Fundraising Legal Guidance
- SECNAVINST 5340.7 of 8 February 1999
(Active Duty Fund Drive in Support of the
Navy-Marine Corps Relief Society)
- DOD 5500.7-r of 30 August 1993 (Joint Ethics
Regulations)
- Hawaii Revised Statutes
Fundraising Guidelines
-
The PRIMARY fundraising plan for the drive is personal solicitation of
service members for monetary donations by designated individuals,
a.k.a. ASKING SAILORS FOR CASH.
-
Commands can also have fundraisers to donate a lump sum, but they
have to follow the rules.
-
-
Initiatives such as fun runs, bake sales, car washes, golf
tournaments, etc. are encouraged.
The legality of other fundraising initiatives depends upon the particular
facts and circumstances involved.
Fundraising Guidelines
Fundraising DON’Ts:
-
DON’T solicit civilians or contractors in the work place, and DON’T
solicit the public
-
DON’T engage in coercive activity…this means:
-
-
DON’T establish 100% participation goals (only 100% contact)
-
DON’T establish personal quotas
-
DON’T establish lists of non-contributors
-
DON’T use results as a factor on performance appraisals
DON’T sell a “civilian clothes privilege” – no authority under the Navy
Uniform Regulations
Fundraising Guidelines
Fundraising DON’Ts (cont’d):
-
DON’T sell liberty (MILPERSMAN 1050-280)
-
DON’T sell parking space privileges (JER 3-210)
-
DON’T gamble…this means lotteries, raffles, anything that is “pay to
play” – it’s illegal in Hawaii (HRS 712.1220)
Fundraising Guidelines
If you have questions about what you can or cannot do, you can contact:
-
Your Legal O or JAG,
-
Ms. Debora Manoi at RLSO Hawaii – 473-4058, debora.manoi@navy.mil
-
LT Murphy, JBPHH SJA – 471-1240, kymberly.murphy@navy.mil
To schedule your command’s fundraiser:
-
If it is something entirely within your command’s spaces (like a bake
sale), your CO can authorize it.
-
If it is anywhere else on base (car wash, grocery bagging, golf
tournament), contact Ms. Manoi to get the fundraiser request form.
