This popular annual event gives people studying for their
STEP professional examinations the opportunity to
expand their knowledge of areas of the trust industry
relevant to their studies. Now in its fifth year, this half-day
conference will cover subjects that students are likely to
come across in practice. We have six speakers who will
look at Disclosure and Confidentiality, Retirement and
Appointment of Trustees, Property and the Associated
Risks of Management, UK Tax Obligations for Jersey
Trustees and the Global Economic Outlook. This event is
free for all STEP Jersey Students, however STEP
Members and non-members are also welcome. A buffet
lunch will be served and the event is accredited for 3.5
hours of CPD.

Unintended tax charges: can the court assist to reverse them?
Nancy Chien & Robert Robert Gardner (Bedells)
What can trustees and settlors do when they have made decisions with unforeseen effects or
consequences, including detrimental tax consequences? This session looks at the remedies that are
available to assist settlors and trustees to unwind their decisions so as to eliminate or mitigate the adverse
consequences. We will consider the latest Jersey and English law authorities on the Rule in Hastings-Bass,
mistake and rectification.

Retirement and Appointment of Trustees

The retirement and appointment of trustees sounds like a simple job and the associated tasks are often
delegated to junior members of law firms and trust companies. There are, however, many pitfalls with
preparing deeds of appointment and/or retirement, transferring assets and generally handing over the
administration of a trust. Take care, for example, over chain indemnities and liens. What of disclosing
internal meeting notes or trustee minutes to the incumbent trustee? This presentation will identify some of
the many knotty issues that can be encountered upon retirement and appointment and suggest practical
way of resolving them.

With the every-changing regulatory framework surrounding the growth of the Private Rented Sector in the
UK, this session will highlight those area’s that a Trustee should be aware of, and walk through some of the
mitigating actions individuals and companies alike can take to reduce their risk exposure.

UK Tax Obligations for Jersey Trustees
Jeremy Duffy (Rooks Rider)
In the current economic climate the UK government is faced with the growing challenge of maximising its
tax revenue whilst making cuts in public services to ‘balance the books’. Increasingly, the spotlight is being
raised on the Crown Dependencies and other offshore finance centres. Jeremy will review a non-resident
trustee's liabilities to UK tax in respect of common investment classes such as listed investments and
property. Jeremy will also cover compliance obligations; when is a return necessary as well as the
increased burden with the introduction of ATED and the new CGT rules for non-residents holding UK
residential property.

Berenberg’s Vice President, Private Clients, Charlotte Baird will discuss the latest developments in
European economics and politics. From the positive developments in Ireland, Spain or Portugal via the
challenges populists pose across Europe and elsewhere in the West to the tragedy unfolding yet again in
Greece, the interaction of politics and economics seems to have never been as intense as now.

SPEAKERS
Charlotte Baird is Vice President, Private Clients, at Berenberg. As a Chartered
Private Wealth Advisor she provides investment advice and financial planning oversight to
high net worth individuals, families and trusts, both overseas and in the UK. She is a
member of the Chartered Institute of Securities and Investment (CISI) following the
completion of the CISI Diploma, where she focused on Investment Compliance and Fund
Management. Along with this, Charlotte holds the Certificate of Financial Planning and the
Investment Management Certificate. Citywealth awarded Charlotte Emerging Manager of
the Year 2012, and in 2013 she was listed in Citywire’s Top 30 Under 30. Charlotte joined
Berenberg in 2011 after having qualified in the Private Clients Services Group at Deloitte.
She graduated from Exeter University with a BA (Hons) in Business and Management with European Study at
the ESB Business School, Reutlingen, one of Germany’s leading international business schools.
Nancy Chien is a senior associate in the International Private Client group at Bedells.
She has extensive experience in a wide range of trust-related structures, ranging from
private client discretionary settlements to pensions and employee benefit trusts. Prior to
joining Bedell, Nancy was a senior associate at Ashurst in London, specialising in pensions
and employee benefit trusts. Her private client experience was obtained at leading Channel
Islands and New Zealand firms. She has been described as a "proactive advisor who
impresses with appropriate advice that comes with high service levels" – Legal 500. Nancy
has been acknowledged as a "Prominent Figure" in the "Leading Lawyers" category in the
2015 Citywealth Leaders List.The Legal 500 2014 directory describe Nancy as "very
proactive" and she was credited as one of the "Top 35 Under 35" by Private Client Practitioner in 2014 and
2013 and recognised in the Citywealth 2013 Jersey Future Leaders List. Nancy is a member of the
International pensions working group in Jersey and a committee member of the Jersey Pensions Association.
Nancy can speak fluent Mandarin and Taiwanese.
Jeremy Duffy qualified as a solicitor in 2006 and is a key member of Rooks Rider
Solicitor’s Wealth Planning team. Rooks Rider is a firm that has specialised in advising
offshore trustees around the globe in respect of UK tax for more than 40 years. Jeremy has
over five years’ experience in private practice advising international clients and trustees on
their UK tax obligations and reporting requirements as well as assisting clients to bring their
tax affairs up to date through various tax disclosure facilities. Beyond his work in respect of
UK tax Jeremy is also the firm’s immigration expert and advises clients considering
relocating to the UK on their options. Jeremy also spent four years in Jersey working with
RBC Wealth Management where he developed an in-depth understanding of the pressures
and issues facing the modern day trustee.
Lucy Jones is a Partner and Head of Investment Lettings and Management at Knight
Frank offering bespoke Lettings, Management and Consultancy services for landlords with
portfolios throughout the UK. Clients include trustees, developers and institutional and
private investors. Lucy is responsible for maximising asset performance and mitigating
operating risk across clients’ property books. Prior to joining Knight Frank, Lucy held various
roles within the LSL Property Services Group most latterly as Operations Director of
Corporate Client Department looking after sizeable property holdings primarily for lender
clients. Lucy is a Fellow of the Lettings Regulatory body ARLA (Association of Letting
Agents) and is one of only around 20 people in the UK to achieve the highest level of
industry qualification, the Diploma in Residential Letting and Management.

In April 2014 Naomi Rive joined Coutts & Co Trustees (Jersey) Limited as its Chief Trust
Officer. A lawyer by training, Naomi was called to the English Bar in 1999 and qualified as a
Jersey Advocate in 2003. Before joining Coutts, Naomi was a Partner and Head of the
Jersey Private Client & Trusts team at international offshore law firm, Appleby. At Coutts,
Naomi has oversight of fiduciary policy and works closely with clients and their independent
legal, tax and investment advisers to ensure the establishment and implementation of robust
and sustainable wealth planning structures. Naomi is Deputy Chair of the Jersey branch of
STEP and sits on the Jersey Finance Trusts Law Working Party. She regularly speaks at
trusts conferences, including STEP and the International Bar Association. Naomi was
recognised as one of the Top 50 Most Influential Offshore Professionals in 2014 by Private Client
Practitioner. She was also ranked in the 2014 Citywealth Leaders List.
Rob Gardner joined Bedell Cristin in 2006 from a leading Caribbean firm, where he
was involved in a wide range of commercial litigation, corporate recovery and restructuring
projects in both the Cayman Islands and British Virgin Islands. Rob works closely with the
Jersey Viscount as well as insolvency practitioners in Jersey and elsewhere. He regularly
advises companies, directors, shareholders, creditors and insolvency office holders on all
aspects of insolvency and restructuring work, particularly where there is a cross border
element. Current or recent work includes advice to the directors of Huelin Renouf Shipping
Limited in the period prior to winding up; acting for the liquidators of the Collection Group
retail chain (which involved the first "pre-pack" liquidation sale of business in Jersey); acting
for HSBC in the Jersey side of the letter of request application to the High Court of England (which went to the
English Court of Appeal); acting for IBRC prior to and during the course of a Court winding up of a Jersey
company holding German assets; acting for liquidators in the court winding up of a Jersey corporate group
owning valuable real estate in Jersey; acting for a former director of two Jersey infrastructure funds in which
the director successfully claimed exit payments at trial. Rob has been acknowledged in the "Honours List" in
the "Leading Lawyers" category in the 2015 Citywealth Leaders List and he is recognised as a rising star in
restructuring and insolvency by IFLR1000 2015. The Legal 500 2014 legal directory describe Rob as an
"insolvency expert with wide experience in both Jersey and the Cayman Islands". He is also involved in a
broad range of commercial litigation, particularly disputes involving trusts and is regularly involved in assisting
with applications by trustees and beneficiaries including in relation to rectification, mistake and the rule in Hastings-Bass.
CHAIR
Lorraine Wheeler is Client Services Director at First Names Group. Previously
Lorraine worked as a Director in the Private Client group of Capita. Coming from the UK,
following secondments in Bermuda and Switzerland, Lorraine settled with her family in
Jersey and has extensive experience in the trust industry, dealing with a range of traditional
and complex structures including trusts, companies, limited partnerships and foundations.
Lorraine qualified under the Chartered Institute of Bankers Trustee Diploma and also has a
BSC (Hons) in Financial Services and a STEP certificate in International Taxation. She has
acted as secretary of the Society of Trust and Estate practitioners in Jersey since 2005 and
is now Chair of the branch, building upon her previous involvement with the Bermuda and
Switzerland branches. She is also a Fellow of the Chartered Institute of Bankers and previously served as
Chair of the Bermuda branch.

Conference documentation will be distributed at the event. STEP Jersey branch reserves the right to amend or cancel this event where the occasion necessitates. In
such circumstances a full refund of any registration fee will be made but STEP Jersey branch shall accept no further liability. Prices may be subject to change. This
booking form constitutes a legally binding contract. The delegate (s) and firm are jointly and severally liable for payment of the fees due. The conference language is
English.
Cancellations / Substitutions:
You are able to send a substitute delegate at any time. If a non-STEP member attends in lieu of a STEP member the difference in fees will be charged. No refunds
(or credits for future events) will be given for cancellations unless the STEP Jersey office is notified at least 24 hours before the event.
