary memory (i.e., RAM) of a computer or installed on the permanent memory of a computer (i.e., hard disk, CD ROM, etc.). You may install the Software on a common storage device shared by multiple computers, provided that if you have more computers having access to the common storage device than the number of licensed copies of the Software, you must have some software mechanism which locks-out any concurrent users in excess of the number of licensed copies of the Software (an additional License is not needed for the one copy of Software stored on the common storage device accessed by multiple computers). 2. OWNERSHIP OF SOFTWARE As Licensee, you own the disk or other physical media on which the Software is originally or subsequently recorded or fixed, but NavSim™ retains title and ownership of the Software, both as originally recorded and all subsequent copies made of the Software regardless of the form or media in or on which the original or copies may exist. This License does not constitute a sale of the original Software or any copy. 3. RESTRICTIONS The Software contains copyrighted material, trade secrets, and other proprietary material. Except as permitted by applicable legislation, you may not decompile, reverse engineer, disassemble or otherwise reduce the Software to a human-perceivable form. You may not modify, network, rent, lease, loan, distribute or create derivative works based on the Software in whole or in part. 4. TRANSFER RESTRICTIONS This Software is licensed to only you, the Licensee, and may not be transferred to anyone else without the prior written consent of NavSim™. Any authorized transfer of the Software shall be bound by the terms and conditions of this Agreement. In no event may you transfer, assign, rent, lease, sell or otherwise dispose of the Software on a temporary or permanent basis except as expressly provided herein. 5. TERMINATION This License is effective until terminated. This License will terminate automatically without notice from NavSim™ if you fail to comply with any provision of this License. Upon termination you shall destroy the written materials and all copies of the Software, including modified copies, if any. 6. UNITED STATES GOVERNMENT END USERS If the Software is supplied to the United States Government, the Software is classified as “restricted computer software” as defined in the clause 52.227-19 of the Federal Acquisition Regulations System (“FAR”). The United States Government’s rights to the Software are as provided in Clause 52.227-19 of the FAR. 7. DISCLAIMER OF WARRANTY ON SOFTWARE (For the purposes of paragraphs 8 and 9 hereof, NavSim™, the directors, officers, employees, agents and representatives of NavSim™, and NavSim’s™ Licensors arecollectively referred to as “ NavSim™”). You expressly acknowledge and agree that use of the Software is at your sole risk. The Software and related documentation are provided “AS IS” and without warranty of any kind. NavSim™ EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NavSim™ DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS, OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. FURTHERMORE, NavSim™ DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SOFTWARE OR RELATED DOCUMENTATION IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY OR OTHERWISE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY NavSim™ OR A NavSim™ AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY. SHOULD THE SOFTWARE PROVE DEFECTIVE, YOU (AND NOT NavSim™ OR A NavSim™ AUTHORIZED REPRESENTATIVE) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER LEGAL RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION. Specifically, but without limiting the generality of the foregoing, the Software and map data are to be used only as an aid to viewing geographic and spatial data and is licensed to serve as a general reference. Although NavSim™ has made every effort to make this software and map data accurate by obtaining all electronic map and chart data from professional and authorized providers, please consider carefully the fact that this particular NavSim™ product provides only estimated values or approximate locations; and thus, may not be adequate for purposes requiring precision in depiction of geographic features, exact measurement of direction or distance, or for similar purposes, including but not limited to navigation, tracking or emergency response. The Software is licensed to you for use as a general position locator, subject to the accuracy limitations of GPS signals, errors in digital maps, and errors in integrating the maps with the GPS. The Software is not intended and is not licensed to you for purposes of steering or guiding a moving vehicle, boat, or airplane, or any other navigational use requiring precise determination of position. The Software is not licensed for use as the sole source of position information. 8. LIMITATIONS OF LIABILITY UNDER NO CIRCUMSTANCE INCLUDING NEGLIGENCE, SHALL NavSim™ BE LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OR INABILITY TO USE THE SOFTWARE OR RELATED DOCUMENTATION, EVEN IF NavSim™ OR A NavSim’s™ AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. In no event shall NavSim’s™ total liability to you for all damages, losses and causes of action (whether in contract, tort, including negligence, or otherwise) exceed the amount paid by you for the Software. 9. CONTROLLING LAW AND SEVERABILITY This License shall be governed by and construed in accordance with the laws of Canada and the Province of Newfoundland and Labrador. Each party hereto irrevocably agrees that the Supreme Court of Newfoundland and Labrador, Trial Division, Judicial Centre of St. John’s, shall have exclusive jurisdiction to settle any dispute and/or controversy of whatever nature arising out of or relating to the Licensee’s use of the Software and/or related documentation, and that accordingly any suit, act or proceeding arising out of or relating to such matters shall be brought in such courts and, to this end, each party hereto irrevocably agrees to submit to the jurisdiction of such courts and irrevocably waives any objection which it may have now or hereafter to such exclusive jurisdiction. If for any reason a court of competent jurisdiction finds any provision of this License, or portion thereof, to be unenforceable, the License as a whole shall not be nullified thereby and that provision of this License shall be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of this License shall continue in full force and effect. 10. COMPLETE AGREEMENT This License constitutes the entire agreement between the parties with respect to the use of the Software and related documentation, and supersedes all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. No amendment to or modification of this License will be binding unless in writing and signed by a duly authorized representative of NavSim™. Insert the BoatCruiser CD. If Autorun is enabled, installation will begin automatically. 2. If Autorun is disabled, run the program setup.exe on the BoatCruiser CD. 3. The Microsoft .NET Framework Version 1.1 will install. The .NET Framework V. 1.1 is necessary to run BoatCruiser, so you must choose ‘YES’ when the .NET Framework installation prompt appears and then ‘I Agree’ to the Microsoft License Agreement. NOTE: If you cancel the .NET Framework Installation, setup of Boat Cruiser will exit. Your computer may need to be restarted after .NET Framework installation, in which case setup will resume after restart. 4. Unless already installed, the .NET Framework Version 1.1 Service Pack 1 will be installed next. Choose ‘OK’ to install the .NET Framework Service Pack 1, then choose ‘I Accept’ to the Microsoft License Agreement. If you cancel the Service Pack installation, setup of BoatCruiser will exit. Your computer may need to be restarted following installation of the .NET Framework Service Pack, in which case setup will resume after restart. 5. Choose ‘Next’ on the welcome screen to proceed to the BoatCruiser License Agreement. 6. Choose ‘I Agree’ to accept the terms of the BoatCruiser License Agreement. If you do not accept the terms of the License Agreement, choose ‘Cancel’ and BoatCruiser setup will exit. 7. Enter your BoatCruiser serial number, found on the inside of the box, and choose ‘Next’ to continue. 8. Select the folder where you wish to install BoatCruiser, if other than the default folder and choose “Install”. 9. Once installation is complete, the ‘Completing BoatCruiser Setup Wizard’ dialog will appear. Choose ‘Finish’ to exit installation and start BoatCruiser. C-MAP MAX/PC Charts Installation Guide 1. Select the appropriate C-MAP MAX/PC CD: MAX/PC CD Disc 4: US & Canada West Coasts, Alaska, Northern Asia, Northeastern Russia, Central America. MAX/PC CD Disk 5: US & Canada East Coasts, Gulf of Mexico & Caribbean, Central America MAX/PC CD Disk 6: US Rivers & Lakes, Great Lakes, Central and South America, Greenland. 2. Insert the MAX/PC CD into your CD drive and follow the on screen instructions to install the C-MAP Chart Selector software. (System requirements printed on back of MAX/PC sleeve) C-MAP MAX/PC Charts Installation Guide con’t 3. Once installation of the C-MAP Chart Selector is complete click the C-MAP NT/PC Selector icon on your desktop to start the program. • A screen explaining the availability of a C-MAP dongle for multiple computers will appear, click OK to close this screen • A file search window will also open, please click cancel to close this window 4. When the Chart Catalogue selector mode opens select the NTMax folder in the left panel (NOT THE NT+ FOLDER) and select the appropriate C-MAP MAX chart. • Selected charts will be outlined in red on the world map. • The FREE Voucher will ONLY unlock those charts ending in CDWM 5. Once you have selected the correct chart, please click “Buy selected chart”. The Shopping Cart window will open. In the lower “Shopping Cart” window, the information for the MAX/PC chart you selected will be displayed, including: Chart License Code Request, Chart code number, name, date, price category and date of purchase. [The upper window “Purchased NT+/PC Chart” lists the charts already unlocked on your computer] • The “Chart License Code Request” is the number required to unlock your new C-MAP chart 6. To unlock your new chart you can choose either “Shopping Online” or “Call Center” from the top menu. 7. To unlock your new chart online click the “Shopping Online” button. The procedure is automatic once you click, however you must have an internet connection. • The computer being used to unlock the C-MAP chart must be the navigation computer. The unlocked charts can not be moved to another computer. • Please read all the online instructions carefully • Make sure to change the currency option to US Dollars • Ensure you enter your “Reseller Voucher Code”, provided with BoatCruiser, when you have to choose the desired payment method. • DO NOT USE CREDIT CARD IF YOU HAVE A VOUCHER. • Once the transaction is approved your C-MAP chart will unlock automatically and the license code will be copied to your C-MAP selector directory. • Open your navigation software program and you now have your C-MAP MAX chart available for navigation. 8. If you do not have an internet connection and want to purchase through C-MAP’s Call Center please click the “Call Center” button and select the appropriate call center nearest you. • You will need to communicate the Chart License Code Request to the C-MAP representative. (The code is at the bottom of the Call Center screen) • Also please have your Reseller Voucher Number ready for the C-MAP representative Introduction to BoatCruiser BoatCruiser is the ideal PC-based electronic chart viewing and navigation aid for recreational and professional boaters. Developed by NavSim Technology Inc. [www.navsim.com], BoatCruiser’s principal functions include viewing and managing Nautical Charts and Topographic Maps as well as tracking the vessel’s position in real-time with a compatible GPS receiver and Autopilot. BoatCruiser HELP BoatCruiser includes a comprehensive built in HELP function located at the top of the screen in the Main Menu. The HELP function offers two Options: HELP (F1) and the Quick Start Menu (F2). HELP: The HELP option contains information about all aspects of BoatCruiser functionality. There are three ways of accessing what you are looking for. HELP Contents contains a thematic listing of BoatCruiser functions, HELP Index lists all available topics in alphabetical order and HELP Search allows for a key word search. Click on any topic in the explorer window and HELP will appear for that topic in the main HELP view. Click BACK to return to the previous page. Quick Start Menu: The Quick Start Menu consists of Wizards and Tutorials aimed at helping you with a number of common BoatCruiser functions. •Wizards perform basic tasks for you including Searching for available charts on your PC and Configuring Peripheral devices such as GPS or AIS that you may wish to connect. •Tutorials provide quick step by step overviews of how certain common functions work in BoatCruiser (e.g., Working with Routes, AIS) BoatCruiser and the Global Positioning System (GPS) BoatCruiser shows your exact position, heading and speed in real-time ensuring that you always know where you are and how to return to your point of origin. All you need is a GPS Receiver with standard NMEA 0183 output as well as a Serial Port and cable or wireless Bluetooth connector. More detailed information about working with GPS can be found in BoatCruiser HELP. BoatCruiser Main Screen Functions BoatCruiser allows you to create an unlimited number of personalized screen layouts to suit your navigation needs. The basic elements of the screen however, remain constant as follows: Screen Layouts One of BoatCruiser’s greatest and most unique advantages is the option to customize screen layouts to suit each user’s individual needs and preferences. To get you started, however, BoatCruiser comes with five default layouts including Basic, Fuel, Planning, Quad and EnRoute. These layouts can be accessed by clicking on the Layout Tabs at the bottom of the BoatCruiser screen or under Layouts in the Main Menu. Screen Layouts con’t • The Basic layout gives you a large chart viewing area with basic navigation information boxes on the right of the screen. The navigation tools included in the Basic Layout are Circular Compass, Tripometer, Position, Course Over Ground, Speed Over Ground and Cross Track Error. • The Fuel layout focuses on Fuel Consumption. When planning a Route the estimated speed can be entered in the Fuel Consumption Grid under Boat Properties. The Fuel panels can then be monitored for cost of Fuel and consumption rate. • The Planning layout contains a split screen that allows you to view detailed Chart or Object information while planning Routes or Creating Markers, Zones and Text Annotations. • The Quad layout features four viewing areas; Main Chart View, Navigational Tools status boxes, Depth Sounder Status and Highway View. The size of the areas of the quad may be modified if you wish to have a larger viewing area of the Chart or other Layout panel. • The advanced EnRoute layout contains more than a dozen navigational tool options. The left of the screen contains status boxes including device status and Waypoint information. AIS targets can be viewed on the right side when AIS (Automatic Identification System) is enabled. Below the list of AIS Targets, Properties of selected AIS target, the Chart or Chart Objects can be viewed. The Selector Compass and Satellites are located at the bottom right of the screen. Directly below the Chart View, the Time Slider can be used to plan the next voyage or to go back in time to look at Tidal and Simulation data. Please see Time Management in BoatCruiser HELP for more information. Context Menus Another amazing BoatCruiser feature, Context Menus put a variety of functional tools right at your fingertips. Simply place the Selector Arrow over any Chart, Route, Marker, Zone, GPS Trajectory, Annotation or MyBoat and right-click. A Context Menu will appear allowing you to instantly Delete, Modify or Export any chosen object. NavManager The NavManager is the brain of BoatCruiser. This control centre and main information repository lets you monitor and regulate all BoatCruiser settings. The Properties of all charts and user created objects including Routes, Markers, Zones, GPS Trajectories, My Boat, Annotations, Locations as well as Peripheral Device Settings can be viewed and modified in the NavManager To open the NavManager, click the NavManager button in the Main Toolbar, or select Tools, then NavManager from the Main Menu. Choosing Properties from any object’s Context Menu will also open the NavManager. The NavManager is comprised of three sections: • the NavManager Toolbar; • the Explorer View which displays all BoatCruiser objects; and • the Editing View which shows detailed information about the currently selected object. A comprehensive list of all NavManager functions can be found in BoatCruiser HELP. Basic Operations Importing Charts C-MAP MAX charts that come with BoatCruiser must be installed according to the instructions in the C-MAP MAX/PC Charts Installation Guide above. Should you prefer to use any other chart format (BSB, S-57, topo) simply open the Quick Start Menu in the Top Menu Bar and choose the Chart Import Wizard. The Wizard will search your computer for any available charts and install them automatically in BoatCruiser. Panning Zooming Panning is the act of moving a chart up, down, side-to-side, or diagonally on the screen. To pan in the Main Chart View hold down on the left mouse button to create a Hand Grab. As you move the Hand Grab cursor, the chart will move (“pan”) in the same direction. You can also use the directional arrow keys on your keyboard to pan. The easiest way to Zoom in or out on a chart is by using the scroll wheel of your mouse. Alternatively, you can use the Zoom In and Zoom Out buttons in the Main Toolbar (or the + and - keys on the keyboard). Clicking on the Zoom Box will create a tool for drawing a rectangular area on the chart. Left click on the chart and drag the tool diagonally over the area you want to work with. When you release the mouse button, the screen will Zoom in to the area you selected. Creating Routes There is nothing simpler! Just click on the Create Route button in the Main Toolbar and plot Waypoints the in the Main Chart View as desired. End the Route by double clicking on the last Waypoint you want to create. You can view and change the properties of any Route by choosing Properties in the Route Context Menu. More detailed information about working with Routes, can be found in BoatCruiser HELP. Creating Markers To create a Marker, click on the Create Marker button in the Main Toolbar, then left-click anywhere in the Main Chart View to insert the Marker. You can view and change the properties of any Marker by choosing Properties in the Marker Context Menu. More detailed information about working with Markers, can be found in BoatCruiser HELP. Basic Operations con’t Creating Zones To create a Zone, click and release the Create Zone button in the Main Toolbar. Move the cursor out to the Main Chart View and click repeatedly to insert Zone Waypoints. End the Zone by double clicking on the last Waypoint you want to make. You can view and change the properties of any Zone by choosing Properties in the Zone Context Menu. More detailed information about working with Zones, can be found in BoatCruiser HELP. Printing BoatCruiser’s Printing capabilities are unmatched. You can calibrate the level of detail of the chart and any objects it contains by defining the number of pages to be printed. To Print, select File then Print from the Main Menu. The resulting printout of the current view will include the page number, date, and time of the printing in the page’s footer. More detailed information about Printing can be found in BoatCruiser HELP. Saving in BoatCruiser BoatCruiser will AUTOMATICALLY save any Charts, Routes, Markers, Zones, GPS Trajectories, Simulations, Annotations and Locations that are present in the system when you exit the program. The next time you open BoatCruiser, all saved objects and settings will appear exactly as you left them. Additional Information CHART DATUM What is a datum? A datum is a model used to define the size, shape and centre of the earth. It is used to establish latitude and longitude coordinate locations for points on the Earth’s surface. Why are datums important? There are a variety of datums in active use, resulting in the possibility that coordinates of a given location, calculated using one datum may differ by hundreds of feet from the same coordinates calculated from another datum. Before relying on any coordinate location information, it is important to know what datum was used in establishing the coordinates. When datums are unknown. The World Geodetic System 1984 (WGS84) is the most commonly used worldwide datum. BoatCruiser will display all coordinates in the WGS84 datum. To do this, coordinates may have to be “shifted” into the WGS84 datum. In some cases BoatCruiser will be unable to determine the original datum of charts, or be unable to shift the datum into the WGS84 datum. In these cases, BoatCruiser will assume the chart datum to be WGS84 and display “Assuming WGS84” in red letters in the Chart Properties page.
