Russ Lyon Sotheby’s International Realty’s Pinnacle Peak Office at
La Mirada is located at the epicenter of the upscale Pinnacle Peak area.

2010 was an interesting year for all of us. It brought us increased REO and distressed sale business, regionally
stabilizing prices, and a year over year increase in units, volume, and average price. In summary, it
showed us the beginning of a lengthy Arizona real estate recovery. As most major indicators,
locally and nationally, show signs of a stabilizing and improving economy we can look
forward to continued gradual improvement in our markets. We've all adapted to this
new reality, and our unique differentiators in the marketplace will continue to set
us apart from the rest and continue to define us as a Company.

At our most recent Continuing Education seminar in September, Bill Gray’s discussion topic pertained to scams
and fraud in the real estate and mortgage industry. The same week, I was privileged to attend a seminar with Judy
Lowe, Arizona’s Real Estate Commissioner, pertaining to the same subject and issues. As a panel member at the
seminar, I was asked to give a ‘job description’ of a real estate licensee. My answer was a reference to two places, the Arizona Commissioner’s Rules, and the National Association of REALTORS Code of Ethics, with an emphasis on Article 1.

Arizona Administrative Code, Real Estate Department, R4-28-1101. Duties to Client
A. A licensee owes a fiduciary duty to the client and shall protect and promote the client's interests. The licensee shall also deal fairly
with all other parties to a transaction.
In both instances, the message is clear, you have a fiduciary duty to your client AND an obligation to treat all parties
honestly (NAR) and fairly (ADRE). If you conduct your business activities by these standards, your professionalism
will shine through and the temptation to consider the ‘alternatives’ will diminish.
I am often asked where our concerns are about agent conduct. In today’s market, the answer is in the short sales
transaction, and the potential for ‘advice’ to be given to owners on their short sale options. In short (no pun intended), the only advice we can give is no advice. The owners need to seek independent legal or tax advice,
and not rely on us for their counsel. The use of the Short Sale Seller’s Advisory is critical to this process. It
has useful information AND links for the Seller to receive help. Quite often, the seller pressures us for advice on the premise that they cannot afford to seek legal counsel. Again, the Short Sale Seller’s Advisory

In June, 2008, we became Russ Lyon Sotheby’s International Realty. A comment frequently
heard in the first few days following the announcement was, “Sotheby’s is for the elite, high-end
inventory; it doesn’t fit our market place!” Of course, after we analyzed the Sotheby’s image, we quickly realized
that their ideals fit every market place and every price range.

City of Hope offers award-winning care to hundreds of thousands of mothers, daughters, sisters and wives who are facing women’s cancers. We are
proud of our “Team RLSIR” who participated in the Walk for Hope and
raised almost $2,800 for the City of Hope and was sixth in team fundraising. Congratulations to Kathy

City of Hope continue the research
for new, better therapies and to
save lives worldwide.
Currently there are annual events held in eight cities nationwide powered
by a year-round movement of fundraisers, volunteers and donors who are
dedicated to ending the devastation of women’s cancers.

My grandchildren have taught me to be inspired by the
wonder of the world in which we live, to stop to see the
little things in life, like squatting down to watch a potato bug roll into a ball, to
not be afraid to try new things, and rekindled in me the joy of just being alive.
We think we are the ones teaching them, when so often they have become our
teachers.
Children are gifted with a natural desire to learn. It is as if the world is a great
big classroom and they are surrounded by opportunities to discover. Lessons learned and a
passion to share and discover more. Oh, if I could only bottle up that passion for learning and
infuse it into the adults of the world!
My grandson, Gibson, is just starting school and he is so excited! The opportunity to learn and all that
goes along with it is an inspiration to him. When Gibson visits, we play school. Once, I showed him a
picture of an apple and asked what letter it started with. Gibson proudly wrote an “A” on his chalkboard and lifted it up to show me. We laughed and had so much fun that night.
Gibson reminded me that learning can be inspirational. It can re-ignite in us a passion to discover new
things. It fills us with a sense of pride as we tackle new challenges and experience success. And you
know what? …it is fun and should leave us wanting to come back for more.
Isn’t that what learning is about? I think so. So when I teach my classes to agents, I bring the lessons
I’ve learned from Gibson into the classroom. I want to inspire you to learn. I want to help you tackle
new challenges. I want to rejoice with you when you succeed. And I want us to all have fun while we’re
doing it! William Yeats said, “Education is not the filling of a pail, but the lighting of a fire.” I couldn’t
agree more. And I’m looking forward to lighting some fires!

An agent today had a contract question. Nothing too unusual. She had a listing and happened to receive two offers on
the property. The seller wanted to make a multiple counter offer
and the agent had never done one before.
After discussing the mechanics of making a multiple counter offer she said,
“This market is so tough. I will be happy when things get better!”
She had just received two offers on one of her listings! Why was that a bad a
thing?
How easy it is to lose perspective. The positivism that should have come from
the enviable situation of having multiple buyers for a listing was replaced by the
negativity of having to jump through a few extra hoops to get the deal done.
If it is true that “It takes one negative to wipe out a hundred positives”, then we
are all certain to face a depressing future. That is, unless we learn to recognize
those positive moments when they happen around us. Little things. A few more
bodies in our open houses. A few more showings on our listings.
Busy means you have to work harder. In our business, that most certainly is
not a negative. Having to jump all those extra hurdles to get a deal done means
your job is not as easy as it used to be. But at least you have a deal to work on. Having to be two places at
once means you have a lot going on. Considering the alternative, where is the negative in that?
The bottom line is this. The front page of the AZ Republic states “Arizona Recession Over”.

$227,561,000. The sale was led by the record-setting price brought by Amedeo Modigliani’s Nu assis
sur undivan (La Belle Romaine) – $68,962,500 –
which was well above expectations and the strongest
price achieved in this category at Sotheby’s in New
York since May 2006. Four works sold for more than
$15 million and 38 sold for over $1million. “We are
delighted with the results of our sale, which build on
the success of the past year, and are our best in this
category in New York since May 2008.”–
