This year marks the 50th reunion of many high
schools in Arkansas. The Class of 1966 has made
a great impact on life in our state over the past 50
years: some big some small. All very important. I
encourage you to attend your reunion and meet
with past friends and share again in that common

On their way to visit a friend
in Mississippi they stopped
by Hot Springs during the
Christmas Season and with all
the downtown lights glowing
multiple brilliant colors they
were very impressed with the
town. Soon they came back on
vacation and decided this was
where they wanted to live and
moved to Hot Springs in 2006.
Clyde in his 80’s and
Georgia in her 90’s are among
the active Seniors in Arkansas.
They go to the gym and swim at least 3 times a week. There is hope for all of
us. Clyde is well known in Hot Springs and most of Arkansas as one of the top
keyboard jazz musicians and composers.
He has played with or put bands together for Frank Sinatra, Mel Torme, Natalie
Cole, Roger Williams, Liza Minnelli, Bob Hope, Marvin Hamlish, Vic Damone,
Wayne Newton, The Four Tops, Bert Bacharach and too many others to name.
He produced the music soundtrack for Kanai Helicopters documentary featuring
Orson Wells narrative and it was shown on United Airlines flights to Hawaii.
As Chairman and Music Director for the HOT SPRING JAZZ FESTIVAL he
excels in putting great Jazz Bands together for a Free Concert to the Public each
Labor Day. This is a full week of Jazz with venues playing all over Hot Springs.

Thursday at the famous Ohio Club.
Hot Springs has a plethora of great musicians who played with major
orchestras, jazz bands and famous groups. We even have a piano player who used
to play in one of Hot Springs famous houses of ill repute. What a history.
And there at his side is his wife Georgia. Georgia came from England, was a
ballet dancer but was interrupted by World War II and worked for the Royal Navy
Medical Department, but left after the war and all the damage and headed to
Hawaii, just after it’s statehood in 1959. Can you imagine a more wonderful place
to be before all the high rise hotels and traffic on Honolulu. She helped Clyde with
many band set-up including Sammy Davis, Jr.

be blurred vision, slow healing injuries such cuts or bruises, tingling or loss
of feeling in hands and feet, and recurring infections of gums or skin.

ASRD: What is DEEP?
PACKARD: DEEP stands for “Diabetes Empowerment Education Program.”
ASRD: How does DEEP help someone diagnosed with diabetes
ASRD: What is diabetes?
PACKARD: Blood sugar or glucose is the main form of sugar the blood cells
use for energy. When a healthy person eats a meal, the level of blood sugar in
the blood rises, which triggers the production and release of insulin. Insulin
is the key that unlocks the blood cell to allow the glucose to enter the blood
cell and use it for energy. When the insulin unlocks the blood cell, the level of
blood sugar lowers and allows the blood to do the work it needs. In diabetes,
the insulin production is either nonexistent or deficient. If the pancreas
cannot produce enough or any insulin, the glucose sticks to the outside of the
blood cell causing the blood sugar to rise and the blood to thicken. When the
blood thickens, it makes it much harder for the heart to pump the blood. High
blood sugar puts someone with diabetes at a high risk for heart diseases, high
blood pressure, neuropathy, kidney damage and the list goes on.
ASRD: What are the signs and symptoms of diabetes?
PACKARD: The signs and symptoms include excessive thirst, frequent

PACKARD: Risk factors include age, family history, obesity, ethnicity,
sedentary lifestyle, and gestational diabetes. Inactivity and weight are two
risk factors that can be reversed. Choosing to become physically active and
adopting a healthy lifestyle can help control diabetes. Risk factors such as age,
family history, ethnicity cannot be changed. We recommend participating in
programs such as DEEP .

PACKARD: It teaches how to self manage diabetes and set goals to prevent
complications, improve eating habits, maintain adequate nutrition,
increase physical activity, develop self care skills, improve relationships
between patients and health care providers and utilize the
available resources. Involving family members who live
with someone diagnosed with diabetes is welcomed
in self management programs. Support is a key
component to being successful in self management.
Setting achievable goals while learning how to self
manage is important. Some of the areas of goal
setting addressed during the DEEP course are
exercise, carb counting, label reading, and
meal/menu planning. DEEP is lead by a Peer
leader, someone who has diabetes and been
trained to facilitate the workshop. The

workshop is 6 session, once a week for 1½ hours. The information offered in
the workshop is understandable and not clinical. Meal planning, achievable
goal setting and carb counting are highlighted throughout the workshop.
Other topics discussed include the importance of blood sugar level, what
happens to the blood when the blood sugar level is high, how exercise affects
blood sugar level and what is a hemoglobin A1C.

Chicago and is written with the
general public in mind, easily
understood and easy for the
participant to put into practice.
The Arkansas Aging Initiative, a
program of the Reynolds Institute
on Aging, with the University of
Arkansas for Medical Sciences is
working in partnership with the
Arkansas Foundation for Medical
Care, (AFMC), and the Texas
Medical Foundation, (TMF).
TMF/AFMC provided the training for
the trainers and has been an invaluable
resource for teaching supplies to offer
DEEP workshops statewide. When put into
practice, results are positive and rewarding,
by way of feeling better, more energy and
desire to continue with a healthy lifestyle.

Levi Transitions
Offers Help for Those
Who are Troubled
Levi Transitions Outpatient Behavioral Health provides outpatient
counseling for adults who suffer from depression and anxiety, as
well as other disorders that impair their ability to live normal lives.
The program helps people who are facing significant life issues
such as relationship problems, difficulty coping with stress, and
bereavement. Referrals to the program are made by family doctors
and various local agencies, as well as by individuals themselves.
The goal of Transitions treatment is to help clients regain peace
and stability, as well as a sense of meaning in their lives. The focus
is not only on helping clients recover from life problems, but also
on helping them discover strengths and positive aspects of their
lives that can enable them to maintain their stability once they
leave the program. Transitions clinical and support staff work to
maintain a safe and supportive environment in which clients can
improve.
Therapy is provided by licens ed therapists who are trained and
experienced in working with the mental health issues that adults
face. In addition to the therapists, Transitions has on staff a full time
registered nurse and an advanced practice nurse. The program is
overseen by a board-certified psychiatrist. Management of clients’
psychiatric medications is included in the services that Transitions
provides.

When prosthetist Frank Snell calls 82-year-old Johnny Best a “very spunky guy,” it’s
probably an understatement. The irrepressible senior made the news last August when he
decided to climb Pinnacle Mountain for the first time in 63 years, despite the fact that he
was walking with the aid of a prosthetic foot, and
had recently lost the vision in both his eyes.
In 2010, while he was out bird hunting, Best
recalls, “Everything went black all of a sudden in
one eye – and it never came back.”
Two years later, after multiple trips to specialists
and assurances that his vision in the remaining
eye was still 20:20, he was driving in downtown
Little Rock and suddenly couldn’t see the street
lights. Undaunted, he drove the car three miles to
an automobile dealership, had a representative meet
him at the curb and sold the car on the spot – with
the condition that they drive him home afterwards, since he couldn’t see.
Totally blind at age 80 – victim of a rare condition called autoimmune retinopathy –
Best took it in stride, reflecting cheerfully, “But here’s the good part: I’ve seen stuff! Unlike
a person who is born blind, I know what red looks like. I’ve seen trees and cars and been
all over the world ; so I have nearly 80 years’ worth of sights to remember.”

Best had prior experience in coping gracefully with another tragic loss: when he was
19, with two years of college sports experience and a rosy future assured by a contract to
play baseball with the New York Yankees, he was involved in an industrial accident that
destroyed most of one foot.
“I was 80 feet up, on top of the machinery,” he remembers, “and climbed down by
myself. The guys on the ground didn’t even know it happened.”
Best received a Syme’s amputation, explains Frank Snell, CPO, president of Snell
Prosthetic & Orthotic Laboratory. “His level is rather unique – at the ankle – which alters
the bulbous nature of the ankle joint. Since John is also very slender, it has been very
challenging to fit him with a prosthesis that bears the pressure in the correct area and
allows him to walk comfortably.”
His dreams of a professional baseball career abruptly ended, Best accepted philosophically what many would call a disastrous setback. He turned his focus on graduating from
college and going into partnership with his dad in the welding business, which he continued to operate successfully on his own after his father retired, for a total of 40 years.
A transtibial prosthesis failed to slow down his enthusiastic enjoyment of what life had
to offer. “I’ve walked beams
across the Arkansas River when
we were building the freeway
bridge; I’ve climbed buildings.
It never stopped me.”
Suzanne, his wife of 61
years, says that he takes life
so comfortably in stride that
most people don’t know he has
a prosthesis. She tells the tale
of a duck hunting adventure
where Best, wearing waders,
tripped twice, and exclaimed
in annoyance to his hunting partner that he thought he had broken his foot, and would
have to go back to the truck.
When they discovered that the truck had a flat tire, Best perched on the tailgate and
asked his pal to help pull off his waders. The prosthetic foot – which was, indeed, broken
– came off with the boot in his unsuspecting friend’s hands, shocking him so badly that
Best was forced to crawl around – footless – to competently change the tire himself while
his stunned companion struggled to compose himself!
The prosthesis he had received following his amputation was crafted in 1952 by his
doctor and another specialist downtown, and “it was a work in progress,” Best remembers.
After being on crutches “forever” he was fitted with “a hard leather device like a horse
harness, with stainless steel bars up the sides. It weighed nearly as much as the rest of

It was the duck-hunting
accident that broke his old
wooden foot that brought
him to Snell Prosthetic &
Orthotic Laboratory in 1991.
On his return to town that
weekend, in the absence

Since then, Best estimates that Snell has made the last ten of the 25 to 30 prostheses he has
worn over the years, which have ranged from actual wooden feet to state-of-the-art carbon graphite energy-storing feet designed to keep up with the hyperactive Best.
“I wore them out pretty quick!” he admits modestly.
Best has no regrets that his life took a different path from the one he had planned at age 19.
He’s proud that he was able to coach his three sons’ Little League baseball team for seven years. “I
worked hard all day and played baseball after that! I liked to say I could do anything anybody else
could do,” Best concludes.
The proof of his claim lies in his news-making 1 ½-mile walk up (and down!) Pinnacle Mountain, blind and prosthetically enabled, with guides who directed each of his steps. It was a trip that
took seven hours – and which Best simply claims “was a lot of fun!”
So, what target has the ambitious Best set for himself next?
“A couple of weeks ago, I got a yen to learn to play the piano. Suzanne and the boys played, so
I thought I’d like to try.” He’s already found a teacher, and plans to start lessons soon. A fan of
gospel music, he’s inspired by Jimmy Swaggart and Bill Gaither.
“John is just a shining example of somebody who has overcome adversity at all stages of his
life,” Snell marvels. “ – from the early years when he had a sports career before him and he had
to redirect his skills to running a successful business for years, to now, as a senior adult, facing
the greatest challenge of his life with the loss of his eyesight. Yet throughout all that, he has not
lost his focus or his value as an individual, his love for sports and his community, and he remains
active to this very day.

A positive attitude is necessary to excel in all aspect of life. So just how
does one go about obtaining this positive attitude? What is a person
made of that has that attitude?
First of all, you must possess the self-confidence to carry on in all phases
of what you are doing in life. Whether it is learning a new skill for the
fun of it, volunteering, performing for one’s personal best in whatever
endeavor you happen to be involved in, or just getting through each
day of life. Obtaining and retaining self-confidence serves you well no
matter what may lie ahead. Having an elevated level of Physical Fitness can only benefit you and your self confidence level. When you
feel good about yourself and how you present yourself to others, you
can only possess a good attitude. When you know people are going to
listen, respect and respond to your ideas, you can only possess a good
attitude.
Physical Fitness is more than just exercising. This is a total lifestyle.
Physical Fitness is obtained through proper nutrition, Aerobic Type Activity (this includes walking) and Weight Training. Each of these three
phases is equally important and performs a crucial part of your overall

beginning! We have so many “things” that we carry around these days,
wouldn’t it be nice if it were easier just to pick them up? It CAN happen if you strengthen your muscles with a mild to moderate weight
training program. At this stage of life, we know that “all good things
take time”, but by taking the time you will HAVE the time to carry on!
So to begin your Physical Fitness Lifestyle, first consult your physician
for an ”OK”. Once you get that All Clear, get started! Go to a gym, go to
the Y, join a fitness class, join a yoga class…. Get MOVING! You will be
very glad you did.

How do I know if I am income eligible to move into Senior Housing with Rental Assistance? Go to
www.huduser.org/portal/datasets/il/il14/index.html and select the county and state
where you would like to live. Review the chart for your household count to see if
you are income eligible. Your annual income must be 50% or less of the median
income for your household size. Income waivers allow the income to be 80% or less
of the median income.

How many persons can live in a HUD subsidized 202 household? Occupancy standards
are established by the housing provider, but the general rule is two persons
per bedroom unless the apartment is too small for two, such as a studio.
Christopher Homes properties are ground level garden terraces that include
studios and one bedroom apartments.
One of the most fundamental needs of very low income elderly nationwide is
safe, decent, affordable housing with supportive services. HUD helps private
apartment owners, such as the non-profit Christopher Homes of Arkansas,
offer reduced rents to low-income elderly and disabled. You can go to the
hud.gov website to search for private subsidized apartments in the U.S.
How is my rent calculated? A household will pay the highest of the following
amounts:
• 30% of the family’s monthly adjusted income;
• 10% of the family’s monthly income or
• $25 minimum rent.
Here are answers to some of the most frequently asked questions about the
privately owned subsidized senior housing programs.
What are my rights as a resident of a HUD-subsidized 202 apartment? A resident
has rights involving their apartment, resident organizations, and
nondiscrimination. For apartment living, rights include
• The right to live in decent, safe, and sanitary housing that is free from
environmental hazards such as lead-based paint hazards.
• The right to have repairs performed in a timely manner upon request
and to have a quality maintenance program run by management.
• The right to be given reasonable notice, in writing, of any
nonemergency inspection or other entry into your apartment.
What are HUD 202 eligibility requirements for moving into an apartment? For the Project
Rental Assistance Contract (PRAC established in 1991) apartments, occupancy is open to
very low-income households which include at least one person 62 years or older.
For the Section 8/202 apartments, occupancy is open also to mobility impaired
age 18 and older who needs an apartment with the features necessary to
accommodate the mobility impaired as verified by a health provider.
Are there exceptions to the age & income eligibility requirements?
• Some properties have age waivers for 50 years instead of 62.
• Some properties have income waivers for persons with low income
instead of very low income.
• Some properties have both age and income waivers. Christopher
Homes currently has eight properties that have both income and age
waivers.
What other eligibility requirements are there? HUD will not subsidize the rent of a
person who:
• Has been evicted from HUD housing in the last three years (except for
special circumstances);
• Currently uses illegal drugs or abuses alcohol;
• Is classified as a sex offender.

Previous legislation passed last year moved to protect Arkansas
residents by requiring caregivers to receive 40 hours of certified
training if they are paid to care in the home for someone 50 or
older.
CAREGIVING
With an aging population…
Training of Family Caregivers is a hot topic
nationwide, in Arkansas and at UAMS.
About 34.2 million Americans have provided unpaid care to an
adult age 50 or older in the last 12 months and a large majority
(84%) report they could use more information on or help with
caregiving topics, this is according to Caregiving in the U.S., a
recent study sponsored by the National Alliance for Caregiving
and the AARP Public Policy Institute. Of those caregivers
participating in the study, the report also showed that almost
half of certain groups found their roles emotionally stressful.
In Arkansas, there are nearly 500,000 unpaid family caregivers,
many of whom share these same concerns. Juggling caregiver
duties along with full-time jobs and other family responsibilities,
a large proportion of them are looking for help.
Recently approved legislation in AR aims to help caregivers
of those who have been discharged from the hospital. The
Arkansas Lay Caregivers Act eases transitions from hospital to
home for patients and their caregivers. Under the new law, a
caregiver designated by the patient will be notified before the
patient is discharged from the hospital. The hospital will consult

The UAMS Schmieding Caregiver Training Program offers help
for caregivers through specialized training and certification for
paid caregivers and two workshops for those who provide care
to their family members.
In the program, caregivers learn how to care for someone in the
home and to care for adults with chronic diseases and illnesses
specific to advanced aging. They also learn communication
and health literacy skills important to letting family members
age in the home. Those skills, including hands-on training, are
central to preventing unnecessary hospital admissions and
nursing home stays.
Since its inception, more than 6,200 people have attended
Schmieding classes, 3,274 have graduated with certificates and
workshops have been presented to 1,238 family members.
Caregiver programs are currently offered in Springdale,
Jonesboro, Pine Bluff, Texarkana, Fort Smith, Hot Springs and El
Dorado, as well as at the Reynolds Institute on Aging in Little
Rock.
Arkansas is the first to offer this type of training to caregivers
statewide, and the UAMS Schmieding program has made it
a national leader in caregiver training. Developed in 2002, in
the program was replicated throughout Arkansas thanks to a
generous donation from the Donald W. Reynolds Foundation
to the UAMS Arkansas Aging Initiative program. Since 2009, the
foundation has provided more than 10 million dollars to the
university to support operation of the programs in Arkansas.

The truth behind human trafficking.

In the United States of America, we live in the “Land of the free,” even if current conditions
do not look like that land that many reading this article fought for with bravery to secure
its freedom. However, it is still true that what many fought for and what you stand for has
resulted in more freedom in this country than in any other on this planet. But with all this
freedom there is a dark reality that many would rather not discuss. That reality is that not
all are free. On January 31st, 1865 the 13th amendment legally abolished slavery. Therefore
slavery is dead, right? Wrong. As with most laws, criminals do not adhere to what they don’t
want to obey.
Human Trafficking has become a word we hear in the news, but few understand what it
is. Simply defined, it is Modern Day Slavery. There are over 27 Million people in slavery
worldwide today. Every continent reports it, almost every country and every single state in
the United States reports it. Slavery is not just transporting a foreign international across
borders for the sake of labor or sex, although it is very much a part of it. However, Slavery
is much broader. Whereas 15,000 foreign internationals are brought into the US for that
purpose, there are an estimated 200,000 American citizen minors that become trapped in
sex trafficking every single year.
The demand drives the supply and the demand means money. Sex Trafficking alone makes
over $32 Billion dollars worldwide a year. It is the fastest growing criminal enterprise, and
it is estimated by the UN that at the end of 2015 it will become the number one criminal
enterprise, surpassing drugs and arms trafficking.

The Legal definition of Human Trafficking includes Force, Fraud or Coercion. These are the
means by which a victim is trapped and also the three means that must be present in order
to prove a person is a victim.
Some indicators to identify victims include: work and living conditions, the person is not
free to leave or come and go as they wish; is under 18 and involved in commercial sex
acts; is not allowed breaks or suffers unusual restrictions at work; owes a large debt and
unable to pay it off, high security measures exist in the work and/or living conditions; lives
at the same location they work. Indicators in behavior and physical health include if they
are anxious, paranoid or submissive; fearful or anxious towards law enforcement; avoids
eye contact, lacks health care, shows signs of abuse. Other indicators include if the person
is not in control of their own money or identification documents; is not allowed to speak
for themselves; lack of knowledge of whereabouts and loss of sense of time; numerous
inconsistencies in their story.
Some ways to protect minors from becoming victims include: Keeping all social media settings on private and only accepting people as friends if you actually know them in personwhen your profile is set to public, then anyone can see your pictures, location and learn
where you go to school or other places you hang out; Don’t develop friendships with people
online that you do not know in person- many minors are tricked by people who pretend to
be their friends and even their boyfriends but eventually get them to meet in person; Be
alert of your surroundings and don’t trust strangers- many traffickers wait at places like the
mall and then target the girls who act needy or want attention from guys.

Modern Day Slavery
Human Trafficking can include but is not limited to: forced labor, sexual exploitation, debt
bondage, domestic servitude. This occurs whenever a human being is bought/sold or used
for profit. We now have laws in place that make this crime very serious and not only is the
trafficker punished, but more often the purchaser is also severely punished. Anyone can be
the trafficker, international gangs, domestic gangs, as well as mothers and fathers who
would rather have the benefit of the money or drugs that their children provide rather
than keep their children safe. Most recruiters into sex trafficking include people who pretend to be friends or boyfriends and then exploit them, often times the victims don’t even
realize they are the victims. Anyone can be the victim but statistically those who are being
targeted for sex trafficking are 80% female and half of all victims are under the age of 18.
Traffickers or recruiters prey on insecurities and vulnerabilities.

Who is Eligible for Medicare Hospice Benefits?
Hospice:
Hospice care is covered under Medicare Part A (Hospital Insurance). You are
eligible for Medicare hospice benefits when you meet all of the following conditions:
• You are eligible for Medicare Part A (Hospital Insurance), and
• Your doctor and the hospice medical director certify that you are terminally
ill and probably have less than six months to live, and
• You sign a statement choosing hospice care instead of routine Medicare
covered benefits for your terminal illness, and
• You receive care from a Medicare-approved hospice program.

How Does Hospice Work?

Hospice care is for any person who has a life-threatening or terminal
illness. Most reimbursement sources require a prognosis of six months or
less if the illness runs its normal course. Patients with both cancer and noncancer illnesses are eligible to receive hospice care. All hospices consider the
patient and family together as the unit of care.
The majority of hospice patients are cared for in their own homes or the
homes of a loved one. “Home” may also be broadly construed to include
services provided in nursing homes, hospitals and prisons.
Typically, a family member serves as the primary caregiver and, when appropriate, helps make decisions for the terminally ill individual. Members of
the hospice staff make regular visits to assess the patient and provide additional care or other services. Hospice staff is on-call 24 hours a day, seven
days a week.
Who is the Hospice Team?
Hospice care is a family-centered approach that includes, at a minimum, a
team of doctors, nurses, social workers, counselors, and trained volunteers.
They work together focusing on the dying patient’s needs– physical, psychological, or spiritual. The goal is to help keep the patient as pain-free as
possible, with loved ones nearby until death. The hospice team develops a
care plan that meets each patient’s individual needs for pain management
and symptom control.
How is Hospice Paid For?
Hospice is paid for through the Medicare Hospice Benefit, Medicaid Hospice
Benefit, and most private insurers. If a person does not have coverage through
Medicare, Medicaid, or a private insurance company, hospice will work with
the person and their family to ensure needed services can be provided.

Respite Care and Medicare?
Respite care is care given to a hospice patient by another caregiver so that the
usual caregiver can rest. As a hospice patient, you may have one person who
takes care of you every day, like a family member. Sometimes your caregiver
needs someone to take care of you for a short time while they do other things
that need to be done. During a period of respite care, you will be cared for in
a Medicare-approved facility, such as a hospice residential facility, hospital or
nursing home.

is mentally, physically and emotionally exhausting. Many people try
to take care of their loved one at home and quickly realize this is an
impossible task and are forced to seek nursing home care. Because this
type of 24/7 care is so demanding nursing homes must charge $5,000
to $7,000 per month. This is a level of care that most people find
impossible to provide at home.
The financial stress of trying to figure out how
to pay for nursing home care just adds to the
pressure you are feeling.
It’s Never Too Late To Plan
If you have a loved one in the nursing home you are facing many
decisions and responsibilities you have never faced before. Days are
filled with concern and care for your loved one as you try to make sure
they are getting the best care possible. Nights are filled with financial
worries about how to pay for months or even years of future long
term care. At $5,000 to $7,000 per month most families have enough
money to cover only 3 months to 3 years of long term care before all
their savings are exhausted. This just adds to the stress of trying to take
care of your loved one. However there is good news. There are ways to
legally arrange your affairs so you don’t have to spend everything you
have saved during your life on long term care expenses. Specifically,
for people who have done no planning at all it is not too late to plan.
Using a combination of wills, trusts, powers of attorney and powerful
but lesser known legal strategies most people can protect their home
and much of their life’s savings from the devastating costs of long
term care. Caring for a loved one who needs around the clock care

Many people have come to my office stressed out and worried they
are going to lose everything they have. After a free consultation they
realize there is hope. There are many legal strategies they never knew
existed that can be used to protect their life’s savings. In my 29 years of
experience I have seen people approach this problem in two ways.
One group did not seek legal advice because they thought it was too
late to do anything. They find themselves in a nursing home having
done no planning whatsoever and immediately give up all hope. They
slowly resign themselves to spending all their savings and investments
on long term care expenses. Next they sell rent houses, farms and
other real estate to pay for care until everything is gone except for their
home. At the end of their rope they ask for help and are directed to
apply for Medicaid. They do qualify for Medicaid to pay the nursing
home but have lost all their assets in the process. After they die
Medicaid places a lien on their home (their last personal possession)
and the home is sold with all the proceeds going to Medicaid. The end
result is everything they ever owned being spent on long term care.
This is a tragic but preventable result.
The second group immediately seeks legal advice
when a loved one enters the nursing home and the
results are completely different.
By implementing the proper legal documents and legal strategies they
are able to save and protect their home and much of their life’s savings.
They protect their assets and yet are able to qualify for Medicaid to pay
their long term care costs usually within 1 to 24 months of applying

protect at least 50% of the home and sometimes the entire home can

important if they are married because no one wants to leave their stay
at home spouse broke and unable to cover their own living expenses.
By planning now you can make sure your spouse won’t be broke
and they will have sufficient assets to take care of their needs. This is
especially important after the nursing home spouse dies.
Many people believe once they are in a nursing home
it is too late to plan but this is NOT TRUE.
Perhaps you have a loved one who has been in a nursing home for 2
or 3 years or longer, it is not too late to protect at least 50% of their
remaining assets. You may be thinking “That’s Impossible” which is
what most people believe but the home can be partially or entirely
protected even at this late date. Even if they are on Medicaid and
Medicaid is currently paying the nursing home and the only asset
they have left is their home it is not too late. Even at this late stage of
the game there are little known planning techniques can be used to

Nursing Home Rehabilitation
When a person goes into a nursing home for rehabilitation (for
usually three to twelve weeks) and returns home – they have
unknowingly just missed out on a “Golden Opportunity” to
protect their home from future nursing home costs without the
traditional five year wait. For most people this is a once in a Lifetime
Opportunity to cut Medicaid’s five year “Look-Back” period down to
just two or three years and thereby protect their home in the process
. So how does this work?
Before you leave rehabilitation you must file an application with
the Arkansas Department of Human Services (DHS) requesting that
the traditional Medicaid five-year “Look-Back” period be reduced
to one, two, or three years. Once your application has been filed at
DHS you can return home while you wait to be approved.
Completing the application generally takes two to four weeks to
complete. Therefore as soon as you know you will be going to a
nursing home for rehabilitation you should IMMEDIATELY begin the
application process. Unfortunately the application process requires
that you provide a considerable amount of information and perform
a checklist of items which usually Cannot be completed in just a
couple of days. This information is usually provided by your spouse
or child while you are in rehabilitation. Furthermore, if the checklist is
not completed before you leave rehabilitation then your application

cannot be
submitted to DHS.
However, even if
you are unable
to complete the
checklist before you
leave rehabilitation

1. MILITARY SERVICE REQUIRED DURING WARTIME: The Veteran served 90 days of
active duty with at least one day during a declared state of war. Eligible Dates are:
WWI April 16, 1917 – November 11, 1918
WWII
December 7, 1941 – December 31, 1946
Korea
June 27, 1950 – January 31, 1955
Vietnam
August 5, 1964 – May 7, 1975
Gulf/Iraq
August 2, 1990 – Present
2. MEDICAL QUALIFICATIONS: The Veteran or widow must be over age 65 and
have at least one or more significant health problems. In my experience I have found
about 90% of those over age 70 qualify medically and about 60% of those ages 65-70
qualify medically. Your personal physician must complete the proper VA paperwork to
determine if you qualify medically.
3. ASSET QUALIFICATIONS: The Veteran or widow can qualify for the full benefit
and own a Home, Car, Household Goods and Furnishings and up to $80,000 of savings
and investments. The exact amount of savings and investments they can have will
differ from Veteran to Veteran because the formula is based on the Veteran’s age, life
expectancy, current income and monthly medical expenses. Veterans who are over
the asset limit may spend some of their money (Countable Resources) on things such
as home improvements, a new automobile (Non-Countable Resources) or pay off
existing debt in order to qualify. Fortunately, at this time, gifts to children can be made
to reduce a Veteran’s Resources and this is not a disqualifying gift. However Congress is
considering making gifts a disqualifying event. This has not occurred yet and Veterans
who apply before any change in the law would not be disqualified by making a gift
to their children. Caution: Gifts to children can have adverse tax consequences and
assets gifted to children can be lost if the child is sued, divorced or files bankruptcy. A
properly structured gift trust can protect these assets gifted to a child from being lost to
such mishaps.

4. INCOME QUALIFICATIONS:
The amount of Monthly Benefit a
Veteran or widow can qualify for
is partially based on their current
income and medical expenses, but
you don’t have to be impoverished.
I have found about 40% of my
clients will qualify for some or all of
the benefit without any planning.
They simply need direction on
how to go about applying for the
benefit. Another 40% of my clients
will qualify immediately with a
little planning and 20% will not
qualify at all because they have
very good income or minimal
medical expenses. However, most
of these 20% will qualify in the
future as their Medical expenses
increase and if they are currently in
need of In-Home Care or Assisted
Living these medical expenses will
usually qualify them for some or
all of the benefit. The other 80%
of my clients will typically receive
the maximum VA benefit at the
time they require In-Home Care or
Assisted Living because In-Home
Care and Assisted Living are
considered medical expenses.
If you or a loved one is currently in
need of In-Home Care or Assisted
Living consider these programs and
the benefits they may provide. Getting the help you need right now
may prevent or at least delay the
necessity of Nursing Home Care in
the future.

VETERAN VA BURIAL BENEFITS
Veteran burial benefits must be requested, generally in writing, they
are not automatic, and can take considerable time and effort for your
family. Your local Dignity Memorial provider can assist with exactly what
you are entitled to receive as a Veteran.
Consider:

•US Department of Veterans Affairs (VA) Benefits do not cover all the
funeral or cremation arrangement of honorably discharged Veterans.
•A “Report of Separation from the Armed Forces of the United States”
(discharge paper) is required to verify military service.
•A Veteran’s family may request a United States flag, at no cost, to
drape the casket or accompany the urn of a deceased Veteran. One
flag per veteran.
•Military funeral honors ceremonies must be scheduled in advance and
include the folding and presentation to the United States flag and the
playing of “Taps”.
•The VA and other branches of service do not provide a free casket for a
deceased Veteran, unless death occurs while on active duty.
•A “Presidential Memorial Certificate” signed by the current President,
must be requested by the deceased veteran’s next of kin and loved
ones.
•Monetary Burial benefits are limited if you choose not to be buried in
a VA national cemetery. If the death is service-related, up to $2,000.00
may be paid for burial expenses.
•Eligibility requirement for burial in a VA National Cemetery have caveats but include: an assigned gravesite(if available), opening and closing
of the grave, a grave liner for casketed remains, a Government headstone or marker and perpetual care at no cost to the family.
•If a Veteran burial is in a private cemetery, headstones, markers or medallions must be requested.
• Replacement of military service medals, awards and decoration must
be requested in writing.

Living Resource Center for people with disabilities in central
Arkansas. Mainstream operates with the conviction that
