Introduction The M idlands Region contains some of the largest and most important rivers in the country. Rivers such as the Trent, Avon and Severn have all hosted national and international angling championships. Other rivers such as the Teme, Dove and Derw ent are prized for individual catches of barbel, chub, salmon and trout M any smaller rivers provide good sport for both the serious and occasional angler and all play a part in contributing to the quality of life of many people. W ith over 7000 km or river, almost 1000 km of canal and an increasing number of popular stillwater venues, the region contains an extremely varied and im portant fisheries resource. The popularity of the region's fisheries is reflected in the high num ber of anglers in the Midlands - with over a quarter of the total national rod licences sold to anglers living in the Midlands Region. Welcome Welcome to your latest copy of the day ticket guide to fisheries in the Midland Region. A year has now passed since the onset of foot and mouth disease which paralysed much of the countryside, disrupting working lives as well has having a major impact on recreation and tourism including fishing. Thanks to the guide, many anglers who could not fish their usual haunts, had the opportunity to explore new venues and new areas and with this new edition, even more venues and up to date information have been included. I am pleased to report that as a result of the Salmon and Freshwater Fisheries Review, the government have recognised the important role that angling plays as both a healthy recreation and in protecting the environment. In forthcoming years this will result in extra grant in aid being given to protect and enhance fisheries within the Midlands Region and enable my colleagues within the Environment Agency to continue and extend their important work. The Agency is working hard to increase angling participation in all parts of the com munity and is committed to increasing angling opportunities for all - but especially juniors who represent the future of our sport. This guide is designed to inform both experienced and new anglers alike of the huge array of diverse fishing opportunities that exist in the Midlands Region. On pages 11-20 you will find a number of free fisheries controlled by the Environment Agency where, provided you have your valid rod fishing licence, you will need no further permission to fish. If this is your first season of fishing then may it be an enjoyable and rewarding one and tight lines to all of you! Chairman m ^ Rod Licences W h o n eed s a lice n c e ? Anyone aged 12 years or over who fishes for salmon, trout, freshwater fish or eels in England and Wales must have a valid Environment Agency Rod Fishing Licence. A rod licence is a statutory requirement (in other words it is required by law) and entitles the licencee to use a rod and line to fish. Rod licences are issued by the Environm ent Agency and it is important to note that these differ from permits (often referred to as day tickets) which give permission to fish on a particular w ater and are issued by fishery owners or angling clubs. W h a t c a te g o rie s o f licence are th e re ? There are two categories of rod licence: • Non-m igratory trout, coarse fish and eel licence • Salmon and m igratory trout (sea trout). This licence also entitles the holder to fish for non-migratory trout, coarse fish and eel. H ow lon g do lice n ce s run for? Full and concessionary licences are valid from 1st April to 31st March following. An eight day licence is valid for 192 consecutive hours. A one day licence is valid for 24 consecutive hours. W h o q u a lifie s fo r a co ncessio n ary lic e n c e ? You are eligible for a concessionary licence if: • You are aged 12 to 16 inclusive (Junior licence) • You are aged 65 years or over (Senior licence) • You receive (Eligible disabled) a. Long term incapacity benefit b. Short term incapacity benefit (at the higher rate) c. Severe disablement allowance d. A war pension which includes unemployability supplement (Please note concessions are only available on an annual licence.) H ow m any rods does a rod licence e n title m e to u se? A rod licence entitles you to fish with up to two rods and line at the same time for coarse fish and eels, but with only one rod and line for trout, sea trout, char and salmon. Always check club rules and local byelaws regarding the rod limit on the water you intend to fish. Additional licences are required if you fish with more rods, where byelaws and rules permit. C arry y o u r licence Please ensure you carry your rod fishing licence with you at all times when fishing - you may be asked to produce it by an Environment Agency officer or other authorised person. If you lose your licence, a replacement may be obtained by contacting the Environment Agency on 01925 653999. There is a small handling charge for replacement licences. Where do I get a licence? Angling and wildlife Angling contributes towards our environment and people's enjoyment of nature, but inexperience or thoughtlessness may lead to wildlife being harmed and the good image of angling being tarnished. To protect the environm ent and wildlife here are a few simple steps that can make a real difference. • N ever drop litter or discard tackle and remember that discarded nylon line is particularly hazardous to wildlife. Discarded or damaged line should be taken home. • A lw a y s clear up litter before you leave - even if it's not yours. • R em o ve im mediately rigs caught up in bankside vegetation, branches or underwater snags where it is practicable and safe to do so and report lost terminal tackle to club bailiffs or the fishery owner for removal, if you can not remove it. • C h o o se your swim with care to reduce the risk of snagging bankside trees, vegetation and obstructions in the water and take extra care where people feed w aterfow l. • N ever leave rods unattended while fishing. If you need to leave your swim, all lines should be retrieved and the hooks secured to the rod. • N ever leave rods on the bank with hooks still baited, as these food items could be picked up by birds or animals. • R e m e m b e r it is illegal to leave a rod unattended while fishing. • Use a hook length of lower breaking strain line than the reel line where possible. • C h e ck your reel line regularly for flaws caused by wear and damage. Remove and carefully dispose of any damaged line and replace your reel line regularly. • Use barbless or reduced barb hooks where possible. Hooked or entangled birds are more likely to be able to rid themselves of the hook and in the event of a rescue being needed, removal of the hook from a bird will be much easier. • Lead weights are illegal in most sizes and non-toxic weights are widely available. Lead weights of 0.06 grams (No. 8 shot) or less, or of more than 28.35 grams (1 oz) may be used. • Bew are of birds swimming into your line or picking up surface baits. • W a t c h your rod at all times when legering with quivertips or other visible bite indicators. Submerge rod tips when legering using bite alarms and keep lines under the surface to avoid waterfowl. • Retrieve your line when float fishing if there is a risk of birds swimming through the line. Even when using a waggler float with the line 'buried', it will be only just below the surface and still presents a risk. • Take great care when fishing surface baits such as bread or 'floaters' as they may attract waterfowl. • A little time spent helping beginners can reduce tackle losses and improve their catches. • Never attempt to restrain an injured swan (or other large bird or animal) by holding onto the line. This can cause severe injury and heightened trauma. Institute of Fisheries Management <rfm)4 The Institute is an international organisation of persons sharing a com m on interest in the modern management of recreational and com m ercial fisheries and is dedicated to the advancement of fisheries m anagem ent in all forms. It is a non-profit making organisation controlled by its membership and governed by an elected council. AIMS 1. To improve the standards of, and promote, effective fisheries m anagement • This is achieved through seminars, an Annual Study Course, through consultation with government bodies and through FISH magazine. 2. To provide the technical and general knowledge necessary for com petent fisheries management • The Institute runs two distant learning courses at Certificate and Diploma levels. 3. To advance the standing of fisheries management as a profession • The Institute is currently assessing a Continuing Professional Developm ent programme for members. In recent years Barbel (Barbui barbus) have become increasingly popular w ith river anglers. This hard fighting fish is normally found in deep fast flowing water but was for thousands of years confined to the south of England as a result of the ice age. Introduced by man into rivers such as the Severn the barbel has proved very successful with fish up to 161b being caught by anglers. Essentially a bottom feeder. Barbel eat m ainly at dusk and during the night on snails, mussels and insect larvae but will even take small fish when the opportunity arises. Easily recognised by the tw o sets of barbels on the upper lip, the fish uses these to detect its food in the gravel bottom of large clean lowland rivers. Carp provided an essential source of protein during the long winter m onths. Carp enjoy rich warm water conditions and can tolerate surprisingly low oxygen levels. One of Britain's largest freshwater fish, the Pike (Esox lucius) is amongst the top predators in the aquatic food chain. Pike have large sickle shaped teeth sloping backward in the mouth so that it is almost impossible for prey fish to escape their fast, darting attacks from deep cover. Fish of over 40lbs (always females) are not rare but despite their great size Pike need very careful handling out of water to avoid serious physical damage. Pike are usually green coloured when young but this deepens with age w hen characteristic banding occurs. They hunt fish including their own kind using a com bination of good vision provided by forward facing eyes and a system of sensory organs located on the head and connected to the lateral line nervous system w hich enable it to detect prey movement before it com es in view. Salmon (Salmo salar) is the most revered of all the game fish. It also has one of the most fascinating life cycles in all the animal kingdom. Adult females lay eggs in the upper reaches of rivers using nests called 'redds' made in gravel. After about three years, young fish begin to change by a process called smoltification in preparation for migration to sea. They may spend one or several years in the cold waters of the north Atlantic where they take on a characteristic pink colouration to the flesh. Fish returning to freshwater to breed have to get past many obstacles including drift nets at sea, a variety of basket traps and other devices in the estuary and fishermen on the bank. Part of this epic journey can be witnessed first hand as this noble fish leaps over weirs and waterfalls on route to the spawning grounds. Amazingly Salmon are able to find the actual river in which they were born. Rather puzzling for anglers is that although Salmon do not feed in freshwater they will take natural and artificial baits but this may be explained by the fact that this needs to be presented on the nose' in order to produce an instinctive strike. Midlands Region o Byelaws Byelaws Introduction to the Regional Fisheries Byelaws Byelaws are statutory rules and regulations put in place by the Environment Agency and which must be complied with by anglers. They exist to prevent damage to fish stocks from insensitive fishing methods and to make sure that fisheries are sustainable for the enjoyment of current and future generations of anglers. These byelaws apply to all types of fisheries within the Midlands Region, be they owned by angling clubs, syndicates, local authorities or by private individuals. Whilst the fishery owners may impose additional more stringent regulations, they are not able to dispense with any of the fishery byelaws laid down by the Environment Agency. They may, for example, restrict the number of rods a coarse angler can use to two, if they feel it is in the best interest of their fishery. However, they may not remove the Agency's maximum limit and allow more than four rods to be fished. Out of necessity, legal English can be complicated, so where necessary the following pages contain explanatory notes to clarify various meanings and definitions. Please note that the following pages are not a definitive legal interpretation of the byelaws, but a 'reader friendly' guide aimed at informing anglers of the rules governing fishing within the Midlands Region. The byelaw numbers in brackets refer to corresponding numbers in the legal byelaws. There are also a number of byelaws which have been introduced recently and which apply throughout England and Wales. These 'national' byelaws are marked as such. Please make sure you read the byelaws in full before you go fishing. If you have any questions on interpretation whatsoever, please contact your local Agency office for clarification. It is far better, for everyone, for any confusion to be sorted out in advance rather than in court. Please be aware that byelaws do change from time to time. Some changes are currently being considered and are likely to be implemented later in the year 2002. This is to make sure that the byelaws continue to provide fish and fisheries the best possible protection. Whatever changes are made, the Agency makes every effort to bring them to the attention of as many fishermen as possible. If you are not sure of the current situation please ask. A Guide to the Fisheries Byelaws for the Midlands Region. 1. APPLICATION (Byelaw 1) Unless o th erw ise stated, these byelaws apply to the w ho le of the M idlands Region of the Environm ent Agency. 2. INTERPRETATION In this guide the following terms have the following meanings: (Byelaw 2) • The Midlands Region' means the combined areas of the natural catchments of the River Severn and River Trent and of all the watercourses draining or flowing, directly or indirectly, into them • The abbreviation 'NGR' means Ordnance Survey National Grid Reference. • All references to a river includes all tributaries and sub-tributaries and all mill leats, streams and channels. • The terms used in these byelaws shall have the meanings ascribed to them in the Salmon and Freshwater Fisheries Act 1975 or the Water Act 1989. 3. CLOSE SEASONS and Close Times Salm on (Byelaw 3.a) The annual close season for fishing for salmon with rod and line shall be the period from and including the 8th day of October to and including the 31st day of January following. NB. A dose season exists for salmon in all waters in England and Wales, although the dates may vary from region to region. Any person who removes any live or dead salmon taken by rod and line from any waters or banks without the previous written authority of the Agency before the 16th day of June in any calendar year shall be guilty of an offence. This byelaw shall not apply to any person who lawfully takes a salmon and returns it immediately to the water with the least possible injury. (National Salmon Byelaw 5; applies throughout England and Wales). Any person w ho fishes for, takes or attempts to take any salmon with rod and line by any means other than an artificial fly or artificial lure before the 16th day of June in any calendar year shall be guilty of an offence. (National Salmon Byelaw 6; applies throughout England and Wales). This means salmon fishing in the Midlands Region is permitted between 1st February and 8th October, but between 1st February and 15th June inclusive only fly and artificial lure can be used and all salmon caught must be returned alive to the water. M igratory Trout (Byelaw 3.b) The annual close season for fishing for migratory trout with rod and line shall be the period from and including the 8th day of October to and including the 1 7th day of March following. NB. A close season exists for sea trout in all waters in England and Wales, although the dates may vary from region to region. Trout (excluding migratory trout and rainbow trout) (Byelaw 3.c) The close season for fishing for trout (excluding migratory trout and rainbow trout) with rod and line shall be the period from and including the 8th day of October to and including the 1 7th day of March following in all waters of the Midlands Region. NB. A close season exists for brown trout in all waters in England and Wales, although the dates may vary from region to region. Rainbow Trout (Byelaw 3.d) i) The close season for fishing for rainbow trout with rod and line shall be the period from the 8th day of October to the 17th day of March following (both dates included) in all rivers, streams, drains and canals of the Midlands Region. NB. A close season exists for rainbow trout in all waters, apart from reservoirs, lakes and ponds, in England and Wales, although the dates may vary from region to region. ii) The annual close season for fishing for rainbow trout in all reservoirs, lakes and ponds shall be dispensed with, regardless of whether fish can or cannot normally swim from or to other waters. NB. This is a national byelaw - the statutory close season has been dispensed with from reservoirs, lakes and pools in all regions. Eels (Byelaw 3.e) During the period from and including the 15th day of March to and including the 15th day of June following, fishing by rod and line for eels is authorised on those waters where the statutory close season for freshwater fish has been dispensed with. This means you may fish with rod and line for eels in stillwaters (except those which are Sites of Special Scientific Interest) throughout the year. It shall be lawful to fish for eels with a rod and line during the annual close season for freshwater fish in the Midlands Region, provided that the hook used shall have a gape of not less than 12.7 mm (0 .5 inches). This means you may only fish for eels in rivers, streams and drains in the region during the freshwater fish close season if the hook used has a gape of 0.5 inch (12.7 mm) or over - see also 6. Lures and Baits. There are no statutory tackle or bait restrictions when fishing for eels in stillwaters. F re sh w a te r (Coarse) Fish (Byelaw 3.f) The annual close season for fishing for freshwater fish • in rivers, streams and drains • in all waters in the Specified Sites of Special Scientific Interest (SSSI) (see opposite); Shall be the period from and including the 15th day of March to and including the 15th day of June following. On all other waters there shall be no statutory close season for freshwater fish. NB. The coarse fish close season in rivers, streams and drains is a national byelaw. A national Environment Agency byelaw removing the coarse fish close season on canals in England and Wales has now been approved. This byelaw dispenses with the statutory close season for coarse fish close season on any canal that: ~ r has an artificial channel (cut); has artificially maintained water levels with negligible flow over the majority of its length (other than that derived from water resources and navigation); ~ has a towpath over the majority of its length; ~ has a length in excess of 250 metres and - is not designated a Site of Special Scientific Interest (SSSI) This means that for canals in the Midlands Region there is no longer a close season for coarse fish subject to the above criteria. A list of the canal SSSI's that remain closed appear in the list opposite. To check local arrangemants please contact your nearest Environment Agency office. TROUT AND GRAYLING SIZE LIMITS (Byelaw 4) The following size limits are in force. The size of the fish is measured from the tip of the nose or snout to the fork or cleft of the tail. Trout (Except Rainbow T ro u t) and Grayling i) The waters of the River Severn (including its tributaries) above or upstream of its confluence with the Afon Clywedog (N CR SN 954 847); the waters of the River Vyrnwy (including its tributaries) above or upstream of Dolanog Weir (NGR Sj 067 127); the waters of the River Banwy (including its tributaries) above or upstream of its confluence with the Afon Cam (NGR SJ 01 7 103); the waters of the River Tanat (including its tributaries) above or upstream of its confluence with the River Rhaeadr (NGR S) 1 30 247). Size limit: 15 cen tim etres ii) All other waters Size limit: 20 centim etres Rainbow Tro u t The waters of the Rivers Derwent and Amber, including their tributaries, which are above or upstream of their confluence at Ambergate, Derbyshire, (NGR SK 346 515), excluding the stretch of the River Wye from Blackwell Mill near Buxton to Cressbrook Mill (NGR SK 1 73 727) above or upstream of Ashford-in-the-Water and excluding any reservoir or lake formed by the construction of a dam across the valley of those rivers or across one of their tributaries. Size limit: 20 centim eres This byelaw shall not apply in the case of any person who takes any immature (undersized) fish unintentionally if it is at once returned to the water with as little delay or injury as possible. 5. PERMITTED METHODS OF FISHING (Byelaws 5 and 10) i) It shall be lawful to use a rod and line and landing net or tailer used as auxiliaries to angling with rod and line for taking salmon, migratory trout, non-migratory trout, freshwater fish or eels. ii) No person shall fish with more than one rod and line at the same time when fishing for salmon and trout in all rivers, streams, drains and canals. No person shall fish with more than two rods and lines at the same time when fishing for salmon and trout in all reservoirs, lakes and ponds. No person shall fish with more than four rods and lines at the same time when fishing for coarse fish or eels. NB. The use of three or four rods requires possession of two rod licences. When fishing with more than one rod and line at the same time, the aggregate number shall not exceed four. When fishing with multiple rods and lines, rods shall be placed such that the distance between the butts of the end rods does not exceed three metres. NB. This is a national byelaw. iii) Any person who leaves a rod and line with its bait or hook in the w ater unattended or so that the person shall be unable at any time to take or excercise sufficient control over said rod and line shall be guilty of an offence. NB This is a new national byelaw. iv) No person shall use any form of line otherwise than in connection with a rod. ie. handlines are illegal. v) No person shall take or attempt to take or kill any salmon, trout, freshwater fish or eels by any of the following methods, that is to say, by tickling or groping the fish or by removing the water from any river, lake or pond by ladling, baling, draining or pumping. 6. LURES AND BAITS No person shall i) in fishing with rod and line for salmon in the Severn area use any float in conjunction with any lure or bait. ii) in fishing with rod and line for trout or any fish other than freshwater fish during the annual close season for freshwater fish, use any float or bait (which term includes ground bait) other than artificial or natural fly (which term excludes bloodworms, jokers and other midge larvae), spinners, minnows, worms, prawns or shrimps. NB. "any fish other than freshwater fish" excludes salmon for the purpose of this byelaw (see section 3). This only applies to those waters which have a close season, ie. rivers, streams, drains and canals. There are no statutory bait restrictions on stillwaters. So, if you wish to fish for eels on rivers during the coarse fish close season, you may do so providing that you use the above baits, do not use a float and use a hook with a gape of at least 0.5 inch (12.7cms). Any person who in fishing for salmon, trout, fresh water fish or eels, uses as bait crayfish of any species whether alive or dead, or parts thereof, shall be guilty of an offence. NB. This is a new national byelaw banning crayfish as bait 7. KEEP NETS, No person shall - KEEPSACKS AND i) LANDING NETS (Byelaw 12) use a keep net (for retaining any kind of fish) during the annual close season for freshwater fish in waters to which such a close season applies. You can, therefore, use a keepnet for retaining coarse fish in stillwaters during the close season on rivers and canals. However, many fishery owners impose their own rules and regulations - please check before you use a keepnet. ii) at any time use a keep net for retaining salmon, trout, the parr or fry thereof. iii) Any person shall be guilty of an offence if he uses:(a) a landing net with any knotted meshes or meshes of metallic material; or (b) a keepnet • with any knotted meshes or meshes of metallic material; or • having any holes in the mesh larger than 25 mm internal circumference; or • of less than 2.0 metres in length; or • with supporting rings or frames greater than 40 cm apart (excluding the distance from the top frame to the first supporting ring or frame) or less than 120 cm in circumference. (c) a keepsack • not constructed of a soft, dark coloured, non-abrasive, water permeable fabric; or • having dimensions of less than 120 cm by 90 cm if rectangular; or • 150 cm by 30 cm by 40 cm if used with a frame or designed with the intention that a frame be used. NB. This is a national byelaw. (iv) Any person shall be guilty of an offence if he retains more than one fish in a single keepsack at any time. NB. This is a national byelaw. 8. STOCKING (Byelaw 1 3) No person shall introduce or have in his possession intending to introduce, any live or dead fish or any spawn thereof or natural food of fish (other than bait) from any source into any waters within the Midlands Region or transfer any fish (including fish for use as live bait) or spawn thereof or natural food of fish from one water to another within the Midlands Region without the previous consent in writing of and subject to such conditions as may be imposed by the Environment Agency. This does not include the use of seafish as bait or preserved dead baits. 9. MIGRATORY SALM ONID CATCH RETURNS (Byelaw 14) Any person to whom a licence is issued by the Agency to fish by rod and line for salmon or migratory trout shall not later than the 1 st day of January in the following year, make a return on a form provided by the Agency giving particulars of dates, the locations and the time spent fishing and the number and weight of any salmon or migratory trout caught (except in relation to small sea trout (500g or less) where only the number caught need be returned) including those returned alive giving details of whether they were caught on fly, spinner or bait, or a statement that no salmon or migratory trout were caught by the licence holder. NB. This is a national byelaw. 10. FISHING NEAR DAMS (Byelaw 16) No person shall take or attempt to take fish by rod and line within a distance above or upstream of the crests or below or downstream of the toe of the weirs on the rivers as stated below:• 15 metres above and 45 metres below Shrewsbury Weir (NGR SJ 501 1 31) on the River Severn. • 15 metres above and 25 metres below Penarth Weir (NGR SO 1 39 927) on the River Severn, Powick Weir (NGR SO 832 524) on the River Teme and Carreghofa Weir (NGR S) 254 219) on the River Tanat. • 5 metres above and 15 metres below Tewkesbury Weir (NGR SO 882 328), Maisemore Weir (NGR SO 818 21 7) and Llanthony Weir (N G R SO 822 182) on the River Severn. Byelaws 11. OF USE OF CERTAIN LEAD WEIGHTS (Byelaw 17) ii) This does not prohibit the use of a lead weight of 0 .06 grams or less, or of more than 28.35 grams. For the purposes of this Byelaw:• "lead" includes any alloy or compound of lead; • "lead weight" means split shot or any other thing suitable for weighting fishing lines which is neither incorporated and fully enclosed in the core of a fishing line nor incorporated in the construction of a swim-feeder, a selfcocking float or a fishing lure; • "fishing lure" means any device, including a fishing fly, which is designed to attract fish and which incorporates a fishing hook. NB. This is a national byelaw. 12. PROHIBITION OF GAFF The use of the gaff is prohibited at all times when fishing for salmon, trout, freshwater fish and freshwater eels. NB. This is a national byelaw. 13. USE OF LIVE FISH FOR BAIT Any person who takes fish for use as live bait shall be guilty of an offence unless the fish are retained at and used only in the water from which they were taken. This byelaw shall not apply to any fish introduced as live bait under and in accordance with a consent issued under Section 30 of the Salmon and Freshwater Fisheries Act 1975 NB. This is a new national byelaw making it an offence to use livebaits at any water other than that which they were taken from. 14. RETURN OF FOUL HOOKED FISH It shall be an offence to fail to return immediately all salmon, migratory trout, or trout, hooked other than in the mouth or throat, to any river, stream, drain or canal. NB. This is a new national byelaw to protect stocks of salmonids. Many reservoirs contain high quality water and are a favourite venue for game anglers seeking specimen sized fish. Native to the Pacific coast of Am erica, the Rainbow Trout (Oncorhynchus mykiss) was introduced to England in 1884. There are only a handful of places in Britain where the Rainbow successfully breeds in the wild and therefore most of our fisheries are only sustained by stocking hatchery reared fish. The reason for this is considered to be that fast flowing water is essential to its reproductive cycle and that in such circumstances Brown Trout eggs hatch first and young 'Brownies' out compete Rainbow fry for territory. Rainbows are thought by many anglers to provide more exciting sport than our native fish. They get their name from the iridescent pink to red band that runs down the flank.
