PLEDGE TO FLAG The Council remained standing for the Pledge of Allegiance. COUNCIL MEETING The City Council of Webb City, Missouri met in regular session Monday, July 14, 2014 at 5:30 p.m. in Council Chambers. Mayor John Biggs presided. ROLL CALL The following members answered roll call: Doug Goodall, Gina Monson, Alan Hughes, Ray Edwards, Don Darby and Jerry Fisher. Absent: Brandon Wilson, and Jim Dawson. There being six members present, and six members representing a quorum. Mayor Biggs declared this session of council officially opened. Also present were: City Attorney Troy Salchow, City Clerk Kimberley DeMoss, Finance Director Tracy Craig, Fire Chief Andy Roughton, Assistant Police Chief Don Melton, Street and Water Director Rick Roth, Sewer Utility Director William Runkle, Parks Director Tom Reeder and Economic Development Director Erin Turner PRESENTATION Steve Campbell, MoDot Representative addressed the council regarding the importance of the Amendment 7, the proposed tax increase the on the August 5, 2014 ballot. Mr. Campbell stated that the tax increase would benefit the State of Transportation for future roadways and for the SW area. Mr. Campbell explained that proceeds from the fuel tax are declining and without a new source of revenue MoDot would be limited to only maintaining existing roads and not building new ones. The Amendment 7 would establish a ¾ cent statewide sales tax for 10 years to provide money for highway transportation. Mayor Biggs asked the council for a motion to support the tax increase. Councilman Fisher made the motion. Councilman Hughes seconded. The motion to support the tax increase carried with six yes votes. Audit Manager Sandra Barrera from KPM presented to the council the audit report for the fiscal year 2012-2013. Ms. Barrera stated there were no adverse opinions and the City had 40% in reserves, which in the accountant’s opinion was very good. Ms. Barrera stated they recommend at least 25% in reserves. CONSENT AGENDA Councilwoman Monson moved to approve the Consent Agenda items for July 14, 2014. Councilman Edwards seconded. The motion carried with six yes votes. Agenda items are as follows: 1. Park Board Min- June 2014 CITY OF WEBB CITY, MISSOURI COUNCIL MEETING REGULAR SESSION July 14, 2014 Page 2 COUNCIL BILL No. 14-004 An Ordinance granting a Special Use Permit for a certain tract of real estate within the City of Webb City, Missouri. (905 W. Broadway) (Mark and Cheryl Johnson, P.O. Box 575, Joplin, MO 64802) Councilman Fisher presented Council Bill No. 14-004 for the second and final reading. Second reading completed. Councilman Fisher moved to accept the second reading. Councilman Hughes seconded. The motion carried with six yes votes. Yes: Goodall, Monson, Hughes, Edwards, Darby and Fisher. Thereby duly giving Council Bill No. 14-004 Ordinance No. 14-007. MOTIONS Emergency Management Performance Grant Councilman Fisher made a motion to allow the Emergency Management to accept a Performance Grant from the State Emergency Management Agency for $36,471.00. This grant will fund one quarter of each salary and benefits for Don Melton and Andy Roughton as they conduct duties relating to Emergency Management. Councilman Hughes seconded. The motion carried with six yes votes. FINANCIAL OVERSIGHT Councilwoman Monson moved to accept the Statement of Accounts dated July 14, 2014. Councilman Wilson seconded. The motion carried with six yes votes. ADMINISTRATION Administrators Report for July 14, 2014 was available for the Council to review. OTHER Councilman Darby thanked Mayor Biggs and Council members for their understanding while he had been unable to attend meetings. Mayor Biggs’s stated that he and the council members were glad to see him return. Members present were: Glen Davidson, Bruce Waggoner, Max Spencer and Gino Lesh. Members absent were: Tom Hamsher, Gary Dawson and Ron Cructher. Staff members present were: Eddie Kreighbaum and Tina Taylor. Mr. Davidson called the meeting to order and asked approval of May 8,2014 meeting minutes. Bruce Waggoner made motion to approve minutes as written. Gino Lesh seconded. All were in favor and none opposed. Chairman, Glen Davidson opened the first public hearing for fence variance request for Katie Smith 1227 Chestnut to extend privacy fence more than half way up side of home. Webb City Council approved code to be changed to half way up side of home with privacy fence June 9, 2014 with its second reading. The Board of Adjustment members didn't agree with Katie Smith on her reason for wanting to extend fence was hardship enough. Bruce Waggoner made motion to deny request for fence variance. Gino Lesh seconded. All were in favor and none opposed. Mr. Davidson opened the second public hearing for garage variance for Dan Mitchell 1158 Huntington Drive to build garage forward of the back corner of home. Mr. Mitchell addressed the Board on how the members have approved requests in the past. Max Spencer made motion to approve variance request. Bruce Waggoner seconded. All were in favor and none opposed. The Board of Adjustments meeting was adjoumed at 4:32 pm. A11 were in favor and none opposed. ,l {-, Planning and Zoning Commission P & Z Meeting: The Planning and Zoning Commission met on Tuesday , June L7,2014 at 5:45 p.m. in Council Chambers located at 200 South Main, Webb City, Missouri. Richard Crow declared this session officially opened. Then following members were absent, David Moore. Also present were: BUILDING INSPECTOR Eddie Krieghbaum City Attorney Troy Salchow lnterim City Administrator Carl Francis MINUTE APPROVAL: Mr. Crow called the meeting to order and asked if there were any corrections or additions to the meeting minutes from the January 21,2Ot4 meeting. There were none. Debi Greek made a motion to approve the minutes. Jeanette Atkinson seconded. All were in favor and none opposed. PUBTIC HEARING: Richard Crow called the first public hearing to order regarding Special Use Permit for Mark and Cheryl Johnson to operate machine shop at 905 West Broadway. Mr. Johnson stated that he has eight employees now, and hopefully by 2076 he will have 20 to 30 new CNC machines and employees. Debi Greek asked Mark Johnson if there was enough parking for the employees. Mr. Johnson informed the commission that before machine shop, it used to be a grocery store, so adequate parking would be available. Also, Mr. Johnson noted that they would not be using the ramp dock, and that most of their deliveries would be from UPS. Terry Roberts made a motion to approve the request Don Wynne seconded. All were in favor and none opposed. The public hearing was closed. Other Business: Comprehensive Plan Erin Turner handed out Drury Books for the members and stated that each P&Z meeting a chapter at a time would go for approval. ADJOURN: Richard Crow made a motion to adjourn meeting. All were in favor and none opposed. The meeting adjourned at 6:30 pm. Chbirman Planning and Zoning Commission \ COUNCIL BILL NO. _14-005____ ORDINANCE NO.__________ AN ORDINANCE AUTHORIZING THE CITY OF WEBB CITY, MISSOURI TO ISSUE A SPECIAL TAX ASSESSMENT ON CERTAIN PARCELS OF REAL ESTATE ARISING OUT OF EXPENSES INCURRED BY THE CITY THROUGH SUMMARY ABATEMENT OF PUBLIC NUISANCES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEBB CITY, MISSOURI, AS FOLLOWS: SECTION 1. Pursuant to Webb City Code Section 220.010 (D) (4), Section 220.010 (D) (5), 220.010 (D) (6), and 220.130, (F), the City hereby assesses, against the tracts of real estate described on Schedule A, attached hereto and incorporated herein by reference as though fully set forth herein, the amounts set forth in Schedule A as special tax bills to recover the costs and expenses incurred by the City in the summary abatement of public nuisances existing on each such tract of real estate. SECTION 2 This Ordinance shall be in full force and effect from and after its date of passage. City staff would like to build two pavilions near the playground for use while children are playing on the new faciltiy or other gatherings. Staff has obtained a list of necessary materials needed and requests approval to purchase the necessary material so they can be constructed. RECOMMENDATION: Motion be approved for the purchase of $4,000 in materials to be used by City Staff for construction of two 10’ X 16’ pavilions near the new playground facility in King Jack Park. FISCAL IMPACT: The Park Fund has adaquate reserves for this project. A budget revision will be made upon council’s approval. City Staff has considered two options for streetlights to be constructed along East Road in Centennial Park area. The quote from Empire District for the 11 poles needed to sufficiently cover the roadway from the roundabout north to Aylor is $549.76 per month that would be a cost the city would bear forever. City Staff has gathered material costs and estimates the cost at $42,228.35. This option would involve city staff performing the work and the city would then only be liable for the electric meter charge in the future. RECOMMENDATION: Motion be approved for Public Works to purchase materials necessary to construct 11 streetlights along East Road north to Aylor. FISCAL IMPACT: The City’s investment today would generate a savings in utility costs of $549.76 per month after 6 1/3 years compared to the cost of Empire District installed poles that are charged forever. The Street Fund would need to pull from reserves, which has an adaquate balance, the cost of this project. A budget amendment will take place after council approval.
