A cattle theft operation
billed as the largest in the 132year history of the Texas and
Southwestern Cattle Raisers
Association was cleared and
the lawful owners of the animals either got them back or
received full restitution.
A total of 289 cattle worth
over $250,000 were stolen
over a period of nine months

The investigation began on a relatively small scale on September 16, 2005,
when Mike Vera, foreman of a ranch owned by Baseball Hall of Fame pitcher
Nolan Ryan, called the Brazoria County Sheriff's Office to report the theft of
15 calves and 15 cows.
Two weeks later Vera called again. Fifteen more calves had been stolen, he
said.
Then on November 8, E.R. Milstead reported to the Pearland Police
Department that someone had stolen 22 cows and nine calves.
The reports of cattle thefts kept coming in, involving a number of jurisdictions: December 11, Joe Dixon of Friendswood, 11 Brangus cows, a bull,
and three calves; December 19, Mr. Hindman of Manvel, two cows and 16
calves; January 3, 2006, Leon Washington, 50 cows and eight calves taken
from Harris County; January 23, 2006, James Badon of Alvin, 11 calves;
February 16, Pete Vacek, 14 cows, 11 calves and two bulls taken in Fort Bend
County; and February 21, 2006, Jorge Galvan, 12 calves and two cows taken
from Angleton.

Why Police Do What They Do
When They Pull You Over

M
any serious crimes have been solved as a result of a traffic stop or
chance encounter with a police officer: A vehicle is stopped for
running a red light and it is determined that the occupants just held
up a liquor store or burglarized a warehouse; a driver is pulled over because
of an equipment violation and, through questioning, the officer learns that the
other occupant in the vehicle is wanted on a felony warrant. The media use
these stories to show how stupid criminals are. What the stories really illustrate, however, is the importance of conducting effective roadside interviews
by police.
The officer conducting a roadside interview is in a unique position to develop incriminating information. Because the initial stop is for a traffic offense,
Miranda warnings are not required. Most of these stops are made when the
officer see a violation occur so the driver already knows that he or she has
been caught doing something wrong and this awareness makes it easier to
acknowledge other transgressions. Finally, the driver is and car occupants are
caught off guard without the opportunity to create a credible alibi or dispose
of incriminating evidence that may be in the vehicle.
While it might be tempting to grill every motorist pulled over for speeding
to find out if he has sexually molested any children or has a dead body in the
trunk of his car, there are moral and legal restrictions placed on expanding the
scope of roadside questions beyond the initial traffic violation. For example,
some states have ruled that, without reasonable suspicion, it is illegal to ask
a person pulled over for a traffic violation permission to search the trunk of
the car however that rule does not apply in Texas.
In many of these cases, officers cite "gut feelings" or "instincts" as causing
them to expand the scope of their questions beyond the initial traffic stop.
These officers have stopped hundreds of motorists and know what a normal
person’s behavioral response is under that circumstance. When a driver or
passenger in a car exhibits abnormal behavior, the officer may expand the

Thomas Johnson
Thomas Isaac Johnson, 29, while on a leisure
vacation from Montgomery, Illinois was driving
drunk in Galveston. Riding with him was Alejandro Garcia, 40, and Angela Lucia Garcia,
31, both from Galveston. The car rolled over
injuring Angela and killing Alejandro. Now
Johnson is charged with Intoxicated Manslaughter.

It must be remembered that people
stopped for traffic violations are, for
the most part, guilty of the offense for
which they were stopped (speeding,
equipment violation, failure to obey
a sign, etc.) and will certainly exhibit
symptoms of anxiety as a result of being
caught. In this sense, persons stopped
for a traffic violation are "guilty" of the
violation. However, they may exhibit
behavior symptoms of guilt or deception because of involvement in some
unrelated criminal activity or because
they lied to the police officer’s questions, e.g., "Where are you coming
from? Whose car is this?"
“Guilt" and "deception" describe people who are involved in something other
than the traffic violation for which they
were stopped. These are indications
that it may prompt the officer to expand
the scope of questioning beyond the
initial purpose for the stop.
During the initial contact with a police
officer, most drivers will experience
nervousness (hand tremor, eye blinking,
or dry mouth. A person may appear agitated and anxious because of a medical
emergency. However, extreme nervousness, or fearfulness that increases during the course of questioning may be an
indication of guilt to something beyond
the initial traffic violation. Symptoms
of extreme anxiety include excessive
physical movement (pacing, crossing,
uncrossing arms, constant hand movements) and mental blocks (inability to
recall simple information like an address
or an inappropriate response to a simple
question).
Persons with nothing to hide pull to
the side of the road when the officer
turns on lights and siren; when at home,
they answer the door when the officer
knocks on it and respond to questions
without objection. Conversely, it is a
classic symptom of guilt for a person
to run from the police in response to an
effort to stop his vehicle or question the
suspect at his home.
During questioning, guilty persons may
engage in behavior that is the equivalent
of alluding the officer. The person may
be guarded, answering most questions
with only a one or two word response.
A key deceptive behavior symptom
associated with guarded responses is
that the he or she does not take time to
think about the officer’s question. Often
these people respond to the officer’s
questions too quickly or even before the
officer finishes asking the question.
The deceptive person may evade a
direct response to the officer’s questions or become challenging:
Q "Where are you going this evening?"
A: "Nowhere."
Q: "Where are you coming from?"
A: "What do you mean?"
Q: "Who is in the front seat with you?"
A: "That’s none of your business."
Q: "What is his name?"
A: "What difference does it make?"
At this point it would be reasonable for
the officer to pursue an effort to establish the identity of the passenger and the
persons whereabouts that evening.
Communicating with one’s hands
(illustrating) occurs when a person is
confident and sincere in his statements.
Illustrators reinforce the credibility
behind the spoken word. The lack of
illustrators can be a significant behavior symptom of possible deception.The
classic description of a guilty person
going through a border stop is that the
subject’s hands are cemented to the
steering wheel at the 11 and 2 o’clock
positions and his eyes stare straight
ahead at the road. Similarly, when questioning a child who has done something
wrong, the child will hide his hands by
putting them in his pockets.
Truthful people use appropriate hand
gestures and will actively communicate
with their hands. These gestures are
not aggressive or threatening, but rather are an extension of communicating
thoughts and information to the officer.
Deceptive persons often go through a
"freeze" response and shut down nonverbally. As a result, their hands do
not become involved when answering
questions.
The difficulty with roadside stops
is finding nonthreatening questions to
establish behaviors. For example, the
following initial questions are fairly
standard when a police officer pulls
over a car on a traffic stop:
"Do you know why I have pulled you
over?"
"May I see your driver’s license?"
"Is the information on your license correct?"
"Is this your vehicle?"
ing these "nonthreatening" questions.
There are many factors that influence nonverbal behavior but a person’s
words have a single meaning, with the
only typical variables being memory or
intelligence. If a driver tells an officer
that the car he is driving belongs to
his father, the fact that a check on the
car’s ownership comes back to someone
else is an inconsistency that certainly
requires further questioning.
If a car is pulled over and smells of
marijuana the officer should certainly
ask the driver about the smell. If the
driver anxiously explains that his car
was parked near a field where leaves
were being burned and that the leaves
caused the smell, this is an irrational
explanation. Based on this analysis, it
would certainly be appropriate for the
officer to ask the driver, "Have you or
anyone else smoked marijuana in this
car this evening?"
In conclusion, most roadside interviews are routine and
straightforward. A car
is stopped, a few questions are asked, a citation is issued and the
subject is on his way.
However, on occasion,
the subject of a roadside
interview is involved in
a more serious crime or
has information that is
important to other on-
going investigations. These are some
brief examples of why police officers
do what they do and ask what they ask
and how they determine when routine
questions should be expanded to cover
possible involvement in other criminal
activity or guilty knowledge.
If you have nothing to hide, just
cooperate with the officer, answer his
questions, you should be on your way
in short order.

The watchman and his grandson were
able to give officers a good description
of a white Ford Fx4 pickup, which they
chased at speeds up to 100 miles per
hour all the way to League City, but
were unable to get close enough to read
the license plate.
"This started us looking at the man
later charged," Boykin said. "I caught
him around FM-521 and SH-35 with a
branded calf that also had some scarring
from having been caught under a feed
trough.
"At the time I didn't know it was
stolen, but the next day he sold it at
auction."
Livestock sales barns in other counties, including Grimes and Austin counties had also reported the theft of cattle.
In one report, a Black Angus calf with
an “A” brand on the left hip, as well
as scarring, was among several calves
reported stolen.
All sales barns in the state were
instructed to look for this stolen calf.
A cattle buyer at a livestock auction in
Groesbeck spotted this calf as it came
through the sales ring in June of 2006,
and notified authorities.
The task force officers immediately
began to investigate, determining the
calf had been sold by the Wharton barn
to the Groesbeck sale. They tracked the
sale back to Jerome Heath Novak, 27,
of Pearland, who had sold the calf to the
Wharton sale barn.
Officers said a search of paperwork
from sales turned up a stack of forms
detailing that Novak had sold a number
of cattle that matched those reported
stolen.

Association contacted Novak and asked
him to come to the Brazoria County
Sheriff’s Office.
When confronted with evidence of
the thefts, Novak originally denied any
involvement. Later that afternoon, however, he contacted Langdon and TSCRA
Ranger Tommy Johnson, asking to meet
with them the next day, saying he would
tell them at that time what happened
and how the cattle were taken.
The next day Novak came to the
sheriff’s office with his attorney, Mike
Echevarria, and made a full confession
to having taken 273 head of cattle.
He took the officers to a pasture
in Brazoria County and showed them
where 93 of the animals were hidden.
The cattle were seized and taken to the
Rosharon livestock sale barn, where
they were separated and returned to
their rightful owners.

ness, worked alone. They said he told
them that he knew a partner might talk
and lead authorities to him.
He worked delivering tractors and
rental equipment over a wide area,
Boykin said. This allowed him to note
the cattle in various pastures, determine
whether they were gentle, and how
much oversight they had.
"Later he would go back with a trailer and a sack of feed, and get them
into pens, and load them up," Boykin
explained.
As for keeping them hidden until they
were sold, "It was a case of hiding them
in plain sight," Boykin said.
He said Novak took the stolen cattle
to a leased pasture, mixing them with
his own cattle. He sold the calves every
month or two at different sale barns.
The older cattle, many of which were
branded, he kept for breeding purposes.
“After we recovered the stolen cattle,
a warrant was issued for Novak’s arrest,”
Langdon said. “He was picked up and
confined in the Brazoria County Jail.
Charges were also filed in Galveston,
Harris, Fort Bend, Austin, Grimes,
Walker and Houston counties.
Through a mutual agreement with
the other jurisdictions, Brazoria County
District Attorney Jeri Yenne arranged for
Novak to make full restitution to owners
of all the cattle before he was allowed to
enter a guilty plea in exchange for fiveyears in prison.
Each of the theft cases involved more
than ten head of livestock, which meant
each was a third degree felony punishable by two to ten years in prison.
"When this started taking place, we
realized it was a major problem," Sheriff
Charles Wagner said. "We wanted to get
it shut down in Brazoria County. It took
a while, but we did it."
The involvement of so many different
law enforcement agencies complicated
the investigation, but the mass effort by
all of them led to its solution, Langdon
said.
He especially credited Brazoria
County deputies Boykin and Captain
Chris Kincheloe; the Texas Rangers
and Rangers from the TSCRA for their
investigative efforts; the Houston Police
Department for its generous use of a
helicopter; Sheriff Wagner and Chief
Deputy Jeff Adkins of the BCSO for
providing the manpower and the financial resources necessary to break the
case; and District Attorney Yenne for
seeing to it that full restitution was
made to all of the owners whose cattle

Alexander Torres, 21, was visiting the San
Luis Hotel from Houston. Hotel management called the police to remove a group
of disorderly people. This man with the
nail in his lip was one of the disorderly
people who wouldn’t leave. Officers Crystal
Teague and Joe Durr walked him to their
awaiting police coach and gave him a ride to
the central booking office. There was no riot,
no one got Tased or sprayed. There was no
professional athlete involved so the TV news
and big time newspapers didn’t talk about it.

This is Mister Freddy Fernandez, 28 years old of Galveston.
Freddy seemingly was engaged in the drug trafficking business until the narcs from Galveston PD paid him a visit at his
Jamaica Beach hideaway armed with a search warrant.
Police say they had Freddy tagged for quite awhile but
just let him run to the end of his rope, then they pulled it in
on him.
When Galveston and Jamaica Beach police showed up at
his rented bay home Freddy turned rabbit and ran. With the
cops hot on his tail he gave it up on FM-3005 at the Galveston Island State Park. Busted!

GALVESTON - A huge benefit staged in June for
Galveston Police Officer Chris Sanderson could not have
been more successful, providing over $30,000 to help the
young officer in his battle with cancer.
Centered at the Big Amos Restaurant complex at Broadway and 39th Streets in Galveston, 200 motorcyclists
gathered for a 100 miles toy run leaving Galveston over
the San Luis Pass Bridge and returning through Surfside
Beach, Santa Fe, Hitchcock, Bayou Vista, Tiki Island and
Chris Sanderson
over the Galveston Causeway.
Visitors enjoyed Bar-B-Que, beer and soft drinks. Children bounced in the
Moonwalk as a band played and everyone enjoyed the hot, but beautiful day.
Shlomo "Mony" Hamo, owner of Big Amos BBQ and other Galveston businesses, worked tirelessly to make the event a successful one. Hamo is a longtime supporter of Galveston law enforcement officers and provided valuable assistance to
them during Hurricane Ike.

Sanderson is battling Rhabdomyosarcoma Cancer but continues patrol duties with

Tiki Island Host DPS Officer’s Meet

The City of Tiki Island and the Tiki Island Police Department recently played
host to an area meeting of the Texas Department of Public Safety Officers Association.
About 40 officers, retired officers and
family members were hosted to Bar-BQue and refreshments prior to a business meeting held in the city council
chambers.
Tiki Island Police Chief Jerry Wright,
a retired state trooper and member of
the DPSOA, said officers from as far
away at the Mexican border were in attendance.
More than 125 scholarships are made
available each year by the DPSOA, to
high school students from diverse social, economic, and educational backgrounds, in pursuit of higher education. Scholarship awards are granted in
recognition of the student’s academic
achievements, community involvement,
and potential for success.
Additionally the DPS Officer’s Association annually awards the Mark Jeffrey Phebus Endowed Scholarship to a
student pursuing a degree in a law enforcement related Major.
The DPS Officer’s Association also
supports The Trooper Teddy Program.
DPSOA assists the Teddy Trooper Program by purchasing large quantities of
teddy bears from our suppliers or by direct financial contributions for such purchases. The teddy bears are carried in
DPS trooper vehicles for distribution to
traumatized children at the scene of an
automobile accident, domestic violence
or natural disaster.
This is one of the way the DPSOA supports the men and women of the DPS
and public at large, especially children
in need of comfort during an unsettling
or threatening event.
The members of DPS Officer’s Association are not unlike the citizens of any
Tiki Island Police Chief Jerry Wright and
Breck Porter
Texas community and often experience
the same hardships and trials common
to everyone. It is at just such times that
this unique DPSOA assistance program
reaches out to support its members.
Whether a natural disaster, a personal
hardship, or medical emergency members are eligible to receive relief funds.
This program provides immediate aid
for the use of DPSOA members.
Overwhelming demand for D.A.R.E.
led to the creation of the DPS Officers
Association Anti-Drug Program. Every
year DPS Officers Association contributes thousands of dollars to anti-drug
programs throughout the state of Texas.
These donations are distributed to Drug
and Alcohol Abuse Programs in schools,
community organizations, and law enforcement agencies by members of the
DPSOA Board of Directors. Public
contributions enable the DPS Officers
Association to provide the resources
needed to both, establish and improve
local Drug Awareness Programs as well
as provide officer training and student
educational materials.

Department's Citizens Police Academy Alumni Association conducted a 'Blue Bucket Brigade' at a busy city intersection and in front of the Kroger's Store. Within five
hours, the members collected over $1800 from passing
motorists and Kroger shoppers to help police officers buy
replacement body armor, not provided by the city. Pictured

David Blair Purvis, 59, of Houston, came to
visit Galveston, driving a drunk car down Seawall Blvd. all the way to the Harborside Bridge
where he stopped on the railroad track and
went to sleep.
Along came officer Derek Gaspard, who interrupted his nap and drove him to the county
lockup where he finished his nap on a steel
cot.
Police say earlier in the day Purvis assault
another man and fled in his drunk car.

Roderick Dasha Newton, 30, was convicted of abducting 20-year old
Jesus Montoya
from a car wash,
forcing him to
make an ATM
withdrawal from
a bank and then
fatally shooting
him twice and
leaving him to Roderick Dasha Newton
die in a field in
Mesquire, Texas, east of Dallas.
At the time of the killing, Newton was
wanted by authorities in Dallas for violating probation from an earlier misdemeanor theft conviction.
A second man charged in Montoya's
case, Julian Paul Williams, testified
against Newton and accepted a 10-year
prison term.
In his appeal, Newton raised five issues, including a challenge to the rejection of a potential juror and accusing the
prosecutor of improperly questioning
Newton's right not to testify. He also
questioned the trial court judge's answer
to a jury question during punishment,
questioned the judge's handling of mitigating evidence, and said his trial lawyer was ineffective by failing to present
evidence that could have spared him the
death penalty.
Newton's lawyers acknowledged some
of his claims had not been exhausted in
the state courts but blamed that on a poor
lawyer initially handling the appeal.
At his trial, prosecutors presented evidence that Newton, a native of Hartford,
Conn., had 27 misdemeanors and felony
offenses over a seven-year juvenile and
adult criminal record.
Montoya was shot after being forced
to withdraw $200 from an ATM. Evidence showed Newton also took Montoya's shoes and necklace, then pawned
the jewelry the following day.
Newton was arrested about two weeks
later after Williams was picked up in a
traffic stop and cooperated with police.
Newton was arrested after a police chase
that ended with him crashing into a car,
then running from the scene on foot. He
was found a few minutes later hiding in
a trash bin.

Kenneth Mosley

Kenneth Mosley was convicted for the
1997 shooting death of Garland police
Officer Michael Moore. Officer Moore
was gunned down
trying to stop
Mosley’s robbery
of a bank.
Mosley who had
already robbed a
Bank One branch
in Garland in
January
1997,
showed up at the
Kenneth Mosley
same bank the
following month and was recognized
by employees as he waited in line. They
called police, and Officer Moore, a 10year veteran, was among officers to respond.
The officer approached Mosley, ordered him to show his hands which were
tucked into his waistband, and was fatally shot in the ensuing struggle as both
he and Mosley fell through a window.
Mosley was shot in the wrist by another
officer as he stepped back into the bank
through the broken glass flashing his
pistol.
Officer Moore died the afternoon of
the shooting. He had been shot four
times in his torso.
At his trial Mosley’s lawyers didn’t
deny he shot the officer but tried to
show Mosley didn’t intend to kill him.
They also argued drug use was to blame
for his behavior.
Mosley, a native of Flint, Michigan,
testified he never knew his gun went off,
saying it was fired by accident five times
as he was trying to surrender it to Officer Moore. But from the witness stand,
he also launched into a profanity-laced
tirade against the officer’s family and
other police officers. Jail officers also
testified that after his conviction, he was
belligerent while in lockup and said it
would make his day to kill another cop.
Dallas County jurors deliberated 30
minutes before deciding Kenneth Mosley should be put to death.
Evidence in his appeal showed that
Mosley sexually assaulted a woman in
1985 and had other arrests including
possession of marijuana, possessing illegal knives, stealing merchandise from
a Home Depot and then returning the
items for cash refunds, and robbing a
Home Depot at gunpoint six days before
the officer’s shooting.

Douglas A. Egbert was en route home
still dressed in his duty uniform after
completing a tour of duty. He observed a
vehicle being operated in an erratic manner that was nearly involved in a collision with oncoming traffic. The driver

of the vehicle pulled into a driveway
and Constable Egbert called for backup,
stopped and approached the driver who
he determined was drunk. The driver
attempted to get out of his vehicle, but
Constable Egbert instructed him to remain seated and attempted to close the
driver’s door.
The driver became belligerent and got
out of his car anyway. He pulled a large
knife and slashed Constable Egbert inflicting a laceration on his left arm. The
man then stabbed Egbert in the lower
left torso with this thrust being stopped
the by deputy’s ballistic body armor.
Egbert retreated from the suspect
while at the same time ordering him to
drop the knife. The assailant refused to
comply and continued his attack. Egbert fired one shot killing the attacker.
Investigators determined that the attacker had a history of violence including a prior assault on a police officer.
Constable Egbert was treated at the
scene by the Houston Fire Department
EMS for the knife wound to his left arm,
declined hospital care and continued to
his home.
He returned to full duty with the Harris
County Constable’s Office.

are seeking the public's assistance
with any information on the December 28, 2008 homicide of 32 year old
Francisca Calkins.
Calkins was found in a hot tub on
the deck outside of her loft apartment
located in the 200 block of Chester
in Friendswood, Texas. The cause of
Calkins' death was drowning but she
also suffered from blunt force trauma.

29-year-old Danny Cruz Ortiz sexually assaulted a 12-year-old girl who
was a customer at his mother's store in

his current address annually in the
month of his birth.
Ortiz failed to register in 2008 and
2009 and a warrant for his arrest was
issued for Failure to Register as a Sex
Offender, with no bond.
Danny Ortiz is believed still to be
in the Houston area. Crime Stoppers

of Galveston. Officers James Emmerson
and Brandon Kiamar happened upon
Mr. Haizlip on a Galveston Street and
