LEGISLATIVE LEADERSHIP TO ATTEND CAWV ANNUAL MEETING
Senate President Bill Cole and House of Delegates Speaker Tim Armstead will highlight the
General Business Session at the 2015 CAWV Annual Meeting, which will be held July 9-12 at
The Greenbrier. “We are very pleased to have President Cole and Speaker Armstead to speak
to our members,” said CAWV President Dan Flesher. “There are many issues before the West
Virginia Legislature that affect our members. We are honored they will attend and give us their
vision for the future of West Virginia, including funding for the state’s infrastructure of roads and
bridges, schools and water and sewer facilities and tax reform,” the president commented.
They join other speakers including new Associated General Contractors of America President
Chuck Greco and Paul Mattox, Jr., secretary of the West Virginia Department of Transportation
and Commissioner of the West Virginia Division of Highways.
Nearly 300 members have already registered for the meeting, which will begin Thursday, July 9,
with a reception. “We have sold out the past few years so I encourage all members to make
their reservations as soon as possible,” said CAWV Program Committee Chairman Roger
Thomas. “The business sessions and the networking opportunities make the meeting a
worthwhile event for all members. If you have yet to attend an Annual Meeting, this year’s
meeting will be a good one to start with. The division meetings will feature discussions on
issues that will affect all members over the coming year,” he stated.
Members are asked to return their activities form to register for golf, trap, culinary and other

LEGISLATIVE INTERIM MEETINGS DISCUSS CHANGE ORDERS, PREVAILING WAGE
The Joint Committee on Government Organization during this month’s legislative interim
meetings learned of a recent report by the Performance Evaluation and Research Division
(PERD) on the state Purchasing Division, and specifically, the division’s change order policy.
The report said Purchasing should discontinue allowing agencies to submit change orders after
their effective dates, “particularly when they have monetary repercussions to the state.” PERD
wants agencies not to permit vendors to perform work through a change order until the change
order has been formally approved by the Purchasing Division and the Attorney General’s office,
encumbered by the Purchasing Division, and mailed to the vendor. The change goes into effect
July 1, 2015. PERD examined 75 sample files to determine which agencies had the submitted
change orders and found that 85 change orders evaluated for the report were submitted by 22
agencies. One agency had two contracts with an increase of $1.8 million but they were for
products and services, not construction.
The upcoming change will have ramifications on state construction projects. The bottom line is
that PERD wants a change order approved and signed before work is to begin on the change
order work. The CAWV has met with the state’s Legislative Auditor, the Secretary of
Administration and the Purchasing Division to alert them of the problems this will occur in the
field if contractors are forced to shut down the project while waiting for the change order to go
the process of being approved and signed off on. They noted that many of the change orders
on state contracts are not related to contracting and that the ruling could have a detrimental
impact on construction projects. They agreed to work with the association to determine a
solution. Legislators at their Sunday meeting also learned the impact this change will have on
construction contracts. More information to members will follow.
The Joint Committee on Government and Finance met Monday to review the new method to
calculate the state’s prevailing wage rate. Under S.B. 361 passed this session, WorkForce
West Virginia, WVU and Marshall had to present their recommendations to the committee by
June 1, with the new prevailing wage rate to go into effect July 1, 2015. Committee members
were not pleased with WorkForce West Virginia’s proposal to calculate the new wage rate,
saying it did not meet the legal requirements of S.B. 361 and it was an incomplete report. If
there is no plan in place by July 1, it appears that prevailing wage will disappear in West
Virginia, at least for some period of time. The committee did direct its attorneys to prepare
options for the legislature to consider if WorkForce does not adopt a methodology it deems
acceptable. If they come up with a plan before July 1, current 2015 prevailing wage rates would
stay in effect until a new rate is determined. If the plan is not approved prior to July 1, prevailing
wage rates would not be required until such time new rates could be developed.
At issue is WorkForce’s decision to go with a survey of contractors to help determine the new
prevailing wage. Lawmakers said that isn’t much different than the way prevailing wage was
determined before. WorkForce’s Research, Information and Analysis Division Director Jeff
Green defended the choice, noting that there would be over 5,000 contractors and
subcontractors surveyed, much more than the current system. In a June 10 Charleston Gazette
article, Phil Kabler reported that the Governor Earl Ray Tomblin intends for WorkForce to
proceed with its plan for recalculating prevailing wage rates.
Other legislators say the proposed plan ignores data from the U.S. Bureau of Labor Statistics,
which they say is the only information the new state law specifically points out that should be
used in determining the wage. Other lawmakers noted that BLS can be used, along with all
appropriate economic data and the actual rate of wages paid in the regions of the state. WVU
and Marshall representatives questioned whether BLS is truly reflective of actual wage rates
which is why the proposal includes an actual survey.
The Joint Committee on Government and Finance is going to meet again to look at options to
determine a methodology for calculating prevailing wage rates. Important to contractors is the
timeline. There is a possibility there will be no prevailing wage requirements on state funded
construction project beginning July 1 and extending until such a time that new prevailing wage
rates are determined. This could be August or September. How projects will be bid during this
period will be a concern to all contractors. The CAWV will be communicating with members
during this process to keep them up-to-date on this issue.
GOVERNOR ORDERS $39 MILLION SPENDING CUT BY JUNE 30
Gov. Earl Ray Tomblin signed an executive order Tuesday calling for a $38.9 million reduction
in state spending by June 30 in order to maintain a balanced state budget. State Revenue
Secretary Bob Kiss said the budget cut will be joined with other steps to make up a projected
$70 million revenue shortfall. “The State has seen some revenue challenges this year in terms
of weaker-than-anticipated tax collections, but we’ve planned for this scenario since the start of
the fiscal year beginning with Governor Tomblin’s insight to continue the hiring freeze,” Kiss said
in a statement released late Tuesday. “Beyond that, we set aside funds to help close our
anticipated gap and we will utilize them to minimize this reduction in expenditures. Given the
economy, we are right in the middle of where we estimated we’d end up and it’s important to
keep in mind that $70 million out of a $4.25 billion general revenue budget is a small number by
comparison.”
2015-2016 BOARD OF DIRECTORS BALLOTS TO BE SENT TO CONTRACTOR MEMBERS
Contractor members will receive an official ballot for election of officers and directors of the
CAWV for 2015-2016. For each office, the nominee with the largest vote will be declared
elected at the association's General Business Session at the Annual Meeting, July 19-12, at
The Greenbrier, White Sulphur Springs. Please mark and return the ballot by July 3, 2015.
AGC WEBINAR: THE NEW CONFINED SPACES IN CONSTRUCTION: WHAT’S
DIFFERENT?
AGC of America is offering a free webinar on June 23 from 2:00-3:00 P.M. The new confined
spaces in construction standard is similar in content and organization to the general industry
confined spaces standard, but also incorporates several provisions from the proposed rule to
address construction-specific hazards, accounts for advancements in technology, and
incorporates letters of interpretation issued for the general industry standard. This webinar is the
first of a two part webinar series. Members can learn the key differences between the
construction standard and the general industry standard which many in the construction industry
implemented to some degree. The speaker will be Jessica Douma, regulatory analyst,

CAWV GOLF OUTING A HUGE SUCCESS
Over 225 CAWV members teed off at Berry Hills Country Club on Friday, June 5, to benefit the
Scholarship Foundation. Money raised totaled over $6,900 for the annual CAWV scholarship
awards. These scholarships are given annually to help college sophomores and juniors studying
civil engineering or pursuing a construction-related degree. Members were divided into a
morning flight and afternoon flight. Prizes were given for longest drive, closest to the pin and the
first place team in each flight.

We are saddened by the death of Randall Bland, 49, a WV Division of Highways employee who
was killed Thursday after he was struck by a vehicle in a work zone in Wood County. Seven
other people were injured when a chain reaction-type accident occurred on U.S. Route 50 near
Parkersburg. Transportation Secretary Paul Mattox, expressing his condolences for the 12-year
WVDOH veteran, stressed the need for the motoring public to slow down in construction work
zones. The CAWV extends its sympathies to Mr. Bland’s family.

SENATE CONSIDERS PROHIBITING CONSTRUCTION REVERSE AUCTIONS
Sens. Rob Portman (R-Ohio) and Mazie Hirono (D-Hawaii) this week introduced the AGCbacked Construction Consensus Procurement Improvement Act, and included the legislation as
an amendment to the National Defense Authorization Act to prohibit federal agencies from
procuring construction services through reverse auctions. Members are urged to contact Sen.
Joe Manchin and Sen. Shelley Moore Capito to co-sponsor the bill and support this amendment.

Both the bill and amendment are identical. In addition to addressing reverse auctions, this
legislation would reform design-build procurement--reasonably limiting the second-step designbuild shortlist and reasonably limiting one-step design-build procurements--and helping prevent
individual sureties from using illusory assets--i.e., vacation homes, coal mine waste--to back
their bonds.
As co-chair of the Construction Industry Procurement Coalition, AGC and its coalition allies sent
members of the Senate a letter urging them to support the amendment to the Defense Act. The
Senate could consider this amendment either this week or next. The House already passed its
version of the Defense Act, which included provisions prohibiting construction reverse auctions
and requiring individual sureties to use real assets to back their bonds.
FAYETTE COUNTY TO VOTE ON SCHOOL BOND LEVY SATURDAY, JUNE 13
The people of Fayette County, WV are expected to make their voices heard Saturday, June 13
in a vote that has divided communities with residents who have strong opinions. A county-wide
election will take place throughout Fayette County to give voters the opportunity to vote for or
against a school bond levy. The county has not passed a school bond levy since 1973. Recent
support in favor of a bond has been low. Two bonds that failed — in 2001 and 2009 — received
only 13.8 percent and 23 percent of the vote in favor of a bond, respectively. In the past several
months, dozens of public meetings have been scheduled in efforts to educate the public and
help voters sort out all angles of the issue. If approved, at least two new schools will be built and
others renovated. Fayetteville and Meadow Bridge high schools have been recommended for
consolidation with Midland Trail High School. The $38.9 million bond was published on the

SAFETY MEETINGS.......A VALUABLE TOOL
Keeping safety meetings active and interesting to employees is sometimes a challenge. Finding
topics to discuss every day or every week can be difficult. But, the value of getting the work
crew together frequently and talking about safety and health issues is one of the most important
functions a supervisor can perform.
Taking time at the beginning of the week or at the start of a new project to talk to employees
about safety is good business. The first thing to accomplish is establishing the importance of
safety and health to the employees. Workers need to know that the company cares and is
committed to providing the safest workplace environment possible. This is also the time to
stress the company’s commitment and policy of SAFETY FIRST.
Don’t limit regular safety meeting discussions to only the labor force. One way to find topics to
relate to is to encourage employees to participate by bringing up ideas for improving safety.
There are plenty of safety topics around every day on a typical construction project.
Staying focused on the ever changing construction activities of any project is a must. It is
equally important that all the job site leaders meet to discuss issues of safety affecting their
individual daily project activity. Keeping supervisors, foremen and managers attention on safety
each day by conducting frequent safety meetings to address planned activity is a very valuable
tool to eliminate risks to employees and reduces costs associated with accidents.
Making notes of issues discussed and the corrective action taken is mandatory. Keeping safety
meeting discussions documented will satisfy OSHA requirements that employees are instructed
on current safety issues related to the project. Well documented safety meetings can be one of
the most effective tools toward accident reduction, cost control and promotion of a safe project.

HOUSE AND SENATE TAX COMMITTEES SCHEDULE HIGHWAY TRUST FUND
HEARINGS
Two key congressional committees meet next week to discuss the Highway Trust Fund (HTF).
House Ways & Means Committee Chairman Paul Ryan (R-Wis.) will convene a June 17 hearing
on the “Long-Term Financing of the Highway Trust Fund.” Senate Finance Committee Chairman
Orrin Hatch (R-Utah) has also scheduled a June 18 hearing entitled “Dead End, No Turn
Around, Danger Ahead: Challenges to the Future of Highway Funding.” The tax-writing Ways &
Means and Finance committees have jurisdiction over the HTF’s spending authority and
revenue streams. In announcing the hearing, Ryan said, “The roads and bridges that keep our
economy moving rely on a highly unsustainable financing system. Solving this challenge for the
long term will require us to think big, and I look forward to exploring new ideas to close the
shortfall once and for all.”
Similarly, Hatch noted, “While many in Congress agree we should aim for a long-term highway
bill, the problem is often agreeing on how to pay for it.” The Finance Committee last held a HTF
revenue hearing May 6, 2014. While Chairman Ryan and other members of Congress claim the
trust fund’s revenue stream is unsustainable, the Congressional Budget Office (CBO) projects
annual revenue will remain constant for the next eight years before they start to gradually
decline—largely due to implementation of new fuel economy standards. According to the CBO,
the Highway Trust Fund requires an additional $16 billion annually just to maintain current levels
of highway and public transportation investment.
HOUSE APPROVES TRANSPORTATION FUNDING BILL
This week, by a vote of 216-210, the House approved the FY 2016 Transportation, Housing and
Urban Development (THUD) appropriations bill. The bill includes funding for the Department of
Transportation, the Department of Housing and Urban Development, and other related
agencies. The legislation assumes that Congress will take action to provide the necessary
revenue for the Highway Trust Fund to support the highway and transit funding levels, noted
below.
Total transportation spending in the bill is $55.3 billion – an increase of $1.5 billion above fiscal
year 2015 and $9.7 billion below the president’s budget request. The bill provides $40.25 billion
from the Highway Trust Fund for the Federal-aid Highway Program and $10.7 billion for the
Federal Transit Administration, including $8.6 billion for formula grants and $1.9 billion for
Capital Investments Grants, known as “New Starts.” These transit capital grants were
decreased 9.4 percent from the FY 2015 level of $2.12 billion. Additionally, the legislation funds
TIGER grants at $100 million – $400 million below fiscal year 2015 and $1.15 billion below the
president’s request.
An AGC-supported amendment was also included which requires the Federal Motor Carrier
Safety Administration (FMCSA) to study the impact of its truck driver Hours-of-Service 34-hour
reset provision (requiring a qualifying restart to include two consecutive off-duty periods
between 1:00 A.M. and 5:00 A.M. and limiting its use to once per week). The bill requires that
the study, “demonstrate statistically significant improvement in all outcomes related to safety,
operator fatigue, and driver health and longevity” before reinstating the 34-hour restart
limitations. Since the rulemaking, limited data has shown that the new restrictions on the use of
the 34-hour restart provision resulted in increased daytime truck traffic. The Senate may take
up its version of the legislation next week.
STATE ROAD FUNDS TURN UPWARDS IN MAY
For the second time this fiscal year, revenues for the State Road Fund are showing a positive
trend. Total dedicated State Road Fund collections through May are $664.8 million. This is
$57.7 million over the Governor’s estimate of $610 million and $19 million over the same period
last year ($645.7 million.) Motor Fuel Tax collections through May total $392.4 million, which is
$5 million over last fiscal year totals. Registration fees at $83.4 million are up 4.7 percent, or
$3.7 million, over last year’s 11-month total. Privilege Tax revenues in May are $188 million,
which is $10.5 million over last year’s numbers.
April was the first month that actual FY 2015 revenues exceeded the same period last year.
Motor Fuel collections, for the first time this fiscal year, exceeded last year’s total revenue.
Registration fees and Privilege Tax revenues have been running ahead of last year’s
collections.
WVDOH TO ADVERTISE CORRIDOR H PROJECT NEXT WEEK
It is expected the WVDOH will advertise next week a P3 project on Corridor H. The
approximately 7.5 mile section from Kerens towards Davis is estimated at $156 million. As in
previous P3 projects, the contractor will be paid monthly payments during the construction
period, about 40 months. There is an estimated 9 million cubic yards of excavation, including
2.5 million CY of waste. Proposers will have about eight weeks to submit their statement of
qualifications with price proposals due late October. Look for more information in future
Highway Bulletins.
