Hamzah Rahmat (BestStar Travel Centre Sdn Bhd) OVERVIEW FROM THE PRESIDENT Another year has passed since we last met at the MATTA AGM on 23 May 2015. The year 2015 was a very challenging year for our business, continuing from 2014. We are now near to the middle of the year 2016, and we hope that the remaining months will be much better. The rapid rate of evolution in our travel industry these past two decades is going to impact us greatly soon, especially the smaller travel players. We must start to think and look into consolidation, for the small to become medium and the medium to become big. We have no choice but to start to grow domestically, then regionally – only then can we become a global player. As it is now, the few global players are taking away our market share and if we don’t start to do something about it, all of it will be taken away by them. Internet and ecommerce will definitely progress further and that will change the travel business environment more. For a better tomorrow, please start thinking about your future now. I am sure you are aware that your association, MATTA, is now very visible and noticed by the respective relevant government agencies and ministries. The current office bearers are diligently looking after the interests of the industry and keeping in check with issues relating to us with the relevant agencies and ministries. Some issues cannot be solved overnight and takes time but those that can are being tackled accordingly. 2 MATTA Annual Report 2015 An example will be the issue of the “Special License for Umrah”. It is now being further delayed to October 2017 instead of 2016 due to our persistent stand to ensure fair policies are in place for all Bumiputera agents doing the Umrah business. Another was the e-Visa system for China nationals. Since the disappearance of MH370, two years ago we have been pushing for the e-Visa. From March 2016, the Government agreed to implement the e-visa for tourists from China. China nationals no longer need to submit their passports to our Consulate or Embassy offices in China for their visa into Malaysia. The highlight event in 2015 was the “An Hour with the Prime Minister” held on 28 August 2015 at PWTC Kuala Lumpur. This is the first time ever in the history of MATTA since it was formed in 1975, that MATTA had an engagement with the Prime Minister of Malaysia, YAB Dato Sri Mohamed Najib bin Tun Hj Abdul Razak. At the session, as the President of MATTA, I reported to the Prime Minister about MATTA and several salient issues on the travel and tourism industry in the country. During the coffee session with the Prime Minister, I had highlighted to the Prime Minister three urgent issues for his consideration for the industry – implementation of e-Visa for tourists to the country, top high end tourism vehicles for the industry, and GST and domestic travel and tourism within the country. Following the session, we officially submitted a written Memorandum on industry related issues with explanations to the Prime Minister’s Office. These are just a few but there are many more of which we have informed you through the email. You must have been receiving emails from HQ about once a week these past three years since I took over the Presidency of our Association. We have been having regular engagements, to name a few: 1. 2. 3. 4. 5. 6. 7. With the Ministry of Tourism and Culture, Malaysia and Tourism Malaysia in industry related issues on inbound and domestic tourism. Attended workshops with the Ministry in review of the Tourism Industry Act 1992. Participated in Tourism Lab 2.0 on the tourism industry. In continuous engagements with the Royal Malaysian Customs Department on GST related issues for the travel industry. Engagements with the Skills Development Department, Ministry of Human Resources for training for members With technology related companies to train our members. With Airlines, IATA and GDS for the air ticketing business. MATTA is an organization of volunteers. Just like me, volunteers serve the Association and its members for the sake of the betterment of our travel industry. You could also volunteer yourself to serve at either National or Chapter level in MATTA. We need more members especially from the “new” generation to come forward to serve the 3 MATTA Annual Report 2015 Association and the industry. Only then, can our industry as well as our Association, MATTA move forward to a better tomorrow. MICEM S/B, a financial surplus resulted from event management of RM1.14 million as compared to RM1.22 million in year 2014, against the budget of RM1.46 million. The major events held were MATTA Fair in March and September of the year. 2. MATTA Academy S/B, the operation results of its education programs decreased to RM37,421 as compared to RM59,400 in year 2014, against the budget of RM118,000. 3. MATTA Assets S/B, a dividend income of RM266,400 was received from investment in Travel Computer Reservation System Bhd (TCRS) in year 2015, which resulted in surplus of RM267,683 as compared to RM55,307 in year 2014. 4. MATTA Properties S/B, there were 3 Chapters Properties purchased in year 2015 – Sabah, Sarawak and Negeri Sembilan. Total properties purchase price was RM1.73 million. 5. MATTA Headquarters, the following are highlighted: a. Legal fees on Barakah, Quah & Housecoff’s case amounting to RM327,099. b. Total HQ subsidy and assistance to Chapters was RM621,870 in year 2015 as compared to RM531,586 in year 2014, against the budget of RM562,100. c. Chapters’ financial results showed a total surplus of RM222,428 as compared to RM164,033 in year 2014, against RM239,624 for the budget 2015. Activities of MATTA for Members a. As an association, MATTA has continued to provide assistance and education to its members to help them in their businesses. b. For National MATTA Fair held in 13th – 15th March and 4th – 6th September 2015 in Kuala Lumpur, a total loyalty rebate of RM853,640 were given to eligible participating travel agents, and GST was absorbed for the MATTA Fair September 2015. The booth rentals at subsidized rates for members were maintained, despite increasing cost from suppliers and vendors. Accordingly, 2 day training & Workshop sessions were held as follows: 1) 2) 3) 22 & 23 January 2015 at Kuching 12 & 13 January 2015 on Penang Island 9 & 10 February 2015 at Shah Alam, Selangor Following the completion of our GST Seminars nationwide, all the queries raised were compiled into the GST Technical Memorandum for Travel Industry, 1 st Batch of which was presented to Dato Subromaniam at RMC on 9 Jan 2016 and 2nd Batch on 18 March 2015. During the last week of March, we also organised ½ day sessions to provide our members with latest updates following our meetings with RMC and to ensure all members were well prepared for Implementation of GST on 1 April. Following the implementation of GST on 1st April 2015, VP Inbound together with our Tax Consultants Mr Kenneth Yong and Mr Lee have also met up with the Royal Malaysian Customs Department on several occasions to seek further clarification of the grey areas in the GST guide. The deliberations and the concessions won, and clarifications from RMC are all tabulated and summarised on MATTA Website and members are advised to refer to the website periodically for regular updates as our Meetings with RMC are still continuing. 37 MATTA Annual Report 2015 The 2 main issues that are still on-going with RMC are i) GST and Langkawi Tours. A letter has been sent to RMC that major GST issues would be created if local travel agents were to charge GST when selling Langkawi tours. Earlier, RMC had recognised the grave “discriminatory” problem this would bring. MATTA has now presented a write up, explaining the major economic problem that would be created if local agents are required to charge GST on Langkawi packages. MATTA urged RMC to re-consider its decision to now change the “NO GST” status on Langkawi Tours. ii) Timing of Hotels’ Tax Invoice. MATTA proposed that all Hotels be now required to issue Tax Invoices at time of collection of full payment for hotel stays instead of the current practice of hotels issuing Tax Invoices only upon checkout. LAUNCH OF GST NAVIGATOR On 23 May 2015, MATTA launched the GST Navigator for Travel Industry. Jointly authored by our VP Inbound, Datuk KL Tan and our GST Consultants Mr Kenneth Yong Voon Ken and Mr Lee Fook Koon, the book was launched by Mr Subromaniam Tholasy, Deputy Director General Of Customs, Royal Malaysian Customs in the presence of Datuk Datuk Seri Mirza Mohammad Taiyab, Director General Tourism Malaysia & Datuk Seri Masidi Manjun, Sabah Tourism, Culture & Environment Minister. The event was carried live on TV by Astro Awani as seen in the snapshot below: Datuk KL Tan presenting the Prime Minister with a copy of the GST Navigator The book was distributed free to those members who attended the National MATTA AGM 2015. The remainder is being sold at RM250 per copy. In the AN HOUR WITH THE PRIME MINISTER, YAB Prime Minister spent almost 3 hours with MATTA. The event started off with an introduction to MATTA with a slide presentation by President of MATTA. 38 MATTA Annual Report 2015 At the event, VP Inbound presented YAB Prime Minister with a copy of the GST Navigator. This is another first scored by MATTA – an NGO that has come up with a comprehensive professional guide to GST for its members. JOINT MEETING BETWEEN MATTA & MAH In another first, MATTA met up with the Malaysian Association of Hotels Committee on 11/9/2015 to discuss joint marketing promotions with hotels. As both industries work together to promote tourism, it is most appropriate that we join forces for certain events and to iron out certain common issues for the good of the industry. As a direct result of the meeting, it was decided to have a joint MAH & MATTA B2B Mart in Cambodia between 26 and 28 Oct 2015. 10 MATTA members were invited to go on this B2B (5 Inbound & 5 Outbound Players) For a first joint event between MATTA & MAH, it was a good event and our Cambodian counterparts have indicated that this is just the beginning of many similar events in the future. B2B SESSIONS Beside the B2B in Cambodia, MATTA organised 2 other B2B as follows: 1) Working with Kedah Chapter, the Inbound Committee held a domestic promotion in Langkawi from 23rd to 25th October, with the theme DISCOVER KEDAH. There were a total of 211 participants from 123 Travel agencies who participated in the event. VIPs attending the event included YB Dato Hj Rawi b Hj Abd Hamid, Kedah Tourism Exco Y Bhg Tan Sri Khalid Ramli CEO LADA Y Bhg Dato Zulkifli Mohamad, CEO Kedah Tourism En Iskandar Mirza Mohd Yusof, Director, Domestic Division of Tourism 2) Tourism Indonesia organised a B2B Mart cum FAM visit to Batam, Indonesia 18 of our Inbound and 18 of Outbound members participated in this event, which Tourism Indonesia has promised is only the first of 4 other events to be held every quarter. PERMANENT SIGNAGES Inbound Committee also proposes to put up permanent signages at all entry points into the country and at most popular tourist attractions, advising inbound tourists that they must use only LICENSED tour operators and vehicles. The Committee viewed several designs and has come up with a couple of buntings. It was decided not to have movable buntings but to put up permanent signages 39 MATTA Annual Report 2015 A meeting was held with Puan Nur Yahati of Licensing Divison of MOTAC, who has agreed in principle with MATTA’s suggestion. She will submit her proposal to get MOTAC to fund part of the cost of the project which will be launched in April 2016 by the Minister of Tourism & Culture at MATIC, Jalan Ampang KUALA LUMPUR. MATTA will approach Malaysia Airports Berhad and other local authorities to seek their approval to put up these signages. Once all approvals are in place, we hope to complete the project by mid 2016 PUSPAKOM Working jointly with Ground Transportation Sub Committee, it has been agreed that Puspakom will conduct 1 day courses for MATTA members at Puspakom offices nationwide. This will instruct our members on what Puspakom inspection entails, so that they are better prepared and able to pass the inspection without having to resort to third parties or runners to arrange for their vehicle inspections. Todate, Training sessions have been held in Wangsa Maju, Kuala Lumpur, Kota Kinabalu and at Shah Alam. Plans are being finalised for training to be held at other Puspakom branches nationwide. Dates will be announced as soon as agreed between Puspakom and the various Chapters. FAM trip to Palestine to understand and learn the situation in Palestine, rather to depend on news from media which are mostly inaccurate. ii. To invite Palestine to participate in exhibitions and conferences in Malaysia such as trade fairs and B2B sessions to promote and to increase the number of Palestine and Malaysian visitors to the respective countries iii. Malaysian travel agents to create integrated packages, e.g. Umrah, Muslim and business packages to include Palestine tour. PRODUCT UPDATES CNTA SEMINAR "BEAUTIFUL CHINA–MARITIME SILK ROAD TOURISM BELT” China National Tourism Administration (CNTA) conducted a 2015 "Beautiful China– Maritime Silk Road Tourism Belt” Joint Tourism Promotion Seminar cum China Attraction Photography Contest Awards Ceremony on 24 July 2015. The objective is to promote the China tourism resources and products as well as increase the tourism exchange and cooperation between Malaysia and China. A number of 40 members participated in the event. CATALONIA PRODUCT TRAINING SESSION Catalan Tourist Board conducted a Product Training Session on 22 August 2015 at Scoop, 8th Floor, 27 Menara Dion, Jalan Sultan Ismail, Kuala Lumpur. The session was divided to two (2) sessions in morning and afternoon. A total of 36 agents attended for both sessions. 45 MATTA Annual Report 2015 NEPAL B2B SESSION & DINNER Nepal Tourism Board together with Society of Travel & Tour Operators Nepal (SOTTO) conducted a Nepal B2B Session and Dinner on 20 August 2015 at Renaissance Kuala Lumpur Hotel. The objective is to establish business partnerships between Nepal travel agents and Malaysia travel agents. 27 delegates from Nepal and 76 from MATTA including three (3) media attended the event. DISCOVER BELGIUM Embassy of Belgium in Malaysia conducted a Tourism Seminar on 18 November 2015 at Residence of the Ambassador, 12 Jalan Langgak Golf, Kuala Lumpur. The aim is to equip members with the knowledge and the unique beauty of Belgium. A number of 52 members participated. VIETNAM ROADSHOW Vietnam National Administration of Tourism (VNAT) together with Vietnam Airlines and Vietnam Tourism Association conducted the Vietnam Tourism Roadshow on 16th 46 MATTA Annual Report 2015 December 2015 in Kuala Lumpur. The objective of the event was to update new policies and offers from Vietnam tourism to tour operators, travel agencies and media in Malaysia. A number of 76 members attended the roadshow. FAM TRIPS KOREA FAM TOUR MATTA received an invitation from Janna Tour, a Muslim travel agency located in Seoul, South Korea inviting members to a FAM Tour to South Korea on 24th July – 1st Aug 2015. VIETNAM HERITAGE SITES Vietnam National Administration of Tourism and provinces' tourism board together with Vietnam Airlines and local travel agents organized a Vietnam Heritage Sites FAM Trip on 18th – 25th November 2015. The objective of this FAM trip is to meet Vietnam travel agents and visit destinations and tourism facilities in Hanoi - NinhBinh - Da Nang - Hue QuangBinh province, experience the 5 star trains, etc. to help agents to design new 47 MATTA Annual Report 2015 programmes for Malaysian tourists. A number of 12 travel agents participated in the FAM trip. BATAM B2B Tourism Indonesia invited Malaysian Association of Tour and Travel Agents (MATTA) to collaborate and support a B2B Mart cum FAM Visit on 23-25 November 2015 to Batam, Indonesia. 18 Outbound agents and 18 Inbound agents participated in the Fam Trip. The Indonesia agents (sellers) were from Jakarta, Bandung, Jogjakarta, Surabaya, Makassar, Medan, Pekanbaru, Aceh, Padang and Lombok. Preparatory work and planning for the event started in late 2014 and carried on through first quarter of 2015. It was spearheaded by 3 members of the Sub Committee for Ground Transportation namely: i) Mr Jayakumar ii) Mr Antony Leopold from Ace Altair Travels Sdn Bhd iii) En Kamarulzaman Bakar from Bonus Travels Sdn Bhd 51 MATTA Annual Report 2015 The Committee held 16 Weekly meetings in March / April 2015 to get this initiative moving and the Inaugural MATTA Treasure Hunt was held on 18 th and 19th April 2015, from KL to Ipoh It was flagged off by the KL Mayor from MATIC as per photograph below: A total of 60 cars with a total number of 240 participants took part and the drive took our members through tourist spots in Kuala Lumpur and Selangor before ending in a local hotel in Ipoh on 18 April 2015. Prize giving was held the same night over dinner. The following morning, participants were taken on a walking tour of Ipoh town by local tour guides before driving back to KL in the early afternoon. A comprehensive report of the Treasure Hunt is reported under the Events Section of the Annual Report 2015. The Ground Transportation Sub Committee’s main role is to address members’ issues relating to Ground Transportation. Thus besides meetings with Ministry of Tourism and Culture, the Committee has to engage with agencies like Puspakom, SPAD, JPJ and Ministry of Transport. Ground Transportation’s biggest challenge this year has been the issues relating to the various permits and licences needed to operate Tourism Vehicles. Besides the KPL Licence from MOTAC, tour operators also need approvals / permits from • Puspakom every 6 months that the vehicles are road worthy • SPAD that the vehicles comply with all Safety requirements • Once both these are in place, then only will JPJ issue Road Tax Expiry dates of each of these licences and permits are not synchronised and if any one permit or licence is not in place, the vehicle has to be taken off the road, which translates into loss of revenue for our tour operators. 52 MATTA Annual Report 2015 MEETINGS CALLED BY MINISTRY OF TOURISM & CULTURE, together with SPAD & JPJ In response to MATTA’s written request of 20 January 2015, the then Head of Licensing Mr Alan Ab Rahim called for a meeting of all Travel Associations, SPAD and JPJ for a discussion on 3 March 2015 at MATIC, Kuala Lumpur. There was only 1 item on the agenda – to streamline the tenure of the permit issued by SPAD. At the meeting, it was agreed that SPAD will now issue permits for a period of at least 2 years instead of the current 2 / 3 months. This is a real feather in MATTA’s cap as it is a reflection on the hard work and tenacity on the part of the MATTA Ground Transportation Committee to obtain this concession from MOTAC & SPAD. We were however unable to get this decision in writing from SPAD. Several follow-up meetings have been held with Ministry of Tourism & Culture, SPAD and JPJ on the same issue over the year. Meeting with SPAD at SPAD Hq, chaired by En Zamri of SPAD VP Ground Transportation with Ketua Pengarah JPJ on 8 Dec’15 Currently SPAD permits all expire end Dec, and this has led to a backlog at SPAD HQ office. Without SPAD permits, tour operators were unable to get the road tax renewed on time. Seeing that Dec is the busiest time for our tour operators, we asked to meet the authorities again. GARIS PANDUAN ISSUED BY MOTAC ON MINIMUM TENURE OF SPAD PERMIT MATTA members had a meeting with MOTAC on 17 Sept 2015, on H & D and Bas Pesiaran. The meeting was chaired by TKSU Datuk Rashidi who had confirmed that effective 1/10/2015, TA with losses – min license renewal would be for 2 years However Companies with losses 3 years in a row and whose accumulated losses exceeded their paid up capital, will be asked to increase their paid up capital. Then on 29 Oct 2015, Representatives from MATTA met with SPAD Hq at KL Sentral, and raised the following points: i) SPAD Licensing should be for min 2 years – in accordance with the GarisPanduan from Mthat has been approved 53 MATTA Annual Report 2015 ii) iii) iv) v) vi) vii) Renewal of Permit now takes 2 months. MATTA proposes to request to reduce this to 2 weeks Certificate of Attendance of ICOP & SHECOP requested for renewal. Members have not been issued with this Certificate, so are unable to comply with this requirement. JPJ does not issue Road Tax for periods less than 1 year. Request that Road Tax is synchronised with Puspakom permit. Mr Arul pointed out that unlike other bus operators a Tour company has to register with Motac, Puspakom, SPAD, JPJ. Tour Operators are the most regulated unlike Bas Sekolah, Bas Kilang, Express Buses etc For Vans – 7 pax and below, requirement of name list and itinerary is very impractical. To request SPAD to waive this requirement PHV or Limousine: should be only for transport companies TP / Hire & Drive On 1st Dec 2015, MATTA met up again with MOTAC, SPAD and JPJ where it was agreed that JPJ would issue short term Road Tax. When this did not materialise, we met with Ketua Pengarah Dato Ismail Ahmad on 8 Dec 2015 and found that JPJ was unable to issue road tax for any period of time fewer than 30 days owing to their computer system constraint. JPJ has agreed that the computer system will be amended to accommodate this short term Road Tax but this will take about 3 months to be implemented i.e. March 2016 In the interim SPAD agreed to issue a Lesen Jangka Pendek from Nov / Dec 2015 to end February 2016, to enable JPJ to issue matching short term Road Tax. They are also allowing their branch offices nationwide to issue these licences instead of referring them all to the HQ office as is the current practice We are looking forward to March 2016, when this major challenge to our ground handlers will be resolved. MEETING WITH JPJ ON SEAT BELTS On 15 Sept 2015, JPJ called for a meeting with the various Travel Associations that operate buses. Use of seat belts for rear seat passengers (including all bus passengers) will now be mandatory on all buses. However for the first 2 years, the department will only play an advisory role and No punitive action will be taken for now. All members have been advised of this new ruling by email blast. BRIEFING BY SPAD ON ICOP SAFETY REQUIREMENTS Following SPAD’s decision to introduce safety requirements for all tourism vehicles, MATTA has also requested SPAD to delay the implementation until 1st July 2016. These Safety Requirements that have been introduced by SPAD are a pre-requisite before the SPAD permit for tourism vehicles are issued but our members need some time to 54 MATTA Annual Report 2015 purchase the necessary items like cones, safety triangles, Reflective string Delineators, complaint contact telephone number stickers on buses, fire extinguishers etc To assist our members in this area, MATTA requested for briefings by SPAD for the Central Region, Northern Region & Southern Region. Accordingly 2 briefings were organised for the Central Region in November 2015. In Jan 2016, a similar Briefing also held in Penang for the Northern Region. Members who attended ICOP briefing in Penang Members in Penang listening intently to the SPAD Trainer Another ICOP training is planned for the Southern Region before SPAD implements the Safety Requirements in tourism vehicles in July 2016. FIRST AID AND CPR COURSE In line with OHS requirements, the Ground Transport committee continues to liaise with Red Crescent Society to provide training for our members. Beside our drivers and guides on the tour buses, it is imperative that even office administrators are trained in First Aid, so that immediate action can be taken in the event of an accident and before the Ambulance or medical personnel reach the site. Following successful training courses in Kuala Lumpur, the Committee conducted courses in various chapters as follows: • Johor on 6 October 2015 at New York Hotel, Johor Bahru • Sabah on 13 October 2015 at Shangri-La Hotel, Kota Kinabalu • Sarawak on 23 November 2015 at Aroma Café, Kuching. Meanwhile the courses planned for Kedah and Perak did not materialise in 2015, as both these Chapters decided to hold it in early 2016. All three courses were well attended and very positive feedback has been received from participants. The one held in Kuching even made the newspapers like Sin Chew Daily and Utusan Borneo, which commended MATTA for consistently looking for ways to improve the standard of the tourism industry. 55 MATTA Annual Report 2015 SPAD LAND PUBLIC TRANSPORT (LPT) SYMPOSIUM 2015 This was held on 18 Nov 2015 and as it was a blueprint for SPAD, it was an opportunity for this authority to explain the future direction of the public transport industry to all stakeholders. Since it was largely on the future of PUBLIC transport, it was not completely relevant for the tourism industry. Accordingly MATTA did not sponsor the event, though invited to do so by SPAD. However in a show of support, VP Ground Transportation and two Sub Committee members attended the Conference. MEETING WITH CHAIRMAN SPAD In Jan 2016, MATTA wrote to Chairman SPAD for a meeting to resolve outstanding issues. Meeting with Chairman SPAD 17/2/2016 MATTA President presenting Chairman SPAD with a momento 56 MATTA Annual Report 2015 The meeting covered a lot of pressing issues like: ICOP safety regulations and date of implementation. In view that some of the requirements as advised at training sessions differ from the booklet that is being distributed, Datuk Surat has agreed to issue a new guidebook, which will then be distributed to all members. We hope this guidebook will be issued before SPAD implements the ICOP requirements. MATTA asked for SPAD to issue PHV licenses. In principle, Chairman agreed to our request but felt that this must be industry-driven so has requested MATTA to put up a paper justifying this request. Chairman also advised his staff to look into the requirement of PENGKALAN for PHV, which he said was not practical for the industry. MATTA requested for SPAD permits to be issued for a minimum of 2 years. SPAD says they are governed by the SPAD Act to follow the tenure approved by Ministry. SPAD will follow whatever tenure MOTAC gives, so MATTA was requested to direct our request to Ministry. Chairman also agreed that the communication between SPAD and MATTA has be approved and any changes to existing rules and regulations will be advised first to MATTA so that this information can be email blasted to all MATTA members nationwide. Chairman was also agreeable to our suggestion that MATTA & SPAD meet regularly to address issues that come up from time to time. Following this, SPAD called for another meeting on 15 March 2016 to discuss the supply-demand of tour buses. 57 MATTA Annual Report 2015 EDUCATION AND TRAINING MATTA ACADEMY SDN BHD MATTA ACADEMY PROGRAMME TRAVEL & TOURS ENHANCEMENT COURSE (TTEC) The Travel & Tours Enhancement Course (TTEC) is a programme implemented by the Ministry of Tourism and Culture through several training institutions, including MATTA Academy throughout the country to train travel agencies as one of the requirements when travel agencies renew their licenses with the Ministry. It is a one day program with 5 modules throughout the day and the modules are presented by speakers from the Ministry of Tourism, Tourism Malaysia, or leaders from the industry. The half day mini workshop was conducted on 27 th January 2016. The workshop agenda include Consumer Purchase Behaviour and Forward Looking on Inbound and Outbound data from APAC. Invitation was mainly for the key decision maker and operation person of the company, which in total a maximum 30 participants. The goals for the pilot project is to get quality participation, lock people and publicize the results with the selected group for the next session in May 2016. MATTA WEBSITE The MATTA website, though currently is sufficient in terms of content, responsiveness and search engine optimization (SEO) is in the process of long revamping. It will be done in three (3) phases, and the gradual improvement for it is within a period of one (1) year. GOOGLE WORKSHOP Google proposed to organize a sponsored two (2) half day training sessions for MATTA members. The objective of this Workshop is to provide training for members on how to go online and to leveraging technology to enhance their operations and increase sales, while the long term objective is to increase SME participation in the online world. Proposed date for the training is aimed for early April 2016 at Google’s office. It is suggested to involve Multimedia Development Corporation (MDeC) and media for the 61 MATTA Annual Report 2015 workshop for them to acknowledge the collaboration and effort between MATTA and Google to empower agents to face the age of technology. EMAIL NEWSLETTER MATTA is currently coming up with a monthly newsletter starting this term. Contents will be developed by MATTA and the E-Newsletter will feature articles, blog posts, interviews with travel entrepreneurs, past and upcoming events. The new Umrah package for 11 days 10 nights at minimum RM5900 was also discussed. Agents who intend to sell Umrah package is compulsory to attend the Kursus Khas Pengendali Umrah which conducted by IPB and will be monitoring by JAWHAR & MoTAC. At the session, the President of MATTA, Datuk Hj Hamzah Rahmat had reported to the Prime Minister about MATTA and several salient issues on the travel and tourism industry in the country. MATTA has continued to play active roles in these associations. ASEANTA – ASEAN Tourism Association MATTA has been a member of ASEANTA for many years already. ASEANTA comprises of the travel agents associations, hotel associations, national carriers and some national tourism organisations of the ASEAN countries. On 25 January 2015, the President of MATTA, Datuk Hj Hamzah Rahmat, was elected as the Secretary General of ASEANTA, with Philippines – Philippines Travel Agents Association (PTAA) as the President. FATA – Federation of ASEAN Travel Associations FATA is the body for travel agencies associations in ASEAN countries, and has furthering the interests of travel agencies in the travel industry and with IATA and other stakeholders. On 25 January 2015, the President of MATTA, Datuk Hj Hamzah Rahmat, was elected as the Secretary General of FATA, with Myanmar – United Myanmar Travel Association (UMTA) as the President. LEGAL MATTER 1. CASE ON AGM 2013 – SUMMONS BY BARAKAH UMHAJ TRAVELS & TOURS SDN BHD This case started on 17 July 2013, with Barakah Umhaj Travel & Tours Sdn Bhd against the results of the election for the Executive Council 2013-2015 held in the AGM of 29 June 2013 took the case to Court. After several hearings in the Court over more than a year, the Kuala Lumpur High Court on 15 Jan 2015, had strike out the case. Barakah Umhaj Travel & Tours Sdn Bhd then took the case to the Court of Appeal which on 20 Oct 2015 had also strike out the case. MATTA was informed the party had not pursued the case further. 86 MATTA Annual Report 2015 2. CASE BY QUAH EWE KHENG AGAINST MATTA Quah Ewe Kheng, the then Hon Treasurer of Penang Chapter, term 2011 -2013 had claimed he ‘lend’ to MATTA Penang Chapter an advance of amount of RM116,772.00 in 2013 to buy air tickets for an event. The case was strike out by the Georgetown Sessions Court on 26 October 2015. Quah is appealing the decision at the High Court and hearing was on 6 April 2016. The High Court allowed Quah’s appeal to go for trial on a date to be fixed. 3. CASE BY HOUSECOFF TRAVEL & TOURS SDN BHD & 4 OTHERS AGAINST MATTA This case was by Housecoff Travel & Tours Sdn Bhd & 4 others (AJ Holidays Sdn Bhd, Gemala Travel & Tours Sdn Bhd, Barakah Umhaj Travel & Tours Sdn Bhd and Southwest Travel & Tours Sdn Bhd) against MATTA for the decision to expel them as members of MATTA on 8 July 2014. The Kuala Lumpur High Court had on 29 October 2015 strike out the case because the said parties have failed to exhaust their internal remedies before filing the suit. The said parties’ had taken the case to the Court of Appeal and the hearing was on 11 May 2016. 4. CASE BY INNOGEN SDN BHD AGAINST MATTA Innogen Sdn Bhd, an exhibition contractor company had taken MATTA to Court for the termination of contract as the main contractor, after being appointed in writing as the contractor for the MATTA Fair 14-16 March 2014. MATTA was then informed there could be a hearing in the Court sometime in June 2015. Before the hearing, and after several discussions with company, MATTA and Innogen Sdn Bhd had on 11 June 2015 agreed to resolve the matter out of Court. The case was resolved with MATTA appointing the company to be the contractor for the MATTA Fairs in March and September 2016. 5. CASE ON PN. NORSHIREEN HINGUN THONG ABDULLAH The case is connected with the case in 2003 relating to the affairs of the ATF 1997 and MITF 1997. The said person was the second defendant in the case, and a judgment was given by the Court on 11 May 2005 for RM2,350,893.52 to MATTA. In the same case, the third defendant, Ismail Chong & Associates, after several discussions with MATTA, had agreed and paid RM2,000,000 in March 2014 to resolve the case out of Court. Our lawyers had advised that we can claim the amount of RM350,893.52 + interest at 8% per year for 6 years. As the judgement was in 2005, we need to apply to the Court for leave to execute the judgment, and the hearing was on 28 March 2016. In the event of the said defendant cannot pay the amount then, we shall proceed with bankruptcy proceedings against the said party. 87 MATTA Annual Report 2015 CONCLUSION The Executive Council would like to record its gratitude and appreciation to all members who had supported and participated in the activities and programmes of the Association, both at the national and state levels, and had also supported the Association on the many issues the Executive Council had taken at various platforms with the Government and other agencies and stakeholders in the travel and tourism industry.
