Comment: Several commentators suggest making mandatory public participation rules or codifying these guidelines. (31, 271 – 476) Response: Statutes and regulations at both the state and federal level with mandatory public participation rules already exist for many specific permits and many other aspects of the department’s operations. This policy is intended to standardize department procedures in areas not already covered by applicable laws. As a matter of policy, the department regularly exceeds these requirements and provides more public participation opportunities than required. Section II: How This Policy Relates to Other Public Participation Options 2. Comment: Section II, Existing Legal Requirements by Statue or Regulation, states that the department will follow all requirements set forth in law and regulation and to the extent that the policy conflicts with a legal requirement, the legal requirement governs. The commentator recommends the language should say "state or federal" law and regulation, with the one requiring the most public participation/notice governing (5) Response: By using the language “all legal requirements” the department is referring to both state and federal law. This will normally result in the department applying the most stringent standards, but an analysis of which specific requirements are controlling must be done on a case-by-case basis and is beyond the scope of this policy. 3. Comment: PADEP's Environmental Justice (EJ) policy should be expanded to cover areas that are presently being impacted by natural gas development operations since these areas meet your definition of EJ areas. People in those areas should be involved in the decisions that result from all permitting and all authorizations, not only the narrowly defined permits that are covered in this proposed policy. By including these impacted communities you can trigger the opt-in provisions in your EJ policy and rightfully broaden the applicability of this policy. (28, 234 – 249, 271 – 494) Response: This policy applies to all permits issued by the department. Changes to the department’s EJ policy are beyond the scope of this policy. This comment has been forwarded to the department’s Office of the Environmental Advocate for consideration. 4. Comment: The commentator suggests the DEP maintain areas of significant local interest and Environmental Justice (EJ) areas separate and distinct. (32) Response: The department understands that the existence of an EJ area and the determination that significant local interest has been expressed are separate issues, but both these issues will be considered in determining the public participation options that are appropriate for a given application. 5. Comment: The commentator states that the Public Participation sections of DEP’s Environmental Justice Policy document must be incorporated by reference in the Policy on 012-0900-003(CR) / March 1, 2014 / Page 78 Public Participation. Public comment must be accepted on Environmental Justice public participation policy together with general public participation public comment. The commentator further states the policy should be withdrawn. DEP should issue a new document containing Public Participation policy, Environmental Justice trigger permit criteria, and General Permit eligibility criteria in a single document, so there can be an integrated discussion of public participation across all forms of DEP guidance. If need be, the relevant sections from other policy documents can be indicated in the Public Participation Policy document and incorporated by reference, but comment must be accepted in an integrated discussion of all aspects of Public Participation. (29) Response: The purpose of this policy is to clearly define the department’s public participation policies in cases where existing statutes, regulations, or guidance do not already specify the procedures that will be used. Including additional topics in this policy would be counterproductive—particularly if the issues included would require statutory or regulatory changes. 6. Comment: In light of the expansion of natural gas activities in Pennsylvania, the commentator strongly recommends that the Environmental Justice policy be more robustly applied to communities with regard to public participation in permitting. Also outlined is how an area of concern and status of an Environmental Justice community is to be identified. To be effective, the proposed public participation policy must require inclusion of EJ areas in all permitting considerations. The commentator requests that the Department begin the process of identifying communities where gas development is occurring and that meet the criteria of EJ areas, using the guidelines in the Department’s Environmental Justice Public Participation Policy. The commentator also recommends that the Department refer this critical issue to the Environmental Justice Advisory Board for action at its next scheduled meeting. (31) Response: The Environmental Justice Advisory Board was consulted and provided comments during the development of this policy. The specific comments above are not within the scope of this policy and should be addressed by the Environmental Justice Public Participation Policy (DEP ID: 012-0501-002) developed by the department’s Office of the Environmental Advocate (OEA). The comment has been forwarded to the OEA for their consideration. Section III: General Policy 7. Comment: In Section III, on page 2, if the applicant proposes “substantive changes” to the project proposal due to the review of a project, the DEP may consider an additional opportunity for public comment. This concept also appears in Section VI, on page 5. The commentators request that “substantive changes” be defined. (3, 7, 23, 32) Response: To avoid confusion, the department has removed the word “substantive” from the policy in reference to changes to the application. Furthermore, the department has clarified that it will consider extending the public comment period when changes to the application are made after the close of the public comment period. This is to ensure that the public is afforded the appropriate opportunity to provide comment on the actual project the department is reviewing. Please note that changes made during the technical review of the application will be managed in accordance with the department’s “Policy for Implementing the Department of Environmental 012-0900-003(CR) / March 1, 2014 / Page 79 Protection (Department) Permit Review Process and Permit Decision Guarantee” (Document No. 021-2100-001. 8. Comment: Section III, paragraph 2, currently says that “Department staff will encourage public participation in the permit review process.” The commentator recommends using the phrase “strongly encourage”. (26) Response: This policy outlines procedures and guidelines the department should follow when engaging in public participation activities associated with the permit review process. The department will make every reasonable attempt to facilitate public participation during the permit review process while adhering to the framework of the applicable regulatory and statutory requirements. When pre-application meetings are held for a permit, the Department will discuss and strongly encourage the applicant to conduct public outreach when such activities are not otherwise required by statute or regulation. 9. Comment: In Section III, paragraph 2, the commentator recommends adding the following: “consider and include consulting with the Office of Environmental Advocate, Community Relations Coordinators and/or Local Government Liaisons on the most appropriate methods to obtain the most valuable public participation.” (26) Response: The department agrees and has added the requested language. 10. Comment: In section III, the commentator suggests adding language highlighting section VIII Additional Information. (26) Response: The department agrees and has added the requested language. 11. Comment: PA DEP should maintain and use “Interested Party” lists for notifications of open permit comment windows, and the Policy should be revised to mention the availability of this service. (8, 26) Response: While the Pennsylvania Bulletin is the most authoritative source for such notifications, the department provides additional resources to notify the public of open comment periods. The department recommends interested parties register with the department’s eNotice system for notifications of interest. Interested parties may also check the DEP Calendar of Events, available on the department’s website (DEP Keyword: Public Participation), for upcoming events. 12. Comment: PA DEP’s eNotice emails do not provide enough information for the public. (8) Response: The department appreciates this comment. Improvements to the eNotice system have already been made related to draft technical guidance. Other improvements to the eNotice system are currently being considered and will be implemented as resources allow. 13. Comment: The Policy should encourage public notice for all permit actions to include publication in the local newspaper with the largest circulation in the host municipality. (8) Response: Section IV of the policy details public notification requirements including the use of local media to announce public hearings and public meetings. Notifications related to other 012-0900-003(CR) / March 1, 2014 / Page 80 permit actions are beyond the scope of this policy. While the Pennsylvania Bulletin is the commonwealth’s official gazette for such notifications, the department provides the eNotice service to supplement that notice in an effort to further assist the public in tracking local permitting actions. In addition, the department’s Newsletter and Calendar of Events, both available through the department’s web site, will list open comment periods, public hearings, and meetings. 14. Comment: The commentators suggest that the department consider using other methods such as social media and Public Service Announcements on local radio to enhance its public outreach for participation in permitting. (31, 15) Response: The department appreciates this suggestion and is committed to enhancing public outreach. For example, the department has recently announced an updated website, an improved newsletter, and calendar of events. Other initiatives will be announced as they become available. 15. Comment: The commentator recommends the department take advantage of the use of informational fact sheets and webinars. (19) Response: The department agrees and has been actively expanding the use of such tools. 16. Comment: The commentator encourages PA DEP to provide guidance on how long after permit issuance the notification must appear in the Pennsylvania Bulletin and suggest 14 days. Further, the commentator requests that PA DEP provide guidance on the information that must be provided in the public notice and suggests it include: 1) permit number; 2) owner/operator; 3) facility name; 4) longitude and latitude; 5) equipment associated with the permit; 6) type and quantity of air contaminants being emitted.; 7) applicable regulations; 8) the conditions in the proposed permit (with reference to applicable federal requirements); and GPS coordinates for the proposed facility. (24) Response: The department recognizes this comment and has already begun working to streamline and improve the Pennsylvania Bulletin notices published by each program area. The commentator’s suggestions will be considered in this process where appropriate. 17. Comment: The commentator requests that PA DEP provide mechanisms to enforce public notice and periodically review the Pennsylvania Bulletin to ensure compliance. (24) Response: When and how public notice is to be handled varies by statute and regulation. The department adheres to the requirements outlined for public notice of department action. However, as mentioned in Comment #41, the department has been working to streamline and improve Pennsylvania Bulletin notices that are published by each program area. In addition, the responsibility of consolidation and review of all Pennsylvania Bulletin notices now takes place in the DEP Policy Office; previously this responsibility was split between two different offices. 18. Comment: The proposed policy should include a requirement for timely dissemination to the municipality of the notice of a permit or authorization so that local governments can achieve broad public. For instance, municipalities will often turn an issue over to their Environmental Advisory Commissions, which will assume responsibility for analysis and developing a community response. Additionally, a local government may want to schedule a public 012-0900-003(CR) / March 1, 2014 / Page 81 information session of its own. (2, 6, 8, 31) Response: Apart from this policy, applicants for certain types of permits are required to give written notice to each municipality in which the permit activities are located as indicated in the statute at 71 P.S. Section 510-5 (relating to cooperation with municipalities). To supplement this requirement, municipalities are encouraged to sign-up for eNotice alerts related to permitting activities in their communities. In addition, the department encourages its Local Government Liaisons to forward such public notices to the affected municipalities in their area, and will also be engaging Liaisons in a higher form of municipal notification. 19. Comment: The commentator suggests that the department establish a standard recommending that each noticed municipality and county, in turn, undertake its own outreach to the members of its community to enhance public awareness of the project and of the opportunity for comment. (2) Response: While the department encourages municipality engagement in the permitting process, establishing such standards are beyond the scope of this policy. 20. Comment: In addition to the 10 day public comment period after an application is significantly revised, the proposed Policy should be revised to include a 10 day public comment period to be routinely provided after any hearing or public meeting. (7) Response: While the department encourages such meetings to be conducted as early in the comment period as practical to ensure receipt of all comments within the published comment period, the department strives to allow at least two weeks after a public hearing until the end of the public comment period to allow ample opportunity to provide feedback. 21. Comment: Not every public comment period corresponds with an issued comment and response document. The commentator recommends that the Department outline in the policy whether or not a comment and response document will be issued for the various types of public comment periods. The commentator also recommends that within each Pennsylvania Bulletin notice it is indicated whether or not a corresponding comment and response document will be issued. (23) Response: It is the department’s policy that all timely public comments are considered and responses are provided in the appropriate document. As no comments are received for many public comment periods, the department often does not know in advance if a CommentResponse Document will be issued. 22. Comment: While the policy recommends that the applicant seek public input prior to submitting a permit, such public input needs to be further defined as to the manner in which it is solicited. Is the applicant reaching out to a segment of the population that supports their project, or is this a general outreach to all the citizenry? Will the company be providing an ‘informational open house’ where they are the sole providers of information including regarding how their facility is regulated? If so, there is an inherent inappropriateness to the applicant ‘controlling’ the message. There is not an open forum for an unbiased and accurate detail of the regulatory procedure, there is not an avenue for those present, including press to receive fair and objective information regarding how the facility may add additional sources of pollutants to the local environment or the manner in which the facility is regulated or the manner in which DEP 012-0900-003(CR) / March 1, 2014 / Page 82 and other agencies provide emergency response. Therefore, the Commentator discourages the pre-application input unless there is an across the board public outreach coupled with reliable information provided by DEP. (23) Response: The department agrees that broad public outreach and providing reliable information are key elements of an effective pre-application meeting. It has been the department’s experience that the majority of businesses in Pennsylvania are receptive to engaging the community regarding their proposed projects. 23. Comment: Since permit applicants are encouraged “to schedule a pre-application conference with the Department as soon as practicable to discuss the permitting needs for the project prior to submitting an application.” what about the public that will be affected? These pre-app conferences should also be open to the public and available on-line live and archived. (26) Response: Based upon experience, the department finds the public is better served by encouraging a full and open discussion of any proposal early in the process. Requiring publication of pre-application discussions could discourage such conferences from taking place. 24. Comment: The commentator supports the concept that project applicants should seek public input from affected communities prior to submitting a permit or other authorization to the Department and that local government be included in the proposed policy. It is critical that basic facts and information about a planned project are presented to the public before plans are set in motion, allowing for a more iterative process that might, in fact, substantially change a permit application or project scope in order to ensure that it is more protective of the environment. (31) Response: The department appreciates the supportive comments. 25. Comment: The commentator encourages DEP to recommend, as a matter of course, that the project proponent contact land trusts and comprehensive land use planners in the region for the purpose of identifying high value resources. This step should be part of the checklist that DEP reviews as it proceeds with the project permitting. The commentator further urges DEP to consider requesting written statements from the contacted parties regarding the siting issues pertinent in the project landscape. (2) Response: While the issues raised are beyond the scope of this policy, the department already uses the Pennsylvania Natural Diversity Inventory (PNDI) Environmental Review Tool to identify potential impacts to threatened, endangered and special concern species, and special concern resources. As part of this procedure, the department considers comments and recommendations provided by the applicable resource agencies. In addition, the department will consider comments of other parties during the applicable public comment period. 26. Comment: The commentator agrees that applicants should consider the items in PA DEP’s proposed Outreach Checklist, but recommends DEP require permit applicants to develop and implement a public outreach plan before and throughout their permit application timeframe and further recommends specific checklist items become mandatory. (18) Response: While the department encourages applicants to develop and implement a public outreach plan, adding additional mandatory requirements for applicants would require statutory 012-0900-003(CR) / March 1, 2014 / Page 83 and/or regulatory changes and is beyond the scope of this policy. The department has decided to rescind the “Permit Applicant Outreach Activities Checklist” in order to prevent confusion. It will no longer be available for use. In the future, the information contained in the checklist may be available in a Fact Sheet. The department encourages applicants to contact their local environmental advocate regarding additional public outreach options. 27. Comment: The policy states that Department staff will consider the appropriate method to obtain valuable public comment as the degree of participation requirements differs with each project. Per the Department's commitment to decision-making that is "open, transparent and accountable," (I. Background), the commentator suggests that the region's Environmental Advocate should be consulted at the minimum in these decisions, especially on potentially controversial issues. This will help with public trust. (5) Response: The policy has been revised to include a reference to the Environmental Advocate. 28. Comment: In the current Policy on Public Participation dated July 16, 2005, the Department’s Center for Collaboration and Environmental Dispute Resolution is required to provide consultation. Projects that may be controversial or of great public interest are specifically flagged in the current policy to include the Center to ensure effective public participation. The proposed policy removes this resource, and thereby the expertise and advocacy of the Center— in turn reducing the benefits of review for the public. We recommend that, at a minimum, the regional representative of the Department’s Environmental Advocate be required to provide expertise and support for public participation. (31) Response: The policy has been revised to include consultation with the Environmental Advocate, Community Relations Coordinator, and/or Local Government Liaison as appropriate. 29. Comment: The commentator notes that dwindling newspaper distribution—and the declining number of local papers—makes this medium less and less effective as a means of notifying the affected public of comment periods and processes. The commentator suggests other forms of notification and also suggests that the Department assess whether reliance on publication in the Pennsylvania Bulletin is effectively serving the public notification function and if other alternatives are appropriate. (2) Response: As the Pennsylvania Bulletin is the commonwealth’s official gazette for information and rulemaking, it is the primary and most authoritative source for department notices. To supplement the Bulletin and enhance public outreach, the department also utilizes other forms of public notification, including, but not limited to, the following: use of local media, including newspaper and television; publication on the department website; and use of the department’s eNotice system. These forms of additional notification are mentioned in Section III of the policy. Going forward, the department will be working with the Citizens Advisory Council to explore and develop other options for notifying the public of department actions. Section IV: Public Participation Options 30. Comment: The commentator suggests that Section IV should present the items in chronological order. (7) Response: The department does not wish to indicate a chronological order. While the 012-0900-003(CR) / March 1, 2014 / Page 84 department often holds public meetings prior to public hearings, that order may change to allow for more effective public participation. 31. Comment: The commentator suggests section IV be edited for consistency, noting that part A references the “application decision” where part B references the issuance “of the permit”. (26) Response: The department agrees and has revised the language. 32. Comment: Often the Pennsylvania Bulletin (PaB) notice will detail an exact due date, such as the notice for this particular comment, July 22, 2013. However, some PaB Notices will simply state 60 days, 30 days, 45 days. Therefore, the commentator suggests that in order to avoid any misunderstandings that for example, the notice state “The Department is accepting comments during a 60 day period beginning on the date of this publication and ending August 15, 2013 at 12:00 a.m.” (19, 23) Response: The department is in the process of reviewing its forms and procedures related to public notice and will encourage this change; the department has already consolidated responsibilities regarding Pennsylvania Bulletin notices to be managed by the Policy Office. 33. Comment: Once a public hearing has been scheduled, there should be guidance to the host community on the expected role of the community in outreach to the public. (2) Response: The department appreciates this suggestion and is in the process of developing additional outreach materials and resources for local communities. 34. Comment: The department should allow for two separate comment periods so the public has the opportunity to comment on a company’s application and DEP’s analysis of the application (8, 9, 17, 21, 24, 28, 33 – 270) Response: Opening the comment period after the proposed permit has been submitted allows potential commentators the greatest opportunity to focus their comments on the relevant issues, legal standards, and factual information upon which the department’s decision will be based. In addition, the department maintains a Record of Decision document that becomes part of the application file and is available during a file review. 35. Comment: Notice of an open public comment period is often NOT published in a manner that actually reaches the public. In rural areas where communities span municipal boundaries and where newspaper service areas may be based on political boundaries, notices placed in one newspaper may not reach all landowners. Advertising the scheduling of a public meeting on the department’s website is not an effective method of notifying the public. In rural areas more than 30% of the population does not have computers or the Department’s website. (30) Response: The Pennsylvania Bulletin is the commonwealth’s official gazette for information and rulemaking. As such, it is the most authoritative source for notice of open public comment periods. It is available online at www.pabulletin.com and print subscriptions are also available. In addition to bulleting publication, the department will provide notices in local media, the department’s website, and other methods as necessary. The department is also committed to improving local outreach efforts to supplement official notifications. In addition to advertising notices of public meetings in local media, the department’s website, and other methods as 012-0900-003(CR) / March 1, 2014 / Page 85 required, the department is also committed to improving local outreach efforts to supplement official notifications. 36. Comment: The commentator supports the use of the Pennsylvania Bulletin and additional forums or venues; the greater the opportunity for public participation in decision making, the better and more protective will be the decisions made by the Department. The commentator also supports the continued use of both electronic and written comments so that more people can take part. (31) Response: The department appreciates the supportive comments. 37. Comment: There needs to be a double check that hearing locations are properly advertised (23) Response: The department agrees and will continue to check such information. 38. Comment: The commentator requests publication of notices in advance of the comment period as the typical 30-day period is insufficient to research and respond (13) Response: The department recognizes that, in some cases, a longer public comment period is appropriate. For certain permits, existing regulations require 60 day comment periods and, even when not required, the department may consider extending public comment periods on a caseby-case basis. 39. Comment: The commentator requests posting of such notices should be required at all "involved" Municipality buildings and should be advertised in local newspapers at least twice if not more during the notification period. (15) Response: Consistent with current practice, such notification will be provided when required by statute or regulation or, on a case-by-case basis when the department determines it is appropriate. Going forward, the department will be working with its local government liaisons to enhance municipal outreach. 40. Comment: The commentator recommends that hearings are always preceded by a meeting rather than a stand-alone hearing. Alternatively, where that is not possible, an informational fact sheet with perhaps even a reference to an available webinar that the public can refer to and then have a period in which to submit comments two to three weeks subsequent to the hearing date would be a much valuable tool to the public in lieu of a preceding informational meeting. (19, 23) Response: While it is not always possible to schedule an informational meeting for every action, the department has been expanding the use of such meetings, fact sheets, and webinars related to permitting actions. In addition, the department strives to provide at least two weeks after a public hearing to allow the public to develop and submit comments on a project. 41. Comment: The Policy should include that PA DEP should always clarify if a meeting it is holding is a “formal” public hearing or simply an informal “Public Information Meeting” and all PA DEP offices should use consistent terminology when referring to meetings to ensure the public knows which of their comments will be “on the record.” (8) 012-0900-003(CR) / March 1, 2014 / Page 86 Response: The department agrees with this comment. The purposes of revising this policy include clarifying what different types of meetings exist and to standardize terminology. 42. Comment: The importance of public exchange has been rendered null by the Department setting up tables in corners of a room and only allowing people to present their questions to the Department. The answers are only heard by the individual posing the question. (30) Response: While the set-up the commentator mentions can often be that of an informal meeting, public meetings and public hearings are not organized in the same manner and all individuals attending will be able to hear the questions and answers being posed and in the case of public hearings, the oral testimony being provided. IV.A: Written/Electronic Comments in Response to a Pennsylvania Bulletin Notice 43. Comment: The commentator recommends that this policy reflect a change in how the Department counts the days in a comment period. One of the most constraining factors for the public is when a comment period includes legal or religious holidays. The Department should extend the comment period for these days. The Department should also not count weekends as calendar days in the comment period. (31) Response: While the department understands this issue, it presents comment periods in calendar days to be consistent with statutory and regulatory language. To change the method of calculation in this policy would cause undue confusion. The department frequently extends public comment periods so they do not end on a weekend or holiday and may grant requests to re-open or extend comment periods to ensure the public has ample ability to participate. 44. Comment: A 30-day comment period is too brief. The commentator recommends that no comment period is less than 45 days. (19, 23) Response: Depending on the permit, the department currently uses 30, 45, or 60days as the minimum length for public comment periods. These timeframes are often set by statute or regulation; however, the department may also extend a public comment period where appropriate. While the Pennsylvania Bulletin is the official source where all public comment periods are announced, the department also provides the eNotice service where users can subscribe to receive email notifications of permits in their area. 45. Comment: The commentator commends the department for the ease of submission of public comments through an easy email method. Federal government agencies offer very complex and frustrating methods of submission. We offer kudos to the Department for not only encouraging, but also, for enabling public participation through such an easy email method. (23) Response: The department appreciates the positive comment. 012-0900-003(CR) / March 1, 2014 / Page 87 IV.B: Public Hearings 46. Comment: In reference to “written request of the community where significant local interest in the pending application is demonstrated to the Department.” Commentators ask whether the request can come from an individual resident speaking on behalf of his/her community, to which Division of the Department the request should be submitted, and how (email or surface mail). (5, 31) Response: Each bulletin notice formally opening a proposal for public comment will include the name and contact information of a department representative to whom requests should be sent. The department receives many requests for public hearings and/or meetings from individuals on behalf of others, including, but not limited to, communities and groups. When submitting a request on behalf of others, the request should clearly indicate the group(s), community/communities and/or individuals being represented. 47. Comment: The commentator recognizes that the focus of a public hearing is for the department to receive testimony, but suggest that an opportunity be provided for the public to speak with regulators about their questions and concerns. (23) Response: To address this issue, the department often schedules public meetings prior to the more formal public hearings. In addition to program staff at meetings, typically a Community Relations Coordinator, a Local Government Liaison and/or an Environmental Advocate will attend the meeting and can assist with concerns. 48. Comment: In Section IV.B on page 3, the DEP states that a written request for a public hearing should be received by the DEP prior to the close of the official public comment period or early in the public comment period in order to facilitate an efficient public participation process. In addition, the DEP states that it may extend the public comment period to accommodate the public hearing. The Commentator recommends that the DEP only accept written requests for public hearings in the first half of the public comment period in order to accommodate these hearings within the assigned public comment period. (32) Response: While the department encourages requests to be submitted as soon as possible, all comments received during a public comment period—including requests for public hearings— will be considered. In cases where a request for a public hearing is received later in the comment period is granted, the comment period may be extended to accommodate the hearing. 49. Comment: The commentator supports the Department’s willingness to schedule public hearings at the request of affected communities and to accommodate the public comment received in those hearings, above and beyond the statutory and regulatory requirements for such activity. To ensure that communities are able to avail themselves of this opportunity, it is important that a DEP point of contact for each application be identified in all notices and announcements. (2) Response: Although the contents of specific Pennsylvania Bulletin notices is beyond the scope of this policy, the department is reviewing its publication practices and will seek to ensure contact information is made available. 012-0900-003(CR) / March 1, 2014 / Page 88 50. Comment: Section IV states that the Department will extend the duration of the public comment period to accommodate the public hearing and "any additional time" required by statue or regulation. This should be a minimum of two weeks after the hearing to allow additional comments. (5) Response: The department recognizes this comment and will consider the appropriate time for an extension on a case-by-case basis. Timing and Location of a Public Hearing 51. Comment: Commentators support meetings being held in the location of the proposed permitted activity. (8, 30, 245 – 270, 477 – 1,803) Response: The department appreciates the supportive comments. 52. Comment: Commentators express concern that meetings are often conducted during the day when most people are at work. (8, 14, 30) Response: The department recognizes this issue. While it is not always possible to schedule meetings at a time convenient for all interested parties, the department will continue to work to improve the public’s ability to participate. 53. Comment: The commentator agrees that hearings on a pending permit where practical occur during the duration of the formal comment period on the pending application. They must not be so late in the process however, that only a few days are remaining to submit comment. The public does need adequate time to prepare and submit their comment. (23) Response: The department appreciates the supportive comment, and agrees that time after the hearing is beneficial to allow submission of comments; the department strives to allow at least two weeks after the hearing and before the end of the public comment period for this purpose. 54. Comment: Public hearings should not occur during the initial 30-day comment period, but should occur only after a comment period is over (if substantial interest has been shown). (9, 21, 24, 28, 33 – 244, 271 – 494). Response: Because the department accepts written testimony at public hearings, it is appropriate to conduct such hearings during the public comment period. In situations where necessary material is unavailable for review by the public, the department will consider extending the comment period on a case-by-case basis. 55. Comment: The commentator supports Public Hearings on permit applications during the formal comment period on all permits that have the potential, individually or cumulatively, to impact communities and the environment. The commentator further supports the Department’s proposal to extend the public comment period if a hearing is granted at the end of a formal comment period, and the proposal that oral comments be given equal weight to written ones, since many individuals choose only to participate in this way. However, the commentator recommends that the policy specify that public hearings will be recorded and that oral testimony will become part of the Comment and Response Document. (31) 012-0900-003(CR) / March 1, 2014 / Page 89 Response: The Department agrees. The requested provisions appear in section IV.B. of the draft policy and will be retained in the final version. 56. Comment: Regarding the postponement of a public hearing, it is very important that attention be paid to conditions in the area where a hearing is to be held. For instance, if local weather is inclement or if there is another local event that could interfere with public participation, a hearing should be postponed and rescheduled. The proposed policy should reflect that the Department’s goal is to maximize the opportunity for input at public hearings. (31) Response: The department agrees. This is addressed under Section IV(B) of the policy under the retitled “Notice of Scheduling or Cancellation of a Public Hearing,” which states that if the department postpones or cancels a public hearing, it will provide appropriate public notice of the postponement or cancellation as well as the rescheduling of the meeting. 57. Comment: The public hearing should be held at a location convenient to the community, where room is sufficient to accommodate a substantial audience, and sufficient time allowed for 5 minute presentations by members of the public. (9, 24) Response: The department attempts to schedule venues that best balance the needs of the event, including convenience of the location for the interested community. Those wishing to testify are encouraged to pre-register to allow for more effective planning. 58. Comment: The commentator supports the department’s proposal that public hearings should be held in the location most affected by a project that is convenient to the impacted community. However, the commentator recommends that these guidelines be inclusive in defining “local interest” by allowing requests to come from a community that will be directly impacted by a proposed project, even if it is not the exact geographic location for it. This is a critical consideration when several small but adjacent communities in rural areas (where much gas development, for example, occurs) inevitably share water and air quality impacts from largescale projects. (31) Response: The department agrees and interprets “local” to include the directly impacted communities near the source in question. This is not limited to the specific municipality where the source is located. Notice of Scheduling or Cancellation of a Public Hearing 59. Comment: The commentator recommends that, when scheduling public hearings, the facilities municipality be contacted to ensure there is no scheduling conflict and a letter be sent advising the municipality of the hearing. (23) Response: The department agrees that communication with municipalities is important; therefore, the department will be engaging it’s Local Government Liaison in a higher level of municipal notification regarding the permitting process. The department also recommends that interested municipal officials and/or staff register with the eNotice system and review the department’s Calendar of Events to be alerted about relevant actions in their area. Like any interested party, if a municipal representative is unable to present testimony because of a scheduling conflict, written testimony may be submitted during the comment period and will be given the same weight as oral testimony. 012-0900-003(CR) / March 1, 2014 / Page 90 60. Comment: The commentators do not agree that two weeks is enough time for notice of a hearing and suggests providing at least 30 days’ notice for a hearing or comment period the minimum necessary. (31, 15) Response: The two-week period identified in the policy represents a minimum standard, but the department will strive to provide additional notice where possible. Public Hearing Guidelines/Attachment B 61. Comment: The Policy should specify that although pre-registration for public hearings is a permissible PA DEP practice, PA DEP cannot require written notice of intent to speak in order to testify. (8) Response: The department does not require written notice to testify at a public hearing, but suggests the public should pre-register whenever possible. As Appendix B, indicates, those who pre-register are called to testify first followed by those who have signed in on-site as time allows. Because the department uses pre-registration information to reserve the venue, the department cannot guarantee there will be sufficient time for all those who signed in on-site to provide testimony. The department is reviewing its notice procedures to clarify written notice is not required and pre-registration by email or telephone is permissible. 62. Comment: The Department should formally require that regional offices take pre-registration for public hearings. Pre-registration not only allows speakers to more fully prepare for their testimony, but also assists the Department in planning the public hearing agenda. (24) Response: The department disagrees. Although pre-registration is encouraged, such a requirement could limit valuable testimony by only allowing those who have pre-registered to present comments. As Appendix B, indicates, those who pre-register are called to testify first followed by those who have signed in on-site as time allows. 63. Comment: Commenters recommend removing the requirement in number 10, which asks speakers to state their address before speaking. Speakers do not always feel comfortable stating their home address in front of large audiences, especially when speaking about a contentious issue such as natural gas. Speakers currently provide their address upon pre-registration, or when signing up to speak the night of the hearing; the transcriber can easily obtain a copy of the information already provided. (24) Response: Item number 10 has been revised to clarify that witnesses need not repeat contact information provided during pre-registration. 64. Comment: The commentator agrees with the guidelines in attachment B. (23) Response: The department appreciates the supportive comment. 65. Comment: The Department is commended for adding Appendix B relating to Public Hearing Guidelines. The simple instructions provided should prove helpful to Department staff as they plan and conduct hearings. It is recommended that item #9 be reworked to offer a less authoritative tone by revising it to read “To aid in accurately transcribing the hearing, it is 012-0900-003(CR) / March 1, 2014 / Page 91 important that attendees remain quiet when others are presenting testimony.” (7) Response: The department agrees and has revised Appendix B. 66. Comment: The Policy should clarify that public hearings should not involve speakers addressing a stenographer only—speakers should be able to address the entire audience at once if desired. (8) Response: The department will, to the greatest extent practicable, configure hearing venues to allow those providing testimony to adequately address both representatives of the department and the audience. 67. Comment: The policy states that “Organizations are requested to designate one witness to present testimony on its behalf”. Many participants wish to identify themselves as a member of an organization but are not speaking for that organization, they are speaking for themselves and their family, but also want to be identified with a group. (29) Response: This guideline only applies to comments made on behalf of an organization and has been included to encourage efficiency and to ensure a greater number of attendees have an opportunity to present testimony. Individuals wishing to testify on their own behalf but list any group or organization affiliation(s) are welcome to do so. 68. Comment: The Department should change this public participation policy to allow residents the possibility to speak up to 10 minutes during public testimony if the timing permits. Commenters suggest establishing the time limit for each speaker to be “not less than 5 minutes, but not more than 10 minutes.” (24) Response: The guideline that limits testimony to five minutes was selected to provide adequate time for an individual to present comments while maximizing the number of speakers that can be accommodated. Witnesses who wish to do so are encouraged to supplement their testimony with written comments. 69. Comment: The commentator requests that all public hearing or meeting facilitators be appropriately trained in meeting facilitation so that they can move the hearing forward in an efficient yet respectful manner. (24) Response: The department agrees and will continue to conduct appropriate training. 70. Comment: Commentators agree that visual aides are helpful for residents to use in certain situations and urge the Department to allow relevant photos and videos to be enumerated in the policy as acceptable props that can be used during testimony and included in the official comment record. (24) Response: The purpose of a public hearing is to receive testimony related to a proposed project. While limited use of relevant visual aids that can be reasonably included in the written record is permitted, the use of videos or the submission of other physical evidence is not appropriate and will not be accepted. 012-0900-003(CR) / March 1, 2014 / Page 92 Transcripts from Public Hearings 71. Comment: Commentators suggest that transcripts of public hearings be posted online on the Department website or otherwise publically available for free. (24, 26, 31) Response: The department agrees and has adjusted its contracts with private companies to allow the department access to transcripts for posting online. 72. Comment: In the current Policy on Public Participation dated July 16, 2005, it is affirmatively stated that the transcript of a Public Hearing “should be provided to the Department within 21 days of the hearing.” This is not stated in the proposed policy and should be inserted. Timeliness of the availability of the transcript is important so that the public can obtain a copy to review before a Comment and Response document is issued by the Department. (31) Response: While the department would prefer to have transcripts as quickly as possible to not unnecessarily delay the decision making process, the availability of transcripts is often controlled by contractual requirements with the private companies who prepare them in addition to other factors. However, the department has adjusted the language to provide an approximate timeline for availability of three (3) weeks after the hearing is held, depending on the length and complexity of the subject matter 73. Comment: B. Public Hearings Transcripts from Public Hearings - The section should be amended to require the placement of said transcripts at the local library which contains the project specific information. (6) Response: Contractual requirements with the private companies who prepare the transcripts of public hearings often prevent the department from distributing copies as suggested. The department is working to revise existing contract language to allow for a wider distribution of transcripts. Transcripts will also become part of the official record and be available for review at the appropriate regional office. 74. Comment: Under Transcripts from Public Hearings, there is no time deadline given for the Department's receipt of the official transcript. Given that oral statements are given the same weight as written statements, it is hard to understand how effectively the Department can offer an official response to oral comments before making its decision on the application. A deadline should be specified. (5) Response: The time required to receive a transcript is dependent on the contractual agreement between the department and the agency preparing the transcript as well as the length and complexity of the testimony. However, the department has adjusted its contracts with the company preparing the transcripts and has amended the policy to include an approximate timeline for availability of three (3) weeks after the date of the hearing. In addition, the department considers all comments (both oral and written) received during the public comment period and addresses them in the Comment-Response Document prior to making its decision on the associated application. 012-0900-003(CR) / March 1, 2014 / Page 93 Web-based Public Hearings 75. Comment: Comments on web- or teleconference- based public participation include: only using them for educational purposes, using them for meetings and conferences but only holding in-person hearings, and supporting their use for all purposes. Commentators uniformly express concern for how such meetings will be conducted and what provisions will be made for those with limited connectivity. (5, 6, 9, 13, 14, 17, 19, 20, 21, 23, 24, 35, 28, 33 – 244, 271 – 494) Response: While web- or teleconference-based public meetings or hearings would be more convenient for many people and would allow the department to efficiently conduct more hearings and meetings, the department is aware that there are some situations where there are no substitutes for in-person hearings or meetings. The department is also aware that there are those who have limited access to the necessary technology. If the department chooses to offer web- or teleconference-based services, it will consider these issues and take steps to ensure all interested parties have a reasonable opportunity to participate. IV.C: Public Information Meetings 76. Comment: Regarding public meetings, the commentator prefers required attendance and participation by the applicant. (23) Response: While the department encourages participation by the applicant, the requested change could only be made by statute and/or regulation and is, therefore, beyond the scope of this policy. 77. Comment: The commentator discourages the provision for the applicant to hold its own public information meetings lacking regulator presence. While the operator is able to disseminate a great deal of information in such a forum, it does not take much more effort to include the regulator. Folks need to hear from the regulator and gain answers to concerns they may have. Lacking regulator presence provides an avenue for misunderstandings of what is permissible according to the regulations and what regulations exactly are in effect. (23) Response: The department encourages applicants to engage the community in which their project is planned. Should the applicant choose to hold their own public meeting(s), the department also encourages applicants to invite appropriate department staff. While the department lacks the authority to require its staff be invited, the public can address any questions or concerns to the department separately if needed. 78. Comment: The commentator recommends that Section IV, Part C, Paragraph 1 be edited to indicate that public information meetings may take place “at the department’s and/or applicant’s discretion.” (26) Response: Paragraph 1 discusses specific public notification requirements that the department will implement as a matter of policy when public information meetings are held at the department’s discretion. While Paragraph 3 states that the applicant can hold meetings of their own, applicants should refer to the applicable statute and/or regulation for specific requirements concerning public notice requirements for their application. 012-0900-003(CR) / March 1, 2014 / Page 94 79. Comment: The Commentator asks why comments at public information meetings do not become part of the record. (26) Response: The purpose of a public information meeting is to provide information and foster a dialog about a proposed project. Such meetings also provide an opportunity for potential commentators to ask questions while they are formulating their official comments. The formality of recording and transcribing the comments and questions during a public information meeting would discourage the open dialog that the department wishes to achieve. Should participants want to have their comments or questions included in the record, they may submit them as testimony during a public hearing and/or as written comments. 80. Comment: The commentator supports Public Information meetings and agrees that such meetings shouldn’t be substituted for a public hearing. The Commentator recommends that that these information sessions will always include a question-and-answer component. The Department should avail itself of all resources available to design and hold a productive public information meeting, including the Department’s Environmental Advocate for the region involved. (31) Response: The department has revised the policy to include a reference to the question-andanswer component and participation of the Office of the Environmental Advocate, Community Relations Coordinators, Local Government Liaisons, and other appropriate staff. 81. Comment: Pennsylvania has led the nation in utilizing the public information meeting format to communicate about projects to communities. The section states that such meetings would occur at the Department's discretion. The commentator would suggest that an applicant desirous of such a meeting should also be given that discretion. There are very specific meeting notice provisions; the commentator would suggest that following the word 'will' on line 4 that the word 'generally' be placed to enable more fluid decision making with regard to such meetings. (6) Response: While the department recognizes the applicant and other organizations may choose to hold public meetings, the guidance in this policy is only applicable to meetings conducted by the department. IV.D: Informal Meetings 82. Comment: The commentator requests the language in section IV.D. of the document be restored to the version in the prior document where it explicitly stated the department would act as an advocate for protecting human health and the environment. (29) Response: Section IV.D. of the prior version of the policy applied specifically to the department’s role at hearings, public meetings and informal meetings. That section was replaced with Section V. of the current policy. In Section V, the department clarifies that in a venue that allows for public dialog, the department’s role is to communicate factual information. It further clarifies that the department is not to act as an advocate for or against the issuance of the permit. Taking an advocacy position at public meetings can discourage open dialog, and is inconsistent with the department’s goals for the public participation process. 83. Comment: All public comment should become part of the official record. Given the aforementioned format of the new “informal public conferences,” it is impossible for this to 012-0900-003(CR) / March 1, 2014 / Page 95 occur given much of the comment occurs off the record at the stations set up by the department, and comments are only recorded if someone wishes to articulate his or her concerns into the recorder device. Is the only way people will be able to ensure that their comments become part of the official record to send them directly to DEP? Is it necessary that they state they want their comments to become part of the official record? (30) Response: For public comments to become part of the official record and considered during the permit process they must be submitted in writing during the public comment period or presented as oral testimony during a public hearing. This is consistent with the procedure used for development of both regulations and non-regulatory guidance. Informal meetings may be held to address questions in a less formal environment. While information from such meetings is often helpful in developing formal comments, the content of the meeting does not become part of the official record. 84. Comment: Regarding Informal Meetings, the commentator suggests that the Department should give some criteria as to how it is determined who is invited, in the interest of transparency. (5) Response: The department agrees and has revised the guidance accordingly. 85. Comment: “Open House” formats are not a defined type of public meeting in Pennsylvania and the Department must cease substituting these unclear meetings for true public hearings. (8) Response: As this policy indicates, the department may use less formal types of meetings to foster dialog with the public, but those sessions are not used as a substitute for a public hearing. Open House formats are a type of informal meeting, for which the intent is to supplement the other avenues for providing input to the Department. 86. Comment: The commentator supports the concept of these conferences as a way for all types of stakeholders to voice their concerns and ask questions of Department staff, but recommends that the policy specify that the Department will respond to and consider all requests for informal conferences equally. This is necessary to avoid the perception or reality of undue influence over permit decisions by applicants and “back-room deals” being worked out directly with the Department, without negotiations ”seeing the light of day” and without the consideration of public input. This change is also necessary to be consistent with the statement in Section V of the proposed policy, which we fully support, that the Department’s role is “communicating to the public the factual information related to the project” and not to “act as an advocate for or against issuance of a permit.” (31) Response: While the department recognizes the concern raised by the commentator, resource considerations may make it necessary to prioritize certain requests over others. Accordingly, the department has revised the guidance to reflect that, while all requests for informal meetings are considered on a case-by-case basis, the department may give added weight to parties involved in or potentially impacted by the proposed project. 87. Comment: In Section IV.D., relating to Informal Meetings, it is not clear when meetings might occur in the review process. The existing Policy contains specific instructions on the meetings and the current wording should be retained. Also, even though the content of the meeting may not become part of the official record, there should be a provision added stating that a record of 012-0900-003(CR) / March 1, 2014 / Page 96 all informal conferences shall be made and retained in the project file, especially in those cases where the meeting is required by statute or regulation. In addition, if new information is developed during an Informal Meeting, it should be handled under the “New Information” process recommended previously. (7) Response: Because informal meetings are an important tool for public outreach and information, the procedural requirements for such meetings have intentionally been kept to a minimum. However, Section IV(D) states that informal meetings will be held when required by statute or regulation or at other times in the review process at the department’s discretion. Specifically and where possible, the department will schedule informal meetings in a timeframe that will allow participants to utilize information from the meeting to develop their official comments. If informal meeting(s) are held, the date(s) of the meeting(s) will be indicated on the cover page of the Comment-Response Document as indicated in Attachment A of the policy. 88. Comment: The commentator recommends there be a system by which residents know that they could request an Informal Conference. They are also helpful when folks are more interested in information than testifying at a hearing. Ideally, the Conference needs to be scheduled prior to the issuance of the permit. There needs to be adequate time for a requestor and others to submit an official comment if they so desire. In such cases involving a general permit, the conference ideally will occur prior to commencement of construction. (23, 29) Response: The policy has been revised to indicate such meetings can be requested by the public and the scheduling should be such that participants can use information from such meetings in the development of their official comments. No permit decision will be made prior to any scheduled public hearing, public meeting or informal meeting. 89. Comment: Informal public conferences were once held so that the community could meet and discuss the proposed application. Comments were recorded and included in the Comment and Response Documents. People were able to air their concerns to the Department and to their neighbors. In addition they were given a venue in which to provide information frequently absent from the application—locations where people have private water supplies; where businesses serve numerous people who rely on their private water supplies; and buildings missing from the permittee’s maps. (30) Response: The department continues to conduct public meetings but the policy clarifies that, in keeping with their informal nature, transcripts of these meetings are not made and comments do not become part of the official record. Public meetings are often followed by public hearings where the testimony is transcribed and comments do become part of the record. Any new information brought to the attention of the department, whether of a formal or informal nature, will be considered when making a permit decision. 90. Comment: The Department has changed the format of these public hearings, now choosing to hold “informal public conferences which seriously limits the opportunity for meaningful public participation. Community members are told they cannot speak publicly at these forums, although the permittee was given a significant portion of the time scheduled to present its plans for the future of their community. This hardly supports the Department’s commitment to the critical component of public input and participation. (30) 012-0900-003(CR) / March 1, 2014 / Page 97 Response: The policy clarifies the differences between formal public hearings and less formal meetings and the purposes of these different types of public forums. Section VI: Extension of Public Comment Period 91. Comment: When projects change sufficiently to warrant additional public review and comment, DEP should notify the affected municipalities and counties in addition to the individuals who previously provided comments on the initial permit application. (2) Response: Municipalities are encouraged to sign-up for eNotice alerts related to permitting activities in their communities. In addition, the department encourages its Local Government Liaisons to forward public notices to the affected municipalities in their area. In accordance with Section VI of the policy, when the public comment period is extended due significant changes to the project the department will publish appropriate notice of the extension in the same venues in which the original notice was published, and will notify all individuals who provided comments on the initial permit application. 92. Comment: Under Section VI relating to Republication to Afford Additional Public Participation, the commentator recommends that the Department retain the language found in the current Policy which states “the Department will consider whether it is appropriate or useful to afford an additional opportunity for public review and comment”, rather than revise the wording as proposed to the “Department may consider”. (7) Response: The department agrees and has included the requested language. 93. Comment: In reviewing the draft public participation policy, the commentator notices that some of the detail from the current policy (dated July 16, 2005) has not transferred to the draft policy. For instance, on page five of the draft policy, the section on republication indicates that when a project “changes substantially” during the review of the application, DEP may consider whether it is appropriate or useful to afford an additional opportunity for public review and comment. The same section on page 7 of the current policy contains specific criteria as to the meaning of “changes substantially,” such as a change of thirty percent or more in the size of the facility or activity, change in the location of the project or change in the environmental impact of the project, which are not in the draft policy. The commentator recommends that DEP retain these or similar criteria in the new policy. (1) Response: Based on experience, the department finds that the need for additional public comment is best decided on a case-by-case basis. Specific criteria were removed to avoid giving the false impression that the listed conditions represent either the minimum threshold to trigger additional comment opportunities or automatic triggers for such opportunities. Section VII: Comment-Response Document 94. Comment: The Comment Response document was once a valuable document, containing substantive information and being sent to the community as part of a give-and-take discussion. The last several the commentator has received came with issuance of the permit and included nothing that really answered the commentator’s questions or comments. (30) Response: Section VII of the current policy provides specific guidance to the department staff 012-0900-003(CR) / March 1, 2014 / Page 98 on the requirements for the Comment-Response Document. It is the department’s policy that all relevant questions and comments be addressed with appropriate answers. VII.A: Format of Comment-Response Document/Attachment A 95. Comment: The current policy notes that “appropriate steps will be taken during the review of an application to address concerns, and the review of relevant comments should occur during the application review rather than held until the end of the process” and that “if the Department does not address the relevant comment through the permit decision, Department staff will provide a reasonable explanation of the Department’s position” (page 4). On page 8, the policy further indicates that “if the Department does not agree with a comment, the document should say so and should provide a reason for rejecting the comment.” This level of consideration for comments with which the Department does not agree or does not address does not appear in the draft policy, but rather simply that a “substantive response” should be provided to each relevant comment (page 2). Under the Comment and Response section of the draft policy (page 6), the Department is required to indicate its agreement with comments and how those comments are addressed, but then notes that the Department may not agree with a comment without requiring an explanation for the disagreement as in the current policy. To encourage better understanding on all sides throughout the permit process, we would encourage DEP to carry over language requiring the Department to respond thoughtfully both to comments with which they agree and comments with which they do not agree. (1) Response: The department agrees and has revised the policy accordingly. 96. Comment: The proposed revisions to Section VII, subsection A. should prove helpful to those responsible for preparing a comment/response document. It includes instruction on what to do if the Department agrees with a comment, but is missing instruction if the Department disagrees with a comment. The commentator recommends that the following sentence, which is contained in Section III. General Policy of the current Policy, be retained in the proposed Policy and moved to Section V.A. Specifically, the sentence to be retained reads: If the Department does not address the relevant comment through the permit decision, Department staff will provide a reasonable explanation of the Department’s position. (7) Response: The department agrees and has revised the policy accordingly. 97. Comment: All documents cited or referred to in a Comment Response document must be made available to the public by publication on the Internet. This is unacceptable. By basing a reply to the commentator’s comment on information the “Department has recently received”, DEP responded to the commentator’s comment using private information. This should not be allowed. The instructions for preparing a Comment Response document must make clear that all information used as the basis for a response must be either contained in or attached to the Comment Response document or cited from public information. (29) Response: The department is currently pursuing initiatives that will allow electronic submission of permit applications and supporting documents. As these systems begin operation, the department may be able to expand the amount of information posted. While the department currently lacks the resources to publish every permit-related document it receives online, such documents are added to the relevant file and available to the public during a file review. 012-0900-003(CR) / March 1, 2014 / Page 99 98. Comment: The commentator supports the requirement that the Department responds to each relevant comment, including hearing comments, and that these responses are published in a Comment and Response Document or a Record of Decision. A public document that fully reports the public input and the agency’s response requires justification by the agency of its decisions and shows how the public input influenced the final outcome, lending validity to the process. The documentation of comments ensures much-needed agency transparency. Without it, the public is left in the dark regarding the basis for final permit decisions, the undue influence of project applicants on permit decisions may be reasonably suspected, and the very legitimacy of the agency’s work may be called into question. (31) Response: The department appreciates the supportive comments. 99. Comment: With respect to comments from public hearings and informal conferences, the commentator requests that a timeframe (such as 30-60 days) be required for DEP responses or actions. (32) Response: While the department wishes to avoid any unnecessary delays in its decision making, it is also committed to complete and thorough consideration of all public comments. Because of the potential volume and complexity of comments, the department cannot commit to a specific timeframe. 100. Comment: Attachment A FORMAT FOR COMMENT AND RESPONSE DOCUMENT is lacking several items required by Section VII.A. Format: (1) Public comment period dates; (2) Public hearing date(s), if any; and (3) Public Information Meeting/Informal Meeting date(s), if any. If these items are to be included on the cover page, per the policy document, they should be included on the sample document. (3) Response: The department agrees and has revised the policy accordingly. 101. Comment: The commentator requests that VII part A be edited to say “If the Department does not agree with a comment, the document should say so and should provide a reason or reason for rejecting the comment.” (26) Response: The department has revised the section in question to address this concern. VII.B: Public Availability of the Comment-Response Document 102. Comment: On page 6 of the draft policy, the comment and response document is required to be made available to the public at the time the Department renders a decision on the permit application, but on page 2 it is indicated that the Document may also be made available earlier in the process if appropriate. We recommend the language on page 6 be updated to include the “earlier if appropriate” designation for clarity and consistency. (1) Response: The department agrees and has made the requested change. 103. Comment: The commentator recommends that the comment and response document be provided via email (or made available online) to all participants who submitted comments. (20, 23) 012-0900-003(CR) / March 1, 2014 / Page 100 Response: It is the department’s policy that all commentators who have left appropriate contact information are to be notified of the Comment-Response Document’s availability. Because of technical limitations with bulk emailing of potentially large documents, the department will generally provide a link to the document rather than attach the document itself. 104. Comment: All Comment Response documents must be made available to the public by publication on the Internet. Issues brought up in Public Comment periods tend to recur in permit after permit. While a commenter on a specific permit will receive the Comment Response document on that permit, a commenter will not likely have access to Comment Response documents for earlier permits in which the same issue may have been raised. So while a commenter may be informed by a Comment Response document, the public in general is not. All Comment Response documents must be published on the Internet, and Policy should establish this as DEP’s requirement. (29) Response: The department agrees and is working to ensure all documents are posted appropriately. 105. Comment: It is imperative that a comment/response document is issued before or concurrent with the issuance of the permit. Numerous times Commenters have been notified of permit issuance in the Pennsylvania Bulletin prior to receipt of responses to significant comments. (24) Response: The department agrees and this provision is included in the policy. VII.C: Relation of Comment-Response Document to Other Department Policies Land Use 106. Comment: Several commentators point out inconsistent statements in the draft Policy regarding consideration of public comments, and request that comments from the public regarding land use issues during the public comment period be considered under this Policy. (1, 2, 3, 5, 31) Response: The department agrees with these comments and the Policy has been revised accordingly. 107. Comment: Decisions should be made primarily by those on the ground who fully understand our townships and boroughs, instead of unilateral decision-making by bureaucrats in Harrisburg or DC. Our local ordinances and local laws must be given their proper legal weight. (4) Response: The department believes that the concern described within this comment is addressed by this policy and the Policy for Consideration of Local Comprehensive Plans and Zoning Ordinances in DEP Review of Authorization for Facilities and Infrastructure (DEP ID: 012-0200-001). Section VIII: Additional Information 108. Comment: New Section VIII. Additional Information is a helpful addition to the Policy; however, the section does not contain enough instruction explaining the Permit Applicant Outreach Activities Checklist (0110-FM-CO0110) and how it should be used. Not until you 012-0900-003(CR) / March 1, 2014 / Page 101 track down the Checklist in the eLibrary is it clear that the Department intends for the Checklist to be completed by the applicant and submitted as part of the application package. It is not clear how DEP would consider the information provided on the Checklist. Also, it would be more convenient if the Checklist were offered as an appendix or attachment to the Policy rather than located elsewhere. (7) Response: The department has decided to rescind the “Permit Applicant Outreach Activities Checklist” in order to prevent confusion. It will no longer be available for use. The information contained in the checklist may be available in a Fact Sheet moving forward. General/Miscellaneous Comments 109. Comment: The commentator recommends that the Department expand its disclaimer that “the Department reserves the discretion to deviate from this policy” in order to spell out and clarify which circumstances would warrant deviation. (31) Response: The language in question is standard language used on all of the department’s policies and technical guidance documents. This language makes it clear that the documents do not create enforceable requirements. In addition, it would be impractical to describe how department staff may apply their discretion in the myriad of situations throughout the state, and under a variety of regulatory frameworks, when using the policy. 110. Comment: The commentator states the public participation process is perfunctory and that, if the applicant has followed procedures, the department has no will to deny a permit application, based on issues raised by neighbors property value, quality of life or potentially, family’s health. (29) Response: The department disagrees. Permit and other decisions are made using the applicable statutory and regulatory criteria. 111. Comment: The commentator states that, by removing Article 1, Section 27 of the Pennsylvania Constitution as an authority, the department is “attempting a kind of de facto, back door repeal” of the article. The commentator request it be restored as an authority. (29) Response: The department disagrees. Removing the reference to the constitutional provision does not affect the scope of the legal authority for this policy. 112. Comment: The commentator notes that the use of “significant local interest” is a subjective standard and recommends the policy provide more clarity. (3, 5, 23, 31, 32) Response: Based on experience, the department finds that the need for additional public comment is best decided on a case-by-case basis. Specific criteria were removed to avoid indicating that the listed conditions represent either the minimum threshold to trigger additional comment opportunities or automatic triggers for such opportunities. 113. Comment: The commentators state that the policy would not be applicable for general permits and permits by rule, particularly General Permit 5 (GP-5). The commentators urge the department to change the participation policy to allow public participation and to hold public information meetings regarding facilities using general permits, particularly when they are in 012-0900-003(CR) / March 1, 2014 / Page 102 close proximity to each other. (7, 9, 10, 11, 13, 14, 16, 21, 22, 24, 27, 28, 29, 31, 33 – 1,803) Response: The purpose of this policy is to provide a general guide to public participation in permitting and other approval processes. These comments address specific programs with their own regulatory requirements, which are beyond the scope of this policy. In addition, the Department has recently issued the general permits mentioned, during which extensive public comment was received and taken into consideration. Any questions about those permits and the associated processes should be directed to the applicable department program. See also Comment 18. 114. Comment: The commentator requests that, all determinations that a source of air pollution is a minor source (especially determinations of synthetic minor source) must be subject to Public Participation, further stating that the determination that specific “artificial” emissions limits establish a site as a synthetic minor source can only be done by examining the specifics of that site. (29) Response: As previously noted, the purpose of this Policy is to provide a general guide to public participation in permitting and other approval processes. These comments address specific programs with their own regulatory requirements, which are beyond the scope of this policy. Nevertheless, air contamination source permitting decisions are subject to the regulatory requirements under 25 Pa. Code Section 127.44 (relating to public notice). 115. Comment: Synthetic minor sources should not in any case be accepted as eligible for GP-5, and must be given full public participation. (29) Response: General permits are used when a specific class of sources can be regulated using standardized specifications and conditions. By issuing a general permit, the department indicates that it approves the activities authorized by the general permit, provided that the owner or operator of the source meets the requirements of the general permit. 116. Comment: The commentator states that public participation must be allowed on any Plan Approval application (general or otherwise) which seeks to establish federally enforceable emissions limits. DEP’s response to EPA’s comment that a permit under GP-5 would not be federally enforceable—due to lack of public participation—was to acknowledge that “the permit” is not federally enforceable but “the emissions limits” are. This ignores completely the determination that the claimed emissions limits apply to the particular facility covered in the application. To state that certain emissions limits (in the abstract) are “federally enforceable” while ignoring clear guidance from EPA that there must be public participation in the determination that these limits apply is unacceptable. DEP must allow public participation in all minor source determinations. (29) Response: When the department first proposes any general permit for an air contamination source a public comment period is provided as required under 25 Pa. Code Section 127.612. The department provided this public comment process when it initially developed GP-5. This comment period is to allow public participation in the development of the specific requirements contained within the general permit. The GP-5 amendments were finalized after a thorough public participation process. When a company wishes to use GP-5 it must demonstrate to the department that the engine (or 012-0900-003(CR) / March 1, 2014 / Page 103 engines) it wishes to install meets the requirements specified by GP-5. If it does, the department authorizes the company to use GP-5 and issues a notice to that effect in the Pennsylvania Bulletin. The public comment provisions under Section 127.612 are not applicable each time the department wants to authorize the use of GP-5. The public comment provisions are only applicable when the department first proposes or proposes revisions to the general permit. The department then finalizes the general permit for use by anyone who can comply with the specific provisions of the general permit. The standardized terms and conditions of GP-5 cannot be modified during the processing of the authorization to use GP-5. Both the Air Pollution Control Act and the implementing regulations require the department to issue authorizations to use the general permits within 30 days of receipt of an application. The Pennsylvania regulations that establish the use of general permits were approved by U.S. EPA and the company must follow the procedures set forth in the regulations. 117. Comment: Individual MS4 Permits, required for all regulated small MS4s that discharge into HQ or EV waters, are subject to public participation requirements. Regulated small MS4s that discharge into HQ or EV waters subject to wasteload allocations in approved TMDLs must prepare an MS4 TMDL Plan for DEP approval. It is the commentator’s understanding that the process for obtaining DEP approval for MS4 TMDL Plans, as part of Individual Permits submitted for MS4s discharging into HQ/EV waters with approved TMDLs, will be done in two phases: (1) an MS4 TMDL Strategy, submitted with NOIs; and (2) MS4 Design Details, which will be submitted for DEP review no later than one-year following DEP’s issuance of the Individual MS4 Permit. Public participation should be facilitated to allow review and comment of the content submitted within the second of this two-phased approval process for MS4 TMDL Plans. However, it is unclear how that would be facilitated as the draft policy is currently written. (3) Response: Public participation of MS4 TMDL plans will be provided consistent with the permitting requirements; however, discussion of procedures for a specific permit type is beyond the scope of this policy. 118. Comment: All permits should be part of the public review process with opportunity for written and oral comments and with 30 days’ notice. (9) Response: Different application types may be subject to varying public participation requirements by statute or regulation. The department will follow all applicable public participation requirements set forth in statute and regulation, and to the extent that anything in this policy conflicts with a legal requirement, the legal requirement governs. This policy builds upon the existing requirements and provides a consistent framework for required public participation activities. 119. Comment: The commentators urge the department to put all permit applications, technical review documents, and any other associated documents or maps online for free public access and in a timely manner to allow for well-informed comments. (8, 9, 11, 13, 14, 16, 17, 20, 21, 24, 25, 27, 28, 29, 33 – 270 ) 012-0900-003(CR) / March 1, 2014 / Page 104 Response: The department recognizes the value of posting these documents online and is currently developing systems that will allow electronic submission of permit information. The ability to receive data in electronic format may allow for such posting and is one of the key benefits of electronic permitting projects currently underway. 120. Comment: The commentators stress the importance of ensuring timely access to permit files. (8, 9, 20, 21, 24, 28, 33 – 270 , 477 – 1,803) Response: The department agrees with this comment and has worked to improve streamlining the informal file review procedures. 121. Comment: PA DEP decisions to deem permit applications “administratively complete” before relevant technical data is submitted deprives the public of the opportunity to submit accurate public comments and must be prohibited. (8) Response: An administratively incomplete application is not generally considered to be an application, because some of the most basic elements are missing. Additionally, an application will not be deemed “administratively complete” if it does not include all necessary documents and information that is sufficiently detailed to perform a Technical Review. 122. Comment: When the permittee is required to make significant alterations to their application after the public meeting/conference/hearing, another public notice should be required and another public meeting/conference/hearing should be required (5, 30, 31) Response: There may be circumstances where additional public comment on a revised project is needed but that doesn’t always mean an additional public meeting/conference/hearing is necessary. The department will use its discretion when it determines whether additional public meetings/conferences/hearings are necessary. The department has included guidelines for extension of a public comment period in Section VI of the policy. 123. Comment: A longer public comment period will also help to address the difficulty that members of the public may have in accessing Department files in a timely manner when preparing comment. The current situation is that Department offices regularly do not make files available for public review within two weeks and that gaining access through a file review or Right to Know request can take a large portion of the typical 30 day comment period on a permit. This leaves commenters at a disadvantage in preparing substantive comments by the deadline. If the Department expects informed public comment, then the Department must improve its public information program to allow citizens to review file information in a timelier manner and to routinely provide more information on the Department’s website. (31) Response: The department recognizes this concern and is working to improve access to necessary information. Should there continue to be difficulties, the department may consider extending public comment periods on a case-by-case basis. 124. Comment: As a companion piece to this Policy, the Department should develop a simple easyto-understand brochure designed to inform the public how and when they can be part of the permit process, the resources available to them, and the key times for input. It is especially important to clearly articulate in the brochure the Department’s authority to require changes to a 012-0900-003(CR) / March 1, 2014 / Page 105 project, or lack of authority to deny a permit if it meets all regulatory requirements. It is misleading for the Department to seek public comment if those comments would have no impact or standing in the permit review. Perhaps this brochure could be launched as part of training the Department provides to assist DEP employees in communicating with the public or as a separate information webinar. Council is available to assist in developing the brochure. (7) Response: The department appreciates this suggestion and is in the process of expanding available web and print resources related to public participation. 125. Comment: The commentator emphasizes that it is key to involve neutral facilitators in the public participation process for controversial permits if the Department is going to achieve robust public participation that helps the agency to arrive at a sound decision on a permit or project. The commentator requests that the Department include trained mediators that specialize in this kind of work since the Department no longer is involving the Center for Collaboration and Environmental Dispute Resolution. Environmental Dispute Resolution is a well-developed field that is involved in many areas of regulation and permitting, such as at the federal regulatory level. The commentator advocates that the Department contract an independent professional (not from within PADEP) with this specific training to help design and implement the public participation and public hearing process for controversial permits. (12) Response: The department recognizes the value of trained facilitators in dispute resolution and maintains a dispute resolution and mediation functions.
