Kevin Williams, a U.S. Navy chief petty officer, was the grill master, cooking up chicken, sausages and other mouth-watering delights. His wife, Vanessa, and children, Jamal and Journi, enjoyed the food and family time, whether it was a game of Monopoly (Kevin’s favorite), listening to music or watching a little TV. “It was always a big deal,” said Vanessa Williams of the holiday family time. They celebrated that way Memorial Day 2013. The next weekend Kevin was going to buy Jamal a car. The Fourth of July holiday would see the family going to Disney World with Kevin’s brother and his children. None of that happened. Kevin Williams disappeared the next day. Wine Decadence at 31 W. Adams St. sells Foley Family Wines by the bottle and case and it’s the warehouse for a team of about 50 consultants who sell the wines at tasting parties in private homes. Anna Valent, Wine Decadence CEO, said in late 2013 an executive with Fidelity National Financial invited friends over for dinner and served Foley Family Wine from vineyards owned by Bill Foley, Fidelity chairman. “Everybody wanted to know where they could buy the wine, so he started taking orders,” said Valent. Within a year, a marketing plan was developed around wine tasting parties in homes. “Most people serve wine at home-sale parties,” said Valent. “We bring the wine to the party.” Wine Decadence Valent consultants bring four wines, plus glasses and cheese, for a twohour tasting and educational session. Valent said Foley Family owns about 50 vineyards and wineries around the world and has access to another 250 fine wine labels. Bottle prices range from $12 to more than $200. “We offer something for every taste and budget,” she said. After guests sample the wines and learn about their origins and food pairings, the consultant takes orders that may be picked up at the store or delivered by courier a few days after the party. The company moved into the space at The Carling in October 2014 and used it as a warehouse to store the wine. With help from a $33,500 Retail Enhancement Grant to the building’s owner from the Downtown Investment Authority, Wine continued on Page A-3 More signals call for Earth Fare in Mandarin Even more indications are surfacing that organic and natural foods grocer Earth Fare is closing in on a supermarket at the Mandarin South shopping center. Property owner Preferred Growth Properties LLC filed site plans with the city for parking lot improvements that clearly outline a 27,550-square-foot “natural grocer” in the largest space at 11700 San Jose Blvd. One reason it is expected to be an Earth Fare is a former tenant in the building, Wood You Furniture, said so. When the business moved to another Mandarin location in Public February, its owners said they were told by a Preferred Growth Properties representative that Earth Fare had signed a lease there. Another reason is when Earth Fare opened its first Jacksonville store in August 2014 at Kernan and Atlantic boulevards, its CFO said the company wanted to open up to four area stores, including in Mandarin. And another link is the size — the Atlantic North store is 24,000 square feet, similar to the Mandarin South size. Store and property representatives have not confirmed the legal notices begin on page A-9 Earth Fare lease. The site plans filed last week cover parking-lot improvements. Preferred Growth Properties, through the PGP Jacksonville LLC ownership entity, and Solid Rock Engineering Consultants Inc. submitted the information. A letter from Solid Rock says PGP Jacksonville LLC proposes to improve the parking lot to meet city design specifications as closely as possible. It says the proposed uses remain the same as existing uses: a retail/grocery/ restaurant building. A Winn-Dixie occupied the grocery space years ago, which appears to be divided now to accommodate other retailers. The Winn-Dixie was at least 45,000 square feet. The internal landscape islands will be built according to the city’s land development code. Details of the changes are in a requested zoning administrative deviation scheduled for review, the letter says. Published for 26,942 The letter and the plans show more detail about Preferred Growth Properties’ intentions for the property, which is at San Jose Boulevard and Loretto Road, south of Interstate 295. Now at about 65,000 square feet, a proposed addition will boost the shopping center to almost 74,000 square feet. That addition will help create space for a 17,730-square-foot junior anchor next to the grocery store. Some tenants, including AutoZone, said previously they intend to remain. The site and landscape plans show 10 retail and restaurant spaces. Including AutoZone, the natural grocer and the junior anchor, there are four retail stores from 1,200 to 2,800 square feet and three restaurants of 2,400 and 2,800 square feet. Preferred Growth Properties, the real estate subsidiary of Books-A-Million Inc. of Birmingham, bought Mandarin South in July 2014. Preferred Growth Properties also is developing The Strand and The Crossing mixed-use centers near St. Johns Town Center. Captain’s Catch could open this summer Captain’s Catch Seafood Restaurant and Sports Bar is being designed at Regency Square Mall as a 200-person capacity dining area and sports bar that will serve fresh seafood that primarily is locally caught, according to its landlord. Bill Connerly, COO of International Décor Outlet, said the 5,900-square-foot restaurant should be built-out in a month or two after permitting is approved. The restaurant is designed in the former Houlihan’s space, near the former Belk store. Connerly said some deconstruction is taking place as the city reviews the permit application. The application states a $350,000 build-out. Connerly declined to identify the restaurant’s owners other than that they are based in New York. He said local people will run the business, which will employ 20-25 workers. He said there was no menu yet, but the focus is on seafood. “We are looking at everything being local,” Connerly said. “If you can’t get local, it will be 100 percent fresh.” He said the restaurant will lease from IDO, which holds the master lease on 200,000 square feet of the interior hall space in the mall’s Photo by Karen Brune Mathis Continued from front page west wing. Connerly said there were 86 spaces available, although some can be combined into larger shapes and others might be split. He said IDO is looking at a fill rate of 80 percent by year-end. IDO also is leasing the Darien Outlet Mall in South Georgia. Connerly said several spaces are under design there and ready for permitting. He said IDO is opening that center up for domestic stores as well, such as coffee shops, restaurants and a design center for a local contractor. The company said on its idooutlet.com site it plans to host grand openings for both the Jacksonville and Darien locations in late August. kmathis@jaxdailyrecord.com @MathisKb (904) 356-2466 Court rejects lawsuit over burial customs By The News Service of Florida A South Florida appeals court has turned down a lawsuit stemming from a woman’s allegation that a cemetery had not properly buried her late husband in accordance with “Jewish burial customs and traditions.” Orna Mammon filed the lawsuit against Menorah Gardens and Funeral Chapels and its parent company and alleged she had received misleading information about Jewish burial customs being followed, according to the ruling last week by a panel of the 4th District Court of Appeal. The widow visited her husband’s grave about a month after Today-Friday, June 3 his burial and found that nonJews had been buried nearby, which she said violated Jewish customs. But a Broward County circuit judge dismissed the lawsuit and the appeals court upheld that decision, pointing to a legal principle known as the “ecclesiastical abstention doctrine.” Broadly, that principle says courts should not resolve internal disputes in religious organizations if the disputes involve religious doctrine. The appeals court said a circuit judge would have to determine what constitutes Jewish burial customs and traditions to determine if misrepresentations occurred. “Because the First Amendment’s ecclesiastical abstention doctrine precludes the circuit court from evaluating these deeply religious questions, the court would be unable to perform its ultimate task of deciding whether the defendants made deceptive and fraudulent misrepresentations regarding ‘Jewish burial customs and traditions,’ said the ruling, written by Judge Jonathan Gerber and joined by judges W. Matthew Stevenson and Spencer Levine. “Thus, the First Amendment’s ecclesiastical abstention doctrine precludes the court from having subject matter jurisdiction here,” the ruling said. After a Florida Supreme Court ruling last month struck down a limit on attorney’s fees, workers’ compensation insurance rates could go up 17.1 percent, according to a proposal submitted to state regulators. The National Council on Compensation Insurance, which submits rate proposals for the workers’ compensation insurance industry, said the hike should take effect Aug. 1. The Florida Office of Insurance Regulation will decide whether to approve the proposal, a process that could lead to a different rate change. Major business groups quickly pounced on the rate proposal, which largely stems from an April 28 Supreme Court ruling that said a state law limiting fees for attorneys who represent injured workers was unconstitutional. The issue likely will spur a legislative battle, as business groups seek to curb increased rates. “We can’t expect the economy to just keep growing with an unexpected and unproductive 17.1 percent ball and chain around every wage earner out there,’’ said Bill Herrle, executive director of the National Federation of Independent Business/ Florida. The Office of Insurance Regulation said a public hearing will be held in July on the rate proposal. Business groups blame legal fees for driving up insurance costs, while workers’ attorneys say adequate fees are needed to help injured people get representation. The Supreme Court, in a 5-2 ruling, said a 2009 law limiting attorney’s fees was a violation of due-process rights under the Florida Constitution and the U.S. Constitution because it prevented challenges to the “reasonableness” of attorney’s fees awarded in workers’ compensation cases. The ruling stemmed from a case in which an attorney was awarded the equivalent of $1.53 an hour in successfully pursuing a claim for benefits for a worker injured in Miami. In Friday’s filing, the National Council on Compensation Insurance, which is known as NCCI, said the Supreme Court ruling will increase costs in the workers’ compensation system by 15 percent. An additional amount of the proposal deals with a law passed this year that relates to healthcare provider reimbursements. In all, NCCI said the combined impact would total $623 million. Florida employers have seen a series of decreases in workers’ compensation rates since lawmakers in 2003 passed a controversial overhaul of the system. The latest decrease, which took effect Jan. 1, was an overall 4.7 percent. But after Friday’s proposal, Herrle and officials from the Florida Chamber of Commerce and Associated Industries of Florida signaled they will work to get the Legislature to make changes to prevent major increases. The Florida Chamber, for example, said it has a task force preparing a legislative proposal. “The Florida Chamber will lead the charge to ensure small businesses aren’t crushed under the weight of increased workers’ comp rates, and that workers have access to quality health care so they can return quickly back to work,” Florida Chamber President and CEO Mark Wilson said in a statement. Associated Industries, meanwhile, said it plans to hold townhall meetings in June and July in Tampa, Aventura and Jacksonville as part of efforts to spur legislative action. “Today’s workers’ compensation rate increase filing by NCCI comes as no surprise,” Associated Industries President and CEO Tom Feeney said in a statement. “Upon reading the Florida Supreme Court’s far reaching opinion … we warned that the unbridled hourly rate attorney fees the decision permitted would trigger a significant increase that directly hurts all Florida employers and will hamper continued job creation,” he said. Wine Decadence has applied for a permit to sell wine by the glass. “We want to be part of the neighborhood,” Valent said. “People can stop by after work, have a glass of wine and then take a bottle home with them.” The retail package store is open 10 a.m.-6 p.m. MondayFriday. New York had become home for both after he moved from Trinidad when he was 14 and she from Guyana at age 19. She was a 24-year-old receptionist at a cleaning service. He was a 20-year-old manager at a coffee shop who found out she was a coffee fan. “He would give me free cappuccinos because he liked me,” she said with a sheepish smile. The two became best friends who took a few years to figure out they were meant to be together. He was younger, well-mannered, quiet and sweet. He was going to Queensborough Community College for computer science before changing course to the Navy. She remembers the day he enlisted — May 5, 1998 — and after boot camp in Chicago, they moved to Jacksonville, where he spent his Navy career as a machinist. It wasn’t as hectic or fast-paced as New York, but that was a good thing. He wanted to go into the country, deep into Callahan when he retired, to boat and fish. “He likes the quiet life,” she said. He liked the family life, too. Kevin and Vanessa married Dec. 8, 2000. He entered Jamal’s life when he was a little over a year, but the two were as close as any father and son could have been. Kevin and Vanessa Williams had Journi in 2002. Work, school, play. The days turned to weeks, weeks to months and months to years for the family as it grew up. Memorial Day 2013 was supposed to be just another holiday together, not the last. The next day was a big one for Journi. She was among a small group of students being honored for their dedication and work in elementary school at a ceremony at the University of North Florida. A proud moment the family would enjoy together. It didn’t happen that way. The day it all changed Vanessa Williams remembers the daily ritual. Kevin Williams woke up the next day like normal. He brushed his teeth. Put on his gym clothes. Kissed his wife five times (it was just his thing) then put on his Calvin Klein Obsession cologne — she didn’t like the smell. On the way to Mayport Naval Station, the alternator in Kevin Williams’ car gave out near Interstate 295 and Merrill Road. She had told hime many times to get rid of that car. She told him again when he called her. “I was not being nice,” she recalled. It is part of the pain she still feels. She admits she was moody that day and the back-and-forth banter left her upset. Little things like him working so much — especially because he wasn’t the happiest at work at the moment — had built up. After charging the battery, he made it to a dealership near The Avenues for a repair. Kevin Williams thought about going into work. A day after a holiday, duties had piled up and they’d be waiting for him if he took off. But it was close to 1 p.m., half the day had disappeared. She thought he should call it a day and head across the street to the mall with her to pick out a dress for Journi to wear to her ceremony. He agreed to the shopping trip, but the earlier agitation came back during the car ride together. “He made our marriage so easy,” she said smiling, holding her fists up in a joking manner. “Sometimes, he would just pick a play fight.” He egged her on that day, not in a hurtful way but enough that — well, she just needed a minute. So in The Avenues mall parking lot, she walked away without him. She thought he’d follow her after a minute or two or he’d be there when she came back with Journi’s blue dress. Neither happened. He was gone. A difficult two years She called his phone, only to see it was in the car. She saw his military phone, too. Nowhere to be found, she had Photos by Fran Ruchalski cope with the sudden loss and a mystery that hasn’t been solved. The Navy initially said he abandoned his post at Mayport Naval Air Station, but his wife has been adamant he’d never do that to his family or the Navy. He loved them both too much. More than two years went by before Vanessa Williams heard the news she hoped wouldn’t be true. Kevin Williams’ body was found in a pond not far from The Avenues mall parking lot where she last saw him after a brief argument — the “stupid” kind that couples end up not realizing why they were combative in the first place. More than three years later, the Williams family still has no closure. But on Monday, it did receive some sense of respect for Kevin Williams’ legacy — his name was one of five added to the Veterans Memorial Wall. The annual ceremony is a way to remember those who served, with more than 1,700 names etched in black granite. “Even though it’s hard seeing his name there, that part is important to us,” said Vanessa Williams. Even more important to her is finding details to the end of her husband’s story. His body was found last year in a pond while authorities were searching for Lonzie Barton. to quickly pick Journi up from school. The two raced back to the mall to look to no avail. No luck at the dealership, either. The ceremony at UNF went on without Kevin Williams in the audience. She knew something was terribly wrong. The Jacksonville Sheriff’s Office and Naval Criminal Investigative Service became involved in the missing persons case. The day after it went public was the worst, Williams said. The news was all over TV and social media. Jamal and Journi took it extremely hard and blamed their mother for what happened. “If mom and dad didn’t get into a fight,” started Williams, tears trickling and her voice shaky. “Mommy went into the mall and left daddy.” The children needed someone to blame. They blamed her for a long time, she said. Both went into a deep depression, she said, and Jamal and her don’t have a good relationship anymore. Journi has her good days and bad days as she prepares for high school. When they get angry, said Vanessa Williams, the feelings unearth themselves again. “I can’t even describe what those two years were like,” said Vanessa Williams, describing her own emotions. “I went insane.” Every day went by with no news. Why wasn’t there any news? Wasn’t anyone looking? In July, more than two years after he disappeared, Kevin Williams’ body was found in a pond not far from The Avenues. He was still wearing his Navy uniform, still had his wallet and identification. How they came upon him was in itself the result of another tragedy: Law enforcement and the community as a whole were Vanessa Williams praised her husband during her speech Monday. At right is their daughter, Journi. scouring the area desperately looking for Lonzie Barton, the toddler whose disappearance gripped the area. Kevin Williams didn’t have any gunshot or knife wounds. Officials say foul play wasn’t suspected, but the cause of death was ruled undetermined. The lack of answers has meant a lack of closure. Vanessa Williams still wants answers. She wants people to care as much as she does. Monday didn’t provide answers, but it did provide some caring. Throughout her few minutes, the emotion rose up her throat and through her lips, audible to all who heard. “I never gave up on him,” she said. “As I know he would never leave us.” Her children and grandchildren will be able to see Kevin Williams’ name on the wall for decades to come, she said last week. For that, the family is thankful, she said, but it needs to be just a start — she wants to find justice for Kevin Williams. She needs it for herself, too.
