N EC T I C U towing & recovery professionals T CO N OctOber2015 Message from the President Dear Members, in this issue There was an interesting article in the Safety and Health Magazine this month. It dealt with the number of accidents that occur when one is talking on a cell phone and WALKING. Although it sounds a bit funny at first, there is a lot there. The number of accidents that occur talking and walking is the highest amount that happen. Think about your driver hooking or loading a vehicle and carrying on a phone conversation – an accident waiting to happen. A good business practice may be to speak with the drivers about this, it’s a lot different than being able to walk and chew gum. Anything that we can do to lower the amount of accidents that result in worker’s comp claims is a good idea. Think about this and how you can incorporate a phone policy into your business. The Legislative session for 2016 is rapidly approaching and we would like to offer the following ideas. First would be changing the law on lights for wreckers. Thoughts about dropping the 8 foot light requirement in favor of a light bar have been voiced for a long time. The light bar would have to indicate the cab width, be mounted on the top of the cab and would have the flashing amber lamps. We already are required by Federal regulation to use the portable lights on the rear of the towed vehicle, it would seem like this would be a perfect solution. The office has been informed that some wreckers are passing wrecker inspection with only a light bar. We would like to know your opinion about this. The second item would be developing an additional category on the Approved Rates and Charges form to address permitted tows. These are tows that you are required to obtain a DOT permit for, usually over 80,000 pounds and you are given a prescribed route to take. These usually take longer, require different driver skill sets, can be more dangerous as there is tremendous exposure and require specialty equipment to perform. DMV will continue to regulate the nonconsensual tow and transport of a vehicle even when the current lawsuit is ended so it may make good sense to do this. Again we are looking for your comments regarding this proposal. The third change suggested is a bit more ambitious. It is changing the way that tow ”4^_53mileage/time is calculated. Currently the fees apply for a “loaded mile” – you start charging when the vehicle is on the hook and you stop charging when it is unloaded. The proposed change is a “portal to portal” mileage fee. If you did city towing this would not change things much, the towers who are in the rural areas would be paid for all their travel, an example would be a Putnam tower called by CSP to an accident 14 miles away, once at the scene the tower then would remove the vehicle to his garage. Instead of getting paid for the “loaded tow” he would be able to charge for “portal to portal” towing. The rates would be adjusted to reflect this and there are pros and cons depending on where you are and your average tow distance. However this idea seems to have a lot of merit and may be an answer for some of our issues. Towers would have to carefully look at the rates to ensure that you would be making money rather than giving up some much needed dollars. Other states have this and they seem quite happy with it, how about it? Let’s hear from you regarding this and the other suggestions so we can plan a strategy at the Legislature and a talk to the State agencies regarding these proposals. If you have other ideas for Legislation please let us know, we will give them a try and see if we can make them a reality. Once we have a draft the selling of the idea becomes the major effort, basically if we cannot interest anyone in our proposals they will go nowhere. We were successful last year as Traffic Incident Management was a huge issue at the Legislature. It will continue to be a major issue in training areas, tracking and reporting incidents, collecting data and mandated studies. Our timing could not have been better than it was last year, plus we had the support from the Transportation Committee who realized the importance of the hold harmless law. Christopher Michael Carreras-McLaughlin On October 7th, 2015, 7 year old Christopher started complaining that his head hurt, then began vomitting and became unresponsive. He was taken to Danbury Hospital and then transferred by helicopter to Yale Children's Hospital. He underwent emergency brain surgery because he has an arteriovenous malformation (AVM). AVM is a very rare and serious condition. His AVM was in his brain and it burst, causing the brain to fill with blood, which is why his head hurt. His cousin Elizabeth started a fundraiser to help Christopher’s parents with expenses; every little bit makes a big difference.
