Data from the UK has continued to confirm that the economy is getting stronger and in response, speculation that interest rates will rise much sooner than the Bank of England suggest has also increased. This has caused the Pound to surge upwards which is fantastic news for any of you needing to transfer Sterling into another currency for your property investments. also recently indicated that interest rates in Those of you purchasing property in Europe will be interested to know that the Pound has pushed up to a mid-market rate of 1.194 against the Euro. This is in response to weak data from Europe last week such as poor figures in industrial production. The European Central Bank now believe will happen as early as 2014. This included growing output from the construction sector and another drop in unemployment. France and Spain top UK homebuyers’ list Spanish Central Bank Sees End Of Recession SPAIN is considering moving into another time-zone – that of the UK, Canary Islands and Portugal – and adopting a more European system of working hours in a radical shake-up of the country’s traditional way of life. France and Spain remain the top choice of UK investors despite falling property prices, says a leading overseas mortgage provider who had a 62% increase in mortgage inquiries in August, making it the busiest month of the year so far. France is top choice for prospective buyers so far during 2013 with 43% of enquiries, down 2% on July, followed by Spain with 36%, up 3% on the previous month and Turkey on 10%, Portugal on 8% and Italy on 5%. A number of factors are involved in rising Spanish numbers. “Tourism is booming, access is easy and the culture is familiar, but it’s also becoming more affordable – mortgage rates are very low, the pound is getting stronger and prices are at rock bottom. People who have been putting their Freedom for Sale 4 plans to buy on hold for the last year or so are taking advantage of the favourable conditions open to them, and deciding to go for it in case they miss out on the best deals. Efforts being made by regional estate agents and tourism boards to improve Spain’s tarnished image are leading to high hopes that increased foreign investment will eventually help to revive the country’s property market. For many people buying property in Spain, it’s a lifestyle choice, and they’re attracted by the climate, amenities and culture, rather than earning a prospective fortune on their home. Buyers are planning to invest over the long term, which is a very sensible attitude. Experts claim residents in Spain are living in ‘a permanent state of jet lag’ because of their clocks being an hour ahead of the time which would normally correspond with the country’s latitude – and they say the long lunch hour and late evening finish is responsible for low productivity and poor family life. Back in 1942, the dictator General Franco, moved the clocks forward to coincide with Central European Time (CET, or CEST in summer) so that Spain and Germany were on the same time-lag. This means that whilst the sun is in its most central position at noon, in Spain it is so at 13.00hrs, or 14.00hrs in summer when the clocks are moved forward. It also means instead of eating lunch and dinner at 13.00hrs and 20.00hrs, as the rest of Europe and most of the world appear to do, Spaniards start lunch between 14.00hrs and 15.00hrs, and start eating dinner at either 21.00hrs or 22.00hrs www.freedom4sale.com [PROPERTY NEWS] Spanish Tourist Sector - Historic Year Spain passes “golden visa’” legislation One area of the flagging Spanish economy that continues to motor along is tourism, with the country attracting both record overseas visitors in August as well as overnight stays in hotels. Record numbers of overseas visitors flocked to Spain in August, while average spending also increased. Spanish Congress has passed its so-called “Golden visa” legislation to allow non-EU nationals to get qualified Spanish residency and Schengen-area access. As a tourist destination, Spain has benefitted from wariness about rival markets such Spanish Central Bank Sees End Of Recession as Turkey, where political tensions prevail, and Egypt, which is experiencing a spiral of street violence. In the first eight months of the year, 42.3 million foreigners visited Spain, an increase of 4.5 percent over the same period a year earlier. The biggest rise was posted by Russian visitors, whose numbers in the January-August period rose by 30.1 percent. Electricity Rise Again In October The law which was approved by the Senate last week has now passed through Spanish Congress and is set to become law as soon as it is published it the official gazette (BOE) in the next few days. Non-EU nationals will need to purchase a property worth 500,000 or more to gain residency which will also be extended to their spouse and children. The threshold is significantly higher than an initial proposal in 2012 which put the figures at just 160,000. The new law is good news for agents and developers looking to find buyers in China and Russia, which are the two biggest non-European markets for property in Spain. Spain’s residency visa law put the country on par with Portugal but behind Cyprus (300,000) and Greece (250,000). Spain’s job-crushing, two-year recession appears to be drawing to a close, the country’s central bank said in September, predicting an end to the downturn in the third quarter of 2013. The country’s rapid economic descent, which sent the jobless rate soaring to 26.26 %, has been easing up since the start of the year, the Bank of Spain said in a monthly report. “Available data, still partial and incomplete, would be coherent with a stabilisation or even a slight increase in output in the July-September period,” it said. The report was the latest sign of greater official optimism about Spain’s economy, the fourth-largest in the euro zone. By the end of 2013, households will be paying 4% more for their electricity than back in January. It’s hardly surprising that the new legislation has bought out the cowboys. What is surprising to the professionals is how fast the illegal marketing has occurred. “A general reduction of prices is not bad in itself,” says Fidel Perez Montes, Director of Diversificación y Ahorro de la Energía, IDAE, “the problem is whether this reduction is accompanied by suspicious practices.” For example, the Colegio de Aparejadores de Madrid has discovered advertisers that guarantee the highest rating (A), “something that turns the certificate in to a mere triviality when the initiative is crucial if we want to reduce CO² emissions to achieve more energy efficient homes and buildings,” says Jesús Paños, President of the college. Another malpractice is to offer the certificate without visiting the premises “This is not acceptable in anyway,” says Jose Antonio Galdón, President of the General Council of Industrial Engineering of Spain, who explains “the Royal Decree requires a skilled and authorized professional to survey the property.” Further concerns are about the cost of the certificate compared to the prices in the UK. Energy Performance Certificates were introduced in England and Wales in 2007 as part of the Home Information Packs (HIPs) for domestic properties. When the requirement for HIPs was removed in May 2010, the requirement for EPCs continued and this created a price war between assessors gunning for work. Some of those same assessors are offering their services here, which they are not legally authorised to do. An EEC must be issued by an architect, engineer, or a qualified technician who is authorised to undertake building projects and thermal installations for buildings (this is important because not all architects and engineers are Freedom for Sale 22 certified). They must belong to an official provincial association (colegio oficial) and have a member number. This allows them to offer their services professionally. If the assessor is not authorised then it will be impossible to register the certificate. A happy and successful purchase will depend in part on the companies and professionals you choose to deal with, so this is not a trivial matter Estate agents Most overseas buyers will work with one or more estate agents when buying property in Spain (whilst the Spanish, especially in rural areas, are more likely to use word of mouth). It is increasingly easy to avoid using estate agents, by for instance going direct to developers when buying on new developments, or contacting private vendors individually via websites that facilitate private transactions. Even so the majority of British people end up using estate agents as these can provide a valuable service if they are ethical, competent and professional. The problem is that there are estate agents that fail to meet these conditions, and dealing with unethical or incompetent estate agents can expose buyers to considerable risks. In the past, membership of one of Spain’s two professional real estate associations (API and GIPE) was as a legal requirement for anyone brokering property in Spain. This ensured that anyone legally selling property had the training and qualifications to do so. However in 2000 the Spanish government deregulated the market and, consequently, pretty much anyone can now play the role of intermediary in property transactions. Though it was often ignored the former arrangement did at least encourage companies and individuals wishing to broker property to undergo the professional training in Spanish necessary to become members of API or GIPE. Under the present arrangement many of the British people legally selling property in Spain don’t speak Spanish and don’t understand the conveyancing process in Spain. This undermines the service they provide, increasing the likelihood that buyers will suffer the consequences of dealing with incompetent estate agents. Another unfortunate reality of the Spanish property business, especially the foreign buyer segment, is that it has attracted people with a timeshare mentality of aggressive and unethical sales. This is no coincidence: as timeshare collapsed, freehold property sales in Spain boomed, and many of the people formerly Freedom for Sale 24 selling timeshare moved into property. All booms have a tendency to attract cowboys looking for easy money, but a business like Spanish property that is: 1) lightly regulated 2) unfamiliar ground for buyers and 3) very lucrative, will attract more than it’s fair share of hucksters. The value of estate agents A good agent can provide a valuable service to overseas buyers. Estate agents are the main property ‘channel’, which means they put buyers and sellers together. Without agents it is difficult and laborious for buyers to find properties, though the internet is challenging the old order and create new models that put buyers and sellers in touch. For the time being, though, agents are still the dominant channel for foreign buyers, and buyers go to them for access to a wide selection of properties from many vendors. Buyers can also benefit from the agent’s knowledge and experience of the local property market, as foreign buyers will usually know little about the market and the process by which property changes hands in Spain. Many of the people selling Spanish property to the British in recent years have been little more than teenagers. They are flown over from the UK by agents ( this happens more in mainland Spanish Costas than the Canaries), promised an easy fortune on a commission-only basis, and then unleashed on unwitting clients despite their total lack of understanding of Spain, Spanish, and the local property market. • Demonstrate real experience and knowledge of the local property market. When buying something as expensive as property you should expect help from an experienced sales representative who can demonstrate knowledge of the local area and property market. They should have lived in the area for at least 5 years. Look for agencies that are locally based in the area where you want to buy and that have a good selection of properties to offer. Avoid using agencies that aren’t locally based, as they may know less than you about the local property market. • Respond to your enquiries in a quick and professional manner. Many companies respond slowly or not at all to client enquiries. These companies are best avoided. • Make an effort to understand your needs and requirements from the outset. This means discussing your requirements in depth. • Help you to understand what the market has to offer and what you can realistically expect to buy given your budget and requirements. Unreasonable expectations benefit neither client nor agent. • Provide you with clear and useful property particulars or reports. • Show you a selection of suitable properties given your budget and requirements. Property ownership in Spain is deeply embedded in the national psyche. Some would even call it a national obsession (followed by football and not necessarily in the same order). Property ownership is widely viewed as ‘superior’ to renting almost as a social status all unto itself (!). Several popular well-known mantras upholding such (false) belief have endured over the boom years. But the receding tide of prosperity, induced by this recession, has exposed them for what they always were – false myths: Ley 4/2013, de 4 de junio, de medidas de flexibilización y fomento del mercado del alquiler de viviendas Ley 4/2013 is the law published in Spain’s Official Law Gazette on the 5th of June that heralds these changes. The official line is that it brings on a slew of novelties which will hopefully bring a breath of fresh air into a stale rental market. This new law significantly amends Spain’s all-important Tenancy Act (Ley 29/1994, de 24 de noviembre, de Arrendamientos Urbanos). Popularly known by its acronym ‘LAU’. However I speculate that the ‘real’ agenda being pushed by this law is another and I elaborate further in my conclusion below. In my opinion this is yet another patchwork law that attempts, for the umpteenth time, to do something about Spain’s chronically failing rental market – and most likely will fall flat on its face. 1. “Alquilar es tirar el dinero” which loosely translates as ‘renting is throwing away (good) money’ Major Highlights of Spain’s Amended Rental Law 2. Another good one is “nunca bajan” translated as ‘(house prices) never fall’ The exclusion of Spain’s Rental Act for touristic property lets. This is hands down the most significant change in my opinion made by this reform as it now purposefully leaves out what are known as ‘touristic tenancies’. The LAU used to rule on all tenancies (except those deemed as ‘luxury’ rentals). Touristic tenancies will now be ruled by Spain’s seventeen regional autonomous communities. To make it more complicated, not all autonomous regions have such laws implemented. Touristic rentals require a licence from the local administration. The matter is so complex that it easily merits its own article given the fact there are seventeen autonomous regions in Spain capable of enacting their own laws on the matter compounding it furthermore. Always making administrative matters easy. 3. and last is my all-time favourite: “siempre lo podrás vender” translated as ‘(don’t worry) you can always sell it’; yeah right! Spanish parents are obsessed with leaving their children property when they should really be concerned on gifting them a top-notch education allowing them a chance in life to win their spurs. Unsurprisingly, because of this historical national fixation for property ownership 83% of properties in Spain are inhabited by their owners as opposed to only 17% being rented out. Compare these (very) sad figures with a far more developed rental market in Europe which boast an average of 30 to 40% rental occupation. Moreover, all this money that is (foolishly) ploughed into property is a wasted opportunity cost that could be better put to use in the money markets investing in companies and start-ups, creating jobs and wealth, rather than saddling with debt legions of Spanish families who now face the grim prospect of a lifetime sentence in the form of a financial millstone around their necks for the remainder of their existence. A huge change of financial culture in Spain is urgently required in line with Protestant countries (historically more financial savvy) that can only be achieved through education from an early age at school. I venture that one positive outcome of this ‘recession’ will be that scores of Spanish will now be forced to rent as opposed to buying outright. The underlying historical reasons on this fascination are numerous and exceed the object of this article so I won’t digress. What matters is that the Government, with millions of properties standing empty and millions more of young – and not so young – workers unemployed, has finally smelled the coffee. They have been busy drafting a new law in an attempt to bolster and streamline an ailing rental market in the hope of making it more dynamic and robust. Freedom for Sale 30 • The legally mandatory five-year rental period for long-term rents is now reduced to a three-year period. • As a direct result of the above, deposits must now be reviewed after the three-year period has elapsed (as opposed to the former five-year period). • The tacit renewal is reduced from a three-year period down to one year. • A landlord may now recover the possession of the property after a year has elapsed under certain circumstances. Unlike before, this now does not have to be expressly worded into the contract. • The landlord may now sell the property and the new owner may terminate the existing tenancy agreement so long as it is not lodged at the Land Registry. Before this law, the new owner was forced to respect the existing mandatory tenancy until it ended. This is a very welcome measure indeed. So for all new contracts signed after the 5th of June 2013 it would be advisable for a tenant to have their tenancy agreement lodged at the Land Registry if they want some degree of protection against the owner selling the property and the new owner moving in and have them vacated. On lodging the tenancy agreement if the owners sells on the property, the new owner will be forced to respect the tenancy for the mandatory three-year period (used to be five years before this law). Tenants may now notify their landlords, at any moment, with only 30 days in advance of their will to terminate a tenancy provided they have already rented it for a six-month period. Before a tenant needed to wait until almost till the end of the tenancy or else face compensating the landlord for the lost rental if they decided to bail out ahead of time. Notwithstanding a suitable compensation can still be agreed. This is an advantage for tenants really, not for landlords, as it allows them more flexibility to terminate a tenancy. If in agreement, the let can now be forfeited for a set period of time so long as the repairs in the property are shouldered by the tenant. This must be mutually agreed. Both parties may now opt-out of the IPC, as the annual benchmark to increase a tenancy, and choose another index. IPC stands for ‘Índice de Precios al Consumidor’ which is a Consumer Price Index which is widely used in Spanish contracts as a benchmark to increase services in line with the annual rise of inflation. It can now be agreed by both parties that long-term tenants may waive their pre-emption and buyout rights (‘derecho de tanteo y retracto’) in a resale as is stipulated in section 25 of Spain’s Tenancy Act. Changes to Spain’s all-important Civil Jurisdiction Law, (1/2000 – LEC) to further streamline the eviction procedure. Non-paying tenants will now be given only a ten-day deadline to bring arrears up to speed. The more legal fat is stripped away, the more efficient and streamlined will the resulting eviction procedure turn out. This is frankly positive but hardly groundbreaking. Conclusion: more beating around the bush Although some of the above changes are indeed a positive step in the right direction, most are superficial. I remain largely sceptical of this new law because, once again, it doesn’t really address the main issues which historically hamper Spain’s rental market, and only beats around the bush. So why on earth bother to approve a law that seemingly won’t make much of a change in the rental market? The cynic in me can’t help but think that, brushing aside negligible cosmetic changes in the overall picture, the real agenda being pushed is that of the hotel industry. After a decade of booming construction, where thousands of new-build properties were bought en masse and let out to foreigners at large, the hotel industry has experienced massive losses as a result of all the unregulated competition from a myriad of humble property investors dotting the Spanish coastlines. This new law – quietly but relentlessly – effectively introduces a restriction to letting by private individuals, leaving it to autonomous regional communities to rule on the fine details of what a touristic licence actually entails. Which is why I place it as the first, and most significant, point on reviewing and listing above the amendments brought about to Spain’s Tenancy Act (LAU). One would have to ask oneself: who stands to benefit with this reform and whose interests are served by it? Certainly not the countless foreign small-time investors looking into buy-to-lets to make some money on the side to supplement their (meagre) income. Again an ill-conceived political measure that meddles in the economy that will prove to be counterproductive on the long-term as it will foreseeably deter would-be buyers who would have otherwise invested had they unrestricted freedom to rent. Talk about shooting oneself in the foot. Forcing home owners across Spain to ensure their properties comply with the same regulations already imposed on hotels (minimum quality standards, health and safety, kitchen appliances etc.) is daft and may be safely labelled as an unnecessary exercise of interventionist legislation aimed to thwart or restrict the sacred use of private property (in benefit of the hotel industry). In any case, let’s not rush ahead as the fine details will be ruled by the seventeen autonomous regions so we will just have to wait and see before judging in advance regional legislations. Few communities have already ruled on this i.e. the Balearics. Back on topic, to foster a robust rental market we’d be better off taking a bold stance and resolutely reworking the whole eviction system from the root rather than approve a string of half-hearted piecemeal laws which honestly will scarcely make a dent on matters. What would *really* kick-start the rental market in Spain would be chiefly: 1. Change the predominant Spanish mentality towards rental and ownership. Rental must stop being demonised by society at large and accepted as a perfectly valid option in life. 2. Have non-paying tenants evicted in less than ten days from a property instead of having to wait for months on end or even years to make it happen. A short to medium-term goal reworking the legal (procedural) system. These two measures would greatly help to nurture and consolidate a budding rental market in Spain. Granted, it wouldn’t happen overnight. It takes considerable time to change people’s mentality. Besides, there are far too many legal constraints and guarantees safeguarding non-paying tenants’ rights. What about the landlords I ask? Long eviction periods lead to tenants trashing properties, to landlords losing rental to offset their mortgage repayments (which in turn may even lead to a repossession of the rented property), besides unnecessarily increasing tenant eviction legal fees paid for by distressed landlords. This nonsense should clearly be put to an end. The rental sluggishness in Spain can largely be pinned down to landlords being afraid of renting out properties given how biased historically laws are in favour of (non-paying) tenants. This is the crux of the problem – fix it and you are half way there to pave the way to a robust rental market. It is Spain’s ruling political class who wield the power to alter matters if they willed it – but I guess they don’t have the backbone for change; too unpopular and ‘politically incorrect’ or maybe they are simply complacent with the current status quo. But hey, politicians and lawmakers, in general, are also entitled to make a (very) nice living by drafting and publishing flawed laws, such as this one, to justify their public stipends and perks whilst the rest of the country languishes bearing the brunt of an unending ‘recession’.
