Polls open at 9:00 a.m. and close promptly at 2:00 p.m. Realtor® members can also vote in Queens at the Realtor® Service Center in Jackson Heights. If you havent received your 2012 LIBOR Dues Bill electronically, please visit ims.mlsli.com, log in with your Stratus User ID and password and then click on PERSONAL INFORMATION. This will allow you to confirm, and/or update your current e-mail address on file, which is very important in today’s business world. Without Congressional action, two programs of vital importance to the real estate business will sunset on Sept. 30, 2011. The end of the current extension of the National Flood Insurance Program (NFIP) and the lowering of FHA and GSE loan limits could create a significant disruption in a housing market struggling toward recovery. It is imperative that REALTORS® remind their Members of Congress on how important these issues are for fragile housing market. The National Association of REALTORS® has launched two Calls for Action on www.RealtorActionCenter.com encouraging REALTORS® to contact their Member of Congress urging them to pass a five year National Flood Insurance Program extension and to keep the FHA and GSE loan limits at the current levels. Additionally, NAR recently brought Federal Political Coordinators from across the nation to Washington, D.C. to participate in direct talks with key Senators and Representatives. Reauthorizing the NFIP Nationally, this program is the only source of flood-damage protection for 5.6 million home and business owners. Since September 2008, Congress has approved nine NFIP extensions and allowed five lapses. During the most recent lapse in June 2010, 47,000 home sales were delayed or cancelled. Real estate markets require certainty to make the long-term investments that are vital to the U.S. economic recovery. NAR is urging Congress to reauthorize the NFIP long-term to ensure access to affordable flood insurance and end the uncertainty of extensions and shutdowns which hurt the housing market. Due to REALTORS® recent participation in the call for action and fly-in, on July 12th the U.S. House of Representatives passed a 5year reauthorization of NFIP by a vote of 40622. While the Senate still needs to take action, this is a major step forward. REALTORS® now need to focus on getting their Senators to pass this critical piece of legislation. FHA and GSE Loan Limits Unless Congress acts, on October 1st the mortgage loan limit formula and cap will fall. This could cause a significant drop in housing prices in more than 669 counties in 42 states and the territories. NAR estimates the average decline to be more than $68,000. Changing the formula for the loan limits (from 125% to 115% of median home price) and lowering the cap means that some 5 million homes˜roughly 27% of all owner-occupied homes in the United States˜will become ineligible for mortgage financing, since there is little to no private mortgage financing available. NAR is urging Congress to support an extension of the FHA and GSE loan limits and oppose any vote to reduce these limits. The housing markets remain fragile and any further disruption to the market will stall our economic recovery. LIBOR Donates $2,500 to Island Harvest in the Aftermath of Hurricane Irene The Long Island Board of REALTORS is proud to announce the 4th Annual REALTORS Against Hunger (RAH) Food Drive (see page 10). The RAH campaign was mobilized in 2008 to fight hunger in our local communities. Long Island REALTORS are committed to helping families and individuals by collecting non-perishable food items at participating offices across Nassau, Suffolk and Queens. In honor of the RAH campaign, LIBOR recently made a $2,500 donation to Island Harvest, the largest hunger relief organization on Long Island. Island Harvest serves as the bridge between those who have surplus food and those who need it, supplying over 570 commu- nity-based nonprofit organizations on Long Island with critical food support to help stem the advancing tide of hunger in our communities. The donation provided to Island Harvest is earmarked to help with underwriting the expense of the emergency food and supplies needed as a result of Hurricane Irene. And on the LIBOR calendar, it’s time to recommit to becoming more educated and involved and, as a result, more professional and more productive. The mission of the Long Island Board of Realtors® is to provide to its members resources that will enable them to reach their highest potential level of business success by enhancing their value to the consumer. Everything LIBOR does, either board-wide or at the Chapter and Division levels, is with that mission in mind. Be well, NAR Launches New Public Awareness Campaign Focus Shifts to “Future Generations” Beginning in September, the National Association of REALTORS® has changed the messaging of their Public Advocacy Campaign to confront the challenges faced by the real estate industry today. The new campaign focuses on securing homeownership opportunities for future generations. For the first time in generations, the American dream of homeownership is being challenged and the new campaign emphasizes Realtors® commitment to protecting homeownership for all families and future generations. The new campaign, “Future Generations” follows the previous campaigns “Homeownership Matters” and “What Matters Most” that have been running in the past two years. The National Association of Realtors® began a national advertising campaign that began in July 1998. Campaign ads are placed on a number of media platforms including television, radio, print magazines, outdoor venues, web banners and online digital media. The public awareness campaign delivers messages quickly and effectively to consumers and public policymakers about issues that matter to REALTORS® and their clients ˆ issues like access to affordable mortgage financing, tax incentives to home ownership, overly stringent credit requirements and cumbersome short sales and foreclosures. LIBOR Set Sail for the Backpack Pirate Adventure On Wednesday, August 11, 2011, the Long Island Board of REALTORS (LIBOR) joined the Long Island Coalition for the Homeless (LICH) and more than 400 children on their journey over to Sailors Haven, Fire Island for Backpack Pirates Summer Festival. This annual event offers under privileged children the opportunity to experience a day at a Fire Island beach, exposing them to an environment that they may not have the opportunity to enjoy. Upon their return, each child received a backpack full of essential school supplies to be used for the upcoming school year. The memorable day included many fun filled activities such as treasure hunts, swimming, nature walks, sand castle contest, face painting, volleyball games, a barbeque lunch with entertainment performances by the Broadway troop “Story Pirates”‰ and the “Black Spot”‰ Pirate Productions, to name a few. The day was made possible through the Every Children’s Dream, an organization that seeks to introduce homeless, economically disadvantaged and vulnerable youth in our community, to cultural athletic and social events they may not encounter as a result of their socioeconomic circumstance. Long Island Board of Realtors Raise a New Cassel Roof with Habitat for Humanity For Realtors, providing home ownership opportunities comes naturally, but finding affordable homeownership opportunities can be challenging. Over the past five years the Long Island Board of Realtors, Inc. have sponsored the building of Habitat for Humanity homes across Long Island, for deriving families. The latest home to be built in Nassau County is located on Brush Hollow Road in New Cassel. LIBOR Presents $12,000 Check to Winthrop-University Hospital’s Pediatric Diabetes Program On July 28, 2011 LIBOR presented a check in the amount of $12,000 to the Pediatric Diabetes Program at WinthropUniversity Hospital, at the Realtor® Service Center in West Babylon. These funds were raised from raffle ticket sales that Education Committee members (led by Chairperson Linda Petralia) worked so passionately to sell during LIBOR’s 23rd Annual E d u c a t i o n Conference and Trade Show held on June 9th at the Crest Hollow Country Club. Winthrop-University Hospital’s Pediatric Diabetes Program is an American Diabetes Association (ADA)-recognized pediatric diabetes and endocrine care program. The program also conducts community education and outreach programs. Its primary goal is to explore all treatment options to provide patients and their families with the best options for achieving and maintaining optimal glucose control. The Tech Fair, scheduled for October 13, 2011, promises to be a phenomenal event based on the caliber of the featured speakers, the selection of new and updated products and the diligence of the staff. In addition, the wealth of information that you obtain is well worth the cost at which it is offered. Needless to say that as the market conditions change and creative unethical ways of doing business are introduced, rules have been implemented to insure the equitable spirit of co-operation. Because of the prospect match capabilities, no listing broker contact information is to appear in any of the photos displayed in the listing photo gallery. Ascertain that if a lawn sign is present, it is not legible. Also, one of the uploaded photos must be that of a front exterior. 2. Your office can obtain an administrative user ID and password to facilitate a non-licensed receptionist. 3. It is expressly prohibited to share your Stratus access information with anyone. I repeat, no sharing of password regardless of the intent. 4. When reporting a closed transaction, it is required that it be done within 48 hours of the closing and that the purchaser’s name be recorded accurately. 5. A photo taken and uploaded on MLS by another broker or salesperson cannot be used on your new listing without their permission even if the listing has expired. That infraction may lead to fines of $5,000 on a first offense and up to $15,000 for the rule violation. The signals have been mixed. In the months of July and August the number of reported contracted and closed sales transactions were up from a year ago while contracted and closed median home prices continue to adjust downward. So we are seeing increased buying activity consistently but the prices are off by a bit from the year prior. The Long Island closed median home price is currently $364,500 compared to $375,000 in August of 2010. That represents a 2.8% drop. The under contracted home price for Long Island slipped by 3.8% from a year ago, with a reported pending August 2011 price of $350,000. The Multiple Listing Service of Long Island˙ (MLSLI) reported a closed median home price of $360,000 in July 2011, which represented a 4% decrease over prices reported in July 2010. Our local real estate market and conditions have been mirroring the country's economic recovery. It's been slower than we'd like but nonetheless moving forward. Home prices are no doubt being affected by the “short sale” which generally sell for less than regu- lar market sales. The positive effect of the short sale is that they have contributed to creating some of the most favorable housing conditions some areas have seen in a very long time. If buyers can secure the financing, there are some great deals out there. Long Island, as well as the rest of the country will probably continue to see this type of selling pattern until the overall economy shows stronger signs of recovery, specifically focusing on the labor market. In real estate location, location, location is the mantra, however these days, three additional words are just as important to the stability and recovery of the real estate market, jobs, jobs, jobs. Recording quality alone does not make a compelling presentation, however. Building a video tour is a creative challenge that requires some combination of skills and resources, beyond the lens. With a little forethought and practice, you can tap this medium’s potential and make it into one of the most effective marketing resources at your disposal. Let’s look at other considerations that should guide your videography efforts. Extras When you want to pan the exterior or capture an entire room, a monopod or tripod ensures a steady image. Mount that to some type of dolly, and you can make a smooth transition from room to room as you lead viewers through the home. Editing Software Most video cameras now include at least basic video-editing software for combining clips and optimizing them for the Web. That’s good enough for a quick video on the fly, but you’ll probably want something a bit more sophisticated for combining clips, adding transitions, and incorporating text and a soundtrack. Look first at the editing software included with your device, then at the software available for your computer: MovieMaker for Windows and iMovie for Macs. Popular alternatives to these include Adobe Premiere Elements and Sony’s Vegas Movie Studio HD. Audio Plan Ahead A video tour is a virtual walk-through. For buyers, a well-made video tour is the next best thing to being there. For sellers, it’s a demonstration you’re a marketing maven. You can minimize the work and production time by thinking things through before you hit the record button. If it helps, map out a storyboard of how you’ll move through the house, which features you want to highlight, and what you’ll say as you move from room to room. Decide before you start filming which shots — and from what angles — will give viewers a realistic idea of that space. Think about where you’ll need to add more lighting or draw the blinds. For your first few tours, the better you plan ahead, the more time you’ll save and the more professional the results will be. After several video tours, the recording process will become almost intuitive. The picture is what they see, but audio helps tell the story. Use background music — something generic and preferably royalty-free — to set the mood. A spoken narrative presents an opportunity to introduce yourself as you talk up the listing and its surroundings. Get the video right first, then add voiceover narration as you watch the clip and describe what you’re showing. Allow as many takes as required to explain what’s special about this listing, as if you were guiding them through the home. Hosting and Syndication You’ll need a hosting account for your video to be available online. YouTube is probably the first option that comes to mind, but there are many others as well: WellcomeMat, blipTV, Vimeo, and Yahoo Video, to name a few. RPAC's 5th Annual Realtors® Got Talent was once again a huge success. Our talent was spectacular! It's always amazing to see how talented some of our Realtors® are. This year we decided to have two winners. The First Prize winner was chosen by our professional judges and was awarded to Tammy Dalton. The second winner was Meredith Kurz who won the Audience Favorite award. Everyone who attended that evening had a great time. Our goal is always to keep the "fun" in fundraising and thanks to our own Matt Arnold we all had a lot of fun! Approximately $5000 was raised that evening and I want to thank all that attended for their support to RPAC. This has been somewhat of a tough year in Real Estate for many of our LIBOR members. I am never comfortable with negativity...especially when it comes to writing my RPAC article but to date only 1,256 of our 20,000 members have made contributions to RPAC. When times are tough it is more important than ever to invest in your business. The REALTORS® Political Action Committee asks that each Realtor® invest in RPAC so that we may continue to support those legislators that help us by supporting Realtor® issues when they arise. Very often proposed legislation that threatens the way we conduct business is defeated through the efforts of the legislators that understand Real Estate. Very often they support legislation that helps protect us in our everyday Real Estate business. RPAC dollars are used to support the legislators that support us regardless of their political party. For those of you that have not yet given in 2011 you have the opportunity now to contribute as you pay your LIBOR dues. General Counsel Buyer Agency ● September/October 2011 ● LEGAL/INDUSTRY NEWS CHAPTER 1 Many of the questions that are asked on the LIBOR Legal Helpline relate to Buyer Agency. There seems to be a great deal of confusion as to the meaning of buyer agency, the payment of a buyer agent and the rights and duties of buyer agents and the other agents with whom they deal. A buyer agent is the fiduciary of a buyer. The agent who is dealing with purchasers who are family and close personal friends should disclose the relationship and come into any transaction with these parties as a buyer’s agent. In addition, buyers who have no prior relationship with the agent may also wish for that agent to work in their best interest and so act as an agent of the buyer. However the situation arises, however, once an agent represents the buyer, the nature of the relationship is contractual and imposes certain rights as well as duties on all the parties involved. When a buyer hires an agent, he is asking that agent to represent him, not the seller, and, in return, offers that agent compensation. Although there is no set hiring agreement and all parties are free to make their own promises to each other, generally Buyer Agency Agreements list the obligations, duties and rights of the agent and the obligations, duties and rights of the client. In this article, I intend to discuss the duties, obligations and rights of the buyer. Next month I will deal with those of the agent, and the following month I want to discuss the way in which other agents, most particularly listing agents, must deal with the buyer and that buyer’s agent when negotiating a transaction. Buyers have every right to be represented and are free to hire any agent they choose. However, these buyers also have an obligation to inform all other agents with whom they come in contact that they are represented and that the other agents must deal with the buyer client’s own agent. This is where many buyers fail in their duty to their agents. They call other agents on ads, go into other TIME IS RUNNING OUT! RESERVE YOURS NOW! agents’ open houses and never mention they have signed an agreement to be represented by a particular agent. Buyer agents must impress upon their buyer clients that the buyers’ failure to fully inform other agents about their buyer agent could result in causing the other agent to inadvertently interfere in the agency relationship between the buyer and his agent, which could lead to a Code of Ethics violation for the unsuspecting agent. Furthermore, when a represented buyer requires the services of a broker and leads that broker or his agents to believe he is not represented and that the assistance they give the buyer could result in an earned commission, that broker and agent are upset and annoyed when, after having done the work, they discover the buyer is going to have his own agent put the deal together and get paid. Therefore, buyer agents must impress upon their buyer clients that it is the buyer client who had promised to pay the agent and that the buyer client’s failure to alert other agents to the buyer agency relationship existing between the buyer and his agent could result in the other agent’s receiving the compensation offered by a listing agent and that the buyer, bound by a contract to his agent, will be the party obligated to pay the agent. Apparently money is no object to buyers when they think someone else is paying it, so please make the buyers aware that they are the ones who could end up having to pay their buyer agent after the listing agent has compensated someone else for the transaction! REALTORS® Call on White House to Host Housing Summit To help develop policies that will stabilize the nation’s housing market and support an economic recovery, the National Association of Realtors® urges the White House to host a summit of policy makers, industry leaders and government stake holders focused on revitalizing the nation’s housing. “As the leading advocate for housing issues, Realtors® know that home ownership supports our nation’s economy,” said NAR President Ron Phipps, broker-president of Phipps Realty in Warwick, R.I. “Housing and home ownership issues affect all Americans, which is why we need strong policies that will help stabilize the housing market and lead the way out of today’s economic struggles.” Ahousing recovery is key to America’s economic strength, and NAR wants to make sure that proposed legislation and regulatory rules or changes to current programs and incentives don’t further exacerbate problems within fragile real estate markets across the country.
