Jim’s Race to Remember
When RAYAC learned that member and former director Jim Ekdahl ran in the Boston Marathon we,
like many members, prayed for his safety. We were very relieved to get this message from Jim.
“Just arrived home this evening and my
family and I are all ok. We were very close to
the second blast. I was on the last block of the
race when it went off. Very scary as the cell
phones were all overloaded and took quite a
while till I could get in touch with my wife & daughter who
were in the crowd just a few doors from the blast. We were
safe by the grace of the Lord and are very grateful for
everyone's concern.”
You can see Jim running just feet away from the second explosion
in this photo that appeared on the internet and was published by
the Gettysburg Times.
After a few days passed, Jim shared more thoughts on his experience. Thank you for sharing your story, Jim!
Is it true that this was the first time you ran in the Boston Marathon? If so, was running in this race one of your
goals?
This was my first time in the Boston Marathon and was certainly a goal to run. It is a fantastic course and the
crowds along the route were amazing.
You’ve been a distance runner for a long time. Has this tragedy affected your passion for the sport?
This event has not affected my enthusiasm for running.
Would you run in the Boston Marathon or other high profile races in the future?
I will definitely be running future races in big venues and I truly hope to qualify to run Boston next year. It will be a
special time of remembrance for those who were killed and injured.
Did you find yourself glued to news reports or was it too emotional to watch the events unfold in the hours and
days after the race?
I did follow the investigation closely because I just wanted to know why someone would harm innocent children
and others watching a sporting event. I am amazed at how quickly they were able to identify the suspects and track
them down. This experience has made me aware how fragile life is and how important it is to treasure your loved
ones. I would like to thank everyone who expressed their concerns for my family and I this past week. It is sincerely
appreciated.

Treasurer’s Report
Steve Snell reported in Treasurer Tony Thomas’ absence. He reported that budget numbers are on target and that the
association’s telephone system will need to be replaced and hopefully can wait until next year.
Solicitor’s Report
Solicitor Hast reported the legal hotline is receiving 35-40 calls per month with a lot of calls about loss mitigation
companies and their fees. He explained that it is a RESPA violation if REALTORS are involved in a decision to remove
those fees from the HUD-1 settlement statement. Solicitor Hast is also working with Dolly Bailey to create CE classes
for PAR forms for Carroll County, Maryland and he is developing and delivering CE for PA on Appraisals and
Assessments. He reminded the Board that he is willing to attend office meetings.
Action Items


Appointments to Professional Standards - Due to the merger of Century 21 Heritage with Prudential, the
committee is unbalanced per committee policy. Will Paradise and Casey Dougherty were appointed to the
committee.
Appointments to Candidate Screening Committee - Vice President Paula Musselman, Robyn Pottorff and
Melinda Eppolito were appointed to attend the candidate screening interviews with supervisor candidates for Dover,
Manchester and Springettsbury townships.

From the Executive Officer
So Who Made That Decision, Anyway?

There have been several MLS decisions made recently that have met with some, shall we say,
“concern” by members. For that reason, I thought I’d give you a primer on MLS organization
structures. I know that does not sound like exciting reading, so I’ll try to keep it fairly brief.
RAYAC’s Multiple Listing Service is operated as a committee of the association. There are twelve members on that
committee and they serve staggered three year terms. Its members represent a mix of offices, specialties (residential
sales, appraisal and commercial), and roles (agent, manager, and broker). All major decisions made by the committee go
before the RAYAC board of directors for final approval.
Some MLS systems are separately incorporated, largely for tax purposes, and therefore have their own separate board of
directors. In most cases, decisions do not need to be further ratified by the association’s board of directors. This is the
type of MLS structure used by the Greater Harrisburg Association of REALTORS and their CPML system.
Some of the largest regional MLS systems are owned by a number of local associations but act very independently and
are separately incorporated. Local associations may select individuals to serve on the regional MLS board. In such
systems, the guidelines of the National Association of REALTORS may still apply. Both the TREND MLS in the
greater Philadelphia area and the MRIS system that operates in the greater Baltimore/Washington area would be
examples of such an organizational structure.
Yet other MLS systems are owned by large brokers and have no direct ties to the associations whose members they
serve. They do not need to follow NAR guidelines (and, that has led them to occasional policy mistakes which resulted
in trouble with federal agencies). The West Penn MLS serving the greater Pittsburgh area is an example of this structure.
One could argue – and I will – that RAYAC’s structure of our MLS provides the most democratization of decisions. We
are closer to the end user, with greater oversight, than other structures. Our members personally know at least some of
the members on the committee. We also provide local staffing of our MLS which not all associations do, preferring
instead to direct most issues to their system’s vendor.
Lest you think our structure gives us virtual control and authority over all decisions, think again. The National
Association of REALTORS provides model MLS Rules & Regulations. While it does provide for certain local options,
much of it is standardized across the nation. All changes to our MLS Rules & Regulations need their approval. Why,
you ask, would we want/need that level of authority vested in our national association way out in Chicago? Answer: to
get insurance coverage and the expertise of their legal department. The MLS sector of our industry is fraught with
issues, many of which can land you in court or in trouble with “the feds.” For these reasons, we don’t want to “go it
alone.”
OK, maybe that wasn’t as brief as you’d hoped, but if you got this far, you must have found it helpful. Want to serve on
our MLS Committee? Let us know. There are only four openings per year but you just may provide the skill or
constituent representation that the committee is looking for.

A Stroll Down Memory Lane

What better way to celebrate the association’s 90th anniversary than to reminisce with some of our most experienced
members? Eight of RAYAC’s members who have 40 or more years in the business shared some of their most
memorable experiences at an anniversary breakfast last month. The York Board of REALTORS was formed on April
14, 1923 (and included Hanover until 1973). My how things have changed! Here are some of the highlights:
Bob Estill
Bob’s first taste of real estate came in 1965 when he took a real estate course at Susquehanna University with Rick
Smith. Bob entered the corporate world with Dentsply where he loved his job but didn’t like being “locked up”. So he
went to Martin Library with Bill Cooley to set up bylaws to form an investment real estate group. Bob’s real estate path
led to investment properties, property management, development projects and his current business, Fox Run Realty.
Joe Mancuso
Joe moved to York in 1967 with AMF. Not long after relocating, AMF moved the facility back to New York. Joe
stayed in York and started in real estate when the average price of a house was $18,000 ... and you still made money.
Andy Collins
There are a few notable changes from when Andy started his career in real estate. The MLS consisted of 5 x 9 index
cards on each property at the association office, which then migrated to weekly listing books, which ultimately became a
computerized system in the 80’s. He also said there were no lockboxes. You had to pick up keys at the listing office.
But the memory that stands out the most for Andy occurred when he was association president in 1979 … TMI. The
media kept asking him how TMI would affect the value of real estate.
Ethel Nitchman
Ethel has always been in sales. She sold World Book encyclopedias prior to her real estate career. The craziest thing
that happened to her was a fire on a property the night before settlement was scheduled. The fire turned out to be arson.
Rick Smith
Rick shared that when he first started in real estate women’s income wasn’t taken into consideration for a mortgage
because a woman might become pregnant. The only way around it … a doctor note stating the husband had a
vasectomy.

Alice Wong
When Alice Wong entered the real estate business after moving here from
Connecticut, only the brokers were members of the association. Alice
(and others) suggested adding a sales division to the board and she served
as its second president when it was pretty much a male dominated
industry.
Dale Elfner
Dale started his Century 21 Dale Realty business in Red Lion and added
the York location when his son, Wade, graduated from college. Wade’s
son, Nathan, is also part of the real estate business that celebrated its 50th
anniversary last year. Dale said he sold a lot more than houses. He sold
churches, funeral homes, a furniture store, a hardware store, a reptile
ranch and a zoo!
Jim Warfield
Jim reminisced about a one page listing agreement that provided sellers
with six, nine or 12 month options for their listing.
A special thank you goes to these members for sharing their stories and to
RAYAC VP Paula Musselman for emceeing the event. There were too
many stories to include. Look for a video recap coming to RAYAC’s
blog in the near future. Next time you visit the RAYAC office, be sure
to sign the “anniversary card”, a memento we plan to keep for our 100th
anniversary in 2023!

Case Study #16-3: Mass Media Solicitation Not a Violation of the Code

REALTOR® A, a residential broker, worked in a market area that included an attractive suburb of a large city. At the
time REALTOR® A launched a new advertising program, there were a number of houses for sale in the neighborhood
listed exclusively with other REALTORS®, each having the respective listing broker’s sign on its front lawn.
Working with his advertising agency, REALTOR® A developed a special brochure describing the service of his offices
and soliciting clients. The format of the brochure was designed so that it could be hung over a door knob, and a
commercial distribution service was employed to hang one of these brochures on homes in REALTOR® A’s market
area.
In the course of distributing REALTOR® A’s brochures, the commercial distribution service placed a brochure on the
front door of every house in REALTOR® A’s market area, including houses that had other REALTORS®’ signs in the
front yard. Several of the REALTORS® whose clients received REALTOR® A’s brochures filed complaints with the
Board against REALTOR® A. The Grievance Committee considered the complaints and referred them to the Secretary
to schedule a hearing by a Hearing Panel of the Professional Standards Committee at which time all of the complaints
would be considered. The complaints charged REALTOR® A with unethical conduct in failing to respect the exclusive
agency of other REALTORS®.
At the hearing, REALTOR® A defended his action by saying that the distribution of his advertising brochures was
widespread in nature; that it had been carried out by a commercial distribution service; and that it was of the same nature
as radio or television advertising or a general mailing that might come to the attention of some clients having exclusive
listing contracts with other REALTORS®.
The Hearing Panel’s decision noted that REALTOR® A, in designing his advertising campaign, did not direct his
brochures to property owners whose identity had come to REALTOR® A’s attention through information disclosed by
other REALTORS® consistent with their ethical obligation to cooperate with other brokers under Article 3 of the Code
of Ethics; e.g., through a “for sale” sign or through information disseminated through a Multiple Listing Service. Rather,
REALTOR® A’s advertising campaign was directed in an indiscriminate manner to all property owners in a given
geographical area. Furthermore, the medium REALTOR® A chose for his advertising campaign was a written brochure,
which property owners could examine or discard as they saw fit. The panel determined that this form of communication
does not harass a property owner, as would telephone calls or direct personal contacts. The Hearing Panel, therefore,
held that REALTOR® A’s advertising campaign did not violate Article 16 of the Code of Ethics.

NET Sales Enforcement
Those agents who have listings in the RAYAC MLS showing compensation based on NET sales price have received
prior notice that the MLS Rules & Regs allow for compensation to only be disclosed by either a percentage of the gross
selling price or a flat dollar fee.
Please note that any active listings showing a compensation based on NET sales price will be treated as being in
violation of the MLS Rules and action will now be taken. That action will include a notice of violation followed by a
mandatory fine of $150 PER LISTING in violation.
What is a Variable Rate Commission?
A dual or variable rate commission arrangement is a listing where one amount of commission is payable if the listing
broker's firm is the procuring cause of sale and a different amount of commission is payable if the sale results through
the efforts of the seller or a cooperating broker.
RAYAC/MLS Rules and Regulations SECTION 5.2
Dual or variable rate commission arrangements: The existence of a dual or variable rate commission
arrangement (i.e., one in which the seller/landlord agrees to pay a specified commission if the property is sold/leased by
the listing broker without assistance and a different commission if the sale/lease results through the efforts of a
cooperating broker; or one in which the seller/landlord agrees to pay a specified commission if the property is sold/
leased by the listing broker either with or without the assistance of a cooperating broker and a different commission if
the sale/lease results through the efforts of a seller/landlord) shall be disclosed by the listing broker by a key, code or
symbol as required by the MLS. The listing broker shall, in
response to inquiries from potential cooperating brokers, disclose
the differential that would result in either a cooperative transaction
or, alternatively, in a sale/lease that results through the efforts of
the seller/landlord. If the cooperating broker is a buyer/tenant

Why is Utility Information No Longer
Available on Customer Reports?
There has been some concern that the "utilities" have been
removed from the MLS. The utilities information has NOT been
removed from the MLS; however, the MLS Committee received a
recommendation to remove this information due to the fact that
utilities have been removed from the Seller Disclosure. It was
determined by the committee that the information has value and
should remain. Although the customer reports have been modified
to remove that information it still remains on the agent
reports. Also, please remember that ALL reports are customizable
and can be modified to suit your specific needs. The MLS
Committee also determined that the utility information should not
be provided in IDX feeds as the data is subjective and no longer
provided by the seller in the disclosure.

Estimate, Adjust and Defend
Instructor: Melanie McLane – In this practical course, students will review relevant characteristics in the appraisal process, identify
methods of acquiring and organizing data about relevant characteristics, understand methods of estimating land value, identify
methods of making adjustments in appraisal reports, and understand the need to be able to defend adjustments made. They will also
learn how to develop adjustments by a variety of methods, know how to complete a work file which supports and defends
adjustments, and identify appropriate, defensible sources of data for use in appraisals.

**Warding Off the USPAP Police and Appraisals for Government Loan Programs
Instructor: Michelle Bradley- AM course- There is genuine concern about how appraisers can maintain compliance with the many
new regulations that have resulted in an increase in the amount of work appraisers must comply with, often referred to as “scope
creep” due to the increasing scope of work issues. Scope creep carries with it more liability; appraisers must learn to make the scope
of work rule their best friend, to reduce liability through increased compliance with USPAP requirements and assignment conditions
such as UAD. Discussion will include common misconceptions and pitfalls of UAD which plague the appraiser. PM course- This
course centers on the understanding of property conditions that affect the marketability of a home and may affect whether the home is
eligible for government loan programs. Discussion will include the appraisal requirements for different types of loans. Real world
examples will be presented that will help you understand how your peers are completing appraisal requirements in their markets.
Students will learn about proper documentation and verification to limit liability.

Social Media Tips
Over 50 RAYAC members met in Gettysburg to learn more
about social media from PAR Chief Executive Officer Dave
Phillips. He offered these specific tips:







He recommends at least having a Facebook and
Linkedin profile.
If a consumer searches “Find a REALTOR” the search
will include social media sites.
Have your posts pass the “Grandmother test”. Don’t post anything you
wouldn’t want your Grandmother to see.
Check out your clients because your clients are watching you.
Google yourself every now and then to see what you find.
Be careful when you pick your Twitter name. REALTOR rules still apply.
Make sure your website is mobile friendly. More internet traffic is coming
from phones and tablets than laptops and desktops.
You’re Invited to Rail Trail Meeting at RAYAC
RAYAC members are invited to learn about rail trail expansion plans and interesting information as it relates to
homeowners along the trail and buyers who want to live near the trail. The York County Rail Trail Authority is holding
its next meeting at RAYAC. There will be a brief presentation on recent rail trail survey findings as well as an
opportunity to ask questions and share experiences from buyers and sellers. There will also be an informal “meet and
greet” with authority members. Plan to attend on Monday, May 20 at 7:00 p.m.

Legislative Link
April was a busy month for REALTORS on movement of key bills in the Pennsylvania General Assembly.
Seller Financing
House Bill 1124, which restores seller financing to its original intent, allowing a person to originate, offer,
negotiate or service less than four mortgage loans in a year was voted out of the House Commerce Committee in
April. PAR has learned federal legislation is proposing up to five transactions per year and will be updating the
prime sponsor of the bill to reflect that change.
Mechanics’ Lien legislation
Senate Bill 145 moved out of Senate Labor and Industry Committee in April. This legislation addresses the
problem of unfair mechanics’ liens by disallowing a lien to be placed on a homeowner if they already paid the
general contractor in full.
RELRA Amendments
Senate Bill 869 was introduced in April that includes PAR’s recommended changes to the Real Estate Licensing
and Registration Act (RELRA). The seven licensing recommendations include: increasing continuing education
hours to 18 hours every two years; increasing pre-licensure education to 90 hours; requiring six hours of
continuing education be in a specific topic area, depending on the type of real estate practiced; completing all
broker license courses within five years; completing all salesperson license courses within three years; requiring
a high school diploma or equivalent for a real estate license and allowing licensees to conduct broker price
opinions under certain criteria.
