ORDERS
All orders will be acknowledged based upon estimates in the field and container areas.
Substitutions will be made in like varieties and hardiness as close as possible to your
order. One size adjustment may be made to conform to seasonal growing conditions.
Customers requesting no substitutions should indicate this on their order.
SHIPPING
All shipments arranged by Simnitt Nursery are via semi trucks. A full load of merchandise
is approximately 8500 units. Shipping must be arranged by the customers for orders
of less than 1700 units. Delivery of less than truck load quantities is contingent upon
trucks to your area
TERMS
All prices are F.O.B. our nursery and are subject to change without notice. Cash is
required before delivery on any unestablished account. Net 30 days on established
accounts. Interest on past due accounts will be charged at 1 1/2% per month or an
effective 18% annual rate.

NURSERY
Claims from damages during shipping should be made to the carrier. All other claims
must be reported to us within 10 days of receipt of shipment and will be reviewed at
that time. In no case will we be liable for more than the purchase price of such nursery
stock, nor shall we be liable for any consequential damage.
